Dear Madame,

I hope you are well as you continuously serve your beloved constituents.

This pertains to the letter of Mrs. Rubinita A. Dulay which was duly received by your
Office on 29 October 2021. She was requesting for your assistance on the
Administrative Fine that Dasmarińas City Fire Station has meted her, specifically in
lessening or waiving the said penalty.

To respectfully brief you of the antecedents, Mrs. Dulay made renovations to her house
on January 2018 which was completed eight (8) months later. However, she did not
secure the necessary Fire Safety Inspection Certificate (FSIC) for Occupancy nor the
Certificate of Occupancy as issued by the Office of Building Officials. It was only on
October 2021 that she went to our Office and applied for FSIC. Consequently, having
belatedly applied for three years, we assessed her of an administrative fine in addition
to the Fire Safety Inspection Fee in accordance with Republic Act No. 9514 (Fire Code
of the Philippines) and its RIRR.

Under Section 9.0.4.1 of the RIRR of the Fire Code, FSIC issued by the City Fire
Marshal is a pre-requisite for the Issuance of Certificate of Occupancy issued by the
LGU and office of the Building Officials. Failure to secure a valid FSIC right after the
construction and before occupying the renovated house would warrant the imposition of
administrative fines as prescribed under Section 12.0.0.4 of the RIRR of the same
Code. It is clearly stated therein that the violation of the prescribed standard of the Fire
Code will be fined of not less than Php 37,500.00 but not more than Php 50,000.00.

As much as we want to extend help to Mrs. Dulay by lessening or waiving the fine, we
cannot do so for want of authority. We humbly submit that the Bureau of Fire Protection
merely operates within the bounds set by the RIRR of RA No. 9514. All fees and fines
are set by law, hence, not subject to negotiations.
