ENVIRONMENTAL COMMUNITY DEVELOPMENT SERVICE (CDS)

CONSTITUTION.

INAUGURAL STATEMENT
The executive council of the Environmental Development Service Group Eket, Akwa Ibom State in
compliance with the directive contained in the resolutions of the member at the first meeting of the Batch
C 2018/2019 leadership tenure (September, 2019) inaugurate the following persons of high integrity in the
group.

PREAMBLE
We the member of the Environmental Community Development Service, Eket Akwa Ibom State, acting
with unity of purpose an in compliance with the objectives of the National Youth Service Corps
DO HEREBY MAKE, ENACT AND GIVE TO OURSELVES THE FOLLOWING CONSTITUTION, which shall be the
guiding document for all Environmental Community Development Service activities.

ARTICLE 1
DEFINITIONS/INTERPRETATION OF TEMRS
In this constitution except otherwise provided:
Members - mean corps members who have duly inducted by the community development service
department Eket and have fulfilled their NYSC obligations to the Environmental CDS Group.
NYSC- means the National Youth Service Corps.
CDS - means Community Development Service
CDS Weekly Meeting - means a properly constituted Environmental CDS meeting; mostly held on
Thursdays.
EXCO - means the Executive Council.
PRO- means the Public Relations Officer
DOS - means Director of Sports / Director of Socials

ARTICLE 2
GENERAL PROVISIONS
1. CITATION: - This constitution shall be cited as the constitution of the Environmental CDS Eket, Akwa
Ibom State (here in after referred to as this constitution).
2. ESTABLISHMENT: - there is hereby established a Community Development Service Group to be known
and addressed and called the Environmental Community Development Service (here in after referred to as
the CDS Group)
3. SUPREMACY: -
i. This constitution is the supreme law guiding and regulating the conduct of members of the group and all
committee established pursuant to its provisions. Any policy, conduct or activity contrary to it is null and
void to the extent of its inconsistency.
ii. Where any provisions of this constitution conflict with NYSC laws or those of the NYSC Community
Development Service department, the latter shall prevail.
4. MOTTO: - the motto of the Group is and shall remain “SUSTAINABILITY”
5. LOGO: - The logo of the club shall be a round shape with the inscription: ENVIRONMENTAL CDS GROUP
on top and EKET down.
6. (a) MEMBERSHIP:- Membership of the Group is being selected by the NYSC Community Development
Service Department Eket; based on member's in Environmental related studies. Such member shall:
i. Be formally inducted into the group.
ii. Pay their monthly dues as at when due.
iii. Abide by the provisions of this constitution.
iv. Pay any legitimate contribution(s) as agreed by the group
v. Participate actively in all the activities of the group.
(b) Upon induction, members shall be presented with the following:
i. Membership Identity Card
ii. A copy of the Constitution.

5. STAFF ADVISER: - There shall be one Staff Adviser for the group who shall be the Public Relation Officer.

6. PATRON/MATRON: - The CDS Group shall appoint patrons and matrons whose maximum number shall
be two. They shall:
i. Be credible individuals who are capable and have the interest of supporting the group.
ii. Be nominated by any member of the group and approved by the members
iii. Their appointment shall be reviewed from time to time according to their concern and involvement in
the activities of the group.

ARTICLE 3
OBJECTIVES
In line with the NYSC Decree and with particular reference to the community Development Services, the
objective of the group shall be:-
a. To project a positive image of the NYSC scheme and that of the Group.
b. To carry out environmental awareness activities addressed to specific groups and to our society in
general
c. To create awareness on sustainable environmental management and regeneration.
d. To promote and sustain healthy environment.
e. To offer Community Development Services like organizing workshops and seminars for social groups and
individuals to acquire knowledge of the environment beyond the immediate environment including distant
environment.

ARTICLE 4
PRINCIPLES
The Group shall function as all times in accordance with the following principles:
a. Utmost goods faith and honesty;
b. Equality of all members and equal opportunity to participate in all the programmes, activities and offices
of the group provided they meet with the requirements stipulated for the office;
c. Peaceful resolution of dispute in the spirit of oneness;
d. Respect for the laws of NYSC
e. Solidarity and Unity purpose
f. Transparency, accountability and regard to democratic norm and values

ARTICLE 5
ORGANS OF THE GROUP
1. THE EXECUTIVE COUNCIL: The Executive Organ of the Group shall comprise of the following offices:
a. The President
b. The Vice President
c. The Secretary General
d. The Public Relation Officer
e. The Provost
f. The Financial Secretary
g. The Treasurer
h. The Director of Socials
i. The Director of Sports

2. FUNCTION OF THE OFFICERS


(a) THE PRESIDENT
He/She Shall:

i. Be the chief executive and spokesperson of the group.
ii. Preside over meetings of both the EXCO and members.
iii. Direct the Secretary General to summon all EXCO meetings.
iv. Be a signatory to the group account.
v. Be the chief Custodian of the group.
vi. Assign any member of the EXCO or group to perform certain functions as the need arises.
vii. Must authorize all financial transactions of the group.
viii. Forward any issue concerning the group found wanting to the appropriate authorities.
ix. Perform any other function required of him by his constitution.

b. THE VICE PRESIDENT


He/She Shall:
i. Assist the President in all his/her duties.
ii. Preside over congress and EXCO meeting in the absence of the president.
iii. Be the head of merit and discipline committee.
iv. Ensure performance according to the set goals of all standing committees.
v. Perform any other function assigned to him/her by the President.

c. THE SECRETARY GENERAL


He/She Shall:
i. Take and keep minutes of both the members and EXCO meeting.
ii. Compile a monthly report of the group's activities.
iii. On the directives of the President, summon EXCO meetings through the Public Relations Officer.
iv. Keep inventory of all Environmental CDS Property.
v. Keep record of the group's internal and external correspondence.
vi. Write and reply all letters with the approval of the President.
vii. Be the head of workshop/field activities/seminar committee of the group.
viii. Perform any other function as may be assigned to him/her by the President, EXCO or the members.

d. THE PUBLIC RELATION OFFICER (P.R.O)


He/She Shall:
i. Be the link between the Executive and the Members.
ii. Be the link between Environmental CDS and other CDS groups.
iii. Summon EXCO meetings at the directive of the Secretary General.
iv. Release notice for an emergency meeting and all other group activities.
v. Be in charge of updating the website and social handles of the group.
vi. Perform any other function as may the assigned to him/her by the President, EXCO or members.

e. THE PROVOST
He/She Shall:
i. Be responsible for maintaining order during general and EXCO meetings.
ii. Work out modalities to ensure that law and order are adequately maintained among the group

members.
iii. Be in charge of the attendance register during the meeting and shall handover same to the Secretary
General at the end of each meeting.
iv. Be responsible for the monthly review of attendance of members.
v. Be the secretary of the merit and discipline committee
vi. Maintain a list of defaulters and handover same to the merit and discipline committee at the end of the
meeting.
vii. Perform any other function as may be assigned to him/her by the members or EXCO.

f. THE FINANCIAL SECREATARY


He/She Shall:
i. Keep an accurate record of both income and expenditure of the group.
ii. Be a signatory to the group's account.
iii. Ensure that all expenditure and undertakings involving monetary transaction are properly documented
and receipted.
iv. Collect all dues, fines and levies as agreed by the members and hand over same to the treasurer.
v. Shall forward all monies collected for the group to the treasurer within 24 hours.
vi. Prepare an accurate Financial Report and present to the congress monthly and submit the final report
to the Audit Committee three weeks before the end of the end of the tenure of an EXCO.
vii. Perform any other function as may be assigned to him/her by the Members or EXCO.

g. THE TREASURER
He/She Shall:
i. Collect all revenue from the Financial Secretary and deposit same at the bank within 48 hours.
ii. Be a signatory to the group's account.
iii. Keep an impress of two thousand naira only (N 2000.00) FOR CONTIGENCY.
iv. Work in collaboration with the Financial Secretary for the efficient keeping of the accounts of the group
monies.
v. Prepare separate income and expenditure accounts to be submitted to the Audit Committee first week
of the month before the passing out parade.
vi. Have copies of all the receipts for verification purposes.
vii. Perform any other function as may assigned to him/her by the Members or the EXCO

h. THE DIRECTOR OF SOCIALS (D.O.S)


He/She Shall:
i. Be responsible for organizing and directing all activities of the group.
ii. Be the head of social committee.
iii. Prepare budgets concerning social activities and submit same to the EXCO for vetting before reaching
the members.
iv. Perform any other function as may be assigned to him/her by the Members or the EXCO.

i. THE DIRECTOR OF SPORTS


He/She Shall:
i. Organize all Sporting activities for the group.
ii. Gather sports news and submit to the PRO for media publications.
iii. Be the head of the sport committee.

iv. Perform any other function as may be assigned to him/her by the Member or the EXCO.

ARTICLE 6
COMMITTEES
1. STANDING COMMITTEES:
All the committees except audit, ad hoc, electoral and the electoral petition committees shall be
constituted at the first general meeting conducted by the new ECXO. All members must at least belong to
a committee while member can render help for a committee without necessarily be a member.

a. The Electoral Committee


This Committee shall:
i. Be a 4-man committee whose members shall be nominated by the EXCO's by the first week of the month
before the passing out parade.
ii. The head of the committee shall be determined by the nominees.
iii. Ensure the conduct of election latest the last Thursday in the month before passing out parade.
iv. Be responsible for the planning and conduction of elections into the Executives Council of the group in
line with the provisions of this constitution.
v. Have its membership drawn from the outgoing batch of corps members.
vi. Shall be dissolved by the new President after the inauguration of the new EXCO.

b. THE ELECTION PETITIONS COMMITTEE


This committee shall:
i. Be a 3-man committee whose members shall be nominated by the members during the time of the
nomination of members of electoral committee.
ii. The head of the committee shall be determined by the nominees.
iii. Receive and treat all petitions before inauguration.
iv. Have its membership drawn from the outgoing batch of corps members.

c. THE AUDIT COMMITTEE


This Committee shall:
i. Be a 3-man committee nominated by the members first week of the month before the passing out
parade
ii. The head of the committee shall be determined by the nominees.
iii. Be responsible for auditing the financial report and statement of account of the EXCO at the end of
their time.
iv. Report directly to the members latest the third week of the month before the passing out parade
v. Shall be dissolved by the new President after the inauguration of the new EXCO.

d. THE SOCIAL COMMTIEE


This committee shall:
i. Not have more than 10 members
ii. Be headed by director of socials
iii. Be in charge of organizing dinner and all social activities of the group

iv. Be in charge of the CDS Programme and Sensitization
v. Social welfare and picnics

h. MERIT AND DISCIPLINE COMMITTEE


This committee shall:
i. Be headed by the vice president
ii. Have provost as secretary
iii. Not more than 10 members
iv. Be in charge of certificate for passing out members
vi. Ensure that merit and discipline are appropriately administered.
vii. Receive issues from members and EXCO, of members that does not comply with the club rules and
regulations.
viii. Recommend outstanding members for awards and special meritorious certificates at the end of tenure
and where necessary

i. SPORT COMMITTEE
This committee shall:
i. Be in charge of the organization of sporting activities and games
ii. Be headed by the sport director
iii. Not have more than 10 members

j. AD-HOC COMMITTEE(S)
i. Ad-hoc committees such as constitutional review committee shall be formed from time to time as
situations demand and such Committee(s) shall be given terms of reference.
ii. All committees shall submit a written report of their activities to the Secretary General.

ARTICLE 7
MEMBERS
1. THE MEMBERS shall be most powerful organ of the group and shall have the following powers:
a. The right to deliberate on all issues concerning the group and may reverse an EXCO’S decision by a two-
third majority.
b. The power to pass a vote of no confidence on any of the EXCO members who may be found wanting in
HIS/HER duties.
c. The power to approve any project before it is executed by the EXCO.
d. The power to set up an Inventory Panel to look into any allegations.
e. The power to set up a Constitution Review Committee, other ad hoc committee if there is a need for it
and adopt or reject the reviewed constitution in accordance with the provision of this constitution.

ARTICLE 8
MEETINGS
The under mentioned are the recognized meetings of the group
1. Members or General Meetings.
2. Executive Meetings
3. Committee Meetings.

1. MEMBERS MEETINGS:
i. Shall be held every Thursday at 9.00am in the premises of the Eket local council.
ii. Shall be presided over by the President or the Vice President in the absence of President.
iii. Every member shall be fully kitted in NYSC attire for the meeting.
iv. No member shall take the floor to speak unless he/she has been duly recognized by the presiding
Officer.
v. Discipline must be enforced during the meeting.
vi. Contending issues shall be put to vote and the winner shall be by simple majority;
vii. Any motion on the floor of the house must be seconded for it to be valid and incase of any counter
motion which is seconded, the two motions shall be put to vote.
viii. Reasonable observation(s) shall be allowed at any point in time in the course of the congress.

2. EXECUTIVE COUNCIL MEETING:


i. Shall be held at least once in a month.
ii. Shall be summoned by the Secretary General, on the directives of the President, through the P.R.O.

ARTICLE 9
MONERTARY AFFAIRS
1. Sources of Fund
a. Monthly dues
b. Levies and fines
c. Contributions from patrons, matrons and Corporate Organizations.

2. safe-keeping of the Group’s Fund:


a. The group shall operate a savings account with any reputable commercial bank.
b. All monetary realized by the group shall be remitted to the treasurer within 24 hours who shall deposit
same in the group’s account in a period not exceeding 48 hours;
c. The treasurer shall keep an impress of N2000.00 only for contingency;
d. The signatories to the group’s account shall be the President, Financial secretary, and Treasurer;
e. A signatory of this account is not a transferable function and cannot be exercised by an Officer in acting
capacity.
f. Spending of monies belonging to the group shall be by the written authorization of the President.
3. The Financial Report of the group shall be presented by the financial secretary to the members monthly.

ARTICLE 10
TENURE OF OFFICE, RESIGNATION, REMOVAL, SUSPENSION AND VOTE OF NO CONFIDENCE
1. TENURE OF OFFICE:
a. The tenure of every EXCO and that of the Standing Committee shall come to end latest by last week of
the passing out parade of the outgoing batch.
b. All Standing Committees, Ad-hoc Committees and Investigatory Panels constituted shall not subsist
beyond the tenure of each EXCO.

2. RESIGNATION:

Any officer of the group wishing to resign his/her office may do so after complying with the following:
a. Serve a one-week notice to the EXCO through the General Secretary stating his reasons and it shall be
deliberated at the next general meeting.
b. In the case of the President, he shall serve a one-week notice to the general members, stating his/her
reasons.
c. Such notice shall be accompanied by a comprehensive report of his/her activities in office and must
conclude with an undertaking that he/she not embezzle, misappropriate or otherwise, misuse the gruop
property or assets.
d. In the case of the President, where his/her resignation is accepted by the members he/she shall forth-
with hand over to the Vice President who shall assume the office as an acting President of the group
pending the appointment of a new President by the Staff Adviser.
e. In any other case, where the members accept the resignation of the Officers in question, a by-election
shall be conducted to replace the resigned Officer.

3. REMOVAL:
Any officer of the group shall be removed from office on the commission of any of the following offences:
a. Violation of the provisions of this constitution.
b. Gross misconduct, corruption and financial mismanagement or misappropriation.
c. Negligence of duty and conduct incompatible with the person of an officer of group.

4. PROCEDURE FOR REMOVAL:


a. Notice of such allegation(s) shall be tabled before the members and copied to the affected officer(s) and
signed by at least ten members who have fulfilled their financial obligations to the group.
b. A panel of three persons shall be set up to investigate the allegations and submit a report within seven
days.
c. The investigation panel shall have the power to summon any member of the group and to request any
documents or correspondence from any member of the EXCO and to receive and hear evidence in
furtherance of its assignment and may make appropriate recommendations of disciplinary nature to
members for any defaulting member.
d. On presentation of a no-case-to-answer by the committee, the matter shall be laid to rest. If on the
other hand a prima-facie case is established against the Officer, the President shall take a motion for
impeachment, it may be seconded, in the absence of which the officer(s) stands impeached.
e. Where there is a counter motion validly made and seconded, matter shall be put to vote and officer
stands impeached by a vote of two-third majority of members present and voting.
f. Where the President is found wanting, he/she shall be asked to step aside to observe the procedure for
removal while the vice president preside.
g. Any person or Officer indicted shall have the opportunity of being heard by the panel of investigation.
h. Election into any vacant office must be conducted immediately by nomination and simple voting.

5. SUSPENSION: An officer of the club may be suspended from office for a period of not more two months
for offences ranging from lack of commitment to the group, absence from meetings and failure to carry
out designated duties.

6. PROCEDURE FOR SUSPENSION: Same as in Article 10, Section 4 of this constitution.

7. VOTE OF NO CONFIDENCE:
a. A vote of no confidence may be passed of any Officer(s) of group. It shall be effectively by a two-third

majority of financial members of the group.
b. Where the motion is successfully, the officer shall be deemed to have resigned compulsorily.

8. PROCEDURE FOR VOTE OF NO CONFIDENCE: Same as in Article 10, Section 4 of this constitution.

ARTICLE 11
ELECTIONS
1. a. The post of the President is elective.
b. Elections into various officers of the group shall be conducted at least two weeks before the Passing out
Parade.
c. An Electoral Committee shall be constituted in accordance with the provisions of this constitution for the
planning and co-ordination of the election.
d. All bonafide members of the group shall be eligible to vote and be voted provided they have fulfilled the
provision of the constitution.
e. A contestant with a simple majority of the total votes cast for a particular office shall be deemed to have
been validly elected for that office.
f. Election results must be announcing immediately after the voting.
g. No officer of the group shall be eligible to contest an election unless he/she first resigns his/her post.
2. By-election: By-elections shall be conducted to fill vacant posts by the EXCO immediately those
vacancies are created.
3. Election Petitions: All election petitions must be filled within 48 hours after election to the Electoral
Petitions Committee.

ARTICLE 12
CODE OF CONDUCT
(1) EXECUTIVE COUNCIL MEMBERS - shall at all times upholds and defend the provisions of this
constitution and in this regard shall:
a. Enforce the provision of this constitution.
b. Conduct themselves in a manner befitting Officer of the group.
c. Shall exhibit boldness and imagination in leadership.
d. Not absent themselves from any meeting of the group without prior approval or lawful justification.
e. Not be unruly or stage a walk out in any meeting of the group.
f. Any member who contravenes any of the provisions of this article shall be treated in accordance with
the laid down guideline stipulated in article 10 (4) (a)-(h).

(2) CDS MEMBERS - shall at all time act in conformity with the provision of this constitution and in this
regard shall:
a. Not fight or harass one another in or outside a meeting.
b. Not use derogatory language on any EXCO or members.
c. Not walk out of any meeting without lawful cause.
d. Noise making during meetings, late coming to the group activities, absentees, improper dressing and
Phone ringing during meetings shall not be entertained from members.
e. Rude behaviour from any member of the club during meetings shall attract a written apology beside any
other sanctions stipulated by this constitution.

f. violations of the code of conduct rules may attract sanctions as specified in this constitution.

ARTICLE 13
AMENDENT AND REVISION
1. Any member of the group may in a meeting raise a motion for amendment of this constitution or any
part thereof stating his reasons, motion must be seconded for it to be valid.
2. The Presiding President shall request a counter motion and if seconded the matter shall be put to vote.
3. On the resolution of 3-quarter (3/4) majority of financial members of the group, a committee shall be
set up to review the constitution or any part thereof in accordance with the motion.
4. A copy of reviewed constitution shall be presented to the meeting and shall be adopted by a vote of 3-
quarter majority of financial members of the meeting.

ARTICLE 14
FINAL PROVISIONS
1. The group shall be administered under the Office of the Community Development Service (CDS)
Department of NYSC Eket, Akwa Ibom State.
2. All decisions and resolutions of the members shall as much as possible be implemented to the latter by
the EXCO.
3. The EXCO and all Committees set up by the group shall adopt their own rules of procedure but if there is
clash with that the group, the rules of the group shall prevail.
4. The group shall express concern by way of courtesy calls, condolence visits etc. in instances of sad
occurrences affecting members of group and may express joy and share in the happiness on such
occasions involving her members.

7. Any members involved in financial misappropriation shall be made to refund the money within
stipulated time and/or face the appropriate authorities.
8. Offences constituting acts of indiscipline shall attract the following fines stipulated against them:
b. Lateness N20.00 (Lateness start from 30minutes after the commencement of the meeting)
c. Improper dressing N50.00
d. Noise making/GSM Sounds N20.00
e. Rude behaviour during meetings N100.00
In the case of non compliance, the affected member shall be refer to the merit and discipline committee
for appropriate action.

1. OATH OF OFFICE FOR EXCO MEMBERS
