What is academic freedom?

The concept of educational freedom is based on the idea that free exchange of ideas on
campus is essential to a good education. In particular, freedom of education is the right of the
members of the faculty, acting individually and collectively, to decide without external
interference: (1) the college curriculum; (2) subject content; (3) teaching; (4) student assessment;
and (5) conducting specialist research. These rights are underpinned by two institutional
processes — shared governance and tenure (see below.) Freedom of education ensures that
colleges and universities are “safe places” for research, places where students and academics can
challenge common sense in any field — art, science. , politics or otherwise.

CASE:
ATENEO DE MANILA UNIVERSITY v. IGNACIO M. CAPULONG, GR No. 99327, 1993-
05-27

FACTS:
The university has been found guilty of violating the Ateneo Law School Rules on
Discipline, which prohibits participation in telecommunications activities. This case has attracted
a lot of people because of the death of one of the neophytes and the traumatic physical injury to
another. As a result of those initiation rituals, Leonardo "Lennie" H. Villa, a first-year student at
the applicant university, died of serious injuries at the Chinese National Hospital on February 10,
1991. He was not the only victim, however, another newborn named Bienvenido Marquez was
also hospitalized. at Capitol Medical Center due to severe kidney failure caused by severe

HELD:
Yes. Ateneo has the ability and the ability to expel his bad students so that he can use that
power right. Students should not call a prestigious institution like Ateneo for a while simply
because they may have a negative impact on current and future students. These are the freedoms
of education in the school environment that include the freedom to decide who can teach, the
freedom to decide what can be taught, the freedom to decide how to teach and the freedom to
decide who can be allowed to study.
Is regulation equivalent to deprivation of rights of educational institutions?

As stated in the Philippine Constitution, education is one of the priorities of the


Government. Apart from basic necessities such as food, shelter and clothing, it is one of the basic
needs that the Government must provide to its citizens. Although the private sector has played a
significant role in promoting education at present, the government must still take the lead in
ensuring quality and accessibility. It should be noted that the full growth of students does not
depend on textbooks and subjects. Apart from providing them with a suitable learning
environment, it is the Government's responsibility to ensure that the quality of education goes
beyond the cornerstones of the classroom; because indeed the real lessons in life are found in the
real world. However, the current formal education system has, in a sense, robbed students of the
opportunity to develop their full potential.

CASE:
RAYMOND A.SON vs. UNIVERSITY OF SANTO TOMAS GR 211273 APRIL 18,2018

FACTS:
Petitionners Son and Antiola were appointed by UST in June, 2005, while Pollarco was
appointed prematurely or in June 2004. Under their various nomination papers, applicants were
nominated as “members of the PROBATIONARY Status Unit,” who reached their permanent
position to meet all the requirements provided under the existing university rules and regulations
and other applicable laws, which include, inter alia, having the required qualifications before the
end of the exam period and their performance of the duties and responsibilities specified in the
job description.

ISSUE:
Was the petitioner’s failure to obtain a master's degree as required by CHED as a
residency status a valid reason for dismissal?

HELD:
Yes, applicants' failure to obtain a master's degree is a valid reason for their dismissal.

The minimum requirement for a master's degree in the field of undergraduate teaching
has been cemented in the DECS Order 92, Series of 1992. Both sides have been violating it. The
fact that the government has never acted against those who break the law, or has chosen not to
enforce the law, does not eliminate the violations committed by flawed educational institutions.
It cannot be said that by agreeing to a period of automatic residency in the CBA, respondents are
deemed to be stopping or abstaining from the use of the requirement. Such negligence is
completely illegal
