At 1:20 in the afternoon, Acting Vice Mayor Alberto T. Ungab called the session
to order. Councilor Wilberto E. Al-ag led the prayer; after which, the singing of the
Philippine National Anthem and “Tayo’y Dabawenyo” followed.
Upon the direction of Temporary Presiding Officer Alberto T. Ungab, Ms. Charito
N. Santos, Secretary to the Sanggunian, called the roll which established that twenty
(20) Members of the Body were present, thus, mustering a quorum.
Floor Leader (FL) J. Melchor B. Quitain Jr. proceeded to move, duly seconded by
Councilors Jessica M. Bonguyan, Richlyn N. Justol-Baguilod, Louie John J. Bonguyan
and Bai Hundra Cassandra Dominique N. Advincula, for the approval of the Minutes of
the regular session held on August 6, 2019. There being no corrections, the motion
was approved.
The Privilege Hour then started with Councilor Augusto Javier G. Campos III as
the first speaker.
PRIVILEGE HOUR
Councilor Augusto Javier G. Campos III notified the other members of the City
Council that, on August 9, 2019, he, along with the other members of the Committee
on International Relations, had a diplomatic meeting with His Excellency Consul General
Li Lin of the People’s Republic of China. They discussed potential areas of cooperation
in the field of trade, commerce, education, arts and culture, agriculture and health.
The Councilor from the second district subsequently presented a motion, duly
seconded by Councilors Antoinette G. Principe-Castrodes, Jaffar U. Marohomsalic, Mary
Joselle D. Villafuerte, Richlyn N. Justol-Baguilod, Jessica M. Bonguyan and Pilar C.
Braga, to consider the matter as having been read under First Reading and to refer the
matter to the Committee on International Relations. There being no further
discussions, the motion was carried. (Docketed as Item No. 288)

When the session resumed, the Temporary Presiding Officer, upon the request of
FL Quitain Jr., directed the Secretary to the Sanggunian to change the status of
Councilors Danilo C. Dayanghirang and Dante L. Apostol, Sr. from absent to present,
which was duly noted.
Indicating concern for public safety especially for the safety of the thousands of
motorists all over Davao City, Councilor Jesus Joseph P. Zozobrado III reported that,
according to the World Health Organization (WHO), 1.25 million deaths are caused by
road accidents every year while more than 10,000 Filipinos perish annually due to road
accidents. The City has more than its fair share of road accidents and most of such
accidents are caused or involved motorcycles.

Moreover, Councilor Zozobrado III expressed his support to the Memorandum
issued by the Mayor regarding the stricter enforcement of development and
construction regulations. Hence, he informed the august body of his intention to
propose a Resolution expressing the same sentiments.
In line with the privilege speech of Councilor Conrado C. Baluran during the
previous session relative to the copra industry and processing of bio-diesel, Councilor
Dayanghirang directed the attention of the City Council to the dire state of coconut
farmers and their families, not just in the City of Davao but in other areas as well, due
to the massive decline of the price of coconuts.
The only question of Councilor Dayanghirang was whether the Philippine Coconut
Authority (PCA) prepared measures to mitigate the adverse effects of the low price of
copra vis-à-vis coconut farmers.
To give way for the PCA and other resource persons to answer the questions
directed to them, Councilor Dayanghirang presented a motion, duly seconded by
Councilors Bai Hundra Cassandra Dominique N. Advincula, Mary Joselle D. Villafuerte,
Jaffar U. Marohomsalic and Bonifacio E. Militar, to declare the session in recess. There
being no objections, the motion was approved.

Upon his recognition, Mr. Romulo Dela Rosa introduced himself as the
Administrator of PCA and a member of its governing board. He explained that the price
of coconut is very dependent on the international price of coconut oil. Because there is
a slump in the prices of all vegetable oils internationally, the price of copra naturally
decreased as well. Because the production of coconut is geared towards the export of
coconut oil, the price of coconuts is gravely affected by the situation in the international
market.
On a positive note, there is already a policy that the percentage of coconut oil in
bio-diesel must be increased from 2% to 5% by 2015. However, this policy has not

been implemented because there are some groups that hinder this eventuality.
Increasing the percentage of coconut oil in bio-diesel will also increase the utilization of
coconut oil by 3% which will immediately increase the price of copra. To start the
implementation of the 5% composition of coconut oil in bio-diesel, the President of the
Philippines need only to direct the Department of Energy to comply with the
requirement of the law then the price of copra will immediately increase in accordance
with the law on supply and demand.
Another measure that may be taken is to rescind the ban on the export of whole
mature coconuts. There is a demand from China on the export of mature whole
coconuts. If this is done, there will be competition between copra and whole coconut
selling.
Upon the prompting of Councilor Dayanghirang, Mr. Dela Rosa declared that he
will submit a position paper to the Secretary to the Sangguniang Panlungsod.
Moreover, Mr. Dela Rosa informed the august body that the PCA has been assisting
local cooperatives in building Coconut Hubs which essentially helps coconut farmers
learn how to process other coconut products so that they will have products other than
copra. With that, Councilor Dayanghirang thanked Mr. Dela Rosa for clarifying certain
matters especially for suggesting mitigating measures to help coconut farmers.
Councilor Dayanghirang asked Mr. Arsadon for his opinion on the law requiring
the composition of coconut oil in bio-diesel to be increased from 2% to 5% so that the
price of coconuts will increase. In turn, Mr. Arsadon stated that the DOE supports such
increase. In fact, there are biofuel producers in Mindanao. Two (2) of which are in
Davao City – one has the capacity to produce 16.5 million liters a year and the other
one produce has the capacity to produce 13 million liters a year. There is also a biofuel
producer in General Santos City, which has the capacity to produce 13 million liters a
year, and another one in Misamis.
Furthermore, the DOE has also been providing assistance to the producers to
increase their capacity in preparation for the increase of coconut oil composition. The
Implementing Rules and Regulations of Republic Act No. 9367, also known as the
Biofuels Act of 2006, states that there will be a Technical Secretariat that will
recommend the implementation of the 5% to the National Biofuels Board. The said
Board will be the one who will recommend the implementation to the DOE. However,
no such recommendation has been made due to the fact that there are technicalities
that must be complied first. The DOE is still preparing for the 5% to be implemented.
When Councilor Dayanghirang asked for the position paper of DOE, Mr. Arsadon
declared that DOE will submit its position paper. In so doing, the representative of DOE
was excused from the session.
Mr. Nengaska assured the City Council that he will submit the roadmap of the
coconut industry cluster as well as the contact information of DTI and Cocolink.
Once again, concern over the environment was brought forth to the attention of
the City Council. Councilor Pilar C. Braga quoted a letter written by Mr. Wenifredo C.
Gorrez, former Executive Director of Konsumo-Dabaw, regarding the continued use of
single use plastics. All over the world, sixteen (16) countries and cities already banned
the use of single use plastics and Siargao followed such move.
Two courses of action were proposed by Mr. Gorrez to decrease the amount of
single use plastics that go to the landfill or end up in the seas. First, the passing of an
Ordinance requiring all public schools in the City to procure and use tables, chairs and
desks which are made from recycled single use plastics. Second, the holding of regular
competition in all schools to use Ecobricks as buildingblocks of whatever they want to
showcase.
A challenge was then left to the City Council to enact another trailblaizing
Ordinance just like the Anti-Smoking Ordinance which, at first, was difficult to
implement but which is now considered a landmark Ordinance that is being replicated in
other parts of the country.
Councilor Braga then referred the letter of Mr. Wenifredo C. Gorrez to the
Committee on Environment led by Councilor Diosdado Angelo Junior R. Mahipus and to
the Committee on Education. Presiding Officer Albert T. Ungab gave a direction to refer
the speech of Councilor Braga to the appropriate committees. (Docketed as Item No.

In connection with the privilege speech of Councilor Pilar C. Brag in the previous
session relative to the cutting of trees at the riverbank of Maa, Councilor Diosdado
Angelo Junior R. Mahipus declared that the Committee on Environment already held a
hearing regarding the issue. As a preliminary report, the Councilor from the second
district stated that there is an ongoing DPWH drainage and revetment project that has,

however, been stalled. The project required the cutting and transfer of around 150
trees. A cutting permit was issued by the Department of Environment and Natural
Resources (DENR) but the said agency did not coordinate with its counterpart, the City
Environment and Natural Resources Office (CENRO). Consequently, Councilor Mahipus
Jr. reminded DPWH regarding the Executive Order issued by the City Mayor creating the
IMAG or the Davao City Infrastructure Monitoring and Advisory Group. Before
implementing any of their projects, such projects must be submitted to IMAG for the
local government to assess and study the effect of such projects to the City. It is thus
imperative that there be consultation and close coordination between national agencies
and the City Government.
Having noticed that there is no particular committee tasked to look after Davo
River, Councilor Mahipus Jr. called for the reconstitution of the Davao River
Coordinating Council which shall oversee the preservation and management of Davao
River. In time, the said Councilor will present the Resolution and Ordinance to this
effect.
First Reading
After concluding the Privilege Hour, FL J. Melchor B. Quitain Jr. proceeded with
the First Reading. His motion, duly seconded by Councilors Wilberto E. Al-ag and Mary
Joselle D. Villafuerte, to consider the following Items as having been read and passed
under First Reading, was duly carried:
271. Email dated 29 July 2018 of Ms. Alexandra Calindas, seeking assistance
relative to her concern against the Lupong Tagapamayapa of Barangay
Manambulan, Tugbok District, this City, for appropriate action of the Body.
279. Letter of complaint from the officers and members of Nagkahiusang Kabus
sa Bunawan, Incorporated, against PB Ronnie Odeña and the members of

Noting that all the items in the agenda were under the Committee on Finance,
Ways and Means and Appropriations except for Item No. 193, Councilor J. Melchor B.
Quitain Jr. moved, duly seconded by Councilor Bonifacio E. Militar, to recast the agenda
in order to discuss such item first. As such, the motion was carried.
Upon recognition, Councilor Bonifacio E. Militar presented Item No. 193 relative
to City Housing and Land Use Regulatory Unit (CHLURU) Resolution No. 033-19, Series
of 2019, favorably endorsing to the City Council the application of Aviana Development
Corporation, represented by Mr. Ivan Francis Evangelista, for Preliminary Approval and
Locational Clearance (PALC) of the proposed two (2) Towers and one (1) Multi-level Car
Park Building project, “The Residences”, located at Azuela Cove Estate, J. P. Laurel
Ave., corner R. Castillo Street, Kilometer 7, Lanang, this City.
The proponent explained that the item was a carryover from the 17 th City Council
and that the applicant already complied with all the requirements for PALC. His motion,
duly seconded by Councilors Mary Joselle D. Villafuerte, Jesus Joseph P. Zozobrado III
and Augusto Javier G. Campos III, for the conversion of the body into a committee of
the whole, for the representative of the applicant to answer questions which maybe
propounded to him, was carried.
Upon query of the proponent, Mr. Evangelista signified that Aviana Development
Corporation already has a socialized housing compliance located in Barangay Biao, Ula

and Los Amigos with one hundred thirty-six (136) units of socialized housing lots.
There is also a greening system composed of four thousand nine hundred eighty-nine
(4,989) square meters or 40.23% which is well within the requirement of the law.
Councilor Jesus Joseph P. Zozobrado III, who wanted to clarify whether the
selling of the units and the construction of the project already started, was assured by
Mr. Evangelista that no such construction was started because the applicant is still in
the process of applying for its Building Permit. Councilor Zozobrado III then reminded
him that no construction should be done without the pertinent Building Permit.
Councilor Mahipus Jr. expounded that residents of the Second District have been
complaining of lack of water supply though the developers assured them of having
enough water supply. He further elucidated that there is a letter from DCWD to the
Department of Public Works and Highways (DPWH) indicating the concern that the pipe
laying for the Tamugan Bulk Water project has been delayed due to the fact that DPWH
disallowed DCWD from commencing with the laying of the pipes until it is finished with
its ongoing project in the same area. Upon the other hand, DPWH still has right-of-way
issues that have stalled their projects. In effect, the applicant Aviana Development
Corporation will not be able to provide water for their prospective residents.
Mr. Evangelista informed the august body that, as a contingency plan, the
applicant requested the National Water Resources Board (NWRB) for a permit to drill to
check on water availability within the estate. Furthermore, it has sought assistance
from third party contractors to perform the drilling once NWRB will grant the request.
Councilor Mahipus Jr. pointed out that, as things stood, there was no assurance
that there would be enough water supply for the future residents of the proposed
condominium. Mr. Evangelista added that the applicant has a certification that the
NWRB filed WTA for appropriation of water at Lanang, this City. The said certification
served as guarantee that there will be water appropriation for Lanang. The applicant
will also be installing water containment facilities to meet the demands of the
prospective unit owners. Manila Water Philippine Ventures Incorporated will supply
water to the proposed project.
Councilor Mahipus Jr. emphasized that there is still no water supply for the area.
The concern of the City Council, according to him, was that it could not ascertain
whether there will be water supply for the area when the project will be finished. He

reminded that the certificate of water availability is an express requirement stated in
the Zoning Ordinance.
Another cause for concern was the absence of discharge permit from the
Environment Management Bureau (EMB) of the Department of Environment and Natural
Resources (DENR) because there was no operational waste water facility. Mr.
Evangelista explained that there was no operational waste water facility because the
construction has not started yet. The waste water facility will be constructed together
with the construction of the project.
The Councilor also inquired regarding the submitted Traffic Impact Assessment
(TIA) which was made in 2015. Developments in the City, such as the pending
construction of the Samal Bridge that will start near the proposed site as well as the
construction of the Coastal Road which will end at an area contiguous to the site, might
change the TIA because the traffic situation in 2019 is far different from the one in
2015. To this, Mr. Evangelista replied that the applicant will undertake a new TIA.
As for the question whether a Rainwater Catchment Facility will be built, Mr.
Evangelista stated that there will be two (2) of such facilities.
Councilor Mahipus Jr. concluded that he was inclined not to vote favorably to
grant the request for PALC because there was no guarantee that the future residents
will have water and there was no existing waste water facility to mitigate the
environmental effects of the construction and operation in that area.
The proponent was then recognized who stated that his committee anchored its
recommendation on CHLURU Resolution No. 033-19, Series of 2019, which favorably
recommended the approval of the request of Aviana Development Corporation.
Additionally, there was already a water facility for the first project of the applicant and
such facility may accommodate the new project. He also pointed out that some
requirements could only be satisfied during the construction of the building. Councilor
Militar categorically stated that he was favorably endorsing the matter.
RECESS

When the session resumed, Councilor Militar moved, duly seconded by Councilor
Danilo C. Dayanghirang, to defer Item No. 193 until the next session to secure
additional requirements which Councilor Mahipus asked. There being no further

Before discussing Item No. 264 on the addendum to the Local Development
Investment Program (LDIP), Councilor Dayanghirang briefed the new members of the
City Council that the LDIP is the general investment plan of the City. The Department
of Budget and Management requires an LDIP before a budget may be approved. From
the LDIP, the local government must cull out programs for the Annual Investment
Program (AIP). From the AIP, the budget is formulated based on the listed programs in
the AIP. The budget contains the final list of programs to be implemented as well as
the amount appropriated for each program. Davao City’s Annual Budget for Calendar
Year 2019 is Php 8.8 billion. Once the annual budget is approved, the local government
unit may come up with Supplemental Budget 1, 2, and 3 to utilize the savings from the
annual budget.
Councilor Dayanghirang stated that the total amount in the Addendum to the
LDIP is Php 1,537,384,000.00. He then presented a motion, duly seconded by
Councilors Bai Hundra Cassandra Dominique N. Advincula, Wilberto E. Al-ag, Myrna
G. L'Dalodo-Ortiz, Pilar C. Braga, Jessica M. Bonguyan and Diosdado Angelo Junior R.
Mahipus, for the Resolution, which was carried.

Item No. 03
After all the items relating to Supplemental Budget No. 1 were discussed,
Councilor Danilo C. Dayanghirang began the deliberation of Item No. 03 on the appeal
of Norbel Aguilles, small private trash hauler and recycler, relative to the increase of
tipping fee in the landfill. After presenting the committee report, the Councilor
presented a motion, duly seconded by Councilor Jaffar U. Marohomsalic, to approve
such report. As such, the committee report was approved.

On motion of the proponent, duly seconded by Councilors Bai Hundra Cassandra
Dominique N. Advincula, Jaffar U. Marohomsalic and Diosdado Angelo Junior R.
Mahipus, the following Resolution was approved:
At this point, Councilor Jesus Joseph P. Zozobrado III raised a concern as to the
justification of the decrease of the fee. To this, the proponent explained that private
trash haulers complained during the committee hearing that the expenses for the
operation of their business have become too high. Originally, the tipping fee was only
Php 1.00 but it was increased to Php 3.00 when the Revenue Code was amended. The
manpower needed as well as the fuel usually utilized to bring the garbage to the landfill
have become too expensive. Thus, the haulers appealed for the tipping fee to be
decreased. Moreover, the reduction of the said fees will not affect the financial
standing of the City. The proponent also pointed out that six (6) committee hearings
were conducted to ensure that the decrease of the tipping fee was a just move and that
such reduction was agreeable to other concerned agencies.
Item No. 04
Councilor Jesus Joseph P. Zozobrado III inquired whether there was a need to
inform the Municipality of Sta. Cruz of this development. The proponent countered that
it was not necessary, in fact, no committee hearing was held on the matter because the
City of Davao already made its decision regarding the sharing of real property tax.

Upon motion of Councilor Dayanghirang, duly seconded by Councilors Bai Hundra
Cassandra Dominique N. Advincula, Pilar C. Braga and Jaffar U. Marohomsalic, the
following Resolution was approved:
Item No. 05
For the next item on the agenda, Councilor Dayanghirang presented the
committee report on Item No. 05 regarding the Offer to Sell of Violeta S. Sia, Jose A.
Pojas and Steve B. Bano, Real Estate Agents, involving a parcel of agricultural land
owned by Jovencita Torres consisting of an area of 68,000 square meters, more or less,
situated at Barangay Biao Joaquin, Calinan District, Davao City. Finding that the matter
was not under the jurisdiction of the City Council as the City Planning and Development
Office was in a better position to consider the matter, the proponent recommended that
the matter be submitted to the City Planning and Development Office.

As the committee report for Item No. 06 about the letter from Bunawan Public
Market Transient Vendors, requesting for the suspension of the rental fee increase of
their stalls was presented, Councilor Danilo C. Dayanghirang noted that the subject fee
was very minimal and the increase was reasonable. Hence, the committee
recommended the denial of the request. Subsequently, the proponent moved, duly
seconded by Councilors Bonifacio E. Militar and Bai Hundra Cassandra Dominique N.
Advincula, for the approval of the committee report. Thus, the motion was approved.
Item No. 37
Being the Chairperson of the Committee on Finance, Ways and Means and
Appropriations, Councilor Danilo C. Dayanghirang presented the committee report for
Item No. 195 regarding Resolution No. 01, Series of 2019 of the Barangay Council of
Gatungan, Bunawan District, this City, requesting for a budget allocation, through
Councilor Dante L. Apostol Sr. for the construction of Women’s building.
For his last item on the agenda, Councilor Dayanghirang presented the
committee report on Item No. 197 regarding the request of Loreta G. Cardanao, SGC
President of Galon Elementary School, Barangay Mandug, Buhangin District, this City,

On motion of Councilor Dayanghirang, duly seconded by Councilors Jessica M.
Bonguyan, Pilar C. Braga and Jaffar U. Marohomsalic, the following Resolution was
approved:
SUSPENDED RULES
After items under the regular agenda were discussed, FL J. Melchor B. Quitain Jr.
manifested that there were urgent matters that needed the City Council’s attention.
Consequently, he presented a motion to suspend the rules, duly seconded by Jaffar U.
Marohomsalic, which was carried.
In a letter dated February 21, 2019 written by Mayor Sara Z. Duterte for Mr.
Anselmo Simeon P. Pinili of the Philippine Charity Sweepstakes Office, the Mayor
mentioned that, according to studies, STL does not deter gambling but it, in fact,
exacerbates Filipino’s dependency on games of luck. In essence, STL has not alleviated
poverty. The Mayor also requested the recalibration of STL operation as well as the
revocation of licenses of STL operators in order to reduce gambling in the City. The
reply was made on May 20, 2019 where it was stated that the matter was referred to
PCSO’s Davao del Sur branch.

Next, Councilor Pilar C. Braga took the floor and presented a motion, duly
seconded by Councilors Wilberto E. Al-ag, Danilo C. Dayanghirang, Bai Hundra
Cassandra Dominique N. Advincula, Mary Joselle D. Villafuerte, Jessica M. Bonguyan
and Louie John J. Bonguyan, for the approval of the following Resolution:
As such, the motion was approved. On motion of Councilor Quitain Jr., duly
seconded by Councilors Myrna G. L'Dalodo-Ortiz, Pilar C. Braga and Jaffar U.
Marohomsalic, the corresponding Ordinance was approved as follows:
The Floor Leader took the floor again to present to the City Council the proposed
Deed of Donation of two (2) units of firetrucks in favor of the City Government of Davao
to be executed by Jinjang Municipal People’s Government. He manifested that, upon
his scrutiny, the Deed of Donation is unconditional and it is gratuitous.
There being no further discussions, the Resolution was approved with the co-
sponsorship of Councilor Myrna G. L'Dalodo-Ortiz. Subsequently, Councilor Quitain, Jr.
presented a motion, duly seconded by Councilors Antoinette G. Principe-Castrodes,

Duly recognized by the Chair, Councilor Jesus Joseph P. Zozobrado III presented
a Resolution in relation to the second part of his Privilege Speech earlier in the session.
Thus, on motion of said Councilor, duly seconded by Councilors Myrna G. L'Dalodo-
Ortiz, Edgar P. Ibuyan Jr., Bai Hundra Cassandra Dominique N. Advincula, Pilar C. Braga
and Jaffar U. Marohomsalic, the following Resolution was approved:
