JUDICIAL AFFIDAVIT OF
of Prosecution witness Mich Padilla-Abrenica

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of
judicial affidavits to serve as the direct examination testimony of the accused, on the
basis of which the adverse party may conduct their cross-examination on the same, I
hereby execute this judicial affidavit in a question and answer format;

That conformably with Section 3(b) of said A.M. No. 12-8-8-SC, I hereby state
that the person examining me is Atty. Rocelle Tangi of the City Prosecutor’s Office,
Ilocos Norte, my counsel, and that the examination is being held at the same address
on 27 October 2021;

That conformably with Section 3(c) thereof, I hereby state that in answering the
questions asked of me, as appearing herein below, I am fully conscious and that I did
so under oath, and that I may face criminal liabilities for false testimony or perjury;

AND UNDER OATH, AVERS THE FOLLOWING:

I, Mich Padilla-Abrenica, Filipino, of legal age, married to Nash Abrenica, we have 3


children ages 24, 22, and 15. With residence at Block 1 Lot 4 Kalayaan Village, Brgy.
201, Pasay City, in answer to the questions propounded by counsel, hereby depose and
state that:

Witness Mich Padilla-Abrenica, by counsel, respectfully submits to the Honorable


Court this Judicial Affidavit of Mich Padilla-Abrenica:

OFFER OF TESTIMONY
 
This affidavit of complainant-witness Mich Padilla-Abrenica is being offered to
prove that accused Nash Abrenica committed a violation of R.A No. 9262 or otherwise
known as The Anti-Violence Against Women and their Children Act.

I, Mich Padilla-Abrenica, as part of my testimony in the above-captioned case,


after having been sworn in accordance with law, hereby answer the following questions
propounded to me:

Q1: In what language do you want your examination to be conducted?

A: This judicial affidavit is prepared in English but I prefer that my examination be


conducted in Tagalog for my convenience and clarity.

Q2: Please state your name and other personal circumstances for the
records.

A: I am Mich Padilla-Abrenica, 44 years of age, married to Nash Abrenica, we have


three children ages 24, 22, and 15.

Q3: What happened on the night of October 12, 2021?

A: I came home at around 8 in the evening. I saw my husband Nash waiting for me
in our sala. I told him that I just had overtime to finish work in our office.

Q4: What happened after?

A: He slapped me and was mad that I am an hour late in our agreed curfew. He said
that I am giving him alibies and was in fact with my friends.

Q5: What did you do after?

A: I told him that I was really working but he did not believe me. He is always jealous
and suspects me of cheating on him.

Q6: What did he do after?


A: He called me a liar. And he said that he will kill every man eyeing me. He also
prevented me from seeing my friends.

Q7: What happened next?

A: He again slapped me. I told him that I would never cheat on him since my life
revolved around him and my children. I also confronted him about his affair with a bank
manager.

Q8: What did he do?

A: He admitted having an affair with the bank manager, but he told me that he was just
using her for our bank accounts.

Q9: What happened next?

A: His admission of having an affair resulted in our series of fights. In one of our
quarrels, he grabbed me on both arms and shook me with a force that caused bruises
and hematoma. At another time, he hit me forcefully on the lips that cause some
bleeding.

Q10: What did you do after?

A: I did nothing. I was scared that if I resisted his beatings, he will take it on our children.
Until on the night of October 17, 2021, I confronted him again for boasting his sexual
relationship to our house help and boxing my younger daughter Shay.

Q11: What happened on the night of October 17, 2021?

A: At around 8 p.m., I saw my husband Nash come home. I approached him to talk to
him.

Q12: What happened after?

A: He ignored me and he proceeded to our room upstairs. I followed him and prevented
him from entering our room.

Q13: Why did you prevent him from entering the room?
A: I was begging to talk to him. I want to clear things up in our relationship for the
sake of our children.

Q14: What happened after?

A: We have a heated argument. I told him that I intend to file charges against him
and his paramour.

Q15: What happened after? 

A: He got angry and told me that if I go on a legal battle with him, I would not get a
single centavo. He also told me that I should just be thankful that he was not leaving me
and cohabiting with his paramour.

Q16: What did you tell him?

A: I told him to calm down but he forcefully pushed me.

Q17: What did he do after?

A: I don’t know ma’am. After he pushed me everything went blurry. I woke up at


the hospital days after the incident having bruises and stitches in my body. I have
finally decided to file a VAWC case and a permanent protection order against my
husband.

Q18: In connection with this Judicial Affidavit, have you read and understood
the contents hereof?

A: Yes.
 
Q19: Has this Judicial Affidavit been explained to you in a language that you
understand?

A: Yes.

Q20:          Do you confirm the truth and veracity of your statements in this
Judicial Affidavit?

A: Yes.
Q21: Are you aware that you made those statements under oath and that
you may face criminal liability for false testimony or perjury?

A: Yes.
