POSIBLE BANG mailagay sa watchlist ng Philippine Overseas Employment Administration (POEA) ang
isang Overseas Filipino Worker (OFW)? Ano ang basehan para rito at paano ito matatanggal?

MAAARING HINDI makaalis ang isang Overseas Filipino Worker (OFW) para makapagtrabaho
sa ibang bansa kung may nakasampang isang administrative case laban sa kanya sa Philippine
Overseas Employment Administration (POEA). Maaaring magsampa ng isang reklamo ang
sinumang tao laban sa isang OFW sa mga sumusunod na basehan ayon sa Section 1, Rule III  ng
POEA Rules and Regulations Governing the Recruitment and Employment of Land-based
Overseas Workers:
1. Pre-Employment Offenses – 1. Using, providing, or submitting false information or documents for
purposes of job application or employment; 2. Unjustified refusal to depart for the worksite after all
employment and travel documents have been duly approved by the appropriate government agency/ies.
2. Offenses during Employment – 1. Commission of a felony or crime punishable by Philippine Laws or
by   the             laws of the host country; 2. Unjustified breach of employment contract; 3.
Embezzlement of company funds or monies and/or properties of a fellow worker entrusted for delivery
to kin or relatives in the Philippines; and 4. Violation/s of the sacred practices of the host country.
Pansamantalang hindi makaaalis ang isang OFW kung may reklamong nakasampa sa POEA
laban sa kanya. Ngunit papayagan naman ng ahensiya na umalis ang naturang OFW sa oras na
ito ay magsumite ng kanyang sagot sa reklamong inihain.

Tuloy-tuloy pa rin ang pag-iimbestiga kahit pa pinayagan na ang pag-alis ng OFW at mananagot
pa rin siya kung may nakitang paglabag ng panuntunan ng ahensiya (Section 7, Rule III, POEA
Rules and Regulations Governing the Recruitment and Employment of Land-based Overseas
Workers).

Ngunit hindi papayagan ang nasabing OFW kung ang ebidensya laban sa kanya ay mabigat
kahit pa siya ay nakapagsumite na ng kaukulang sagot (Section 9, Rule III, POEA Rules and
Regulations Governing the Recruitment and Employment of Land-based Overseas Workers).

Samantala, maaari ring hindi makaalis ang isang OFW na umalis kung meron siyang warrant of
arrest o hold departure galing sa kinauukulang ahensiya o korte. Sa gayon, kailangan munang
kumuha ng clearance o payagan siya ng ahensiya o korte upang siya ay makaalis ng bansa para
magtrabaho (Section 6, Rule III, POEA Rules and Regulations Governing the Recruitment and
Employment of Land-based Overseas Workers).

Sana ay nasagot namin ang iyong katanungan. Ang legal na opinyon namin ay maaaring
mabago kung madaragdagan o mababawasan ang mga nakasaad sa iyong salaysay.
