of the current Workplace Health and Safety legislation and access the codes relevant to

As an example of the responsibilities set out under WHS legislation, here is an excerpt from
the NSW Work Health and Safety Consultation, Co-Operation and Co-Ordination Code of
Practice 2011: Consultation requires that:
• Relevant work health and safety information is shared with workers
• Workers are given a reasonable opportunity to express their views and to raise health or
safety issues
• Workers are given a reasonable opportunity to contribute to the decision making process
relating to the health and safety matter
• The views of workers are taken into account, and
• Workers are advised of the outcome of any consultation in a timely manner.

WHS committees and representatives


WHS committees and/or representatives are intended to formalise the means for
consultation and cooperation between management and workers. A health and safety
committee must have at least 50% elected employee representation. Their role is to ensure,
through liaison with management that WHS requirements are met. The committee
represents the interests of workers who are encouraged to report perceived workplace
issues.
A health and safety representative (HSR) is an elected individual who serves much the same
purpose as a committee. Employers have a legal responsibility to enable the election of a
HSR if it is requested by one or more employees. HSRs investigate worker complaints about
WHS, conduct workplace inspections and liaise with employers to encourage improvements.
Other ways to consult with others on WHS issues:
• Suggestion boxes
• Team meetings on WHS
• One-on-one discussions
Q 5 According to the Model WHS Act, Subdivision 1, Part 17, there is a requirement to
conduct hazard analysis and implement risk controls in order to manage hazards: A duty
imposed on a person to ensure health and safety requires the person:
a) To eliminate risks to health and safety, so far as is reasonably practicable; and
b) If it is not reasonably practicable to eliminate risks to health and safety, to minimise
those risks so far as is reasonably practicable.
List the 5 steps in the hierarchy of controls. Given the above requirement, which aspects
would you need to consider when deciding on control measures for any hazards you have
identified, based on the hierarchy of controls?
