LEAVE AND LICENCE AGREEMENT

THIS AGREEMENT is made and entered into at


_________________, on this _____ day of the month of
________, of the year Two Thousand and Twenty One.

BETWEEN

SMT. KAVITA NANDAKUMAR, wife of Nandakumar Lakshmipathy,


aged 36 years, house wife, Indian National, resident of D
1027, Ashiana Anantara, Mango, Jamshedpur, Jarkhand
831012, hereinafter referred as “THE LICENSOR” (which
expression unless repugnant to the context or meaning
thereof shall mean and include her heirs, executors, legal
representatives, administrator and/or assigns) OF THE ONE
PART-

AND

SHRI___________________________________, S/o
____________________, Resident of _____________, Indian
National, PAN Card No. _______ and Mobile No. _______,
hereinafter called as “THE LICENSEE” (which expression
unless repugnant to the context or meaning thereof shall
mean and include his heirs, executors, legal
representatives, administrator and/or assigns) OF THE
OTHER PART.

WHEREAS, there exists a flat on the Tenth Floor, bearing


number D-1027 in the Building known as Orient 1, in the
Housing Society namely Ashiana Anantara, located at Mango,
Jamshedpur, more particularly described in Schedule I
written hereunder and herein after referred to as the
‘SAID PREMISES’
THIS AGREEMENT is effective from the _1st day of the Month
of May 2021.

WHEREAS the LICENSOR is the owner in possession of the


said premises.

The LICENSEE approached the LICENSOR and requested the


LICENSOR to allow him to use said premises for residential
purpose for a period of Eleven months with effect from 1st
May 2021 to 31st March 2021.

AND WHEREAS the LICENSOR has accepted the request of the


LICENSEE and agreed to grant his permission and leave and
license to the LICENSEE to use the said premises for
residential purpose only for a term of Eleven months
commencing from 1st May 2021 upon the terms and conditions
agreed by and between the parties herein after provided:

NOW THEREFORE THIS AGREEMENT WITNESSETH AS UNDER:

1. The Licensor hereby agrees to grant a


license/permission for the residential use of the
premises for a period of Eleven months located in
the Housing Society known as 'Ashiana Anantara’ on
the Tenth Floor, more particularly described in
Schedule-I written hereunder for a license
fee/compensation of Rs. 9000/- per month excluding
maintenance and electricity, along with all the
fittings and fixtures herein.

2. THAT the LICENSEE shall pay to the LICENSOR the


sum of Rs. 9000/- (Rupees Nine Thousand only) per
month as the Licence Fees/ compensation on account
of the use of the said premises by the LICENSEE
for a period of Eleven months upto 31st March 2022_
which shall be paid on or before 7th day of each
month, in advance for which it relates by
electronic transfer directly into the Licensor’s
bank account, more particularly described in
Schedule-I.
3. That the LICENSOR hereby agrees that the LICENSEE
has kept with the LICENSOR the sum of Rs.
20,000( Rupees twenty thousand) by cash, as
Security deposit for the due and faithful
performance of the terms and conditions appearing
in this agreement and which shall be refunded back
by to the LICENSEE without any interest thereon on
vacating the said premises only after expiry of
this Agreement i.e. on 31st March 2022_ after
deducting dues of any damages or loss caused and
also after deducting arrears of license fee, if
any.

4. The LICENSEE shall keep/maintain all the fixtures


and electrical fitting in good condition and shall
pay all the costs/bills of electricity in the said
premises regularly during the subsistence of the
Agreement.
5. The LICENSEE shall pay maintenance charges to the
Housing Society/Relevant authority as applicable
for the said premises regularly during the
subsistence of the Agreement.

6. The LICENSEE shall keep the said premises in


clean, sanitary and hygienic and tenable condition
and shall incur the cost of making good any
damages caused thereto or to the adjacent premises
by the LICENSEE and shall indemnify the LICENSOR
against any loss or damage caused by his
negligence or misuse of the said premises. A sum
equivalent to one month rent will be deducted from
the advance refundable to the LICENSEE, for
painting the Premises.
7. The LICENSEE shall not alter or cause to be
altered any part of the said premises licensed or
carry out any repairs to the same without the
written permission of the LICENSOR and if the
LICENSOR grants such permission for alteration,
the costs and expenses thereof shall be borne by
the LICENSEE without seeking any adjustment in the
monthly compensation/fee against the LICENSOR.

8. That this agreement shall not confer or create any


tenancy right of obligation of like nature in
favour of the LICENSEE and the LICENSOR shall at
all times be considered to be in the said premises
by the permission and leave and license of the
LICENSOR.

9. That on expiry of the term of this agreement, the


LICENSOR shall consider the further renewals only
if the License fee/compensation is paid in time on
its due date, as agreed in clause No.2. Further
first renewal of 11 months shall be by enhancing
Rs. 1500/- (Rupees One thousand five hundred) per
month and thereafter by enhancing Rs.2500/-
(Rupees Two Thousand five hundred) per month at
the time of each further renewal after obtaining
consent of the LICENSOR.

10. It shall be the exclusive discretion and at the


option of the LICENSOR to renew the license for
any further period and on the terms and conditions
she may deem fit by executing a fresh Agreement.
In case of non-renewal of the license Agreement,
the LICENSEE will have to vacate and hand over the
said premises to the LICENSOR at the end of the
period of license. In case of failure to vacate
and hand over the said premises by the LICENSEE to
the LICENSOR by the end of the last day of the
license and/or on termination of this Agreement in
terms of the clauses herein, it is specifically
agreed between the parties that the LICENSEE shall
be liable to pay the LICENSOR damages to the tune
of Rs. 1,000/- per day for every additional day
that the LICENSEE illegally occupies the said
premises.
11. The renewal of this Agreement, if agreed to by and
between the parties, shall only be in writing and
not otherwise.

12. That during the subsistence of this Agreement the


LICENSOR shall have right to sell or transfer the
said premises to any person of desire and in such
an event, the LICENSOR shall give one month notice
to the LICENSEE. THE LICENSEE shall have no
objection to such a transfer of said premises.

13. The LICENSEE and/or any other person/s on his


behalf shall not create any nuisance to the other
residents in the locality.

14. The possession of the licensed premises for all


legal purposes shall be deemed to be with the
LICENSOR who shall be entitled for an
unrestricted entry therein and exit therefrom.
Further it is specifically agreed by and between
the parties hereto that this instrument shall not
create any tenancy, sub tenancy, lease or any
other right in respect of the licensed premises in
favour of the LICENSEE except as being a mere
LICENSEE.
15. The LICENSEE shall maintain the licensed premises
in proper condition and shall take utmost care of
the said premises during the subsistence of this
Agreement.

16. Breach of any of the conditions of this Agreement


shall entitle the LICENSOR to revoke the license
granted herein forthwith and in such an event,
three months compensation/fee deposited by the
LICENSEE by way of advance be forfeited for such
breach of the Agreement.
