CONTRACT OF LEASE
KNOW ALL MEN BY THESE PRESENTS:

            This CONTRACT OF LEASE, made and entered into this _______day of July, 2021 at
the City of Dipolog, by and between:

            DEVES B. BUSICO, Filipino, of legal age, married and a resident of Barangay
Potol, Dapitan City, Zamboanga del Norte, and hereinafter referred to as the LESSOR,

- and –

PROLINK represented by EDGIL CONSTANILLA, Filipino, of legal age, single,


and a resident of Roxas, Zamboanga del Norte, and hereinafter referred to as the
LESSEE,

WITNESSETH; That
 
            WHEREAS, the LESSORS is the co-owner of parcel of land known as Lot 7114
situated in Barangay Oyan, Dapitan City, Zamboanga del Norte with an area of FOUR
THOUSAND EIGHTY ONE (4,081) SQUARE METERS and covered by Certificate of Title
No. T-27349;

WHEREAS, the LESSEE desires to rent a portion of said parcel of land containing
an area of ONE HUNDRED FORTY (140) SQUARE MATERS to be utilized as LESSEE’s to
TOWER REPEATER;

            WHEREAS, the LESSORS are willing to lease said parcel of land unto the LESSEE
under the following terms and conditions:

            1. That the lease shall be for a period of three (3) years starting on July______
2021up to July 2024;

2. Upon the execution of this contract, the LESSEE shall pay the total amount of
FOUR THOUSAND FIVE HUNDRED PESOS (=P=4,500.00) unto the LESSOR as
advance rental payment for the month of August, September and October 2021. In
addition thereto, the payment of the monthly withholding tax for the rent shall be for
the account of the LESSOR. That the LESSEE shall pay the monthly rental of ONE
THOUSAND FIVE HUNDRED PESOS (P1, 500.00), Philippine Currency starting on the
November 2021 and every months thereafter, payable with or without demand on or
before the 30th day of the month;

3. That the LESSOR shall allow the LESSEE to construct temporary light
materials building to be use as tower repeater and for other purposes related /
involving his business in internet services;

4. That electric bill shall be for the account of the LESSEE, the exact amount of
which will be based on the electric reading for each month;

5. That the leased premises shall be devoted exclusively for the furtherance of
the business of the LESSOR;

6. That all improvements to be made or introduced on the premises shall require


the prior consent of the LESSOR;

          7. That under no circumstance will the leased premises be subleased to any
other person or entity without the written consent and approval of the LESSORS;

         8. That the LESSEE hereby agrees to return the leased premises at the expiration
of the contract in as good a condition as reasonable wear and tear will permit without
any delay whatsoever;

            9. That in case the LESSEE shall have arrears in rental payments and unable to
pay said arrears before vacating the premises, the LESSOR shall have the option to take
possession of any tangible and valuable property to offset the amount of rental arrears
without the need of judicial action;

           10. That in case the leased premises shall be abandoned, vacated or deserted for
a period of one (1) month, without any previous notice to the LESSOR and during the
time the LESSEE is in default in the payment of the monthly rental, then under such
circumstances the LESSOR can consider the leased premises as legally abandoned and
may enter the premises and take possession thereof without prejudice to its right of
action against the LESSEE;

           11. That the LESSEE is obliged to observe and maintain peaceful condition inside
and outside the premises;

           13. That the LESSEE hereby warrants that he read and understood all the
foregoing provisions of this contract and shall abide by the same, otherwise, any
violation will subject the LESSEE to ejectment and other legal sanctions.

      IN WITNESS WHEREOF, the parties have hereunto set their hands this ________day of
July, 2021 at the City of Dipolog, Philippines.

ACKNOWLEDGMENT
BEFORE ME, on the date and place above-mentioned personally appeared
DEVES B. BUSICO and EDGIL CONSTANILLA who exhibited to me their valid
identification card nos. as indicated below their names, known to me to be the same
persons who executed the foregoing document and that they acknowledged to me that
the same were their free acts and deeds.

This CONTRACT OF LEASE consist of two (2) pages including the page on which
this acknowledgment is written, signed by the parties and their witnesses on the left
margin of the first over their respective names in the second page.
