COMPLAINT AFFIDAVIT

I, Creamo Oh, of legal age and with postal address, 51 San Carlos Heights, Baguio City, after being duly
sworn to in accordance with, hereby depose and say:

1. That I am filing a complaint against Mirabella Madrigal, of legal age, married,

businesswoman, a resident of 22 San Carlos Heights, Baguio City, and who can be served with summons
and notices at 22 San Carlos Heights, Baguio City for Estafa and Violation of BP 22.

2. That sometime in February 14, 2022, Mirabella Madrigal contacted me through another
trader and was asking to loan cash to support her capital.

3. That on Febuary 25, 2022, after assuring that his check was well funded, I agreed to
rediscount his Landbank check with check number 123456789 with face amount of Five Hundred
Thousand Pesos (Php 500,000) and maturity date on February 28, 2022; The said check was rediscounted
in the amount of Four Hundred Ninety-nine Thousand Nine Hundred and Ninety-nine Pesos (Php 499,999)
which I handed to him at Abanao Square, Baguo City.

4. That on February 27, 2022, the said check was deposited in my BPI account for payment,
however, the same was dishonored by the drawee bank by reason of Drawn Against Insufficient Fund
(DAIF);

5. That I contacted Mirabella Madrigal and informed him of the dishonor and asked him to
make good of the check or pay it personally, however, he refused to pay despite repeated demands;

6. That I have no recourse but to issue him a demand letter, however, he still failed to
make good of the check or make an arrangement to me. Instead, he never contacted me either by call or
a simple text to tell his willingness to settle the same;

IN WITNESS WHEREOF, I have hereunto affix my signature this 4th day of March in the year 2022 in the
City of Baguio, Benguet, Philippines to attest the truthfulness of the foregoing and to file my formal complaint
against Mirabella Madrigal for Estafa and Violation of BP 22.
