a. SH. N.D.V BHAT civil judge Karnataka has passed order against
appellants in civil suit no. 5400 of 1993 titled NOVA GRANITES (INDIA)
Ltd. Vs COACH CRAFT (BANGALORE) Pvt Ltd on 21 october 1993 ,
whereby application for amendment u/o 39 rule 1 & 2 and order 43
rule with section 148A & 151 of CPC filled by plaintiff/ would be
petitioner, was dismissed.
2. That the caveator is expecting that petitioner may file a civil Misc. petition
under section 148A of CPC against the respondent in this Hon’ble court as
such this caveat is being filled .
3. That the caveator has a right to appear and contest the civil misc. petition if
preferred by the petitioner .
4. That the caveator desires that may be given the notice of the filling of the
civil misc. petition as and when the same is filled by the petitioner to enable
caveator to appear at the time of hearing for admission and no stay may be
granted without hearing the respondent /caveator.
5. That a copy of this caveat has been seat Regd A/D post to the petitioner .
It is, therefore, must respectfully prayed that nothing may be done in Civil
Misc.. that may be filed by the petitioner without notice to the caveator or his
counsel .
