On Wednesday January 26, the Deputy Commissioner of the State of Connecticut’s Department of
Administrative Services informed us via e-mail that the Office of School Construction Grants & Review
(OSCGR) will not reimburse any project for more than one construction administrator. Reference is hereby
made to the agreement (“Agreement”), dated April 29, 2020, by and between the Hartford School Building
Committee (“HSBC”) and the Construction Advocacy Professionals, LLC (“CAP”), concerning a project
relative to Bulkeley High School in Hartford, Connecticut (“Project”).
Pursuant to the applicable provisions of Articles 7 and 14 of the Agreement (in particular, 7.1, 7.1.1, 14.4, and
14.4.1), HSBC, as the “Owner” under the Agreement, hereby terminates the Agreement for HSBC’s
convenience and without cause. Consequently, and in accordance with Article 14.4.2 of the Agreement, CAP is,
therefore, required to do the following: cease Project operations as of Friday January 28 (“Effective Date of
Termination”); take actions necessary for the protection and preservation of the work related to the Project,
including but not limited to remove all personal property from the Project, leave all property and files related to
the Project at the job site, and transfer any digital files to Emily Sifuentes at Arcadis O/G via e-mail at
Emily.Sifuentes@arcadis.com (“Work”); and, except for the aforementioned Work directed to be performed by
CAP prior to the Effective Date of Termination, terminate all existing subcontracts and purchase orders and
enter into no further subcontracts and purchase orders.
