1. In your own words, explain the difference between JUDICIAL LEGALIZATION and
ADMINISTRATIVE LEGALIZATION.

Administrative legalization is the process of acquiring free patent for a tract or tracts of
lands while judicial legalization is the process of acquiring and converting imperfect and
incomplete titles to alienable and disposable lands of the public domain.

2. Is it still necessary that DENR shall approve the ALIENATION or TRANSFER of

homestead? Explain your answer.

Yes, the DENR will always have the final say. Every transfer made without the previous
approval of the Secretary of DENR shall be null and void and shall result in the cancellation of
the entry and the refusal of the alienation or transfer of homestead. Their approval is always a
must.

3. The cancellation of Free patent is between the grantor and the _____?

The cancellation of free patent is between the grantor and applicant/grantee. The grantor,
which is the DENR, always has the right to cancel the free patent of the applicant/grantee if
certain lawful reasons compel them to do so.

4. Which agency of the government can bring action in court in order to REVERT a private land
back to the government?

The DENR is the agency capable of bringing action in court in order to revert a private
land back to the government since they are the highest-governing body responsible for any land
matter.
