Time: 3 Hours Maximum Marks: 100

Instructions:
 All questions carry equal marks (25 marks)
 This question paper contains total 6 questions.
 Attempt any 4 questions out of 6 questions.
 Answers may be written either in English or in Hindi but the same medium should be
used throughout the paper.

Q1. Ramesh inherited a house from his father in1990. He inherited a piece of agricultural land
from his uncle. He has a nursing home which he purchased from his earnings from medical
profession. His son Rohit claimed partition of all the properties. Decide.

Q2. X, belonged to Mitakshara joint family. He died in 2021 and is survived by his father F,
mother M, a brother Br, two sisters Sis1 and Sis2, wife W, two daughters D1 and D2, and
daughter of a pre-deceased son (S)D. Allocate the share to the members of the family in the
coparcenary property on his death.

Q.3. Harish, a 50-year-old rich Hindu man, married Seema, a poor Hindu woman of 20 years,
who was given in marriage by her brother Mritunjay. Seema had inherited a piece of land from
her father. Harish before his marriage to Seema was taken care of by his brother's children,
Vishal and Vikesh. Apprehending his death and understanding that Vishal and Vikesh would not
take care of his young wife, Harish made a will of his house in favour of Seema and made it
clear that the property was being given to her for her maintenance after his death. Seema was 2
months pregnant when Harish died. After Harish's death, Vishal and Vikesh completely ignored
Seema. Seema died due to severe complications in pregnancy and her child also could not be
saved. Explain the concept of absolute property of Hindu female and name the heirs of Seema
with reasons.

Q.4. Concept of partition of coparcenary property has changed over time under Hindu law.
Justify the statement with the help of decided cases.

Q.5 Mir, a 10 years old Muslim male, along with his mother, Farzana and father, Abdul lived
with his rich maternal grandfather, Farrukh as he did not want Farzana and her family to face
financial hardships of life. In order to secure Mir, Farrukh in an iftaar party organished at his
house, announced in front of all guests that he gifts 5 acres of his farmland in favour of his
grandson Mir. Since Mir was still very young to take care of the farmland, Farrukh continued to
take care of the gifted property. Since Furrukh's sons, Jawed and Zulfikaar did not care of their
father in his old age, Farzana completely looked after him. After few months Farrukh fell ill and
on his death bed he gifted his entire property to Farzana. He died within 3 days of making the
gift. With the help of decided cases, explain the validity of gifts.

Q.6. Shah, a Muslim male was survived by his father Aslam, brother Kadir, wife Saifeena, two
sons Kuber, and Karim, daughter Saba, Kuber's son Saif, Karim's son and daughter, Imran and
Sana. Karim converted to become a Christian and Karim's son Imran negligently killed Shah
while he was cleaning his revolver. Allocate the shares to the heirs if Shah was
