AN ORDINANCE PROVIDING SANCTIONS AND/OR PENALTIES ON NON-
SUBMISSION OR LATE SUBMISSION OI ORDINANCES AND RESOLUTIONS OF
COMPONENT LOCAL GOVERNMENT UNITS WITHIN THE TERRITORIAL
JURISDICTION OF THE PROVINCE TO BE SUBMITTED FOR REVIEW BY THE
SANGGUNIANG PANLALAWIGAN OF CAMARINES SUR

WEEREAS, Section 56, Section 327 alrd Section 468(ax1)(i), all oi the Republic Act 7160 or rhe
Local Covernment Code of 199'1, provides that:

"SECIION 56. Review o{ Conponent Cih' and Muricipal Ordinances or Resolutions by


the Sarg$tlliqll&P€]1hlara/igan. - (a) Within three (3) davs a{ter approval tie Secretary
to the Sangguian Padungsod or Sangguniang Ba_yan shall forward to tlle Sangglrdang
Panlala1\,'igal1 for review, copics of appror.ed ordinanccs aid the rcsolutions approving
the local development plans and pubLic investment programs formulated by the local
development councils.
ft) Within thirty (30) clays after receipt of copies of such ordinalces and resolutions, the
Sargguniang Parrlalawigan shall examine the do(1ln1ents ot tlansmit ihe]Ir to the
provincial attorne)-, or if there be none, to the provincial proseL_utor for prompt
exanlirlation. The provirrial alfomey or provincial prosecutor shall, within a peiod
of ten (10) da1's irom receipt oI the documents, inJomr the Sangguiang
Panlalawigan in writing of his comments or reconunendations, which may be

(c) If tle Sangguniang Pailalawigal finds that such im ordinance or resolution is
beyond the power conferred upon the Sanggu altg Pallungsod or Sangguniang
Bayan conceme4 it shall declare such ordinance or resolution invalid in lt'hole ot in
part. The Sangguliang Pailalalvigan shall enter its action in the minutes al'ld shail
advise d1e co(esponding €itv or m1ldcipal authorities oJ the action it has taken.
(d) lf no action has been taken bl' the Sangguniang Panlalau.igan within thirty (30) days
after submission of such ar1 ordinarrce or resolutiorL the same shall be presumed
consistent with law and therefore valid."

WHEREAS, Section 327 ard Section a6B(aX1Xi), all of $e Republic Act 7:160 or the Local
Govenment Code of 1991, provides that:
'SECTION 327. Review of Aprrropriation Ordinances
N4unicip4littq. - The Sanggr-niang Padalawigar shall review the ordinance audlofizing
amual o/ supplemental appropriatio4s of componeit cities and mulicipalities in tle
same manner ard within the same period prescribed Ior the review of other ordinances.
ff wit}rin ninetv (90) days from re.eipt o{ copies of such ordinance, the Sangguniang
Pallalawigar-r tates no aarion thereon, the same shall be deemed to have been revjewed
in accordarte rvith law and shall continue to be in fulI force and effect. within the
same period, dre Sangguniang Pa alawigal] shall have ascertained that the ordinamce
authorizing annual or supplemental appropriations has not complied wilh the
rcquirements set {oth in this Title, tile Sangguniang Padalawigan shall, \4,'ithh the
ninetl-da]' pedod hereirabove prescribed, declare such ordinance Ltoperative in its
entirety or in part. Items of appropdation contra:rv to limitations presc bed in this Tide

The Sangguliang Par alawigan shall within the same period advise the Sargguniarg
Panhmgsod or Salggunial1g Bayai cor,cemed tluough the local chief executive o{ any
action on the ordinance under review. Upon receipt oJ such advice, the citl' or mur1icipal
keasurer concen-Ied shall not nake hrrther disbursements o{ fuids from any of dle items
of appropdation declared inoperative, disallowed or teduced. '

IVHEREAS, Section 468(ax1)(i), d[ o{ the Republic Act 7160 or the Local Govemment Code of
1991, provides that:

"SECIION. 468. Powels, Duties, Iunctions and Compe4q4:Eq4. - (a) The Sarggurnarg
Pallalawigai, as the legislative body oI the province, shall enact ordinances, approve
resolutions ard appropdate {unds {or the general welfare oJ the provilce ard its
bhabitants plrsuant to SeLrtion 16 of dris Code and in the proper exercise of lhe
corporate powers oI the province as provided Ior rulder Section 22 of this Code, aid
shalll
(1) ApproYe ordinances and pasg resolutions necess.uy {or an efiicient a]rd effective
plovircial goverrrment and, in this connectiolt shall:

(i) Review all ordinances approved b- the s.Lnggudars oi componeni cities and
municipalities a]rd executive orders issued by the mayors of sald component
urits to detelmine whether these are within the scope of the prescribed powers
oI the sanggutan and of the mayor;

WHEREAS, notwithstanding the aJorecited provisions of the Local Govenrment Code of 1991,
there are loci:rl govemment units tlat fail to submit to the Sargguniang pallalawigan
resolutio'u ar.d all ordi'a'ces Ior review, while others submit such resoiutioru ar-rcl orclina.ces
in a vely late mamer, fherebv jeopardizing the authority oI the province 10 super\.ise arci
nlonitor the acis of these local govenlment units to be within the scope of their prescribed
powe$ and functions;

WIIEREAS, the pol\.ert duties and fimctions of ihe SarggLrnia:ng padalawigan to review
pertineni resolutions arld ordilarces adopted and enacted by the sallgguniar of the component
local government units of the Province as ptovided for ard guaranteod by the Local
Govemment Code of 1991 clearly imply that the Province has the autliodty to supervise arrd
monitor the acts of the component LGUS, thus, non-submission 01 late submission of such
resolutions and ordinances to the Sargguniang Pallalawig,ai fot review is ta.r.rtamount to
sidetracking such authodty aid thus increasing the possibfity of creating poJicies in violation of
existing laws likewise creating admii,sbative brcach to the local govemDrent unit;

WHEREAS. in order to maintain an('l asseft the power, duty and function ot thc Sangguriarg
Pdtalawigan to rer.iew vital /esolutions aid or.dinance adopt€d and enacted by the concemed
salggurrian ol component local government urdts and to uphold tlle welJare arcl best interest oI
d1e constituents of the Province, there is a need to provide sanctions and/ol penalties for non-
submission and late submission of tesolutions and ordinaices by component local govemment
urrils withirl llp f rovin.e;

NOW THEREIORE, on motion of Honorable Amaclor L. Sinando, and was dulv seconded by
Honomble Darius S. Nopra, be it -

RESOLVED. AS IT IS HFRFRY RESOLVED to enact, as it hereby enacts, to {ol1owi11g


Ordinance:

BE IT ENACTED, by the Sangguniang Pardalawigan of Canarines Sur in session assembled,


that:

Section 1. Title. This Ordinance shall be known as,'Oidinance providing Sanctions arld
Penalfies for Non-Submission ot Late Submission of Resolutions and Ordinances for
Review"

Se.tion 2, Declaration of Policy. It is hereby the declared policy of the Provincial Governmert
ot Camarines Sur to exercise the powers expressly grante4 those necessarilv impLied there
fronr, as well as powers necessary appropdate, or incidental Jor its elficient aid effective
govemzmce/ and ihose which are essential to the promotioi of the general weUare and shall
ensure and support, anong other things, *lat resolutions and ordinances adopted and enacted
b,v local govemment urits be submitted to the Sanggunia:ng panlalawigan in the prescribed
period of time ard such resolutions ar-rd otdinances are within the scope o{ prescribed port ers
.md ftnctions. The Provincial Govemment shall uphold the practice of good govemance that
values desirable development outcomes as well as rphold thc principles of accountabfity and
transparency as espoused by the National Govemment and the Depiutment of lnterior a:rtd
Local Govemment. Likewise, the Provincial Govemment shall also promote tesponsibility and
accountabilitv in public service among the emploJ:ees and officials of local govemjment units
within its telriiolial iurisdictior.L

Towards this end, the Pror.incial Govemment shall maintah alrd assert its authoritv to ensule
that certain provisions of the Local Govemment Code, as well as relate.1 poLicjes ot narional
gove,rrnpnl. dt'c pronerlr implementcd

Section 3. Mandate- This ordjrlarce is enacted pursuait to Section 86, Section 322 ancl Section
ard Section 468(a)(1)(i), all of the Repubtc Act 7160 or the Local covernment Code of 1991, ard
other allied laws.

Section 4, Obiectives and Purposes. This ordinar-rce is enacted Jor the following objectives and
purposes:

1) To encourage local govemment uriis to srLbmit in thc duly prescribed period pefiinent
resolutions aid ordinances to tlle Sangguniang Panlalawigar for review;
2) To mainlain ancl assert the power, dutv and function o{ the S.mgguniang padalawigan to
revie.w pertinent resolutions and ordinarces as mandated bv the Local Govemment
Code.
3) To p1o\.ide sanctiolls for non s1lbmission a]rd late submission of pertinert l.esolutions and
ordinances bJ' local govemment units to the SanggLrnLmg Piinlaltru.igai, as well as
penalties for employees and o{ficials responsible lor such ron-submission ar1d late
subnission;
4) To provide a netiocl oI coordination r,\.ith the Department of Interior ard Local
Covemment (DILG) in the conferment o{ [he Seal of Good Housekeeping (SGH) and the
grant of the Peformance Challenge Fund (PCF) to the 1ocal govemnent tnit that
complies with this Ordinarce;

Section 5. Definition of Terms. Ior the purpose of this Ordinaace, the fouowing tems shall be
defined as Jollows:

a) 'Employee" refels to drose persons appointed by the loca1 chief executive or the vice
mayor, whether or not his or het emplovment status is casual temporarv, hold-over,
permalent or regular capacitt';
b) "Public Official' rcfc$ to those pcrsons elected and holds public office in a local
gor.emment urit
.) "Locai Covemment Unit" or "LGU' refers to every the component nunicipality within
the teritorial iurisdiction of the Province oJ Camarines SuI including the City of kiga;
d) 'Orclinaflce" refers to general ordinances, appropriation ordinances, tax ordinances ard
special ordinances, or a combination of such kind oJ ordinances whj.h include, but not
Limited to: zorfng ordinances, kaJfic codes, market codet fisherres codeE ald other
sinrilar legislative measures.
e) "Relevar1t Resolulion" shatl include resolutions approving the local deYelopment plans
and public il1\'estment proglans, resolutions enacting an ordinance
(resolution/ordinarce), and resohtions adopted and/or enacted bv the sarggxr1iar
havirg a nature oI an ordinarce, such as but not linrited to: those involving contracts,
directing the paFlleni of money or cleating liability, disposition and aclluisition of
pubLic properties, imposing tax ard penalties, creating o{fice and/or positio&
estabLishing goups and/or cooperative undertalings among local govemment 1111its,
ald similar legislative neasures provided for by the Local Govenrment Code oI 1991
and other pertinert laws ard other issuances.

"PerJor:maice Challenge Fund" or "PCF" refers to the finarcial incentives grarted by the
naiioial government through the Department of Intedor and Local Government (DILC)
to local govemment units that are committed in valuing the lundamentals of goo.l
govemance by meefing the requirements of Seal of Good Ho$ekeeping (SCH), and in
some cases/ gar:nering the "Cawad Pamana ng La} i" awarcl. (DILG Memorardufi
Circular No. 2013-148 clated December 19, 2013) Local government units are likewise
required to compb' with the relevant pror.isions of this f)rdinance in order io be
conferred with the Seal of Good Housekeeping and avail the grant oI perfomarce
Challenge Fund (PCF).
c) 'Sea1 of Good Housekeeping" or "SGH" refers to the recoFlition/acknowledgement and
cor{ement oJ the 'Seal" bl' the Deparlment o{ ihe Interior aid Local iovemment
(DILC) to loca1 govemment units that accord primacv to the principles o{ a..oultabfity
ard trarspa:rency of which such principles are esseniial in building the long-term
{oundation of a responsible local goverunleni system in the courtr.. (DILG
Nfemorandum Circular No. Included in the conferment of the ',Seai,' is the cert#ication
by the Secietarl' to the Sangg@iang Panlalau'igan certiJying to the effect that the
concemed local govemment urit has submitted for review its oldinance authorizing the
alnual appropriation Ior the cu:rleni year.
h) "Undue Delay" refe$ to the ciraumstance drat caused urreasonable delav or dif{icult1,
on the froies\ ol documpnli ard papers ot lertinpl)l resoludon\ dnd ordindn( e5 tor
approval aid submissioll to the Sarrggulliang Parlala\a.igan {or rcvicw;
'Justifiable Reasons" refers to dre explanation oI an advelse action of a public official or
employee that is ieasonable ard acceptable to defend his or her acts that caused undue
delay on the process of documents and papers.

Section 6. Coverage. This Clrdinance shall cover all local govemment urits (LCUS) in ihe
Province, their respective local chiel executives, tleir respective local sa gguniar, their
rcspective presicling officer alrl members of the sanggrurian, and the Department of lnteior
and Local Covemment (DILG) Canarines Sur Provincial Office;

Section 7. Reiteration to Submit Ordinanceo and Resolutions fol Review. Local govemment
units are he.reby reminded aid directed to submit to the Sarggrnialrg Panlalawigar all
ordhances ard resolutions as defined herein for review.

extension of time be mote tha1r d1fut\. (30) days for ordilances authoriing amual and
supplemental appropriations and attached resolutions; and, that, in no case that such extension
of time be more than ten (10) davs for submission of other resolutiors ard ordfirances.

Section 8. Sanction for Late Submission of Resolution or Ordinanae. Subnission ol

Section 9. Sanction fot Non-Submission of Pettinent Resolution or Oldinance Authorizing
Annual Appropriation. No local govemment urlit shall be conJered with t]le Seal o{ Good
Housekeeping (SGH) ldess ard urtil their pefinent resolution or resolutions and respective
ordinance autlorizing amual appropriations for the curent year have been submitted to dre
SanggurLiaag Panlalawigan for review.

The Secletan' to the Sargguniang Par alawigan shall jssue a certification to the Department of
Interior and Local GovemDrent (DILG) Camarines Sur Provincial OfIice to the effect that a local
gov€mment unit has submitted its resolution ard ordinarce autiorizing amual applopriations
for the current year arrl is therelore qualified to be confered with the Seal of Good
Housekeephg (SGH).

The Department of Interior and Local Gover:nme.nt (DILG) Camarines Sur provincial Office js
hereby enjoined to coordinate initially widr the Provincial Govemmmt oJ Camadnes Sur, t]1r1l
the Office of the Secretary to the Sanggur-fang Pallalawigar, be{ore a Seal of Cood
Housekeeping (SGH) be conferred to a local govenrment urtt.

Section 10. Liability of Official and Employee. Non-submission or late submission of pertinent
resolutions aIId ordtnances of local govemntent lrtts to the Sarrgguniarg parlalawigan for
rcvie ' are caused b)- irresporsible acts o{ official/s and/or employee/s and such acts accouits
to liabfities and subsequent pcnalties;

In addition to the grourds for administrative disciplinaty action prescdbecl undef existing laws,
the acts and omissions of any official or emplovee declared uilaw{ul or prohibited by this
Clrdinance, shall constifute grourds {or administrative discipLinary actioq and without
prejudi.e to cri]]1inal and civil liabilities provided by existing laws or ordinan es.

Seation 11, Prchibited Acts. The fotlowing acts or omjssions causiug the non-submission or late
submission of resolutions and ordinances {or review shall be considered as unlawful or
prohibited acts:

(a) Unfair discdmination in rendering public seryice due to party afffiation or preJerence;
(b) Failule to affix signature, if necessary, and to hand or.er in a prompt manner the signed
document to lhe authorized ljaison or tie appropdate employee to facfitate smooth
process thereof;
(c) Failure to process and complete action on documents and pape6 component oI a
peftinent resolution or ordinarce wid)in a reasonable time trom preparaiion thereof,

Se.tion 12, Penalties. AIly local official or officer who \,iolates any provision of this Ordinance
shall suller the Jollowing graduated penalties:

(a) First ofiense: The offender violaiing the ordinance shall be penalized with a fine o{ One
Thousald Pesos (Php 1,000.00) or ar imprisonment of one (1) day to thirty (30) dal.s, or
both, at thc discretion o{ the court;
@) Secor-rd offense: The offender violating the ordinance shall be pe_nalized with a fine of
Three Thousand Pesos (Php 3,000.00) or an imprisonment of one (:t) day to thtutv (30)
days, or both, at the discretion of the court;
(c) O{fenses conuritted a third time: The offender violating t}re ordinarce shall be penalized
with a fine of Five Thousand Pesos (Php 5,000.00) or an imprlsonment of one (1) day to
thirtv (30) days, or both, at the discretiorl of the court.

Ary public official, officer or employee who violates this ordinarlce may be meted
admhistrative disciplinary action, without prejudice to the fiLing of the appropdate civil or
cri]lrinal action.

Section 13, Creation of the Oversight Committee; lts Composition. There is hereby created al
Oversight Comn1ittee to supeftise ar1d monitor the adherence to the provisions herein of those
covered by this ofdinance. :l he composition oI the Oversight Comnrittee shall be the following:

Section 14. Applicability Clause. Al1 other matters, relating to the impositions in this
Ordiruurce shall be govemeal by pertinent provisions of exGting laws and oiher ordinance, such
as but not lirnited to Repubtc Act No. 623, otherwise k:rown as the "Code o{ Conduct ard
Ethical Standards for Pub[c Officials ard Employees"; Republic Act No. 9481 otherwise known
as "Anti-Red Tape Act of 2007rj .rrrd other applicable laws, issuances and rules arlcl regulations.

Section 15, Separability Clause. If any prorision of this Ordinance ot the application of suci
provision to arly person ot ciremstance is declared invatd or unconstitrltional, the remainder
of the Ordinance or the application of such provjsion to other persons or cirotmstances shall
remain valid arrd subsisting.

Section 16. Repealing Clause- A11 executive ordet rules and legulations, resolutions artl
ordinances, contral. to ot inconsistent with the pro.!,'isions of this Ordinance are herebv
repealed or modified accordingly.

Section 17. Effectivity Clause. This Ordilance shall take effect fiJteen (15) davs a{ter its full
pubLicalion in a newspaper oI ge.neral circulaiion within the Province of Camarines Srrr.
