LABOR CONTRACT

THE PARTIES TO THIS AGREEMENT ARE:

Position: Online ESL Tutor

Agreed to sign this contract with the following terms and conditions:

1. TERMS AND JOB LABOR CONTRACT

Kind of contract: Unlimited contract
Commencing on: September 10, 2020
Position: Online ESL Tutor
Job description: Follow the attachment on Job Description

2. FEES PAYABLE TO THE TUTOR.

In consideration of the services to be provided by him/her hereunder, the Tutor, during
the term of his/her employment, shall be paid a basic salary of (6,000.00) six thousand
pesos/month.
3. PAYMENT

Payment shall be made one (1) to five (5) days after cut off dates which are 15th and 30th
of every month.

4. SCHEDULE OF LESSONS

Tutoring is done at the VinaTeach Office for (3) hours/ day and scheduled according to
the tutor’s preferred time frame between 6pm to 11pm.

5. CANCELLATION OF LESSONS BY STUDENT

The Student may cancel the scheduled session by giving at least 2 hours prior notice to
the company in which case the session will not be counted and can be rescheduled.
Lessons not attended by the student without giving 2 hours prior notice to the company
shall be counted and deducted to their eight (8) sessions of the month.

6. CANCELLATION OF LESSONS BY TUTOR

The tutor may cancel lessons by giving 2 hours prior notice to the company in which case
no fees shall be incurred. The Tutor shall reschedule the appointment at a time agreeable
to both parties.

7. LATE ARRIVAL

A fee of (50.00) pesos will be deducted to the Tutor for (5) five minute late arrival in
class; no adjustment shall be made for time lost because of late arrival by the Student.

Any lost time because of the late arrival of the Tutor shall be compensated for by
extending a lesson by mutual agreement and by such amount of time that was lost.

8. OBLIGATIONS OF THE TUTOR

* The Tutor shall keep confidential all information of the Student and shall contact
VinaTeach for any feedback or review regarding the student’s performance.

* The Tutor shall not assign any of his/her duties or obligations under this tutoring
contract to a third party.
 9. OBLIGATIONS OF THE EMPLOYER

* Ensure the work and fulfill the commitment in the Contract.

* Duly and in time settle all the rights and obligations to the employee in accordance with
the Contract.

10. RIGHTS OF THE EMPLOYER

*Manage the employees to fulfill the job in accordance with the contract (arrange,
transfer, suspend job…)

* The Company has the rights to terminate the Labor Contract if the employee keeps
breaking the company’s regulations and causes difficulties in the management even though
he/ she has been reminded several times.

11. CASH BOND AND TERMINATION

*In the first (2) two months of the employment, the Tutor will be deducted the cash bond
agreement with the company amounting to (3000.00) three thousand pesos in a staggard basis
payment.

*If the Tutor’s contract has ended or he/she has already resigned from his/her positions,
his/her cash bonds should be returned to him/her in full amount.

*This tutoring contract may be terminated by either party at any time by giving the other
party (30) thirty days prior written notice. In the event that the Tutor failed to render the (30)
days before resignation, the cash bond will be forfeited.

12. GENERAL PROVISIONS

*Other provisions not shown in this contract will be applied based on labor law.

* This contract is made into two (2) copies, one (1) copy will be kept by the Employer
and one (1) copy to be kept by the Employee. This contract is made and signed on _________ at
