ON THE LISTED DATE AND TIME, DETECTIVE J. BUTLER OF THE LEE COUNTY SHERIFF'S OFFICE FUGITIVE
WARRANTS UNIT, WAS ON TEMPORARY DUTY ASSIGNMENT IN CENTRAL DISTRICT AS OF THIS DATE HE WAS
REQUESTED TO ASSISIT THE MAJOR CRIMES UNIT. DETECTIVE BUTLER CAME INTO CONTACT WITH THE STATED
PERSON AT THE LISTED LOCATION. JUST FOLLOWING THAT TIME, A COMPUTER CHECK THROUGH WANTS AND WARRANTS
WAS CONDUCTED AND THEN CONFIRMED THAT THIS SUBJECT HAD AN OUTSTANDING WARRANT(S) FOR THIER ARREST.

Whereas, Timothy J. Davis, JR, Lee County Sheriffs Office, has this day made oath
before me, in Lee County, Florida, that James Paul Tally,
1. On or about February 19,2022 in Lee County, Florida, did imlawfiilly, by an act
imminently dangerous to another, and evincing a depraved mind regardless of human life,
kill and murder Suzatme Lapierre, a human being, by bludgeoning or striking her,
contrary to Florida Statute 782.04(2),
contrary to the statute in such cases made and provided, and against the peace and dignity of the
State Of Florida.
AND it appears to the Court that probable cause for the issuance of this warrant has been
shown and the Court being satisfied of the existence of the grounds thereof.
NOW, THEREFORE, you are commanded forthwith to arrest the said James Paul Tally
and bring him before me or another Coimty or Circuit Judge with jurisdiction to be dealt with
according to law.

Before me, a Notary Public in and for Lee County, Florida, personally came Detective Timothy
Davis, who, being first duly sworn, deposes and says that on or about February 20, 2022, in the
Coimty aforesaid, one James Paul Lally, did unlawfully commit the offense of Murder. This
occurring in Lee County, Florida.
On Sunday, February 20, 2022, at approximately 8:19 p.m., deputies with the Lee County
Sheriffs Office responded to 12310 Apollo Drive, Fort Myers, Florida, 33908, in reference to a
reported missing person. Deputies made contact with the complainant who stated her adult
daughter, Suzanne Marie Lapierre, a white female bom on July 30, 1964, was missing for
approximately 48 hours. The complainant stated she lives one block away, in the same
community as Lapierre, and normally has contact with her at least four times each day.
The complainant last spoke with Lapierre on Friday, Febmary 18, 2022, when they attended a
medical appointment together. The complamant and family were unable to make contact with
Lapierre on Saturday, Febmary 18, 2022, or Sunday, Febraary 19, 2022, and grew concerned for
her well-being.
The complainant responded to the residence with a key to enter and search for Lapierre. The
complainant was not able to locate Lapierre or her vehicle, a 2011 red Chevrolet HHR bearing
FL tag H1DI58, at the residence. The complainant located Lapierre’s small canine in the
residence alone, which Lapierre has never done before. The complainant observed a large
amoimt of blood in multiple locations throughout the residence. The complainant exited the
residence and called 911 to report their findings, and waited outside for law-enforcement.
Deputies responded to the residence and observed a large amount of partially dried blood that
w^as still red in color in Lapierre's bedroom. Deputies observed blood droplets and blood smears
at the entrance of the residence, a smear or drag mark with blood was also observed outside the
residence, near Lapierre's attached garage. A bloody towel and a bloody gardening rake were
located by the attached garage door. It appeared as if someone had attempted to clean up.
Deputies exhausted all known attempts to locate and contact Lapierre and/or her boyfriend,
James Paul Lally, a white male bom on March 3, 1970.
Due to the nature of the incident, the Major Crimes Unit responded and assumed control of the
investigation. Detective Saffold authored a search warrant for the residence and the Lee County
Sheriff’s Office Crime Scene Unit responded.
During digitally recorded sworn statements, detectives learned that approximately six months
ago, Lally moved into Suzanne residence. Lapierre was not comfortable with the arrangement
and requested Lally to move out by the end of February.
During a neighborhood canvass, detectives learned a neighbor (retired Law Enforcement Officer)
was awake at 3:00 am on Febmary 18, 2022, and observed that the red HHR moved from the
driveway to the side door of the residence with the lights off. This ride door was the door where
the bloody drag marks, towel and rake were located. The vehicle remained for approximately 30
minutes then left the community, only to return approximately one hour later and parked in the
driveway. Surveillance video was located at the community entrance which showed the red HHR
driving on Febmary 17, 2022, and Febmary 18, 2022, but the driver was not visible.
Through investigative techniques, it was revealed that Lally had pawned two pieces of gold
jewelry on Febmary 19, 2022 at 10.52 a.m., in Sarasota. Lee County Sheriffs Office detectives
went to the pawnshop, took photos of the jewelry and showed the photographs to Lapierre
mother. Lapierre’s mother immediately recognized these two pieces of jewehy as family
heirlooms that Lapierre would never sell. Video surveillance footage was reviewed and Lally is
seen pawning the jewelry. The employee positively identified Lally as the person who sold the
jewelry through a photographic lineup. Lapierre was not observed by the employee during the
transaction.
On Febmary 21, 2022 The Jacksonville Police Department located Lally at a family residence
and took him into custody on unrelated charges. Lapierre’s Chevrolet HHR was located in close
proximity to the residence and contained numerous pieces of what appeared to be Lapierre
property. The vehicle’s registration was no longer on the vehicle. At this point in time, Lapierre
could still not be located.
On February 21, 2022, Detective SafFold and Sergeant Rail travelled to Jacksonville and at
approximately 9:37 p.m., conducted a post Miranck interview with Lally at the Jacksonville
County Sheriffs Office. Lally was provided with his Miranda rights. He acknowledged those
rights and stated that he would answer investigators questions. The following is a synopsis of
said interview and is not verbatim (refer to audio statement for specific detail):
Lally began his statement by telling detectives that he “bludgeoned” the decedent and would tell
investigators where the “body” could be found. As the interview progressed, Lally stated he
disposed of the decedent off of “Briarcliff ’ but could not remember exactly where. When asked
to walk investigators through what had occurred, Lally stated he drove the decedent’s vehicle
fiom their residence on Apollo Drive to the dump location, with her in the back (deceased). He
provided a specific area where the remains could be found both verbally and on written maps.
The maps were provided based on the search parameters given by Lally. When asked why he
picked the dump site, Lally stated that he used to work in that area and knew it was secluded.
Lally explained the incident started when they got into a “dispute” in one of the bedrooms of the
residence (Apollo Drive) on February 20,2022. The dispute occurred due to the decedent asking
Lally to move out as tiieir romantic relationship and financial standing was no^going well.
Additionally, Lally remembered hearing the decedent whis1^fing~on the phone about sending
him to a shelter which, “set him off.” Lally stated that there was a hammer sitting on a table in
the room that he grabbed and continued to strike the decedent multiple times in the head. Once
she was obviously deceased, Lally moved the decedent’s vehicle to the side of the residence and
dragged the decedent to her vehicle. After placing her in the vehicle, Lally drove the victim’s
vehicle with her inside to the 1600 block of Dusty Road in Fort Myers Florida. Upon arrival,
Lally removed the decedent fiom the vehicle and placed her behind a cabbage palm tree, face
down and placed palm-fians over her in an attempt of concealment. Lally also stated that he left
the hammer used in the offense near the decedents remains. He went on to tell investigators
where they can find his / her bloody clothing at the scene.
After hiding the remains, Lally stated he drove to multiple locations, ultimately stopping at a
pawn shop in Sarasota where he sold the decedents aforementioned personal effects for gas
money, so that he could make it to Jacksonville. Lally identified the items located by Law
Enforcement as the items he stole and pawned. At one point Lally spontaneously stated, “I lost
my temper, she didn’t deserve it.”
At the conclusion of the interview, Lally confirmed that he killed the decedent because he was
angry with her and that all of her wounds were due to hhn striking her with a hammer. After
bludgeoning the decedent to death, Lally confirmed he utilized the decedent’s vehicle to
transport the remains and dumped them on Dusty Road in Fort Myers, Florida. Lally explained
in intimate detail the decedent’s injuries, what she was wearing and the fact he placed palm-fians
over her remains, in an attempt to keep her hidden. Lally described how he attempted to clean
the scene on Apollo Drive and placed multiple bloody garments in the closet of one of the rooms.
He also admitted to pawning the decedent’s personal jewelry for gas money as he was going to
his aunt’s house in Jacksonville.
It should be noted that throughout the interview, Lally continuously stated that he was the sole
aggressor in regard to the attack on the decedent. While he expressed remorse, Lally illustrated
how he was infuriated with the decedent and knew what he did was wrong. Lally described the
decedent as a good person who did not deserve what he did to her.
On February 22, 2022, at approximately 11:45 p.m., Lee County Sheriffs Office Investigators
utilized the information provided by Lally to orchestrate an extensive search of the area
provided. With this, the remains of a female matching Lapierre’s description was located in the
same position and clothing as described by Lally. The remains were covered by palm-frans and
lying face down.
Due to the discovery of the remains, a crime scene was established and a search warrant was
obtained for the 1600 block of Dusty Road, Fort Myers, Florida. The scene was processed and
the Medical Examiner’s Office responded. After documenting the scene and manipulating the
remains, extensive injuries (consistent with blunt force trauma) were noted on the right side of
the face and head. Drag mark abrasions also appeared to be present on the back. The remains
were transported to the District 21 Medical Examiner’s Office for postmortem examination. The
remains have been tentatively identified as Lapierre.
Based on this investigation Detective Davis finds probable cause”exists for the arrest of James
Paul Lally, bom on March 3, 1970, in that the elements of the listed offenses are present. This
affiant requests that an arrest warrant for Murder pursuant to F.S.S. 782.04(2) be issued.
