COMES NOW petitioners, by undersigned counsel, and to this Honorable
Court, respectfully allege that:

PREFATORY STATEMENT

This Petition is filed in utmost good faith and for the sole purpose of
upholding the mandate of the Constitution that “Suffrage may be exercised by all
citizens of the Philippines not otherwise disqualified by law, who are at least
eighteen years of age, and who shall have resided in the Philippines for at
least one year, and in the place wherein they propose to vote, for at
least six months immediately preceding the election. No literacy,
property, or other substantive requirement shall be imposed on the exercise of
suffrage.”1

LEGAL BASIS

1. The instant petition seeks for the exclusion of unqualified registered

voters as provided for under sec 52 of COMELEC Resolution no. 10695 issued
pursuant to Sec 35 of RA no. 8189 , which states-

“Sec. 38. Voters Excluded Through Inadvertence or

Registered with an Erroneous or Mispelled Name. - Any
registered voter whose registration record has not been
included in the precinct book of voters, or whose name
has been omitted in the list of voters or who has been
included therein with a wrong or mispelled name may
file with the Board an application for exclusion of his
record, or reinstatement or correction of his name as
the case may be. If it is denied or not acted upon, the
voter may file on any date with the proper Municipal or
Metropolitan Trial Court a petition for an order directing
that the voter's name be entered or corrected in the
list.”

age, Filipino and registered voters of BARANGAY MANAPA, BUENAVISTA,
AGUSAN DEL NORTE.

MILFLORES, ELMO B. , are claiming to be real persons, of legal age and
residents of the Philippines for at least one (1) year and of BARANGAY
MANAPA , Buenavista, Agusan del Norte for at least six (6) months
immediately preceding the May 2, 2022 National and Local Elections,
which claims are false and lack legal and factual basis.

4. Respondents, on account of their physical absence in BARANGAY MANAPA

, BUENAVISTA, AGUSAN DEL NORTE and of the fact that nobody in said
barangay can confirm their true identity or knows them personally, are
either fictitious or are still residing in the place where they were previously
registered as voters or domiciled and not residents BARANGAY MANAPA ,
Buenavista, Agusan del Norte to be eligible to become registred voters of
said barangay.

5. If respondents do show up and are able prove their real identities, it

appears that they have no intention to permanently reside in BARANGAY
MANAPA , Buenavista, Agusan del Norte because of their physical absence
thereat .

6. Evidently, the only reason of their registration as voters in said Barangay is

to circumvent our election laws and give undue advantage to a particular
candidate and party.

7. During the recently held registration for the May 2, 2022 National and
Local Elections, Respondents, allegedly applied for registration to be
included in the book of voters of PRECINCT NO. 0085B, BARANGAY
MANAPA BUENAVISTA, AGUSAN DEL NORTE.

8. Regrettably, public respondents, the Election Registration Board of

Buenavista, Agusan del Norte, in total disregard of the facts and of the Law
as well as applicable Jurisprudence, approved said applications.

9. Herein Petitioners challenge the aforementioned approval of respondents’

applications for registration and call for respondents’ EXCLUSION in the list
of voters of PRECINCT NO. 0085B, BARANGAY MANAPA ,BUENAVISTA,
AGUSAN DEL NORTE on the ground:

 that are they are either fictitious;

 or are not residents of said barangay;
 or are only transient and temporary visitors of the barangay with
no the intention to leave their previous respective residences and
 to reside in BARANGAY MANAPA , BUENAVISTA, AGUSAN DEL
NORTE.

10. The non-apearance of any respondent on the day set for hearing of this
Petition will verily confirm the fact that he or she is fictitious.

Petitioners’ COMPLIANCE
WITH JURISDICTIONAL
REQUIREMENTS

11. As part and proof of Petitioners’ compliance with the Jurisdictional

requirements of their petition , attached herewith are –

 The approved list of voters of PRECINCT NO. 0085B, BARANGAY

MANAPA ,BUENAVISTA, AGUSAN DEL NORTE marked as ANNEX “A” .

 Proof of service of notice of Petitioners’ petition upon respondents,

as evidenced by the attached affidavit of service marked as ANNEX
“B” and by their signatures herein evidencing their personal receipt
and notice of this Petition.

 Court receipts evidencing payment of docket and other legal fees

(attached to the records).

 Proof of voter registration of Petitioners in BARANGAY

MANAPA ,BUENAVISTA, AGUSAN DEL NORTE, collectively marked as
ANNEX “C”.

 The filing of this PETITION is NOT within 100 days prior to a regular
election nor within 65 days before a special election and is within the
February 28, 2022 deadline set by the COMELEC for filing petitions for
exclusion.

EVIDENCE

12. Petitioners will take the witness stand. Their Joint Judicial Affidavit is
hereto attached and marked as ANNEX “D”.

13. Petitioner may present additional witnesses and herein reserves their
presentation as corroborating witnesses.

14. Petitioner in addition to the documents attached to the Petition,

reserves the presentation of additional documents to further prove that
private Respondents are fictitious, have no physical presence in BARANGAY
MANAPA , BUENAVISTA, AGUSAN DEL NORTE and do not have the
intention to permanently reside in said place.
15. To date, respondents, are still physically absent in said barangay and are
practically unknown to the residents in said place, making their registration
as voter in PRECINCT NO. 0085B, BARANGAY MANAPA ,BUENAVISTA,
AGUSAN DEL NORTE, a violation of the residency requirements to be a
registered voter thereat. Their registration as voters of said Barangay is
unconstitutional and against the Law.

WHEREFORE, premises considered,

it is respectfully prayed of this Honorable Court

PRAYER
that Respondents be ordered EXCLUDED in the permanent list of voters of
PRECINCT NO. 0085B , BARANGAY MANAPA ,BUENAVISTA, AGUSAN DEL
NORTE.

Such other reliefs and remedies just and equitable under the premises are
likewise prayed for.
