STATUS REPORT RE NARCISO CASE

To: Heirs of Rolando Narciso

Dear Sir/Ma'am;

Good day.

We would like to respectfully submit a report and update regarding the status of your
case as of January, 2022, to wit:

1. It can be gleaned from the records of the Registry of Deeds that despite our legal
efforts, the title to the property has already been transferred to the alleged
claimants. For this reason, on 26th of February, 2020, we pursued another
recourse to recover ownership over the title by filing a PROTEST due to an
UNAUTHORIZED VOLUNTARY LAND TRANSFER AGREEMENT before the
Municipal Agrarian Reform Office (MARO) of Sta. Josefa, Agusan del Surwhich
is in the nature of an Administrative Action. This administrative remedy gives way
for settling the issue in another manner, wherein MARO may explore other means
of resolving the same without necessarily resorting to strict observance of the
rules, such as negotiation, mediation and other modes of alternative dispute
resolution;

2. On June 2021, we submitted a written manifestation with MARO in order to


follow up regarding the status of the Administrative Protest because we have not
received any response or update from MARO since the pandemic began. On
November 2021, we filed another (2nd) written Manifestation with MARO for the
same reason, and that is to follow on the status of the filed Administrative
Protest;

3. On January 5, 2022, MARO through its newly appointed officer, VILMA


ROMERO, responded to our written manifestations and acknowledged the
receipt of the Administrative Protest. According to her, the Protest was not
endorsed to her when the previous MARO officer retired from work. In her
response, she requested for a copy of Provincial Assessor’s Certification as to the
declared landholdings of the spouses Luis Narciso and Josefina Salak Narciso, so
with Alexander, Vernon and Rolando Narciso and their spouses (if there is any),
in the provinces where they are residing in order to determine whether or not the
PROTEST from CARP may be granted. We will comply as requested;
4. Through the same letter, MARO is also proposing to have a face-to-face meeting
with us and the Agrarian Reform beneficiaries in the presence of the Agrarian
Reform Provincial Legal Officer. This is however expected a move by MARO
because of the administrative nature of the PROTEST. We will also comply as
required;

5. Moving forward, we are looking into the possibility of putting into the records
before the Registry of Deeds, a notice of pendency of action (notice lis pendens) in
order to annotate Administrative Protest to the title of the property for the
purpose of protecting your real rights as may be allowed under the Rules so that it
will serve as a warning to all prospective purchasers or subsequent
encumbrancers that the same property is under litigation; and that they should
keep their hands off it unless of course, they intend to gamble and suffer on the
results of the litigation.

6. Finally, we wil be focusing our efforts on the pending Administrative Protest while
we are working on the annotation of the notice lis pendens following the rules and
guidelines of MARO.
