Faye, one of the employee of TABAKO Corp. informed his superior
through an e-mail message that Seano, President of the Employees Union is planning to commit Arson by burning the warehouse where important equipment and supplies were stored. Seano filed a defamation case against Faye. Do you think Faye is guilty of defamation? Why or Why not?
Based from the acts that Faye committed, she is ineligible to be
guilty of Oral Defamation or Slander since her actions are based by writing which according to the Art.358 of the Revised Penal Code that Oral Defamation or Slander is libel committed by oral (spoken) means, instead of in writing. Nevertheless, Faye should be guilty of Libel by means of writings or similar means according to the Art.355 of the Revised Penal Code since her acts are by email message which considered to be writing.
