Deed of Sale of A Portion of Land-Casiano-Costo
This DEED, made and executed in the City of Catbalogan, Province of Samar, by and
between:
HAIDEE Q. CASIANO-COSTO, of legal age, married to Darius Costo, Filipino, and with
residence at Brgy. Cabiton-an, Daram, Samar, hereinafter called the VENDOR-
-in favor of -
SPS. FRANCISCO A. CABAGINAN, SR. and CARMELITA C. CABAGINAN, both of legal age,
Filipinos and residents of Brgy. Cabiton-an, Daram, Samar, hereinafter called the VENDEES-
WITNESSETH: THAT-
WHEREAS, the VENDOR is the lawful and registered owner of a parcel of land designated as Lot
No. 4086, Pls-1067-D, located at Brgy. Cabiton-an, Daram, Samar, covered and embraced by Transfer
Certificate of Title No. 118-2014000096 issued by the Registry of Deeds for the Province of Samar,
Catbalogan City, and more particularly described as follows:
“A PARCEL OF LAND, LOT NO. 4086, PLS – 1067 –D; CASE- 4, COVERED BY
PROCLAIMATION NO. 2282, SITUATED IN BRGY. CABITON-AN MUNICIPALITY OF DARAM,
PROVINCE OF SAMAR, ISLAND OF DARAM. BOUNDED ON THE N., ALONG LINE 1–2 BY LOT
4428; ALONG LINE 2-3 BY LOT 4088 ALONG LINE 3-4 BY LOT 4089; ALONG LINE 4-5 BY LOT
4090; ALONG LINE 5-6 BY LOT 4100; ALONG LINE 6-7 BY LOT 4101; ALONG 7-8 BY LOT

All points referred to are indicated in the plan and are marked on the ground by P.S.
CYL. CONC. MONS. 15X 40 CM. bearings grid this lot was surveyed in accordance with
existing rules and regulations promulgated thereunder by VICTOR P. DANE, on JUNE 22,
to SEPT. 28 1974 and approved on APRIL 30, 1975.

WHEREAS, the VENDEES had offered to buy a portion of the above described land consisting
of SIXTY THREE (63) SQUARE METERS, only, pending subdivision in accordance with law, for a
price and under the terms and conditions herein set forth;
NOW, THEREFORE, for and in consideration of the premises, and more particularly of the sum
of THIRTY ONE THOUSAND FIVE HUNDRED PESOS (PhP31,500.00), Philippine Currency, the
receipt whereof is hereby acknowledged from the VENDEES to the entire satisfaction of the VENDOR,
the said VENDOR does hereby sell, transfer and convey, in a manner absolute and irrevocable, in favor
of the VENDEES, that portion of land described above consisting of SIXTY THREE (63) SQUARE
METERS, their heirs and assigns;
WHEREAS, the VENDORS hereby covenant and agree with said VENDEES that they are lawfully
seized in fee of said PORTION of land, that it is free and clear of all liens and encumbrances of any kind
whatsoever, and that they have a perfect right to convey the same, and will warrant and forever defend
the same unto said VENDEES, their heirs and assigns, against the lawful claims of third persons
whomsoever;
WHEREAS, the parties hereby agree to engage a licensed geodetic engineer to undertake the
preparation of the necessary survey plan of subdivision segregating the definite portion object of this
sale and submit the same to the proper government authorities for verification and approval in
accordance with law.

This is to acknowledge receipt of TEN THOUSAND PESOS (P10,000.00),
Philippine Currency, from LUCIA ABALAJEN-BACCOL, of legal age, married to Ronilo
P. Baccol, Filipino and with residence at Brgy. Pabanog, Paranas, Samar, as FULL
PAYMENT for the sale of a portion of unregistered unsegregated land located at
Brgy. Pabanog, Paranas, Samar, consisting of FIFTY FIVE (55) SQUARE METERS,
covered under Tax Declaration/ARP No. 22-029-00357 and PIN 036-22-029-02-034,
issued by the Municipal Assessor of Paranas, Samar.

1999 of his Notarial Registry, and more particularly described as follows:
WHEREAS, the VENDEE has offered to buy a portion of the above described
land consisting of TWO HUNDRED (200) SQUARE METERS, only, pending
subdivision in accordance with law, for a price and under the terms and conditions
herein set forth;
WHEREAS, the VENDORS hereby covenant and agree with said VENDEE
that they are lawfully seized in fee of said PORTION of land, that it is free and clear
of all liens and encumbrances of any kind whatsoever, and that they have a perfect
right to convey the same, and will warrant and forever defend the same unto said
VENDEE, her heirs and assigns, against the lawful claims of third persons
whomsoever;

WHEREAS, the VENDORS are co-owners, open. adverse and continuous
possession of a portion of residential land which they inherited from their late father,
Rodrigo Baccol, located at Brgy. Pabanog, Paranas, Samar, consisting of 2/8 th
shares or FIFTY FIVE (55) SQUARE METERS, more or less, and which residential
land is and more particularly described as follows:
WHEREAS, the VENDEE has offered to buy the shares of the VENDORS to
the residential land above described where the VENDORS houses are standing
thereon, and the VENDORS has agreed to sell pending subdivision in accordance
with law, for a price and under the terms and conditions herein set forth;
WHEREAS, the VENDORS hereby covenant and agree with said VENDEE
that they are lawfully seized in fee of said PORTION of land, that it is free and clear
of all liens and encumbrances of any kind whatsoever, and that they have a perfect
right to convey the same, and will warrant and forever defend the same unto said
VENDEE, her heirs and assigns, against the lawful claims of third persons
whomsoever;
That this instrument pertains to the sale of a parcel of land which is not
registered in accordance with the Spanish Mortgage Law or the Land Registration
Act, (Act 496) and hence, the parties have agreed to register this instrument under
the provisions of Sec. 194 of the Revised Administrative Code, as amended by Act
No. 3344.

DEED OF ABSOLUTE SALE OF A PORTION OF UNSEGREGATED LAND
THEMA M. SABERON, of legal age, widow, Filipino and with residence at Brgy.
Rawis, Calbiga, Samar, hereinafter called the VENDOR-
-and-
NORMA T. BACSAL, of legal age, single, Filipino and with residence at Brgy.
Calayaan, Calbiga, Samar, hereinafter called the VENDEE-
WITNESSETH: THAT-
WHEREAS, the VENDOR is the lawful owner, open. adverse and continuous
possession of a portion of agricultural land located at brgy. Calayaan, Calbiga, Samar,
consisting of SIX THOUSAND EIGHT HUNDRED SEVENTY (6,870) SQUARE
METERS, more or less, and which land i and more particularly described as follows:
WHEREAS, the VENDOR acquired said portion of land from its former owner,
LUZ P. CAMACHO, by virtue of the “Deed of Absolute Sale of a Portion of
Unregistered Land” on January 30, 2003, and was acknowledged and sworn to
before a Notary Public, by Atty. Medino L. Acuba, entered as Doc. No. 92; Page No.
19; Book No. XIII; Series of 2003 of his Notarial Registry;
WHEREAS, the VENDEE has offered to buy said PORTION of the land above
described which the VENDOR has acquired consisting of SIX THOUSAND EIGHT
HUNDRED SEVENTY (6,870) SQUARE METERS, and the VENDOR has agreed to
sell pending subdivision in accordance with law, for a price and under the terms and
conditions herein set forth;

NOW, THEREFORE, for and in consideration of the premises, and more
particularly of the sum of ONE HUNDRED THIRTY THOUSAND PESOS
(PhP130,000.00), Philippine Currency, the receipt whereof is hereby acknowledged
from the VENDEE to the entire satisfaction of the VENDOR, the said VENDOR does
hereby sell, transfer and convey, in a manner absolute and irrevocable, in favor of
the VENDEE, her heirs and assigns, that portion of land described above consisting
of SIX THOUSAND EIGHT HUNDRED SEVENTY (6,870) SQUARE METERS,
WHEREAS, the VENDOR hereby covenant and agree with said VENDEE that
he is lawfully seized in fee of said PORTION of land, that is free and clear of all liens
and encumbrances of any kind whatsoever, and that he has a perfect right to convey
the same, and will warrant and forever defend the same unto said VENDEE, her
heirs and assigns, against the lawful claims of third persons whomsoever;
That this instrument pertains to the sale of a parcel of land which is not
registered in accordance with the Spanish Mortgage Law or the Land Registration
Act, (Act 496) and hence, the parties have agreed to register this instrument under
