APPLICATION FOR WITHDRAWL OF O.A. NO. 12/2020

TITLED AS RAHUL YADAV VS. GOVERNMENT OF NCT OF
DELHI & ORS. ON BEHALF OF THE APPLICANT.

MOST RESPECTFULLY SHOWETH:-

1. That the present O.A. was filed by the Applicant under

Section 19 of the Central Administrative Tribunal Act,

1985 against the illegal, arbitrary, unjust,

discriminatory, malafide action on the part of the

Respondents as they were not filling up all the

 vacancies for the post of Assistant Superintendent

under Post Code 38/13 in Advertisement No. 02/13 in

spite of availability of vacant seats as well as

availability of suitable and well qualified candidates.

That abovementioned O.A. was filed by the Applicant

praying interalia for direction to the Respondents to

expedite the selection process and to fill up vacancies

for the post of Assistant Superintendent in Delhi

Prisons Department under Post Code 38/13 in terms

of Advertisement No. 02/13 and also direction to the

Respondents to consider the candidature of the

Applicant under OBC Category for the Post of

Assistant Superintendent in Delhi Prisons Department

under Post Code 38/13 in terms of Advertisement No.

02/13 who was qualified as well as suitable candidate

and was kept in select waiting list.

2. It is submitted that the issue of the Applicant herein

has been resolved by the Respondents and the

Applicant have got employment during the pendency of

this present Application. It is further submitted that

 the Respondent No. 3 i.e. Director General of Prisons,

Prison Headquarters: Central Jail: Tihar Janakpuri,

New Delhi had issued an officer of Appointment letter

vide No. F.18(1273)/Estt./CJ/PHQ/2020/CD-

003625057/12480 dated 29.12.2020 whereby

Applicant was asked to report for joining his duties.

office of Director General of Prisons, Prison

Headquarters: Central Jail: Tihar Janakpuri, New

Delhi is attached herewith this application and marked

3. It is submitted that in pursuance of the offer of

Appointment letter dated 29.12.2020 Applicant had

completed all the documentation/formalities and join

the services with the Respondents herein with effect

from 04.05.2021 and currently undergoing his training

period.
4. Therefore, under the circumstances, the Applicant

intends to withdraw this present O.A. with liberty to

file the same if needed. The applicant therefore, may be

allowed to withdraw the present O.A. under the facts

and circumstances of the case.

PRAYER

It is, therefore under the circumstances most

respectfully prayed that this Hon’ble Tribunal may be

pleased to allow this application and direct for withdrawal

of the present O.A. No. 12/2020 with liberty to file fresh

one, if needed in future.

And/Or may pass any other order/direction which may be

deemed fit and proper in the interest of justice under the

facts and circumstances of this case.
