Chair of Review Committee has MAJOR issues with the breakdown of these
costs - TOTAL $32,675.00 (see attached).
• It makes NO sense to the Chair that $15,313.00 (approx) are legal fees
for Chapman Tripp, whose services this Committee never engaged, nor
were we informed of the engagement of these services. Though it may
be standard practice for the CEO to engage such services to provide
advice regarding the KPMG contract, the fact remains that the CEO did
not pass-on this advice to the Committee, nor did she progress the
contract.
• As a Committee of Te Kauhanganui, we have a fiduciary responsibility
to be accountable for our costs to Te Kauhanganui. For this reason, the
Committee must know of all costs we are incurring, especially for legal
advice we have never received.
• It will make NO sense to Te Kauhanganui that this committee has
accumulated costs to the total of over $30k, and nearly half these
costs are for legal services this committee never requested, required,
or enlisted. The legal fees from these costs must be extracted
immediately.
• For 7 meetings over a period of six months, $17k (approx) is
reasonable for catering, accommodation, travel and fees. PLEASE
NOTE: Members of this Committee are NOT Board Members. Even Te
Arataura Members are NOT Board Members. Te Arataura too, is a
Committee of Te Kauhanganui, but the fees of the 3 Te Arataura
Members on this Committee are captured in their honorariums.
• Chair emphasises that the costs are NOT the problem. The problem is
the fact that this Committee is yet to commence a Review that
should've started in November 2010. Please note that the facts that
have led to our current situation, and these costs, will be included in
the Chair's Report to Te Kauhanganui.
• Lastly, the Chair's efforts to provide leadership and administration to
this Committee, who has engaged in several meetings with the
external agency assigned to conduct this independent review, are not
duly recognised. Te Arataura and the CEO refuses to compensate the
Chair. This is yet another fact that shall be included in the Chair's
Report to Te Kauhanganui.
