Assignment on Mediation(Problem 1)

Problem Statement:- There is an election going on in your constituency and


you have received a lot of complaints from the local politicians about the
misconduct and error in the election process.

Objective:-As a mediator your task is to facilitate communication between the


parties in conflict with a view to helping them reach a voluntary resolution to their
dispute that is timely, fair and cost-effective.

Role as a mediator

As a mediator you have to follow certain rules and regulations before coming to
any conclusion. Although you can manage the meeting and are in charge of
the proceedings, you should not impose solutions or decisions and have no
power to force a settlement. Furthermore,you have no right or duty to
provide legal advice to the parties even if you happen to be a lawyer.

You have following duties as a mediator :-


1. ​Code of Conduct:- You are required by the Act to follow the Centre’s Code
of Conduct for Mediators in the performance of their duties as mediators.

2. Impartiality :- You should mediate only those matters in which he/she can
remain impartial. Impartiality means freedom from favoritism, bias or
prejudice both in conduct and appearance

3. Confidentiality:- This Act stipulates that everything said during the course
of mediation, including all communications between the parties and the
mediator are confidential.
How to make decisions ?
As a mediator there are times when you find yourself stuck in the loop of
conflictions where you find everyone or no one guilty. Also you have to take care
of the election process also and assure every voter that everything is fine.
You can follow following ways to make elections more meditative:-

1. Approach elections as consensus building efforts that identify potential


solutions to important public problems by organizing discussions around
shared values.

2. Restructure and democratize the electoral system to increase diversity,


participation, and broader representation of interests.

3. Provide free public campaign financing for all candidates, remove soft
money bribery from politics, and reduce incentives for graft, corruption, and
politically motivated appointments.

4. Establish national minimum standards for elections.

5. Establish a shorter number of days for state primaries to reduce costs,


media hype, hypocrisy, and opportunistic appeals to narrow sectional
interests.

6. Prevent the removal of voters from voting lists without ample advance
notice to those impacted, offer opportunities to appeal, and impose
penalties for partisan elimination of voters.

Challenges:-

You may be challenged on grounds of impartiality by any mediation party.


However, if the challenge does not withdraw, the chairman of the Board of Governors of
the Centre will decide on the challenge and his decision will be final and binding.

Conflicts of interest

If you have a conflict of interest you may only accept or continue the mediation if
the parties explicitly consent in writing, provided, however, that if the mediator
deems that the conflict of interest gives rise to the slightest reasonable doubt as
to the integrity of the process you should decline to proceed regardless of the
consent of the parties to the contrary.
