Check List for creation of Mortgage

Prior appointment from Mortgage creating branch is obtained
All the documents are sent in sealed cover
The checklist is enclosed
The covering letter verifying mortgager’s (Owner of the property) signature is
enclosed
Self-attested ID proof of mortgage is enclosed
In case of illiterate persons, photograph duly approved by affixing round seal
along with thumb impression is enclosed.
The copy of sanctioned proposal is enclosed
In case of mortgage on the strength of certified copy, prior approval from ZLCC
is obtained
The search report obtained from Panel Advocate and valuation report from
panel valuer (not older than 6 month), duly examined and Approved by Branch
Manager. The advocate has to clearly mention that EQM can be created by
Deposit of Title Deed. The search report and valuation report should be as per
banks prescribed format (Please refer Br. Cir. 111/47 for search report and
113/32 for valuation report).
All the requisite documents as prescribed by the advocate including original
Title Deed and other documents are enclosed.
In case of leasehold land of MIDC-Consent of MIDC and tripartite agreement is
obtained
Four COPIES OF ORAL ASSENT ARE ENCLOSED
1. Original stamped copy
2. Two Xerox of stamped copy, to be returned to branch (one for
intimation and one for Branch Record).
3. One copy approved by Branch Manager.
4. One copy for pasting by mortgagee branch (the said copy should not
run in more than one pages)
Stamp Duty Paid
For loan up to Rs. 5 Lacs 0.1% of Loan amount
For loan above Rs. 5 Lacs 0.2% of loan amount
Being continuation mortgage as the total limit (original + additional) exceeds
Rs. 5 Lacs the stamp duty paid is 0.2 % of additional loan amount
The description of the property and boundaries should be the same at four
documents
1. Title Deed
2. Search report
3. Proposal
4. Oral Assent
The certificate received form mortgage creating branch along with copy of oral
assent duly signed is kept on record.
CERSAI created other than agriculture properties within 30 days. Preferable
before disbursement
Notice of intimation given to sub-registrar where the property is situated
within 30 days. Preferably before disbursement
Charge to be created with Talathi in case of landed property and with builder
or society in case of ownership flats/ commercial shops.
After closure of loan account for release of original title deed please give
covering letter attesting borrower’s signature along with self-attested ID Proof.
Please also mention the details of mortgage created i.e. ledger folio/ cover no.
and date of creation of mortgage.
