PETITION

THE PETITIONER, by the undersigned counsel and unto this


Honorable Court most respectfully avers:

1. Petitioner is a Filipino citizen, of legal age, sister of the decedent, and a


resident of 92 P Santos Ateneo Avenue Bagumbayan Sur, Naga City and
named as executor in the will of the decedent;

2. On November 7, 2020, deceased PRINCESS M. NAPIGQUIT died,


having previously executed a notarial will, in accordance with the
formalities of law, and in a language known to her, at at her last known
residence, at 92 P Santos Ateneo Avenue Bagumbayan Sur, Naga City. A
copy of the will is attached as ANNEX A;

3. That the authenticity and due execution thereof have been


attested to by the attesting witnesses, namely, ZIA B. DELA
ROSA, of legal age, single, Filipino and a resident of Topaz street
Filoville subdivision Calauag, Naga City; SHERINA V. CASIDO, of
legal age, single, Filipino, and a resident of Block 4 lot 9 phase 2
Villa Karangahan San Felipe, Naga City, and CHERRY B.

BAJAMUNDE, of legal age, single, Filipino and resident of 36
Rodriguez Apt., P. Santos st., Bagumbayan Sur, Naga City; 


4. The names, ages and residences of the heirs, legatees and


devisees of said decedent are as follows: 

CAMILLE M. NAPIGQUIT 25 years old Naga City JAIME M.
NAPIGQUIT 22 years old Naga City 


5. That the property left by the decedent consists of real and personal
property, estimated to have the gross value of FIFTY MILLION PESOS
(Php 50,000,000) more or less;

6. That the testator, at the time of the execution of the said will, was 60
years old, widow, of sound and disposing mind, and not acting under
duress fraud or undue influence and was in every respect capacitated to
dispose of his estate by will.

7. Petitioner, as named executor, moves and prays that letters


testamentary be issued to her, that she is competent to serve as executor
and is ready to give a bond as required by the Rules of Court.

PRAYER

Wherefore, premises considered, it is respectfully prayed upon this


Honorable Court that judgment be rendered declaring that:

(a) Upon proper notice, publication and hearing, the above- mentioned will
of PRINCESS M. NAPIGQUIT be approved, allowed and admitted to
probate;

(b) Letters testamentary (or of administration) be issued to herein


petitioner, without bond;

(c) Such other relief be granted as shall be deemed just and equitable in
the premises.

I, CAMILLE M. NAPIGQUIT, of legal age, after having been

duly sworn in accordance with law, depose and state that:

1. I am a petitioner in the above-stated case;



2. I caused the preparation of the foregoing petition;

3. I have read the contents thereof and the facts stated therein are true
and correct of my personal knowledge and/or on the basis of copies of
documents and records in my

possession;

4. I have not commenced any other action or proceeding involving the


same issues in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;

5. To the best of my knowledge and belief, no such action or proceedings


is pending in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;

6. If I should thereafter learn that a similar action or proceeding has been


filed or is pending before the Supreme Court, the Court of Appeals, or any
other tribunal or

agency, I undertake to report that fact within five (5) days therefrom to this
Honorable Court.

LAST WILL AND TESTAMENT

of

Princess M. Napigquit

KNOW ALL MEN BY THESE PRESENTS:

I, Princess M. Napigquit, of legal age, single, Filipino, having been


born on the 21st day of December, 19, 1958, now actually residing at 92 P
Santos Ateneo Avenue Bagumbayan Sur, Naga City, being of sound and
disposing mind and memory, and not acting under undue influence,
violence, fraud, or intimidation of whatever kind, do by these presents
declare this to my Last Will and Testament which I have to be caused to be
written in English, the language which is known to me. I hereby declare
that:

1. I desire that my remains be buried according to rites of the


Roman Catholic Church and with dignity suitable to my circumstances;

2. I give and bequeath to my business partner YELA ELIZONDO,


half of my shares in our ready to wear clothing business, The Days Co;

3. I give and bequeath to my parents JO M. NAPIGQUIT and GENE


S. NAPIGQUIT, all my other properties, real and personal whatsoever and
wheresoever located;

4. I designated CAMILLE M. NAPIGQUIT, as the sole executor and
administrator of this Last Will and Testament, and in her incapacity, I name
and designate JOSHUA BARDAJE as her substitute.

5. I hereby direct that the executor and administrator of this Last Will
and Testament or her substitute need not present any bond;

6. I hereby revoke, set aside and annul any and all of my other will or
testamentary dispositions that I have made, executed, signed or published
preceding this Last Will and Testament.

IN WITNESS WHEREOF, I have hereunto set my hand this 20th day
