ORDER

When this case was called for initial presentation of prosecution evidence,
Public Prosecutor John Quincy Carandang and accused Raison Dela Cruz y
Santos, assisted by Atty. Alexis Ailex Villamor, were present.

Due to the state of public health emergency, the Court presided from the
courtroom of the Metropolitan Trial Court Branch 49, Caloocan City while the
public prosecutor and the defense counsel entered their remote appearances from
Marikina City and Caloocan City, respectively. The accused was accessed from the
Custodial Facility Unit of Caloocan City. The accused understood that the trial was
conducted through videoconferencing.

The private complainant, Lovely May Pontilla, failed to appear despite

notice. The prosecution, through Assistant City Prosecutor John Quincy
Carandang, manifested that the private complainant is no longer interested in
actively pursuing this case.

Upon motion of the defense, to which the prosecution did not object, let this
case be PROVISIONALLY DISMISSED with the express conformity of the
accused. As a necessary consequence, the Station Commander of the Custodial
Facility Unit is hereby ORDERED to IMMEDIATELY RELEASE accused RAISON
DELA CRUZ y SANTOS on his own recognizance unless he is being held for some
other lawful cause.

The July 1, 2020 setting of this case is hereby cancelled in view of the
provisional dismissal of the case.

Let a copy of this Order be furnished to the private complainant.
