NOTICE INVITING TENDER

Indian Oil Corporation Limited (IOCL), a Public Sector Oil Company and the largest Commercial
undertaking in the country, is engaged in the business of refining, transportation and marketing
of crude oil and petroleum products. Indian Oil Corporation Limited is one of the Fortune
“Global 500” Corporations.

Indian Oil Corporation Limited (IOCL) hereby invites e-tenders under two-Bid system from Tank
Truck (TT) owners for award of contracts for road transportation of bulk petroleum products
with effect from 01.04.2022 or at a date to be decided at the discretion of the company for a
period of THREE years with option for extension up to further TWO years at the sole discretion
of the company.

1.1 SCOPE OF WORK & CONTRACT PERIOD:

Road transportation of bulk petroleum products like MS/ HSD/ Branded Fuels etc. from
bulk oil storage & handling location given hereunder in Imphal, Manipur State to
locations within the state and outside the state.

a) The estimated requirement of Tank Trucks in different capacity cluster is below :-

Note:-
The above Tank Truck requirement is for the total volumes anticipated to be dispatched
from the tendered location.

The requirement of 12-16 KL TTs and 18-40 KL TTs as mentioned above is indicative.

1.3 PQC (PRE QUALIFICATION CRITERIA) :

3 Valid RTO registration and Legible Copies need to be submitted. TTs offered
PESO License for ready TTs without documents shall not be considered for
offered evaluation.
4 Purchase Invoice containing Legible Copies need to be submitted. TTs offered
Chassis no. for chassis without documents shall not be considered for
offered by tenderers. evaluation.
5 Booking slip for chassis for Legible Copies need to be submitted. TTs offered
SC/ST tenderers offering TTs without documents shall not be considered for
on booking slips. evaluation.

Notwithstanding any other condition/ provision in the tender documents, bidders are required to
submit complete documents pertaining to PQC along with their offer. Failure to meet the PQC
will render the bid to be summarily rejected.

IOC reserves the right to complete the evaluation based on the details furnished by the bidder,
with or without seeking any additional supporting documents/ clarifications.

1.4 IMPORTANT NOTES :

1. The general tenderer shall have to offer minimum 3 (three) tank trucks. All the TTs
offered by the tenderers should be owned tank trucks only. Tenderers may offer ready
TTs with valid RTO registration and CCOE License or may offer TTs based on purchase
invoice of chassis. Separate purchase invoice shall be required to be submitted
for each of the TT offered.

2. In case of SC/ST & MSE SC/ST, tenderers shall be required to offer minimum 2
(Two) TTs. All the TTs offered by the tenderers should be owned tank trucks only. In
addition to participation with ready TTs, in this category, tenderers will also be allowed
to participate with a Purchase Invoice of Chassis or Booking Slip for the Chassis.

Separate purchase invoice/ booking slip shall be required to be submitted for


each of the TT offered.

3. Above minimum requirement of TTs is only for qualification criteria, however IOCL may
award the work to tenderer for lesser no. of TTs also to meet the total requirement of
TTs.

4. The successful tenderers offering ready built TTs, upon placement of LOA shall produce
the TT for physical inspection with all licences within 30 days from the date of LOA. The
successful tenderers offering TTs based on purchase invoice of chassis upon placement
of LOA shall produce the TT for physical inspection with all licences within 3 months
from the date of LOA.

5. SC/ST tenderers participating with booking slips are required to produce Purchase
Invoice of TT within one month of date of LOA and shall produce the TT for physical
inspection with all licences within 3 months from the date of LOA.

6. The Maximum number of TTs that can be offered by a tenderer is 10% of TT


requirement, i.e. 33 TTs (10% of 333 TTs rounded off to nearest decimal) of the total
number of TTs required in the tender. In case, number of TTs offered is more than
10%, only 10% TTs (TTs with newest age) will be taken for evaluation.

7. The tank trucks offered or purchase invoice or booking slip should be in the name of
tenderer i.e. in the name of Firm or Partner or Company or Proprietor. In case of
partnership firm participating in this tender, the formation of such partnership firm shall
not be later than closing date of the tender. The partnership firm should be registered.
Un-registered partnership firms will not be considered. The partnership firm should have
a valid PAN card in the name of the partnership firm as on the date of the closing of the
Tender.

Tenderers are required to submit copy of Registration Certificate from Registrar of Firms
to establish the registered partnership firm enclosing all annexures wherein names of all
the partners of the said partnership firm are mentioned or Certificate of Incorporation
(as applicable).

In case, partnership firm registration certificate is not uploaded with the bid, the
tenderers shall be given one opportunity to submit the same during technical evaluation.
If the tenderer fails to submit the same within stipulated time, the tender of the
tenderer shall not be considered for further evaluation. However it may be noted that
the date of partnership firm registration in the certificate shall not be later than closing
date of the Tender.

8. All ready built TTs offered should have valid RTO registration and PESO License. All TTs
offered against purchase invoice should necessarily have chassis no. mentioned on the

invoice. Tenderers offering TTs against purchase invoice/booking slips should submit
separate purchase invoice/booking slip for each of the TT offered. Capacity against each
Purchase Invoice/Booking slip shall be clearly mentioned by Tenderer.

9. Age/Model of Tank Truck (as reckoned from the date of manufacture in RTO
Registration) offered should be below 15 years or higher model. The age/model of TT
shall be valid on the date of closing of the tender. In case only year of
manufacturing is mentioned in the RTO Registration, the age should be reckoned from
1st January of the year of manufacturing. In case both month and year of manufacturing
is mentioned in the RTO Registration, the age should be reckoned from 1st day of the
month of manufacturing.

10. RO dealer can also quote as General/SC/ST/MSE Tenderer, however accordingly all
requirement as General/SC/ST/MSE tenderer has to be fulfilled. Such RO Dealer/
Consumers applying under General transport category can include TT/Chassis offered
against EOI for being eligible or to get benefit of selection criteria under general
category. However TTs offered against EOI will be for own use only or can be utilized at
Corporation discretion for undertaking other than own supplies. RO Dealer however
cannot claim for RTKM equalization for those TTs. All terms and condition of EOI will be
applicable for those TTs which RO Dealer will earmark for their own use.

11. The tenderers shall fill the details of ownership of TTs, Age of TT, RTO Registration
Certificate, PESO License, Purchase Invoice, Booking Slip, etc as applicable in the
particulars of TTs offered. Evaluation shall be done on submitted document and
technically qualified party shall be allowed for Reverse Auction. There will be no physical
verification of these documents at the time of tender evaluation and tenderers will be
selected on the basis of documents submitted by them. RTO registration and PESO
license of ready built TTs offered in the tender will be verified from www.peso.gov.in and
that of TT registration from state specific site (where ever applicable) on internet before
issuance of LOA. All necessary credentials shall be verified further by the respective
locations for which LOA have been issued before being recommended for issuance of
work order by State Office.

12. Please note that at any stage if it is found that the information/ document submitted in
the tender is false/ forged, suitable action as deemed fit including rejection of tender.
Hence, tenderers are advised to submit true/correct information/ document in the
tender.

13. Corporation reserves the right to revise / extend any date / time from scheduled
timelines of published tender.

14. The Successful Bidder (i.e. L-1 Bidder) of this Tender is mandatorily required to be
registered on GeM Portal and must have obtained unique GeM Seller ID from GeM prior
to issuance of P.O./ W.O.

1.5 RESERVATION CRITERIA:


The provision of reservation shall be 15% (fifteen percent) & 7½% (seven and a half
percent) for Scheduled Castes (SC) and Scheduled Tribes (ST) respectively on all India
basis as per Govt. of India directives. The SC/ST tenderers shall not be eligible for any
price preference or relaxation of any standards other than whatever mentioned in the
tender document.

In line with “Public Procurement policy for Micro and Small Enterprises (MSEs) order
2012 & Amendment order 2018”, 25% of the total quantity shall be earmarked for
procurement from MSEs. Out of the above 25 percent, a sub-target of 16% (i.e., 16%
out of 25%, which is 4%) is earmarked for Micro and Small Enterprises owned by the
Scheduled Caste or the Scheduled Tribe entrepreneurs and a sub-target of 3% is
earmarked for Micro and Small Enterprises owned by women entrepreneurs.

Note: Reservation has been calculated Category-Wise. During Calculation of quota in terms of nos. of
TTs, the fractional figures have been rounded off to nearest integer since fractional TT allocation is
not possible. Equal to or greater than 0.5 is rounded off to 1 and less than 0.5 is rounded off to 0.

Example: In case a general category tenderer is participating/offering 3 ready built TTs


(having RTO registration & PESO licence) and 1 nos. TTs with Purchase Invoice of the
chassis, then the EMD payable shall be Rs. 1,15,000/-.
EMD should be deposited thorough Online EMD payment through Net Banking or
NEFT/RTGS
For detail about process of payment of online EMD, bidders shall refer “ Special Instructions
to the Bidder (SITB) ” and “ FAQs - Online EMD Facility in IOCL e-Tendering ” documents
attached separately along with the tender.

Offline EMD payment through Demand Draft (DD), Bankers Cheque (BC) and Swift Transfer
shall not be accepted.

Exemption from submission of EMD:

a. Exemption from payment of EMD shall be allowed to all Micro & Small parties registered with
any of the following agencies/bodies as per Public Procurement Policy for Micro & Small
Enterprises(MSE) Order 2012 provided that the registration certificate issued by any one of
these below mentioned agencies must be valid as on close date of tender. Bidders who have
applied for registration or renewal of registration with any of these agencies/bodies but have not
obtained the valid certificate as on close date of tender are not eligible for exemption.

Note: Against UAM, copy of acknowledgement generated online shall be acceptable.

Udyam Registration Certificate issued by Ministry of Micro, Small and Medium Enterprises
valid on Tender closing date will also be accepted. Bidders who have applied for registration or
renewal of registration but have not obtained the valid Udyam Registration Certificate as on
close date of tender are not eligible for exemption.

In case of an upward change in terms of investment in plant and machinery or equipment or


turnover or both, and consequent re-classification, an enterprise will maintain its status till expiry
of one year from the close of the year of registration.

b. PSUs (Central & State) and JVs of IOCL are exempted from submission of EMD - Self
Declaration to be uploaded by the bidder.

A copy of the EMD instrument or exemption certificate in case of exempted categories shall be
uploaded along with clear scanned copies of relevant documents to substantiate the claim
towards their credentials along with the tender documents.

Tenderers not paying EMD or not uploading valid exemption certificate on or before
tender submission date and time, will be summarily rejected.

1.7 POWER OF ATTORNEY:

Authority of the person uploading the bids with his Digital Signature Certificate (DSC)
shall be required to be submitted in the bids. Only one POA is allowed for a person.
Document required showing the authority of the person uploading & submitting the bid
with his Digital Signature Certificate shall be as given as follows:

An Individual/ POA holder is not allowed to submit multiple bids in the tender (even with
authorization/ POA) with one DSC.

1.8 MULTIPLE BIDS:


A person shall be deemed to have submitted multiple bids in the tender, if he submits
more than one bid either individually or in any combination of person (individual
capacity, proprietor, affiliates, partnership, association of persons, Company). All such
multiple bids shall be liable for rejection.

An affidavit to be submitted by the tenderer (as per the format in the tender) that no
multiple bids have been submitted.

1.9 PRICE BID- REVERSE AUCTION PROCESS


Post completion of Technical evaluation, IOCL shall finalize the tender through Electronic
bidding (Reverse Auction). The e-Reverse Auction shall be conducted on notified Date &
Time. IOCL has made arrangement with M/s MSTC who shall be IOCL’s authorized
service provider for the Reverse Auction. The technically qualified tenderers are required
to register themselves with MSTC portal (www.mstcecommerce.com) within the due
date informed, for participation in the Reverse Auction. Each tenderer will be assigned
Unique username & password by M/s MSTC for participation in the Reverse Auction.

Although requirement of TTs has been mentioned in two capacity clusters and tenderers
are required to offer TTs accordingly, Transportation rates shall be offered for three
capacity clusters in four types of RTKM categories as detailed below. In reverse auction,
Tenderers shall have to offer single percentage and the same will be applicable for all
the rate items mentioned below:-

** Rates shall be mentioned by IOCL and tenderers to offer single %ge in allowable band of 0% to
(-) 10% in reverse auction process, which shall apply to all the above rates.

In the Reverse Auction process, the tenderer will be allowed to place his offer in terms of
%ge of the departmental estimate displayed on the portal. The allowable band for the same
shall be 0% to (-) 10% of the departmental estimate. During the process, immediate last L-
1 rate offered shall be displayed and the individual tenderer can revise his offer (only
downward) with a predefined decremental value (in %ge).

Tenderers are required to offer their best price offer in the “On-line Reverse Auction”.
Detailed terms & conditions & procedure of Reverse Auction are given in the Tender
document.

1.10 SUBMISSION OF TENDER (TECHNICAL BIDS) :


a) The tenderer shall submit separate tenders for each location for which tenderer wishes
to offer Tank Trucks. If same TT is offered by more than one tenderer, the TT shall not
be considered for evaluation for both the Tenderers. In case same TT is offered at two
locations, the same will be rejected at both the locations.

b) The tenderers are advised to carefully go through the following and comply:
i. Terms and Conditions of the tender document.
ii. Bulk Petroleum Road Transportation agreement
iii. Instructions for tenderers participating in e-tenders.

c) The tenderers shall, while quoting the rates for transportation, take into consideration
the provisions of the rules thereto and the hazardous nature of the POL products and
the liability to pay the loss for non delivery/damage to the product at higher risk rate.

1.11 EVALUATION OF TENDERS:

RANKING IN LOT SYSTEM:

i. LOT-1 - TTs (having RTO Registration & PESO license) will be segregated into
LOT-1, where TTs will be ranked based on age of TT Capacity cluster wise (e.g. 12-16
KL and 18-40 KL: lower age TT will be ranked higher) irrespective of the tenderer. In
case the age of TT is also the same, then allocation will be divided proportionately
among such tenderers.

ii. LOT-2 - TTs offered on Purchase Invoice of Chassis and Booking Slip -These
shall be considered, in case of shortfall of TTs after exhausting TTs in LOT-1. List of
offered TTs in LOT-2 shall be maintained tenderer wise. Allocation to be done based
on the newest age of the purchase of Invoice / Booking slip.

a) PRICE BID RANKING of the tenderers i.e. L-1, L-2, L-3, etc shall be decided on
minimum percentages quoted for all categories in the Reverse Auction. In case rates
offered by L-1 tenderers in the Reverse Auction, are not acceptable, then IOCL has the
discretion to negotiate with L-1 tenderers to bring down the rates. L-1 rate shall be
finalized and first allocation of TTs shall be done to L-1 tenderers.

b) If the total requirement of TTs is not met by above process from at b), IOCL shall offer
L-1 rates to balance tenderers in order of their ranking i.e. L-2, L-3, L-4……………etc. for
their acceptance.

The above process shall continue till requirement of the trucks is fully met against this
tender.

c) If the total requirement of TTs is not met by above process at b) and c), IOCL reserves
the right to either further negotiate with L2,L3………Ln tenderers OR Cancel the tender
and go for fresh NIT OR invite public EOI at established L-1 rates to fulfill the required
nos. of TTs.

d) The total requirement of 12-16 KL TTs and 18-40 KL TTs mentioned in tender is
indicative. IOCL reserves the right to revise the requirement nos. of 12-16 KL and 18-40
KL TTs at the time of placement of LOA.

e) The technically qualified SC/ST/MSE tenderers shall be ranked separately. Tank Trucks
offered by these technically qualified SC/ST/MSE tenderers shall be allocated as per
Govt. of India directives.

SC/ST Allocation: LOT-1, LOT-2 & LOT-3 as stated above will be prepared for SC &
ST category separately and reservation will be as per government norms. In case of
SC/ST tenderers, offers with Purchase Invoice as well as Booking slips will be considered
in LOT-3. However, during allocation, the offers with purchase invoice will be preferred
and if the requirement of reservation is still un-met, allotment to offers under booking
slips shall be done. Pro-rata approach shall be followed for allocation in LOT-3 as
explained at para 1.11 a)iii subject to acceptance of L1 rate by bidder.

In case nos. of reserved category TTs are not filled, the balance requirement of TT will
be met from General Category. Unfulfilled quota of SC/ST if any shall be carry forward
to next tender.

f) MSE Reservation : In line with “Public Procurement policy for Micro and Small
Enterprises (MSEs) order 2012 & Amendment order 2018”, 25 % of the total quantity
shall be earmarked for procurement from MSEs, with a sub target of 16% (i.e. 16% of
25% which is 4 %) shall be further earmarked for procurement from MSEs owned by
Scheduled Caste or the Scheduled Tribe Entrepreneurs and a sub target of 3% shall be
further earmarked for procurement from MSEs owned by women Entrepreneurs.
Provided that, in the event of failure of such Micro and Small Enterprises to participate
in tender process or meet tender requirements and L-1 price, 4% sub-target for
procurement earmarked for Micro and Small Enterprises owned by Scheduled Caste or
Scheduled Tribe entrepreneurs and 3% sub-target for procurement earmarked for Micro
and Small Enterprises owned by women entrepreneurs shall be met from other Micro
and Small Enterprises.

The above provision will be subject to MSEs quoting price within price band (L-1+15%);
i.e. L-1 plus 15% and bringing down their price to L-1 in a situation where the L-1 price
is from someone other than an MSEs. In case of more than one such MSEs, the supply
shall be shared proportionately from the MSE bidders.

In case the L-1 tenderer is an MSE bidder, the ranking criteria as elaborated for General
category shall prevail amongst the MSE tenderers and allocation will be done upto the
location’s requirement.

In case MSE tenderer do not accept to match the L-1 rate, the unfulfilled quota under
MSE will be met from General Category and no carry forward will be done for any other
tenders.

1.12 OPENING OF TENDER:

a) The ‘Technical Bids’ of the tender shall be opened as per the schedule given in the e-
Tender. After scrutiny of the ‘Technical bids’, the eligible tenderers shall be notified
regarding date, time for participating in the Reverse Auction (PRICE BID).

b) IOCL reserve the right to accept or reject any or all the tenders in part or in totality, or
to negotiate with any or all the tenderers, or to withdraw/cancel/modify this tender
without assigning any reason whatsoever, or to accept some or all of the tank trucks
offered.

c) Tenderer’s offer complete in all respects must be submitted on or before the due date of
closing of the tender in line with the instructions given using own/authorized class III

of existing conditions or inadequacy of information will not be considered after
submission of the bid and during implementation.

landslides. The main purpose of this Atlas is its use for disaster preparedness and
mitigation at policy planning and project formulation stage.

This Atlas is one of its kind single point source for the various stakeholders including policy
makers, administrators, municipal commissioners, urban managers, engineers, architects,
planners, public etc. to ascertain proneness of any city/location/site to multi-hazard which
includes earthquakes, winds, floods, thunderstorms, cyclones and landslides. While project
formulation, approvals and implementation of various urban housing, buildings and
infrastructures schemes, this Atlas provides necessary information for risk analysis and
hazard assessment.

The Vulnerability Atlas of India has been prepared by Building Materials and Technology
Promotion Council under Ministry of Housing and Urban Affairs, Government of India and
available at their website www.bmtpc.org.

It is mandatory for the bidders to refer Vulnerability Atlas of India for multi-hazard risk
assessment and include the relevant hazard proneness specific to project location while

1.14 Purchase Preference (Linked with Local Content) (PP-LC) Clause & Guide to
Preferential Bidding
1. The classification, Margin of Purchase preference, broad allocation and tender
categorization shall be as follows:

3. Considering that the PP-LC Policy is to be simultaneously applied in Tenders for


procurement of Goods and services with the PPP 2012, the following evaluation
methodology shall be applied :
a) MSE bidders can avail for Purchase Preference benefits under either PPP’2012
or PP-LC. Bidders shall be required to furnish the option between the two
policies under which it wishes to avail Purchase Preference as per Annexure-
I.
b) If the MSE bidder does not indicate the option (even after opportunity), IOCL
shall evaluate the bid as per the default option as per PPP 2012.
c) The option once exercised cannot be changed.

d) The option for Purchase Preference shall be provided to the applicable bidders
in the following order:
i. Bidders qualifying under PPP 2012,
ii. Bidders qualifying under PP-LC Policy.

4. For the purpose of extending Purchase Preference benefits, the latest quote of
respective bidder(s) during the tender-cum-auction process shall be considered.

5. The modality for evaluating purchase preference benefits under PP-LC Policy and
PPP-2012 simultaneously shall be as per the following:
Details on Purchase Preference Benefits under PPP-2012 for MSE Bidders have been
mentioned in the Evaluation Criteria in the Tender Document.
Purchase Preference benefits for PP-LC Bidders will be provided in line with the PP-
LC Policy.

6. Notes:

i) PP-LC bidder mentioned above means Class-I Local supplier as defined in the
PP-LC Policy issued by MoPNG vide reference No. FP-20013/2/2017-FP-PNG
dated 17.11.2020.
ii) Only preferential bidders (eligible MSEs / PP-LC (Class I)) quoting within the
applicable purchase preference margins and agreeing to match L-1 price shall
be considered.
iii) In cases of Public Tender for works, if the bidder does not provide declaration
against being a Class I or Class II Bidder (even after opportunity(s)), the bid
shall be rejected as being from a non-eligible bidder.
iv) The above condition shall also be applicable on Tenders against Procurement
of Goods and Services other than for MSEs opting to avail benefits under PPP
2012.
v) As a matter of general rule, MSE under PPP 2012 will get preference over PP-
LC bidder.
vi) For Purchase Preference under PPP 2012 in the above listed scenarios, sub
allocation between SC/ST and Women MSE shall be done from within the MSE
allocation in all cases as mentioned in the Tender Evaluation Criteria.

7. Sanctions:

IOCL shall impose sanction on manufacturers/ Service providers not fulfilling LC of


Goods/ Services in accordance with value mentioned in the certificate of LC.
a) The sanctions may be in the form of written warning, financial penalty and
blacklisting.
b) In the event that a manufacturer or supplier of goods and/or provider of services
does not fulfill his obligation after the expiration of the period specified in such
warning, IOCL can initiate action for blacklisting such
manufacturer/supplier/service provider.
c) A manufacturer and/or supplier of Goods and/or provider of services who has
been awarded the contract after availing the Purchase Preference is found to
have violated the LC provision, in the execution of the procurement contract of
goods and/or services shall be subject to financial penalty. The financial penalty
shall be over and above the PBG value prescribed in the contract and shall not
be more than an amount equal to 10% of the contract price.

tendering site https://iocletenders.nic.in directly from the website in secured and transparent
manner maintaining confidentiality and security throughout the tender evaluation process and
award.

All interested tenderers are requested to register themselves with the portal indicated above

Certifying Authorities of India (CCA) has authorized certain trusted Certifying Authorities (CA)
who in turn allot on a regular basis Digital Certificates, Documents which are signed digitally are
legally valid documents as per the Indian IT Act (2000).

Why is a Digital Signature required?


In order to bid for Indian Oil e-tenders all the vendors are required to obtain a legally valid
Digital Certificate as per Indian IT Act from the licensed Certifying Authorities (CA) operating
under the Root Certifying Authority of India (RCAI), Controller of Certifying Authorities (CCA) of
India. The Digital Certificate is issued by CA in the name of a person authorized for filing Bids /
Offers on behalf of his Company. A Vendor / Tenderer can submit their Bids / Offers On-line
only after digitally signing the bid / documents with the above allotted Digital Signatures.
Tenderers have to procure Class 3 Digital Certificate on their own from any of the Certifying
Authorities in India.

As per the Guidelines of the Government, all the new bidders are instructed to obtain Class – 3
DSC with Signing certificate to participate in the tenders which has been published in the portal.

The existing user’s i.e. Users already enrolled with Class – 2 / Class 3 DSC certificates will be
allowed to use this portal till the expiry of the existing DSC validity period. On the expiry of the
existing token, the user should purchase the new Class-3 DSCs.

Submission of Documents
The relevant documents as mentioned in the Tender and Price Bid have to be submitted online
only. Prices should not be submitted in a physical sealed envelope. Indian Oil shall not be
responsible in any way for failure on the part of the tenderer to follow the instructions.

It is advised that the tenderer uploads small sized documents (preferably up to 5 MB) at a time
to facilitate in easy uploading into e-tendering site. Indian Oil does not take any responsibility in
case of failure of the tenderer to upload the documents within specified time of tender
submission.

Submission and Opening of Bids


Bid along with all the copies of documents should be submitted in the electronic form only
through Indian Oil e-tendering system.

Before the bid is uploaded, the bid comprising of all attached documents should be digitally
signed using digital signatures issued by an acceptable Certifying Authority (CA) in accordance
with the Indian IT Act 2000.
