AN ORDINANCE PROVIDING FOR THE INTEGRATED ECOLOGICAL SOLID WASTE


MANAGEMENT OF CAGAYAN DE ORO CITY, AND FOR OTHER PURPOSES.

BE IT ORDAINED by the Barangay Council of Barangay Balulang, Cagayan de Oro City on


session assembled that;
SECTION 1. TITLE – This Ordinance shall be known as the “INTEGRATED ECOLOGICAL
SOLIDWASTE MANAGEMENT”
SECTION 2. MANDATE
(a) Republic act No. 9003, otherwise known as Ecological Solid Waste Management
Act of 2003, provides for an ecological solid waste management program, creates the necessary
institutional mechanisms, declares certain acts prohibited and provides penalties for violations;

(b) Section 10 of Republic Act No. 9003 provides that, “Pursuant to the relevant
provisions of R.A No. 7160, otherwise known as Local Government Code of 1991, the LGU’s shall
be primarily responsible for the implementation and enforcement of the provision of this Act
within their respective jurisdiction.”;

(c) Section 47 of Republic Act No. 9003 provides that, “The Local government unit
shall impose fees in amounts sufficient to pay the costs of preparing, adopting, and implementing
a solid waste management plan prepared pursuant to this Act.” The purpose of which, as related to
the implementation of laws and regulations related to control of pollution and protection of the
environment ,particularly to solid waste management, is a matter of general welfare of the
Barangay and it inhabitants;
SECTION 3. DEFINITION OF TERMS
(a) Collection – refers to the act of removing solid waste from the source or from a
communal storage point;
(b) Compostable – refers to biodegradable or compostable materials free from
contamination such as pathogens and hazardous substances, and considered safe for agriculture
use.
(c) Composting – refers to the controlled decomposition of organic matter by micro-
organisms, mainly bacteria and fungi, into a humus-like product.
(d) Junkshop – dealing with a particular kind of junk or with all kinds of junk, and it
may thus assume a different business name.
(e) Material Recovery Facility – refers to the designated structure to receive,
temporarily store, sort, separate and recover wastes before the transfer, transport and final
disposal of remaining non-reusable waste into the identified sanitary site.
(f) Recyclable materials – refers to any waste material retrieved from waste stream
that can be still converted or utilized into other purposes.
(g) Recycling – the process of treating used making them suitable for beneficial use
including any process by which waste materials are transformed into new products.
(i) Residual waste – refers to waste that present no other use or purpose, and
cannot be classified as compostable, recyclable, non-reusable.
(k) Re-use – the process of recovering the waste materials intended for the same or
different purpose without alteration of the physical characteristics of the recovered materials.
SECTION 4. SEGRAGATION OF WASTE AT SOURCE
(a) That segregation of waste shall be primarily conducted at the source or point of
origin, to include household, commercial/ business establishments, and health care centers.
SECTION 5. ESTABLISHMENT OF THE MATERIALS RECOVERY FACILITY
(a) MRF primarily enforce and supervise the solid waste management, collection,
segregation, and resource recovery of the waste generated by the households, establishments and
premises.
SECTION 6. PENAL PROVISIONS
(a) Littering, throwing, dumping of waste matters in public places, such as roads,
sidewalks, canals, esteros, or parks, and establishments, or causing or permitting the same.
(b) Re – mixing of source- separated recyclable material with other solid waste in
any vehicle, box, container or receptacle used in solid waste collection or disposal.
(c) Buryimg of biodegradable or non-biodegradable materials in flood-prone areas.
SECTION 7. PENALTY
(a) Any person , resident, or neighbour shall immediately report to the Barangay
Chairman or his authorized representative who are found violating acts under section 6 of this
ordinance; Provided that, the person, resident, or neighbour who caused the reporting shall not be
liable for any administrative, criminal or civil liability thereof.
(b) Any person or resident shall be fined the amount of Php 200.00 nor more than
Php 1, 000.00, or imprisonment of not more than thirty (30) days or both such fine and
imprisonment at the discretion of the court. For second and subsequent violation, the additional
penalty shall be imposed after thorough evaluation and determination by the Barangay Council
through the Barangay Chairman.
SECTION 8. REPEALING CLAUSE
(a) All ordinances, rules and regulations, or parts thereof whose provisions are in
conflict with or contrary to, the provisions of this ordinance are hereby repealed, amended and
modified accordingly.
SECTION 9. EFFECTIVITY.
(a) This ordinance shall take effect after fifteen (15) days from the date its approval.
