SANDIGANBAYAN

ORIGINAL

 EXCLUSIVE
The Sandiganbayan shall have exclusive original jurisdiction over petitions for the issuance of
the writs of mandamus, prohibition, certiorari, habeas corpus, injunctions, and other ancillary writs and processes
in aid of its appellate jurisdiction and over petitions of similar nature, including quo warranto, arising or that may
arise in cases filed or which may be filed under Executive Order Nos. 1, 2, 14 and 14-A, issued in
1986: Provided, That the jurisdiction over these petitions shall not be exclusive of the Supreme Court.

APPELLATE

The Sandiganbayan is vested with appellate jurisdiction over final judgments, resolutions or orders of the RTC
whether in the exercise of their original or appellate jurisdiction over crimes and civil cases falling within the
original exclusive jurisdiction of the Sandiganbayan, but which were committed by public officers below Salary
Grade 27.

CONCURRENT

The procedure prescribed in Batas Pambansa Blg. 129, as well as the implementing rules that the Supreme Court has
promulgated and may hereafter promulgate, relative to appeals/petitions for review to the Court of Appeals, shall
apply to appeals and petitions for review filed with the Sandiganbayan. In all cases elevated to the Sandiganbayan
and from the Sandiganbayan to the Supreme Court, the Office of the Ombudsman, through its special prosecutor,
shall represent the People of the Philippines, except in cases filed pursuant to Executive Order Nos. 1, 2, 14 and 14-
A, issued in 1986.

REGIONAL TRIAL COURTS & DISTRICT SHARIAH COURTS

ORIGINAL

 EXCLUSIVE
i. Actions wherein the subject matter is not capable of pecuniary estimation
ii. Actions involving title to or possession of real property or an interest therein, where the assessed value of
such property exceeds PhP 20,000. - [in Metro Manila, PhP 50,000. -] except forcible entry and unlawful
detainer
iii. Actions in admiralty and maritime jurisdiction where the demand or claim exceeds PhP 100,000. - [in
Metro Manila: PhP 200,000. -]
iv. Matters of probate, testate or intestate, where the gross value of the estate exceeds PhP 100,000. - [in Metro
Manila: PhP 200,000.
v. Actions involving marriage and marital relations
vi. Cases not within the exclusive jurisdiction of any court, tribunal, person or body exercising judicial or
quasi-judicial functions
vii. Actions and special proceedings within the exclusive original jurisdiction of the former Juvenile and
Domestic Relations Court and of the Court of Agrarian Relations as now provided by law; and
viii. Other cases where the demand or the value of the property exceeds PhP 100,000. - [in Metro Manila: PhP

DISTRICT SHARIAH COURTS

ORIGINAL

 EXCLUSIVE

The Shari'a District Court shall have exclusive original jurisdiction over:

i. All cases involving custody, guardianship, legitimacy, paternity, and filiation arising under P.D.
No. 1083

ii. Petitions for the declaration of absence and death and for the cancellation or correction of entries
in the Muslim Registries mentioned in Title VI of Book Two of P.D. No. 1083

iii. All actions arising from customary contracts in which the parties are Muslims, if they have not
specified which law shall govern their relations; and

iv. All petitions for mandamus, prohibition, injunction, certiorari, habeas corpus, and all other
auxiliary writs and processes in aid of its appellate jurisdiction.

CONCURRENT

Concurrently with existing civil courts, the Shari'a District Court shall have original jurisdiction over:

i. Petitions by Muslims for the constitution of a family home, change of name and commitment of an
insane person to an asylum;

ii. All other personal and real actions not mentioned in paragraph 1 (d) wherein the parties involved
are Muslims except those for forcible entry and unlawful detainer, which shall fall under the
exclusive original jurisdiction of the Municipal Circuit Court; and

iii. All special civil actions for interpleader or declaratory relief wherein the parties are Muslims, or
the property involved belongs exclusively to Muslims.

APPELLATE

Appellate jurisdiction.

i. Shari'a District Courts shall have appellate jurisdiction over all cases tried in the Shari'a Circuit Courts
within their territorial jurisdiction.

ii. The Shari'a District Court shall decide every case appealed to it based on the evidence and records
transmitted as well as such memoranda, briefs or oral arguments as the parties may submit.

METROPOLITAN, MUNICIPAL & MUNICIPAL CIRCUIT TRIAL COURTS


ORIGINAL
 EXCLUSIVE

(1) Actions involving personal property valued are not more than PhP 100,000. - [in Metro Manila: PhP 200,000.]
(2) Actions demanding sums of money not exceeding PhP 100,000. - [in Metro Manila: PhP 200,000. -]

(4) Probate proceedings (testate or intestate), where the gross value of the estate does not exceed PhP 100,000. - [in

(5) Forcible entry and unlawful detainer cases
(6) Actions involving title to or possession of real property, or any interest therein, where the assessed value does
not exceed PhP 20,000. - [in Metro Manila: PhP 50,000. -]

(7) Provisional remedies where the principal action is within their jurisdiction

Jurisdiction of Metropolitan Trial Courts, Municipal Trial Courts and Municipal Circuit Trial Courts in
criminal cases. —

Except in cases falling within the exclusive original jurisdiction of Regional Trial Courts and of the Sandiganbayan,
the Metropolitan Trial Courts, Municipal Trial Courts, and Municipal Circuit Trial Courts shall exercise:

i. Exclusive original jurisdiction over all violations of city or municipal ordinances committed
within their respective territorial jurisdiction; and

ii. Exclusive original jurisdiction over all offenses punishable with imprisonment of not exceeding
four years and two months, or a fine of not more than four thousand pesos, or both such fine and
imprisonment, regardless of other imposable accessory or other penalties, including the civil
liability arising from such offenses or predicated thereon, irrespective of kind, nature, value, or
amount thereof: Provided, however, That in offenses involving damage to property through
criminal negligence they shall have exclusive original jurisdiction where the imposable fine does
not exceed twenty thousand pesos.

DELEGATED
Cadastral or land registration cases covering

b. contested lots where the value of which does not exceed P100,000. -

SPECIAL
Petitions for habeas corpus in the absence of all Regional Trial Court Judges in the province or city
