Hope this email finds you well and safe.

This refers to your request for clarification on the appointment of SHS teachers under provisional status by
virtue of Republic Act (RA) 10612 or the Fast-Tracked Science and Technology Scholarship Act of 2013.

Please be informed that the memorandum DM-PHROD-2021-0423 or the Period of Effectivity of the
Existing Provisional Appointments of Teachers in the Senior High School was issued to our field offices in
order to clarify the period of effectivity of all provisional appointments of Senior High School Teachers
(SHS) for the School Year (SY) 2020-2021 including those recipients of Department of Science and
Technology – Science Education Institute (DOST-SEI) undergraduate scholarship and now rendering their
Return of Service as SST I through teaching SHS specialized subjects under provisional appointments. In
the said memorandum, all provisional appointments issued this SY 2020-2021 shall only be effective
on July 10, 2021, as the last day of the teaching and learning activities as stipulated in the DepEd
Order (DO) No. 12, s. 2021 or the Amendment to DepEd Order No. 030, s. 2020. This is in consonance
with the definition of ‘provisional appointment’ in Sec 10.b of the Civil Service Commission (CSC) Omnibus
Rule on Appointments and Other Human Resources Actions (ORAOHRA) revised 2018, which states
that "it shall not be effective beyond the school year during which it was issued."

Please be guided that all SHS provisional appointments caused by virtue of RA 10612 shall be
automatically renewed a day after the last day of SY 2020-2021, provided that they still meet the
conditions stipulated in RA 10612 and RA 10533 or the Enhanced Basic Education Act of 2013, to
wit:

1. Award recipients must teach full-time high school subject(s) in Mathematics, Biology, Chemistry,
or Physics; or Information Technology or Agricultural, Aquaculture or Fisheries Technology, both
in the university and technical-vocational tracks in the secondary education curriculum, for a
minimum of two (2) years, in a public or private high school (Chapter III Sec. 10 of RA 10612) or
for a period equivalent to the Return of Service requirement as may be indicated in their service
contract; and

2. Notwithstanding the provisions of Sections 26, 27, and 28 of Republic Act No. 7836, otherwise
known as the “Philippine Teachers Professionalization Act of 1994”, the DepEd and private
education institutions shall hire, as may be relevant to the particular subject:
(a) Graduates of science, mathematics, statistics, engineering, music, and other
degree courses with shortages in qualified Licensure Examination for Teachers
(LET) applicants to teach in their specialized subjects in elementary and secondary
education. Qualified LET applicants shall also include graduates admitted by
foundations duly recognized for their expertise in the education sector and who
satisfactorily complete the requirements set by these organizations: Provided, That
they pass the LET within five (5) years after their date of hiring: Provided,
further, That if such graduates are willing to teach on a part-time basis, the
provisions of LET shall no longer be required (Sec. 8a of RA 10533).

The five (5) year allowance period to pass the LET is likewise indicated in Sec. 11(e) of RA 10612 in
consonance with the above provision. Please also note that the provision indicated in Sec. 10(b) of
Omnibus Rules on Appointments and Other Human Resource Actions only applies to the scholar-
graduates of the Department of Science and Technology - Science Education Institute (DOST-SEI)
covered by RA 7687 or the Science and Technology Scholarship Act of 1994.
