Sub.: Clarification reeardins Merchant Shinnins 'Regulation of Entrv of Shins into


Ports. Anchoraees and Offshore Facilities' Rules. 2012.

Whereas the Merchant Shipping (Regulation of Entry of Ships into Ports, Anchorages

and Offshore Facilities) Rules, 2012 were notified vide G.S.R. 3l l(E) dared 20th April 2012.

2. Whereas during investigation of maritime casualties that occurred during cyclone


Tauktae, it has been observed that certain vessels operating in Indian offshore facilities may
not have been complying with the requirements of the Merchant Shipping (Regulation of
Entry ofShips into Ports, Anchorages and Offshore Facilities) Rules,2012.

3. It is clarified that, the requirements of the Merchant Shipping (Regulation of Entry of


Ships into Ports, Anchorages and Offshore Facilities) Rules, 2012, are also applicable to the
'offshore facilities'. All vessels shall comply with these rules and the operator of the
'offshore facility' shall ensure that all vessels calling their offshore facilities comply with the
requirements specified in the aforesaid Rules.

4. In addition to the requirements specified in the Merchant Shipping (Regutation of


Entry Ships into Ports, Anchorages and Offshore Facilities) Rules 2012, compliance with the
following requirements shall also be ensured by the Port Authorities or Operator of the
Offshore Facilities, for vessels calling at Indian Ports, Terminals, Anchorages and Offshore
facilities, as applicable:

a. All statutory, convention, insurance certificates and trading license ofthe vessel
shall remain valid during stay ofsuch vessel in the Indian coastal waters;

b. The vessel shall continue to be manned in accordance with the applicable
'Minimum Safe Manning Document'issued to such vessel, during its stay at the
offshore facility and Indian coastal waters.

5. Compliance with above mentioned requirements needs to be checked each time the
vessel enters the Port or Offshore Facility, in case if the vessel stays in port or offshore
facility continuously for one month or more then compliance needs to be re-checked by the
port authority or the offshore facility operator on monthly basis. In additional, port authority
or offshore facility operator may check as and when required to ensure compliance.
