ABOUT US

Alliance For Cause (AFC) is a Non-Profit Group that seeks to create a nexus and bridge the
gap between individuals who wish to bring a change and individuals who are waiting for a
change. We aspire to create a platform that will enable students from different walks of life to
showcase their skills and simultaneously serve the betterment of the world. All the funds raised
through this Competition will be solely used for Charity.

ABOUT THE COMPETITION

Mono-Advocacy Competitions are conducted to simulate proceedings as they would be in


reality to provide students with a pragmatic learning experience. They offer the chance to
enhance one’s skills in the crucial areas of legal research, drafting, oration before an
adjudicating authority and deliberation. Alliance for Cause is now this competition with an aim
to promote student involvement in Social issues by providing a fair and competitive
environment for exchange of thoughts. Unlike traditional moot court competition, participants
compete as individuals and not as participants to further develop one’s individualistic and
critical thinking traits.

I. RULE BOOK
1. DEFINITIONS

The following terms shall have the corresponding meanings unless otherwise specified:

1.1.‘Competition’ shall refer to 1st NATIONAL VIRTUAL MONO ADVOCACY


COMPETITION, 2021.
1.2.‘Competition Problem’ shall refer to the facts and issues released by the organizers of
the Competition with its clarifications and corrections.
1.3.‘Competition Rules’ shall refer to the official rules of the Competition as may be
amended from time to time.
1.4.‘IST’ shall refer to Indian Standard Time.
1.5.‘INR’ shall refer to Indian Rupee.

1.6. ‘Knock-out round’ shall refer to the Quarter-final, Semi-final and Final rounds of the
Competition.
1.7. ‘Organizing Committee’ (hereinafter to be referred as O.C) shall refer to the
committee responsible for the administration and conduct of the Competition i.e.,
Alliance For Cause.
1.8.‘Official Email’ shall refer to the Official Email ID of the O.C., i.e.
allianceforcause@gmail.com

2. ELIGIBILITY
2.1.All students pursuing graduate or Post-graduate course from any recognized college,
University or Institution in India shall be eligible to participate.
2.2.Participants are to register and participate individually and not as participants.
2.3.No participant shall contradict the composition mentioned above. No faculty member,
coach, or a designated observer will be allowed to join the video-conferencing or meet
during the session.
2.4.A participant will be considered eligible to participate only if the registration is
completed on or before 18th March, 2021 (24 Hours IST).

3. REGISTRATION
3.1.Teams are required to complete the registration on or before 18th March, 2021.
3.2. The Registration Fee is Rs. 300/- per participant.
3.3.The Registration fee can be paid online through GooglePay, PayTM, or Online

3.4.The payment reference number and date of payment have to be inserted in the
registration form only then will the registration be deemed to be complete.

3.6.Once the form is submitted, an acknowledgement mail will be sent within 24-48 hours
to the teams.
3.7.Registration fees once paid are neither refundable nor non-transferable since all the
proceeds raised through this contest will be devoted to philanthropy.

4. MEMORIAL SUBMISSION
3.5.Each participating participant in the Competition is required to prepare memorials on behalf
of the Petitioner’s side only (i.e., Respondent’s side memorial need not be submitted).
3.6.Memorials are to be submitted in .pdf format before 23:59 IST, 25th March, 2021. File
name should only mention Participant Code. For instance: PC10.pdf.
3.7.Memorials are required to be submitted through the submission form given here.

3.8.No submissions will be accepted via emails.
3.9.Please note that no hard copies are to be submitted. Any Memorial submitted after the
deadline will not be accepted. The prescribed page limit for the memorial is 30 pages.
3.10. Formatting Specifications
A. Main body: Times New Roman, Font Size 12, 1-inch margin on each side, Line
spacing: 1.5, Body of text: Justified, A4 size paper.
B. Footnotes: All citations are to be made according to the Harvard Bluebook
Citation Guide (19th Edition), Times New Roman, Font Size 10, Single spacing.
3.11. Participant Code: The participant code must be ascribed on the right top of the cover of
the index. The memorial shall nowhere mention any particulars of the participant, except
the Participant Code. There must be no mention of Name, Contact number, Email ID,
University name etc. at any place. Any material presented to the Panel should be devoid of
any identification marks/seal of the Participant. If any such mark/seal exists, it must be
rendered unrecognizable.
3.12. Memorials must contain all of, and only, the following components:
a) Cover page;
b) Table of Content;
c) List of Abbreviations;
d) Table of Authorities
e) Statement of Jurisdiction;
f) Facts of the Case;

g) Statement of Issues;
h) Summary of Issues;
i) Arguments Advanced;
j) Prayer.
COVER PAGE:
a) The Participation code should be in the upper right-hand corner.
b) The name of the forum before which the proceedings are being conducted;
c) The year of the Competition;
d) Name of the parties.
3.13. The Statement of Facts must contain a concise statement of the relevant facts of the
issue. As far as may be, the Statement of Facts should be limited to the stipulated facts and
legitimate inferences which can be drawn from those facts.
3.14. For every hour of delay in the submission from the prescribed time of submission, one
mark shall be deducted. Any memorial submitted after 25th March, 2021 will not be
accepted.
Note: The above deduction would apply even if the delay were not of a complete hour.
Hence, for example, a memorial submitted at 00:01 IST on 11th March, 2021 would
still be subject to a 1-mark deduction.
Not following the instructions regarding given will lead to the following penalties:
a) Use of incorrect font, font size, line spacing, page margins, page size: 3 marks for
every page on which there is a violation;
b) Failure to include a specified component in the memorial: 5 marks for every
component;
c) Length of the Memorial: 3 marks for every page in excess of the prescribed limit; d)
Violation of anonymity: Disqualification.
3.15. Administrators reserve the right to publish, use the memorials submitted for the
Competition. Memorials shall be attributed to the relevant institution and participants
during such publication and dissemination. The Administrators also reserve the right
to use the submissions for any other purpose they may deem fit while ensuring
appropriate attribution.

5. VIDEO SUBMISSION
The video must include but is not limited to:
a) Jurisdiction
b) Arguments Advanced
c) Prayer
The video’s time duration must not exceed 10 minutes.

II. STRUCTURE OF THE COMPETITION


In Consideration of the fact that majority of the law universities have their examinations
scheduled in the month of March along with the online classes, the O.C. has decided to alter
the structure of the competition to suit the abovementioned circumstances.
The participants will be required to submit a video recording in mp4 format of their Petitioner’s
Oral Arguments (i.e., Respondent side’s arguments are not to be submitted) in the link
provided above (i.e., ‘Video Submission Link’).

III. EVALUATION CRITERIA

IV. MISCELLANEOUS
➢ The O.C. reserves the right to amend, modify, change or repeal any of the competition
rules at any stage.
➢ The O.C. shall communicate any changes made in the competition rules to the
Participating Participants.
➢ If a participant believes that violation of the rules of the competition has taken place at
any stage of the competition, the participant(s) within half an hour after the completion
of the round in which violation has allegedly occurred should inform the O.C. through
email. Participant(s) under no circumstances shall approach the Judges with any
complaints.
➢ Dress Code for the Oral Rounds shall be according to the rules of The Advocates Act,
1961 without band and gown. If a participant does not have the prescribed uniform on
account of the Covid-19 pandemic, they are to be dressed professionally in Western
Formals.
➢ The background of the participating participants should be plain and shall not contain
any symbols or any representations.
➢ The decision of the Organizing Committee shall be final in all matters concerning the
competition.

MOOT PROPOSITION

1. Mr. Thompson is the Head-Chef in a leading 5-star restaurant, SonKar Foods Ltd. His
journey was not an easy one, whilst many discouraged him saying “Cooking is not
something that men do”, he was very passionate about his cooking and kept reinventing
recipes. In fact, the speciality of his restaurant was his innovative method of recreating
old and traditional dishes with a novel twist.
2. Mr. Thompson, right from the beginning, has been an asset for SonKar Foods. The
exponential growth of the restaurant owes it all to Mr. Thompson’s brilliance, hard
work, perseverance and innovation. He is a recipient of many international and national
culinary awards and honours and he also runs cooking classes, passionately for young
school-going students as he believes that children, right from the start should learn to
be independent, and also that cooking serves as a great recreation amidst their academic
burdens and stress.
3. In all the award shows that he goes to or he judges, he always mentions about his team
and about how his junior chefs have played an integral role in where he is today and
this makes all these junior chefs immensely adore him as their contributions are being
recognized in an international forum.
4. Due to such a hectic schedule, Mr. Thompson could hardly find any time to spend with
his family, comprising his parents, his wife and his two sons. His wife, Mrs. Milo
Thompson especially, felt neglected as her husband seldom came home and even if he
did, he came home late in the night after everyone slept and left very early in the
morning to work. Mrs. Milo had a lot of qualms with her parents-in-law and she was
unable to express her grief to anyone as her husband was never able to spend time with
her.
5. Even though Mrs. Milo was a qualified lawyer herself who graduated from a top law
school in India, and was working with a leading law firm with a hefty pay, she left her
job after marriage for taking care of her kids and her parents-in-law as they were very
old and were suffering from severe ailments. However, she perennially felt that her
efforts were being hardly recognized as her in-laws constantly kept pointing out flaws
in everything she did and she could not share her issues with anyone else.
6. In January 2020, Mrs. Milo started suffering from depression owing to acute
suppression of her feelings and a lack of an environment to voice out the same. She
decided to solicit professional help because her constant mood swings also started

affecting her relationship with her sons. Her sons feared to even talk to their mother
about their everyday routines, as they did not know when and how their mother would
scream at them.
7. Mrs. Milo tried to convey that she needed medical help to her husband. However, Mr.
Thompson was deeply absorbed in an international conclave that was supposed to held
in SonKar Foods which was huge monetary business opportunity to the restaurant. He
worked and slept everyday only in the restaurant and refused to pick any calls from his
residence as he felt it was distract him from his work. The owner of SonKar Foods, Mr.
Joshua had also promised him a stake in the restaurant upon the successful competition
of the conclave which gave more impetus to Thompson to work hard, day and night.
8. Ambushed, Mrs. Milo approached Dr. Sonya Agarwal, by herself, who is a qualified
psychiatrist from Aadesh Hospitals. Dr. Sonya, after analysing in depth about Mrs.
Milo’s medical history, complications and mental status, prescribed certain drugs to her
which she had to take at the prescribed quantity to avoid her mood swings, as the initial
stage of her treatment.
9. After taking the medicines for a few days, Mrs. Milo suffered from severe stomach
ache. Mr. Thompson, who was still preparing for the conclave, ignored the many calls
made by his sons and his parents about Mrs. Milo’s health. Mrs. Milo, then contacted
Dr. Sonya, who told her that stomach ache is a common side effect of the drug and that
it was normal and that the pain would subside in a few more days.
10. However, even after a few more days, the pain did not subside and she also started
feeling nauseous and tired. Mrs. Milo called Dr. Sonya again requesting for an
appointment. Dr. Sonya, however, brushed aside her fears and told her that it was
normal. She also told her that she had to keep taking the drug as that was the one saving
her from her mood swings.
11. Mrs. Milo continued taking the drug for a fortnight, upon which her stomach ache
became intolerable. She also started having decreased urination, severe nauseousness,
shortness of breath and started feeling very weak and slept all day. Taking note of the
same, her sons begged her to go visit the doctor. Mrs. Milo called Dr. Sonya again to
explain her symptoms, however, the call was handled by the receptionist of the hospital
who said that Dr. Sonya had travelled abroad for her book release and will not be back
for a month.

12. Mrs. Milo again tried contacting her husband because she desperately needed help with
the kids and her parents-in-law, which resulted in vain. Unable to handle the situation,
Milo called her friend from college, Mrs. Michela Pratt, who immediately took her to
their family doctor, Dr. Asher Millstone.
13. Dr. Asher ordered for a complete master-check up upon Mrs. Milo which revealed that
she had renal failure owing to the drug. It was the stage where it was incurable by
normal medicines and dialysis had to be performed. Mrs. Milo’s whole world came
crashing before her because the doctor also explained that the damage to her kidneys
may be permanent and that she may have to undergo this procedure life-long.
14. Michela took Milo home and also cooked dinner for her family that night, while Milo
was crying all day and did not possess any energy. Mr. Thompson came home that time
and was perplexed as to why the entire house seemed like it had witnessed an
earthquake. The conclave was a huge success and SonKar Foods had benefitted
immensely. Mr. Joshua as promised, had also given a huge shareholding in the company
to Mr. Thompson.
15. Mr. Thompson asked Milo why she was so devastated. Unable to answer, she began
crying again. Michela, then, sat down Mr. Thompson and explained the whole situation
to him. He was taken aback and his big, wide smile now narrowed down to tears. He
was unable to see Milo like this as he immensely loved her. He knew the kind of
sacrifices she had made for him and his family and he felt he was always indebted.
16. He held Milo’s hand and assured her that he was going to be with her all along hence
forth and would never let her suffer like this alone. He profusely apologized for having
neglected her to the extent that it led to her being depressed. The next day, Mr.
Thompson had to go to SonKar Foods Headquarters as he was being formally inducted
into the company and a press meet was also arranged, thereafter.
17. He requested Michela to stay with Milo until he came back and rushed to the
Headquarters. He was formally inducted into the company and a huge press conference
followed. The media personnel kept asking him multiple questions and he tried to keep
his cool amidst all the chaos that he had in his life. One representative from “Popular
TV” sensed that he was battling emotions and tried to cash upon it. He asked, “Even
though Mr. Joshua is happy welcoming you, you don’t seem very happy, sir! Got a
competitor offer is it?” he asked provokingly.

18. Mr. Thompson lost his cool and he asked the reporter how he could be so insensitive.
He also said, “When educated and qualified doctors like Dr. Sonya Agarwal and huge
institutions like Aadesh Hospitals, themselves are so insensitive to the pain and
sufferings of their patients, what can I expect from the media and reporters?” He further
went onto to say that “Compassionless people, like Dr. Sonya Agarwal and money-
minded, ruthless institutions like Aadesh Hospitals are now the medical fore-runners of
our country. I cannot imagine how and where this is going to end”. Following this, Mr.
Thompson left the press-conference.
19. This became a huge breaking news on both the internet, news channels and dailies.
“Popular Chef accuses Dr. Sonya and Aadesh Hospital of ‘insensitiveness’” was the
headline everywhere and this also led to a huge Twitter campaign with
#punishtheinsensitivedoctorandhospital. This led to the market shares of the hospital
go for a topple and Dr. Sonya’s book release programme also became a colossal failure.
20. Aggrieved, Dr. Sonya and Aadesh Hospital sued Mr. Thompson for defamation,
soliciting damages to the tune of Rs. 15 crores. Mrs. Milo also filed a case against Dr.
Sonya Agarwal for medical negligence and against Aadesh Hospitals for being
vicariously liable and solicited damages to the tune of Rs. 15 crores. Both cases have
been combined for the purpose of hearing before the appropriate forum.

GENERAL INSTRUCTIONS

1. Participants have to identify the right forum in which the cases will have to be argued.
2. Participants can frame their own issues (to a maximum of 4 issues) for arguing, even
the jurisdiction of the forum can be challenged.
3. The moot problem is only hypothetical and resemblance to any real-life incidents is
only a co-incidence.
4. The laws applicable to India and the appropriate rules/regulations/guidelines etc., of
Madras High Court and other sub-ordinate courts are pari-materia to the laws applicable
to the problem.
