INTRODUCTION

Tort law is the area of law that protects people from bad acts of others. When a person
commits a tort, they violate civil law. If a person is damaged by someone else’s wrongful act,
they can bring a claim for compensation against the person who commits the tort. The
purpose of tort law is to ensure that wrongdoers pay for the damage that they cause instead of
the victims.

Tort law refers to the set of laws that provides remedies to individuals who have suffered
harm by the unreasonable acts of another. Tort law is based on the idea that people are liable
for the consequences of their actions, whether intentional or accidental, if they cause harm to
another person or entity. Torts are the civil wrongs that form the basis of civil lawsuits.

A tort, in common law jurisdictions, is a civil wrong that causes a claimant to suffer loss or


harm resulting in legal liability for the person who commits the tortious act.

Tort law, where the purpose of any action is to obtain a private civil remedy such as damages,
may be compared to criminal law, which deals with criminal wrongs that are punishable by
the state. Tort law may also be contrasted with contract law which also provides a civil
remedy after breach of duty; but whereas the contractual obligation is one chosen by the
parties, the obligation in both tort and crime is imposed by the state. In both contract and tort,
successful claimants must show that they have suffered foreseeable loss or harm as a direct
result of the breach of duty.

The word tort has been defined from the latin term tortum,which means’to twist’. Thus “tort”
means “a conduct which is not straight or lawful,but,on the other hand, twisted, crooked or
unlawful.” It is equivalent to the English term ‘wrong’.the law of torts consists of various
torts or wrongfull acts whereby the wrongdoer violates some legal right vested in another
person. The law imposes a duty to respect the legal rights vested in the in the members of the
society and the person making a breach of that duty is said to have done wrongful ac. As
crime is a wrongful act, which results from the breach of a duty recognized by criminal law, a
‘breach of contract, is the non performance of a duty undertaken by a party to a contract,
similarly ‘tort’ is a breach of duty recognized under the law of torts. For example, violation of
a duty not to injure the reputation of someone else results in the tort of defamation violation
of a duty not to interfere with the possessions of land of another person results in the tort of
trespass to land; and the violation of a duty not to defraud another results in the tort of deceit.
Definition of Tort Law
1. An area of law that deals with the wrongful actions of an individual or
entity, which cause injury to another individual’s or entity’s person,
property, or reputation, and which entitle the injured party to
compensation.
