This has reference to your memorandum dated January 20, 2020 forwarding for appropriate
action the above subject request of Mr. Arnold Malinis, Owner of A.B. Malinis Construction
(Annex A).
Relative thereto, please be informed that we had already given consideration on the said request
by providing Mr. Malinis through e-mail a PDF format of files of the said requested documents
(Annex B). Hence, we regret to inform you that the second request of Mr. Malinis to acquire an
electronic /editable copy of those files may not be accommodated. May we apprise you that such
document is an excel program intended to aid and facilitate certain process of our document
preparation and solely for use of DPWH Implementing Offices.
This office may not give consideration on documents requested possibly for the purpose of
utilizing such electronic file for private operations and related benefits especially if itis not for the
purpose of addressing matter which are of public concern. To note, the Program of Work (POW),
Approved Budget for the Contract (ABC), and Detailed Unit Price Analysis (DUPA) in format as
per said template are documents prepared by the DPWH and not by the contractor thus, may not
be utilized by Mr. Malinis being a contractor.
