Rights of every Filipino Youth
1. Right to be born, have name and nationality.
2. Right to live with a family who loves, cares and teaches good morals to him/her.
3. Right to have proper care and importance from other people.
4. Right to have basic needs such as food, water, shelter, clothing and health care.
5. Right to have everything they need for a better life.
6. Right to be educated.
7. Right to play and enjoy whenever they have the opportunity.
8. Right to be protected from any kind of abuse.
9. Right to have a peaceful environment and be protected during war and armed
conflicts.
10. Right to be heard and to freely share their ideas.
Legal Bases
§ The 1987 Philippine Constitution
-The State shall protect the right of children to assistance, including proper
care and nutrition, and special protection from all forms of neglect, abuse,
cruelty, exploitation and other conditions prejudicial to their development.
-All educational institutions shall inculcate patriotism and nationalism, foster
love of humanity, respect for human rights, xxxx, teach the rights and duties
of citizenship, strengthen ethical and spiritual values, develop moral
character and personal discipline, encourage critical and creative thinking,
broaden scientific and technological knowledge and promote vocational
efficiency.

“empower the school and its administrators and teachers, or the
individual, entity or institution engaged in child care to exercise
“SPECIAL PARENTAL AUTHORITY” and responsibility over the minor
child while under their supervision, instruction or custody.”

whether INSIDE or OUTSIDE the premises of the school, entity or
institution.”

abuse, exploitation, violence, discrimination,
bullying and other forms of abuse.

children’s rights, positive discipline and the
prevention of bullying.

Committee.

§ The CPC shall be composed of the following:
1. School Head/Administrator-Chairman
2. Guidance Counselor/Teacher- Vice-Chairman
3. Representative of the Teachers as designated by the Faculty
Club
4. Representative of Parents as designated by PTA
5. Representative of Pupils as designated by the Student
Supreme Council
6. Representative from the Community as designated by the
Punong Barangay, preferably a member of the Barangay
Council for the Protection of Children (BCPC)
§ The CPC shall perform the following functions:
1. Draft a school child protection policy with a code of conduct and
a plan to ensure child protection and safety, which shall be
reviewed every three (3) years.
2. Initiate information dissemination programs and organize
activities for the protection of children.
3. Develop and implement a school-based referral and monitoring.
4. Establish a system for identifying students who may be suffering
from significant harm based on any physical, emotional or
behavioral signs.
5. Identify, refer and, if appropriate, report to the appropriate offices
cases involving child abuse, exploitation, violence, discrimination
and bullying.
§ The CPC shall perform the following functions:
6. Give assistance to parents or guardians, whenever necessary in
securing expert guidance counselling from the appropriate offices
or institutions;
7. Coordinate closely with the Women and Child Protection Desks of
the Philippine National Police (PNP), the Local Social Welfare and
Development Office (LSWDO), other government agencies, and non-
governmental organizations (NGOs), as may be appropriate;
8. Monitor the implementation of positive measures and effective
procedures in providing the necessary support for the child and for
those who care for the child; and
9. Ensure that the children’s right to be heard are respected and
upheld in all matters and procedures affecting their welfare.
1. Expeditious conduct of investigation and reporting of cases.
2. School Head or Schools Division Superintendent shall
forward the complaint and intake sheet within 48 hours to
the Discipling Authority, who shall issue an Order for the
conduct of a fact-finding investigation, not later than 72
hours from submission.
a. Upon receipt of the complaint, the School Head shall
properly fill-up the intake sheet- Annex B of DepEd Order
No. 40 , s. 2012
b. Conduct INTERVENTION program to the parties or
students
c. Intervention made by Guidance Counselor is made in
series/ programs and to be reported to the Regional Office
d. If the school have no Guidance Counselor, refer to the
nearest school with counselor or the DSWD.

NOTE: The school personnel SHOULD NOT BE ALLOWED to


settle and investigate child abuse cases in the school without
proper authorization.
Complaints of child abuse, violence,
discrimination, exploitation, bullying or other acts
of abuse under this Department Order shall be
within the exclusive jurisdiction of the Department,
and shall not be brought for amicable settlement
before the Barangay, subject to existing laws, rules
and regulations. Complaints for acts committed by
persons not under the jurisdiction of the
Disciplining Authority of the Department shall be
referred to the appropriate authorities.
§ Ifthe person complained of is a non-teaching
personnel, the Schools Division Superintendent
shall cause the conduct of a fact-finding
investigation within the same period.

§ Criminal and civil liability shall not be a bar to the


filing of an administrative case.
§ The Revised Rules of Procedure of DepEd in
Administrative Cases (DepEd Order No. 49, s. 2006,
shall apply in all aspects.

§ The identity or other information that may reasonably


identify the pupil or student shall remain confidential.

§ The identity of the respondent-teacher shall likewise


be kept confidential.
