SUBJECT: APPEAL OF THE ADMINISTRATIVE DECISION THAT ADRIJANA BORKOVIC


IS PERMANENTLY INELIGIBLE TO OPERATE A VACATION RENTAL IN THE
CITY OF PALM SPRINGS AND THE ADMINISTRATIVE FINE OF $5,000 AND
ADMINISTRATVIE FINE OF $10,000 FOR OPERATING AN UNREGISTERED
VACATION RENTAL PROPERTY LOCATED AT 2880 N. SUNRISE WAY, PALM
SPRINGS , CALIFORNIA

SUMMARY

Tim Householder, manager for Desert Luxury Estates, has requested an appeal on behalf of
the owner Adrijana Borkovic, for the property 2880 N. Sunrise Way, of the permanent
ineligibility to operate a Vacation Rental in the City of Palm Springs and administrative citation
AB0290 issued in the amount of $5 ,000 .00 for operating an unregistered Vacation Rental
property located at 2880 N. Sunrise Way, Palm Springs. Additionally, staff has included
administrative citation AB0301 issued in the amount of $10 ,000 for operating an unregistered
Vacation Rental property located at 2880 N. Sunrise Way as part of the appeal.

RECOMMENDATION :

1) Open the Appeal Hearing and accept public testimony.

2) Adopt Resolution No. , A RESOLUTION OF THE ADMINISTRATIVE APPEALS

STAFF ANALYSIS:

AB0290

The owner for the property located at 2880 N. Sunrise Way, Palm Springs did not hold a
Vacation Rental Registration Certificate by the City of Palm Springs as of the date of the
Administrative Citation issuance on July 6, 2020 .

Staff has determined that the owner has, without a Registration Certificate, advertised
and operated the property at 2880 N. Sunrise Way as a Vacation Rental from elements
as follows in violation of Palm Springs Municipal Code 5.25 .040 (a):

1. Vacation Rental Code Compliance Officer Report (page 25)


2. Guest booking itinerary for the dates June 28 , 2020 to June 30 , 2020 (2-nights)
(page 30)
3. Advertisement for short-term rental for the property 2880 N. Sunrise Way was
found on desertluxuryestates.com ; (page 36)
4. Advertisement on desertluxuryestates.com titled as "Roxy Palm Springs";
(page 36)
5. Advertisement on desertluxuryestates.com states a 3-day minimum' (page 36)

Staff finds that the guest booking itinerary for the dates June 28 , 2020 through June 30,
2020 (2 nights) for stay at property 2880 N. Sunrise Way and the advertisement found on
desertluxuryestates.com is in violation of §5 .25.040(a) and proceeded to issue
Administrative Citation AB0290 to Adrijana Borkovic, the individual on title , for Operating
a Vacation Rental without a Vacation Rental Registration Certificate. The Administrative
Citation was mailed by the Department of Special Program Compliance staff to the
mailing address on title.

Staff further includes that after issuance of citation AB0290 dated July 6, 2020 and after
the appeal request received by the City Clerk dated August 31 , 2020 , a second violation
of 5.25.040(a) occurred on November 15, 2020 for the property located at 2880 N. Sunrise
Way, Palm Springs.

Staff determined that the owner has, without a Registration Certificate, advertised and
operated the property at 2880 N. Sunrise Way as a Vacation Rental from elements as
follows in a second violation of Palm Springs Municipal Code 5.25 .040 (a) :

1. Guest booking itinerary for the dates November 12, 2020 to November 16,
2020 (4-nights) in the amount $5,413 .74 ; (page 40)
2. Advertisement for short-term rental for the property 2880 N. Sunrise Way was
found on airbnb .com/rooms/411 07632; (page 42)
3. Advertisement on airbnb.com/rooms/411 07632 titled as "Roxy Palm Springs
Desert Vibes at this 6 Bedroom Pool Pad"; (page 42)

4. Advertisement on airbnb .com/rooms/411 07632 has eight reviews (page 47)

Staff concludes that the advertisement airbnb .com/rooms/4 1107632 and guest booking
itinerary for stay for the dates November 12, 2020 to November 16, 2020 (4-nights) in the
amount $5,413 .74 at property 2880 N. Sunrise Way is in violation of §5 .25 .040(a) and
proceeded to issue Administrative Citation AB0301 , issued in the amount $10,000, to
Adrijana Borkovic, the individual on title , for Operating a Vacation Rental without a
Vacation Rental Registration Certificate. The Administrative Citation was mailed by the
Department of Special Program Compliance staff to the mailing address on title

Desert Luxury Estates is a registered Agency with the City of Palm Springs under
business license 2002258 and remits Transient Occupancy Tax for properties they
manage under Transient Occupancy Tax #3153 .

Under Palm Springs Municipal Code 5.25 .050 Agency

(a) An Owner may retain an agent with an exclusive listing arrangement or a


representative to assist in the compliance with the requirements of this Chapter,
including , without limitation , the filing of a complete Vacation Rental registration
the management of the Vacation Rental unit or units, and compliance with the
requirements of this Chapter including the collection and payment to the City of all
transient occupancy taxes due and payable on the Vacation Rental unit. The
Owner and any such agent or representative of Owner must have the authority to
evict any tenant, resident, or guest permitted to reside at the Vacation Rental for
violation of any provision of this Chapter or regulation thereof. Except as provided
in Subsection (b) of this Section and notwithstanding any agency relationships
between an Owner and an agent or representative, the Owner of the Vacation
Rental unit or units shall execute all applications and documentary requirements
as provided in this Chapter and shall remain responsible for compliance with the
provisions of this Chapter. The failure of an agent to comply with this Chapter shall
not relieve the Owner of the Owner's obligations under the provisions of this
Chapter.

The following Palm Spri ngs Municipal Codes sections and Regulations are applicable to
this matter.

The Palm Springs Municipal Code §5 .25 .030 Definitions, reads as follows:

"Vacation Rental" means a single-family dwelling, or any portion thereof,


utilized for occupancy for dwelling, lodging, or sleeping purposes without the
Owner being present for a period of twenty-eight (28) consecutive days or
less, .. ."

Palm Springs Municipal Code §5 .25 .040(a) reads as follows :

The operation of a Vacation Rental or a Homeshare Interest without a Vacation

Rental Registration Certificate is prohibited.

Palm Springs Municipal Code §5 .25 .090(c) reads as follows in regards to the
administrative fines :

(c) Any person who operates a Vacation Rental without a Vacation


Registration Certificate, shall be liable to the City for the payment of transient
occupancy tax pursuant to the provisions of the Palm Springs Municipal

Code Chapter 3.24, including without limitation penalties and interest,


payment of an administrative fine in the amount of Five Thousand Dollars

($5,000.00), and permanent ineligibility to operate a Vacation Rental in the


CI•ty ... "

Administrative Regulation "Operation of a Vacation Rental" dated 07/2017 defining


"Operation" of a Vacation Rental to include the following :

1. "Advertisement" of the property means on any web based advertising,


hosting platform, print media, bulletin, signage, radio, and television or
on any other medium for the purposes of promoting interest in, testing
the market for, or soliciting the occupancy of a property for a period of
twenty-eight (28) consecutive days or less.
2. An owner, agent or other representative of the owner has an interest in
rental, exchange, trade, gift, or grant of a guest stay at a property of Jess
than twenty-eight (28) consecutive days or less.
3. An owner, agent or any other representative of the owner interacts with
another party whether directly or indirectly through personal or
digital/electronic contact with the intent to provide availability of the
property for occupancy of 28 days or Jess, or to complete a rental and/or
reservation of the property for future occupancy of 28 days or less."

Administrative Regulation "Authority for the Issuance of Administrative Citations"


dated 08/2014 reads as follows:

"Vacation Rental Enforcement Officials are hereby authorized to issue, an


Administrative Citation for the violation of the provision of Chapter 5.25 of the Palm
Springs Municipal Code without first complying with the pre-citation or courtesy notice
requirements contained in PSMC Section 1. 06.030."

Palm Springs Municipal Code §5.25 .050(a) reads as follows :

Jurisdiction : This administrative hearing is conducted in accordance with Palm


Springs Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals
Board.

WHEREAS Adrijana Borkovic did not obtain a Short-Term Vacation Rental


Registration Certificate for the property located at 2880 N. Sunrise Way, Palm Springs,
pursuant to Palm Springs Municipal Code Chapter 5.25 ; and

WHEREAS Tim Householder, manager of Desert Luxury Estates, did not secure
a Vacation Rental Registration Certificate for the property located at 2880 N. Sunrise
Way, Palm Springs pursuant to Palm Springs Municipal Code Chapter 5.25 ; and

WHEREAS , any person who operates a Vacation Rental without a Vacation


Registration Certificate, shall be liable to the City an administrative fine in the amount of
Five Thousand Dollars ($5 ,000 .00) , and permanent ineligibility to operate a Vacation
Rental in the City, Palm Springs Municipal Code 5.25 .090 (c) ; and

Operating a Vacation Rental without a Vacation Rental Registration Certificate , was
issued on July 6, 2020 to Adrijana Borkovic for the property located at 2880 N. Sunrise
Way, Palm Springs; and

WHEREAS , Tim Householder on behalf of the owner Adrijana Borkovic for the
property located at 2880 N. Sunrise Way, Palm Springs , filed an administrative appeal
of Administrative Citation No. AB0290 issued in the amount of $5 ,000 for Operating a

Vacation Rental without a Vacation Rental Registration Certificate for the property
located at 2880 N. Sunrise Way, Palm Springs with the City Clerk and paid the appeal
fee ; and

WHEREAS, the Administrative Appeals Board opened and conducted a duly


noticed Administrative Appeal Hearing on April 28 , 2021 ; and

WHEREAS, the Administrative Appeals Board was presented evidence that


Adrijana Borkovic violated Section 5.25 .040 (a) of the Palm Springs Municipal Code by
a guest itinerary for the dates June 28 , 2020 to June 30 , 2020 (2-nights) for the property
located at 2880 N. Sunrise Way, and

WHEREAS , the Administrative Appeals Board was presented evidence that


Adrijana Borkovic violated Section 5.25 .040 (a) of the Palm Springs Municipal Code by
an advertisement for the property located at 2880 N. Sunrise Way, Palm Springs from
desertluxuryestates.com ; and

WHEREAS, the Administrative Appeals Board has carefully reviewed and


considered all the evidence presented in connection with said appeal on Apri l 28 , 2021 ;
and

THE ADMINISTRATIVE APPEALS BOARD HEREBY FINDS , after due


consideration given to the relevancy, weight and credibility of testimony and evidence,
and based upon a preponderance of the evidence in accordance with the Board 's
procedures, as follows :

SECTION 1.

D The Appellants are in violation of Palm Springs Municipal Code 5.25.040(a).


The Administrative Appeals Board upholds the administrative decision that
Adrijana Borkovic is permanently ineligible to operate a Vacation Rental in the
City of Palm Springs, including the property located at 2880 N. Sunrise Way,
Palm Springs and the fine of $5,000.

D The Appellant are not in violation of Palm Springs Municipal Code 5.25.040(a).
The Administrative Appeals Board overturns the administrative decision that
Adrijana Borkovic is permanently ineligible to operate a Vacation Rental in the
City of Palm Springs, including the property located at 2880 N. Sunrise Way,
Palm Springs and the fine of $5,000

SECTION 2. The Administrative Appeals Board directs the City Clerk to deliver a
copy of this Resolution to each party and to file a disposition report with the Palm
Springs City Council.

issued on December 7, 2020 to Adrijana Borkovic for the property located at 2880 N.
Sunrise Way, Palm Springs ; and

WHEREAS , Tim Householder on behalf of the owner Adrijana Borkovic for the
property located at 2880 N. Sunrise Way, Palm Springs , filed an administrative appeal
of Administrative Citation No. AB0290 issued in the amount of $5,000 for Operating a
Vacation Rental without a Vacation Rental Registration Certificate for the property
located at 2880 N. Sunrise Way, Palm Springs with the City Clerk and paid the appeal
fee ; and

WHEREAS, The Department of Special Program Compliance included with the


appeal of Administrative Citation No. AB0290 , Administrative Citation AB0301 for
consideration ; and

WHEREAS , the Administrative Appeals Board opened and conducted a duly


noticed Administrative Appeal Hearing on April 28 , 2021 ; and

WHEREAS, the Administrative Appeals Board was presented evidence that


Adrijana Borkovic violated Section 5.25.040 (a) of the Palm Springs Municipal Code by
an itinerary for the dates November 12, 2020 to November 16, 2020 (4-nights) from a
Vacation Rental guest for the property located at 2880 N. Sunrise Way, and

WHEREAS , the Administrative Appeals Board was presented evidence that


Adrijana Borkovic violated Section 5.25.040 (a) of the Palm Springs Municipal Code by
an advertisement for the property located at 2880 N. Sunrise Way, Palm Springs from
airbnb .com/rooms/411 07632 ; and

WHEREAS , the Administrative Appeals Board has carefully reviewed and


considered all the evidence presented in connection with said appeal on April 28 , 2021 ;
and

THE ADMINISTRATIVE APPEALS BOARD HEREBY FINDS , after due


consideration given to the relevancy, weight and credibility of testimony and evidence,
and based upon a preponderance of the evidence in accordance with the Board's
procedures, as follows :

SECTION 1.

The Administrative Appeals Board upholds the administrative decision that
Adrijana Borkovic is permanently ineligible to operate a Vacation Rental in the

Palm Springs and the fine of $10,000.

The Administrative Appeals Board overturns the administrative decision that
Adrijana Borkovic is permanently ineligible to operate a Vacation Rental in the
City of Palm Springs, including the property located at 2880 N. Sunrise Way,
Palm Springs and the fine of $10,000

SECTION 2. The Administrative Appeals Board directs the City Clerk to deliver a
copy of this Resolution to each party and to file a disposition report with the Palm
Springs City Council.

You are hereby notified that a violation of Palm Springs Municipal Code Section 5.25.040(a)
has been determined to exist with respect to your ownership and use of the property referenced
above. Accordingly, you are receiving this Administrative Citation # AB-0290. Pursuant to
Section 5.25.090(c), you are ordered to pay an administrative fine in the amount of five
thousand dollars ($5,000.00). Further, you must cease operating and advertising as a
Vacation Rental immediately, and you are permanently ineligible to operate a Vacation
Rental in the City.

Also, pursuant to Section 5.25.090(c), each future violation arising from your continued
operation as an unpermitted Vacation Rental will result in an admin istrative fine in the amount
of not less than ten thousand dollars ($10,000.00), and may result in the City of Palm Springs'
pursuit of civil and/or criminal remedies against you.

Palm Springs Municipal Code Section 5.25.040(a) prohibits the operation of a Vacation Rental
or a Homeshare in the City of Palm Springs without a Vacation Rental Registration Certificate.

Section 5.25.090 (c) provides the fines and penalties for operation of a Vacation Renta l in the
City of Palm Springs without a Vacation Rental Registration Certificate.

Received contracts on 6-27 and 6-28 from the two renters that were staying at 2880 N Sunrise.
This is not a registered rental and is being rented ou t illegally. Violating the city code 5.25.040

A responsible party receiving an administrative citation may appeal such
citation within fifteen (15) calendar days from the date the citation is
mailed . The provisions of Palm Springs Municipal Code Chapter 2.50 will
apply to appeals . An appeal must be filed in writing by using the

Operating a Vacation Rental without a Vacation Rental Registration Certificate

You are hereby notified that a violation of Palm Springs Municipal Code Section 5.25 .040(a)
has been determined to exist with respect to your ownership and use of the property referenced
above . Accordingly, you are receiving this Administrative Citation # AB-0301 . Pursuant to
Section 5.25 .090(c) , you are ordered to pay an administrative fine in the amount of ten
thousand dollars ($1 0,000.00) . Further, you must cease operating and advertising as a
Vacation Rental immediately, and you are permanently ineligible to operate a Vacation
Rental in the City.

Also, pursuant to Section 5.25 .090(c) , each future violation ans1ng from your continued
operation as an unpermitted Vacation Rental will result in an administrative fine in the amount
of not less than twenty five thousand dollars ($25,000.00), and may result in the City of Palm
Springs' pursuit of civil and/or criminal remedies against you .

Additional information concerning this violation is reflected below.

As the owner of the property at issue or as the individual or entity responsible for the
violation, you are individually responsible for correcting the violation.

YOU HAVE THE RIGHT TO APPEAL THIS CITATION


Payment of this administrative fine must be made within fifteen (15) days from the mailing date
of this letter. Should you file an appeal , the appeal and hearing provisions of Palm Springs
Municipal Code, Chapter 2.50 will apply. If you choose to appeal this citation , payment of the

tenants and guests must abide by. Tenants agree to maintain the premises in good order and

Loud parties in the home or on the premises are prohibited and grounds for immediate eviction .
Tenants agree there will be no disturbance, annoyance , endangerment or inconvenience of the
neighbors. Due to the proximity of the houses, using vile or obscene language while outdoors is
likely to disturb and annoy the neighbors. Parking is limited to the garage and driveway. Parking
at this house is available for 6 cars maximum in the garage and in the driveway. Parking vehicles

the large natural gas BBQ, complete with sink, mini-fridge,
and 2 burners. The outdoor kitchen has bar stools for 6,so
everyone can hang together for pre-dinner drinks, while
watching the outdoor TV. Seating for 6 and dining seating
for 8 under the covered patio. Let the dogs and kids run
around the grassy lawn, also included on this oversize half

countertops, and double islands, and is completely stocked
with place settings, cooking utensils, and glassware.

The master bedroom has a King bed, flatscreen TV, fireplace,


and pool access. The master bathroom is super luxe, with
large soaking tub with exterior mountain views, double
vanities, and tiled shower with full body shower system.
Bedroom 2 is the attached casita, with King bed, mini fridge
and sink, and en suite bathroom with tiled shower. Bedroom
3 has a King bed, flatscreen TV, ceiling fan, and shares a jack

Excellent place to get together with a couple of friends for some downtime. Pool, spa, fire pit, bbq.

Beautiful home with equally great accommodations with bedrooms separated from the open floor plan.
The weather was unseasonably cold and the hot tub was undoubtedly the perfect retreat. Defiantly
recommend this conveniently located home for group travel to PS!

The property was amazing! The home/property was huge and so well maintained. My friends and I
enjoyed the spending most of our time in the beautiful pool/spa. There were some strict noise
ordinances, but some neighbors played very loud music through the night and seemed not to have
issues. I would definitely return again, my friends and I loved our time spent together at this property.

This house is absolutely amazing. It's beautiful, spacious, and very close to down town. The house was
spotless. Only thing to be cautious of is the HOA regulations.

Top notch place with excellent customer service. The home is more beautiful in person than in the
pictures. The bedrooms and bathrooms were spacious, clean with beautiful, modern design. The back
yard with pool, spa and grill area are stunning and a great place to relax and have fun. OLE was only a
phone call away for anything we needed. There were a few marks on the walls here and there but
nothing majorly noticeable or distracting and for the minor things that were broken (eg the garbage
disposal), OLE simply thanked us for the heads up and asked if we needed the item fixed right away
(which we didn't!). Overall is was a great and easy experience. I will definitely return to this property or
another OLE property for a future trip!

Beautiful house, excellent backyard with big pool. The kitchen was very big, and the bedrooms each
have their own restroom which was a plus!
