An Act to make better provision for the regula­


tion and inspection of mines other than coal
and shale mines ; to regulate the treatment
of the products of such mines; and for pur­
poses incidental to or consequent on those
objects. [28th December, 1901.]
BE it e n a c t e d b y t h e K i n g ' s M o s t E x c e l l e n t Majesty, b y a n d
w i t h t h e advice a n d c o n s e n t of t h e Legislative Council a n d
Legislative A s s e m b l y of N e w S o u t h "Wales i n P a r l i a m e n t assembled,
a n d b y t h e a u t h o r i t y of t h e same, as follows :—•

PRELlMINAEr.
1. (1) This A c t shall come i n t o operation on t h e first day of
F e b r u a r y , one t h o u s a n d n i n e h u n d r e d a n d t w o ( w h i c h d a t e is in t h i s
A c t referred to as t h e c o m m e n c e m e n t of this A c t ) , a n d m a y be cited
as t h e " M i n e s I n s p e c t i o n A c t , 1 9 0 1 . "
(2) T h i s A c t shall a p p l y to all m i n e s o t h e r t h a n m i n e s of
coal a n d m i n e s of shale.
P r o v i d e d t h a t t h e G o v e r n o r may b y p r o c l a m a t i o n p u b l i s h e d in
t h e G a z e t t e , e x e m p t a n y m i n e or class of m i n e s from t h e o p e r a t i o n of
this A c t or a n y of its provisions, a n d s u c h e x e m p t i o n m a y be e i t h e r
w i t h o u t conditions, or d u r i n g t h e t i m e a n d on t h e conditions specified
in t h e p r o c l a m a t i o n . 2.

3. Subsection ( 3 ) of section sixty-four of t h e M i n i n g A c t , 1 8 7 4

a n d t h e r e g u l a t i o n s m a d e t h e r e u n d e r , a r c h e r e b y repealed : P r o v i d e d
t h a t t h i s r e p e a l shall n o t affect a n y e x e m p t i o n g r a n t e d u n d e r a n y
e n a c t m e n t so repealed.
4. ( 1 ) I n this Act, unless the subject-matter or context
otherwise indicates,—
" Boy " m e a n s m a l e p e r s o n u n d e r t h e age of e i g h t e e n years,
" D i v i s i o n " m e a n s division of this A c t .
" H i g h explosive " m e a n s d y n a m i t e , g e l a t i n e d y n a m i t e , g e l i g n i t e ,
r a c k a r o c k , l i t h o f r a c t c u r , or a n y o t h e r s u b s t a n c e u s e d for
b l a s t i n g purposes w h i c h is exploded b y m e a n s of a d e t o n a t o r .
" Inspector "
" I n s p e c t o r " m e a n s i n s p e c t o r of m i n e s u n d e r this A c t , and
includes t h e chief inspector.
" J u s t i c e " m e a n s j u s t i c e of t h e peace.
" M i n e " m e a n s a n d includes a n y place, open cut, q u a r r y , shaft,
t u n n e l , drive, level, or o t h e r e x c a v a t i o n , drift, g u t t e r , lead,
vein, lode, or reef w h e r e i n or w h e r e b y a n y operation is carried
on for or in c o n n e c t i o n w i t h t h e p u r p o s e of o b t a i n i n g a n y
m e t a l or m i n e r a l o t h e r t h a n coal or shale, b y a n y m o d e
or m e t h o d , a n d a n y place a d j o i n i n g t h e r e t o on w h i c h a n y
p r o d u c t of t h e m i n e is stacked, stored, crushed, or otherwise
treated.
" M a c h i n e r y " m e a n s s t e a m or o t h e r engines, boilers, furnaces,
s t a m p e r s , or o t h e r c r u s h i n g a p p a r a t u s , ore-reduction or
c o n c e n t r a t i n g p l a n t s , w i n d i n g or p u m p i n g gear, w h i m s , w h i p s ,
windlasses, c h a i n s , t r u c k s , t r a m w a y s , t a c k l e , blocks, ropes,
a n d tools, a n d includes all appliances of w h a t s o e v e r k i n d used
in or a b o u t or i n connection w i t h a m i n e , or for t h e t r e a t m e n t
of a n y p r o d u c t of a m i n e .
" O w n e r " m e a n s person w h o is t h e i m m e d i a t e p r o p r i e t o r or
lessee, or occupier of a m i n e , or of a n y p a r t thereof, a n d

does n o t i n c l u d e a person w h o m e r e l y receives a royalty , r e n t ,
or fine from a m i n e , or is m e r e l y t h e p r o p r i e t o r of a m i n e ,
subject t o a n y lease, g r a n t , or license for t h e w o r k i n g thereof,

or is merely t h e owner of t h e soil, a n d n o t interested in t h e
m i n e r a l s of t h e m i n e ; b u t a n y c o n t r a c t o r or t r i b u t e r for t h e
w o r k i n g of a m i n e , or a n y p a r t thereof, shall be subject to
t h i s A c t in like m a n n e r as if h e were a n owner, b u t so as
n o t to e x e m p t t h e o w n e r from a n y liability.
" M a n a g e r " m e a n s person h a v i n g t h e m a n a g e m e n t of t h e m i n i n g
operations carried on in or upon a m i n e .
" P l a n " a n d " sections " i n c l u d e correct copies or t r a c i n g s of a n y
original p l a n a n d sections.
" S h a f t " i n c l u d e s pit.
" T h e M i n i s t e r " m e a n s t h e Secretary for M i n e s .
" T h e U n d e r S e c r e t a r y " m e a n s t h e U n d e r Secretary for Alines.
" W a r d e n " m e a n s w a r d e n referred to i n or appointed u n d e r t h e
M i n i n g A c t , 1874, or a n y A c t a m e n d i n g or r e p e a l i n g t h e
same.
" Chief I n s p e c t o r " m e a n s t h e Chief I n s p e c t o r of M i n e s .
( 2 ) W h e r e b y t h i s A c t a n y n o t i c e m a y be g i v e n b y or to,
or a n y a c t m a y be done by a n i n s p e c t o r in respect of a m i n e , a n d t h e
m i n e is s i t u a t e i n a district or locality appointed, a n d in respect of w h i c h
an
a n i n s p e c t o r or inspectors is or a r e n a m e d u n d e r this A c t , such notice
shall h e given by or to, a n d s u c h a c t shall be done by s u c h inspector
or a n y of s u c h inspectors or by t h e chief inspector.
B u t w h e r e t h e m i n e is n o t so s i t u a t e , t h e notice m a y b e g i v e n
b y or t o , a n d t h e a c t m a y b e done b y a n y inspector.

PART II.
M A N A G E R S AND E N G I N E - D R I V E R S .

DIVISION 1.—Managers.

5. (1) E v e r y m i n e i n w h i c h m o r e t h a n t e n persons a r e employed


below g r o u n d shall be u n d e r a m a n a g e r , w h o shall reside i n i t s vicinity
a n d exercise daily personal supervision of a n d be responsible for t h e
control, m a n a g e m e n t , a n d direction of t h e m i n e .
( 2 ) T h e m a n a g e r shall be t h e owner of t h e m i n e or some
p e r s o n n o m i n a t e d by h i m . S u c h owner shall n o m i n a t e himself or
some o t h e r person b y w r i t t e n notice sent to a n inspector.
( 3 ) Subject to t h e provisions h e r e i n a f t e r m e n t i o n e d , a person
shall n o t b e qualified to be a m a n a g e r of a m i n e unless h e is registered
as t h e holder of a certificate of c o m p e t e n c y or of service as m a n a g e r
g r a n t e d u n d e r this A c t , or of a certificate a p p r o v e d b y t h e board of
e x a m i n e r s of m a n a g e r s .
(4) Provided t h a t w h e r e n o t m o r e t h a n t w e n t y persons a r e
employed below g r o u n d in t h e m i n e it shall be sufficient for t h e
m a n a g e r t o hold a p e r m i t , w h i c h t h e M i n i s t e r is h e r e b y a u t h o r i s e d
to g r a n t ; s u c h p e r m i t shall r e m a i n in force for t w e l v e m o n t h s , b u t
m a y be r e n e w e d from t i m e to t i m e b y t h e M i n i s t e r .
( 5 ) P r o v i d e d also t h a t if t h e r e is a t a n y t i m e n o m a n a g e r
of a m i n e qualified as r e q u i r e d b y this section, t h e owner of t h e m i n e
m a y a p p o i n t a n y c o m p e t e n t person n o t h o l d i n g a certificate u n d e r this
A c t to be m a n a g e r , for a period n o t e x c e e d i n g t w o m o n t h s or s u c h
l o n g e r period as m a y elapse before s u c h person h a s a n o p p o r t u n i t y of
o b t a i n i n g b y e x a m i n a t i o n a certificate u n d e r t h i s A c t . I n s u c h case
t h e o w n e r shall send to a n inspector a w r i t t e n notice of t h e m a n a g e r ' s
n a m e a n d address, t h e d a t e of his a p p o i n t m e n t , a n d of t h e r e a s o n for
such appointment.
( 6 ) I f a n y m i n e is worked for m o r e t h a n fourteen days w i t h o u t
t h e r e b e i n g such a m a n a g e r for t h e m i n e as is r e q u i r e d b y this section,
t h e o w n e r of t h e m i n e shall b e liable t o a fine n o t e x c e e d i n g fifty
p o u n d s , a n d t o a f u r t h e r fine n o t e x c e e d i n g five p o u n d s for every d a y
d u r i n g w h i c h t h e m i n e is so w o r k e d . 6.
6. (1) T h e M i n i s t e r shall a p p o i n t fit persons t o act as a hoard
of e x a m i n e r s of m a n a g e r s , w h o m a y hold e x a m i n a t i o n s a n d e x a m i n e
a p p l i c a n t s for certificates of c o m p e t e n c y as m a n a g e r s .
T h e e x a m i n a t i o n shall he p a r t l y in w r i t i n g a n d p a r t l y o r a l ; a n d
r e g a r d shall be h a d to s u c h k n o w l e d g e as is necessary for t h e practical
w o r k i n g of m i n e s in N e w S o u t h W a l e s .
( 2 ) The Minister may m a k e rules—
(a) r e g u l a t i n g t h e proceedings of t h e said b o a r d ;
(b) p r e s c r i b i n g t h e places a n d times of h o l d i n g e x a m i n a t i o n s ;
(c) p r e s c r i b i n g t h e r e m u n e r a t i o n of m e m b e r s of t h e said board ;
(d) p r e s c r i b i n g t h e fee to be paid by a n applicant desiring to be
e x a m i n e d , b u t so t h a t t h e fee do n o t exceed t w o p o u n d s ;
(e) r e g u l a t i n g t h e c o n d u c t of e x a m i n a t i o n s ; a n d
(f) prescribing t h e qualifications of a p p l i c a n t s for e x a m i n a t i o n .
A n d every s u c h r u l e shall be observed b y t h e said board.
7. T h e M i n i s t e r shall g r a n t a certificate of c o m p e t e n c y as
m a n a g e r to every a p p l i c a n t whO is d u l y r e p o r t e d b y t h e board of

e x a m i n e r s to h a v e passed t h e e x a m i n a t i o n satisfactorily , a n d to h a v e

given satisfactory evidence of his sobriety , experience, ability, a n d
general good conduct, a n d t h a t he has h a d p r a c t i c a l e x p e r i e n c e in a
m i n e for a t least t h r e e years.
8. (1) A certificate of service as m a n a g e r shall be g r a n t e d by
t h e M i n i s t e r to every person w h o satisfies s u c h board of e x a m i n e r s
either—
(a) t h a t before t h e c o m m e n c e m e n t of this A c t h e was a c t i n g a n d
h a s since t h a t d a y acted ; or,

(b) t h a t h e h a s at any t i m e w i t h i n five years before t h e com­
m e n c e m e n t of t h i s A c t for a period of n o t less t h a n twelve
months acted;
in N e w S o u t h wales in t h e c a p a c i t y of a n inspector of m i n e s or of
a m a n a g e r of a m i n e in w h i c h n o t Joss t h a n t w e n t y persons were
ordinarily e m p l o y e d below g r o u n d :
P r o v i d e d t h a t such certificate of service m a y bo refused to a n y

person w h o fails to give full a n d satisfactory i n f o r m a t i o n as to his
n a m e , a n d t h e place a n d date of his b i r t h , a n d as to his sobriety a n d
g e n e r a l good c o n d u c t , a n d to pay s u c h r e g i s t r a t i o n fee as t h e M i n i s t e r
m a y direct, n o t exceeding t w o p o u n d s .
( 2 ) E v e r y s u c h certificate shall c o n t a i n p a r t i c u l a r s of t h e
l e n g t h a n d n a t u r e of t h e previous service of t h e person to w h o m t h e
same is g r a n t e d .
( 3 ) A certificate of s e n ice g r a n t e d u n d e r t h i s section shall
for t h e p u r p o s e s of t h i s A c t h a v e t h e same effect as a certificate of
c o m p e t e n c y as m a n a g e r g r a n t e d u n d e r t h i s A c t .

9. (1) A n y certificate of competency or service as m a n a g e r
g r a n t e d b y a n y d u l y c o n s t i t u t e d a n d recognised a u t h o r i t y outside

Now S o u t h W a l e s m a y be a p p r o v e d by t h e board of e x a m i n e r s of
m a n a g e r s , it' t h e holder thereof p r o d u c e s such certificate a n d gives
satisfactory evidence to such hoard of his sobriety, general good con­
duct, a n d b o n a fides.
( 2 ) E v e r y such certificate so a p p r o v e d shall be e q u i v a l e n t
in all respects to a similar certificate g r a n t e d u n d e r this A c t ; a n d t h e
holder thereof m a y be registered upon t h e p a y m e n t of such fee not
exceeding two pounds as t h e Minister m a y direct.
10. T h e certificates of c o m p e t e n c y a n d service as m a n a g e r s
g r a n t e d u n d e r this A c t shall be in such form as t h e Minister m a y
d i r e c t ; a n d every such certificate shall specify, i n addition to a n y
p a r t i c u l a r s hereinbefore in this A c t required, t h e n a m e , a n d t h e place,
a n d date of b i r t h of t h e person to w h o m such certificate is g r a n t e d .
11. A register of t h e holders of certificates of c o m p e t e n c y or
service as m a n a g e r g r a n t e d u n d e r this A c t , a n d of certificates a p p r o v e d
b y t h e board of e x a m i n e r s of m a n a g e r s , shall he k e p t by such person
a n d in such m a n n e r as t h e Minister m a y direct.

DIVISION 2.—Engine-drivers.

12. After t h e e x p i r a t i o n of six m o n t h s from t h e c o m m e n c e m e n t


of this A c t , a n y person—•
(a) w h o is n o t registered as t h e holder of a certificate of com­
p e t e n c y or of service as a n e n g i n e - d r i v e r g r a n t e d u n d e r this
A c t or of a certificate approved b y t h e board of e x a m i n e r s
of engine-drivers ; or
(h) w h o ( w h e t h e r or n o t t h e holder of a certificate as aforesaid)
is w h o l l y or p a r t i a l l y deaf, or whose sight is defective, or
w h o is subject to fits, giddiness, or a n y other infirmity likely
to i n t e r f e r e w i t h t h e efficient discharge of his duties,
a n d w h o is in c h a r g e of m a c h i n e r y in use a t a n y m i n e in w h i c h
s t e a m , water, electricity, gas, oil, or air, or a n y two or m o r e of t h e m a n ;
used as m o t i v e - p o w e r (except water-power used for p u m p i n g ) a n d a n y
o t h e r person who, k n o w i n g t h a t s u c h person is n o t registered as t h e
holder of s u c h certificate, or t h a t h e is subject to s u c h defect or
infirmity, employs a n y such person as aforesaid shall be g u i l t y of a n
offence a g a i n s t t h i s A c t . A i r w i n c h e s , w h e n used for w o r k on t h e
surface, s i n k i n g p u m p s , b o r i n g m a c h i n e s , a n d p u d d l i n g engines, w h e n
fixed on an elevated p u d d l i n g brace, shall n o t b e d e e m e d to be
m a c h i n e r y w i t h i n t h e m e a n i n g of t h i s section. »
13. (1) T h e M i n i s t e r shall a p p o i n t fit persons t o a c t as a board
of e x a m i n e r s of engine-drivers, w h o m a y hold e x a m i n a t i o n s a n d
e x a m i n e a p p l i c a n t s for certificates of c o m p e t e n c y as engine-drivers.
(2) T h e M i n i s t e r m a y m a k e r u l e s —
(a) r e g u l a t i n g t h e proceedings of t h e said b o a r d ;
(b)
(b) p r e s c r i b i n g t h e places a n d times of h o l d i n g e x a m i n a t i o n s ;
(c) p r e s c r i b i n g t h e r e m u n e r a t i o n of m e m b e r s of t h e said board ;
(d) p r e s c r i b i n g t h e fee t o be paid b y a n a p p l i c a n t desiring t o be
e x a m i n e d , b u t so t h a t t h e fee do n o t exceed t w o p o u n d s ;
(e) p r e s c r i b i n g t h e c o n d u c t of e x a m i n a t i o n s ; a n d
(f) p r e s c r i b i n g t h e qualifications of a p p l i c a n t s for e x a m i n a t i o n .
A n d e v e r y s u c h r u l e shall be observed b y t h e said board.
14. T h e M i n i s t e r shall g r a n t a certificate of c o m p e t e n c y as
e n g i n e - d r i v e r t o every a p p l i c a n t w h o is d u l y r e p o r t e d b y the b o a r d
of e x a m i n e r s of engine-drivers t o h a v e passed t h e e x a m i n a t i o n satis­
factorily, a n d t o h a v e g i v e n satisfactory evidence of his sobriety,
experience, ability, a n d general good c o n d u c t .
15. (1) A certificate of service as e n g i n e - d r i v e r shall b e g r a n t e d
by t h e M i n i s t e r to every person w h o furnishes to t h e board of e x a m i n e r s
of e n g i n e - d r i v e r s satisfactory evidence t h a t h e h a s , for a period of
twelve m o n t h s prior to t h e c o m m e n c e m e n t of t h i s A c t , b e e n i n c h a r g e
of a n d h a s efficiently m a n a g e d m a c h i n e r y i n w h i c h s t e a m , w a t e r ,
electricity, gas, oil, or air, or a n y t w o or m o r e of t h e m are used as m o t i v e
power:
P r o v i d e d t h a t such certificate of service m a y b e refused t o any
person w h o fails t o give full a n d satisfactory i n f o r m a t i o n as t o his
n a m e , a n d t h e place a n d d a t e of his b i r t h , a n d as t o his sobriety, and
g e n e r a l good c o n d u c t , a n d t o p a y s u c h r e g i s t r a t i o n fee as t h e M i n i s t e r
m a y direct, n o t exceeding t w o p o u n d s .
(2) E v e r y s u c h certificate shall c o n t a i n p a r t i c u l a r s of the
l e n g t h a n d n a t u r e of t h e previous services of t h e p e r s o n t o w h o m the
s a m e is g r a n t e d .
( 3 ) A certificate of service g r a n t e d u n d e r this section shall,
for t h e purposes of t h i s A c t , h a v e t h e s a m e effect a s a certificate of
c o m p e t e n c y as e n g i n e - d r i v e r g r a n t e d u n d e r t h i s A c t .
16. (1) A n y certificate of c o m p e t e n c y or service as engine-driver
g r a n t e d b y a n y d u l y c o n s t i t u t e d a n d recognised a u t h o r i t y outside N e w
S o u t h W a l e s m a y b e a p p r o v e d b y t h e board of e x a m i n e r s of engine-
drivers, if t h e h o l d e r p r o d u c e s t h e same a n d gives satisfactory evidence
to s u c h board of his sobriety, general good c o n d u c t , a n d b o n a fides.
( 2 ) E v e r y s u c h certificate so a p p r o v e d shall b e e q u i v a l e n t
in all respects t o a similar certificate g r a n t e d u n d e r this A c t , a n d the
h o l d e r thereof m a y b e r e g i s t e r e d u p o n t h e p a y m e n t of s u c h fee (not
e x c e e d i n g t w o p o u n d s ) as t h e M i n i s t e r m a y direct.
17. T h e certificates of c o m p e t e n c y or service as e n g i n e - d r i v e r s
g r a n t e d u n d e r this A c t shall b e in s u c h form as t h e M i n i s t e r m a y
direct, a n d every s u c h certificate s h a l l specify, i n a d d i t i o n t o a n y
p a r t i c u l a r s h e r e i n b e f o r e i n this A c t r e q u i r e d , t h e n a m e , a n d t h e place,
a n d date of b i r t h of t h e p e r s o n to whom s u c h certificate is g r a n t e d .

18. A register of t h e holders of certificates of c o m p e t e n c y or
service as e n g i n e - d r i v e r g r a n t e d u n d e r this Act, a n d of certificates
a p p r o v e d by t h e board of e x a m i n e r s of e n g i n e - d r i v e r s , shall be k e p t
b y s u c h person a n d in such m a n n e r as t h e M i n i s t e r m a y direct.

DIVISION 3.—Managers and Engine-drivers.


19. If at a n y t i m e r e p r e s e n t a t i o n is m a d e to t h e M i n i s t e r b y an
inspector t h a t a n y m a n a g e r or e n g i n e - d r i v e r is b y reason of
i m c o m p e t e n c y or n e g l i g e n c e , unfit to discharge his d u t i e s , or has
been c o n v i c t e d of a n offence a g a i n s t this A c t , t h e M i n i s t e r m a y cause
i n q u i r y to be m a d e i n t o t h e c o n d u c t of t h e m a n a g e r , or e n g i n e - d r i v e r ,
a n d w i t h respect to every such i n q u i r y t h e following provisions shall
h a v e effect:—•
(a) T h e i n q u i r y shall be p u b l i c , a n d shall be held b y a C o u r t
consisting of such w a r d e n as m a y be n a m e d b y t h e M i n i s t e r ,
s i t t i n g e i t h e r alone or assisted b y a n y assessor or assessors
n a m e d b y t h e M i n i s t e r ; a n d s u c h C o u r t shall b e h e l d a t such
p l a c e as t h e M i n i s t e r m a y a p p o i n t .
(b) T h e M i n i s t e r shall, before t h e c o m m e n c e m e n t of t h e i n q u i r y ,
f u r n i s h to t h e m a n a g e r , or e n g i n e - d r i v e r a s t a t e m e n t of t h e
case on w h i c h t h e i n q u i r y is i n s t i t u t e d .
(c) S o m e person a p p o i n t e d b y t h e M i n i s t e r shall u n d e r t a k e t h e
m a n a g e m e n t of t h e ease.
(d) T h e m a n a g e r , or e n g i n e - d r i v e r m a y a t t e n d t h e i n q u i r y b y
himself, his counsel, solicitor, or a g e n t , a n d m a y , if he t h i n k s
fit, be sworn a n d e x a m i n e d as a witness.
(c) S u c h C o u r t shall, on t h e conclusion of t h e i n q u i r y , send to t h e
M i n i s t e r a r e p o r t c o n t a i n i n g a full s t a t e m e n t of t h e case, a n d
t h e decision of t h e C o u r t t h e r e o n , a n d s u c h r e p o r t of, or
e x t r a c t s from t h e evidence, as t h e C o u r t m a y t h i n k fit. T h e
M i n i s t e r m a y c a u s e t h e report of t h e C o u r t to be m a d e
p u b l i c a t s u c h t i m e a n d in s u c h m a n n e r as h e m a y t h i n k fit.
(f) T h e C o u r t shall h a v e p o w e r to cancel or suspend t h e certifi­
cate of t h e m a n a g e r , or engine-driver, if it finds t h a t h e is b y
r e a s o n of i n c o m p e t e n c y or negligence, or of bis h a v i n g b e e n
convicted of a n y offence a g a i n s t this A c t , unfit to discharge;
his d u t y .
(g) T h e C o u r t m a y , if if t h i n k s fit, r e q u i r e a m a n a g e r , or e n g i n e -
driver to deliver u p his certificate, a n d if a n y m a n a g e r , or
e n g i n e - d r i v e r fails w i t h o u t sufficient cause to t h e satisfaction
of t h e C o u r t , to c o m p l y with s u c h r e q u i r e m e n t , h e shall be liable
to a fine n o t e x c e e d i n g one h u n d r e d p o u n d s . T h e C o u r t shall
hold a n y certificate so delivered u p u n t i l t h e conclusion of t h e
i n q u i r y , a n d shall t h e n e i t h e r restore, cancel, or s u s p e n d
t h e certificate a c c o r d i n g to its j u d g m e n t on t h e case.

(h) T h e C o u r t shall h a v e for t h e p u r p o s e of t h e i n q u i r y , all t h e
powers of a Court of P e t t y Sessions, a n d all t h e powers of an
inspector u n d e r t h i s A c t .
(i) T h e Court m a y also, b y s u m m o n s signed b y t h e w a r d e n
presiding, r e q u i r e t h e a t t e n d a n c e of all s u c h persons as it
t h i n k s fit for t h e p u r p o s e of t h e i n q u i r y ; a n d every person
so s u m m o n e d shall he allowed s u c h expenses as w o u l d b e
allowed to a witness a t t e n d i n g on subpoena before t h e
S u p r e m e C o u r t ; a n d in case of d i s p u t e as to t h e a m o u n t
to be allowed, t h e same shall be referred by t h e C o u r t to t h e
P r o t h o n o t a r y who, on r e q u e s t signed b y t h e Court, shall
ascertain a n d certify t h e p r o p e r a m o u n t of such expenses.
20. (1) S u c h Court m a y m a k e s u c h order as it t h i n k s lit
r e s p e c t i n g t h e costs a n d expenses of t h e i n q u i r y , a n d s u c h order shall,
on t h e a p p l i c a t i o n of a n y p a r t y e n t i t l e d to t h e benefit thereof, be
enforced b y a n y s t i p e n d i a r y or police m a g i s t r a t e or a n y t w o justices
of t h e peace in p e t t y sessions, as if s u c h costs a n d expenses were a
fine imposed b y t h a t c o u r t of p e t t y sessions.
( 2 ) T h e M i n i s t e r m a y , if h e t h i n k s fit, p a y to a n y assessors
s u c h r e m u n e r a t i o n as h e m a y a p p o i n t .
( 3 ) A n y costs a n d expenses ordered b y t h e C o u r t to be
p a i d b y t h e Minister, a n d a n y r e m u n e r a t i o n paid u n d e r t h i s section,
shall b e paid o u t of m o n e y s provided b y P a r l i a m e n t .
21. (1) W h e r e a certificate of a m a n a g e r or e n g i n e - d r i v e r is
cancelled or suspended in p u r s u a n c e of t h i s A c t , t h e M i n i s t e r shall
cause t h e cancellation or suspension to be r e c o r d e d i n t h e r e g i s t e r of
holders of s u c h certificates.
(2) T h e M i n i s t e r m a y a t a n y t i m e , on t h e r e c o m m e n d a t i o n
of t h e board of e x a m i n e r s of m a n a g e r s , or t h e b o a r d of e x a m i n e r s of
e n g i n e - d r i v e r s , as t h e case m a y be, r e n e w or restore, on s u c h t e r m s as
h e t h i n k s fit, a n y certificate w h i c h h a s been cancelled or suspended in
p u r s u a n c e of this A c t , a n d cause t h e r e n e w a l or restoration to be
recorded in t h e register aforesaid.
22. W h e n e v e r a n y person proves to t h e satisfaction of t h e
M i n i s t e r t h a t h e has, w i t h o u t f a u l t on his part, lost or been deprived of
a n y certificate g r a n t e d to h i m or a p p r o v e d by a n y board of e x a m i n e r s
u n d e r t h i s A c t , t h e M i n i s t e r shall, on p a y m e n t of s u c h fee, if a n y , as
h e m a y direct, b u t n o t e x c e e d i n g t w o p o u n d s , cause a copy of t h e
certificate to w h i c h t h e a p p l i c a n t a p p e a r s b y t h e register to be
entitled, or a s t a t e m e n t c o n t a i n i n g s u c h p a r t i c u l a r s as t h e r e g i s t e r
m a y disclose (hereinafter t e r m e d " s t a t e m e n t of p a r t i c u l a r s " ) , to be
m a d e o u t a n d certified b y t h e person w h o keeps t h e register, a n d
delivered to t h e a p p l i c a n t ; a n d a n y s u c h copy of a certificate or
s t a t e m e n t of p a r t i c u l a r s w h i c h p u r p o r t s to be so m a d e a n d certified as
aforesaid shall h a v e t h e s a m e effect as t h e original certificate, a n d for
t h e p u r p o s e s of t h i s A c t shall be d e e m e d to be a certificate of t h e
s a m e n a t u r e as t h e original certificate. 23.
23. (1) A l l expenses i n c u r r e d b y t h e M i n i s t e r in c a r r y i n g into
effect t h e provisions of this A c t w i t h respect to certificates of c o m p e t e n c y
a n d service shall he defrayed o u t of m o n e y s provided by P a r l i a m e n t .
( 2 ) All fees p a y a b l e u n d e r this A c t b y t h e a p p l i c a n t s for
or holders of certificates, or for a copy of a certificate, or a certified
s t a t e m e n t of p a r t i c u l a r s , shall be paid i n t o t h e T r e a s u r y as t h e Colonial
T r e a s u r e r m a y from t i m e to t i m e direct, a n d be carried to t h e Consoli­
dated Revenue F u n d .
24. E v e r y person w h o c o m m i t s any of tin; following offences
t h a t is t o s a y —
(a) forges, or counterfeits, or k n o w i n g l y m a k e s a n y false state­
m e n t in a n y p e r m i t or a n y certificate of c o m p e t e n c y or service
u n d e r t h i s A c t , or a n y official copy of a n y s u c h certificate,
or a n y certified s t a t e m e n t of particulars ; or

(b) k n o w i n g l y u t t e r s or uses any such p e r m i t , certificate, or copy
or s t a t e m e n t of p a r t i c u l a r s w h i c h has b e e n forged or counter­
feited or contains a n y false s t a t e m e n t ; or

(e) for t h e p u r p o s e of o b t a i n i n g for himself or any o t h e r person
e m p l o y m e n t as a m a n a g e r , or engine-driver, or t h e grant,
r e n e w a l , or t h e r e s t o r a t i o n of any p e r m i t or certificate under
this A c t , or a copy of a n y s u c h certificate, or a certified
s t a t e m e n t of p a r t i c u l a r s , e i t h e r —
(I) m a k e s or gives a n y declaration, r e p r e s e n t a t i o n , s t a t e m e n t .

or evidence' w h i c h is false i n any p a r t i c u l a r ; or
(II) k n o w i n g l y u t t e r s or uses a n y s u c h declaration, representa­

tion, s t a t e m e n t , or evidence, or any d o c u m e n t containing
t h e same,
shall be g u i l t y of a m i s d e m e a n o u r , a n d be liable on conviction ft
i m p r i s o n m e n t for a t e r m n o t e x c e e d i n g t w o years, w i t h or without
hard labour.

PART III.
EMPLOYEES.

DIVISION 1.— Wages.

25. (1) N o w a g e s shall be paid to any p e r s o n e m p l o y e d in or
a b o u t a n y m i n e at or w i t h i n a n y p u b l i c - h o u s e , beer-shop, or place for

t h e sale of any spirits, beer, wine, cider, or o t h e r spirituous or f e r m e n t e d
liquor, or o t h e r h o u s e of e n t e r t a i n m e n t , or a n y office, g a r d e n , or place
b e l o n g i n g t h e r e t o or occupied t h e r e w i t h .

( 2 ) E v e r y person w h o c o n t r a v e n e s or p e r m i t s any person
to c o n t r a v e n e t h i s section shall be g u i l t y of a n offence a g a i n s t this

A c t ; a n d in t h e e v e n t of any such c o n t r a v e n t i o n b y any person
whomsoever,
w h o m s o e v e r , t h e o w n e r a n d m a n a g e r of t h e m i n e shall each be g u i l t y
of a n offence a g a i n s t this A c t , unless h e proves that he had taken
all r e a s o n a b l e m e a n s , b y p u b l i s h i n g a n d to t h e best of his power
enforcing t h e provisions of this section, t o p r e v e n t the contravention.

DIVISION 2.—Restriction on employment.

26. (1) Boys u n d e r t h e age of fourteen y e a r s a n d females s h a l l


n o t be employed i n or a b o u t a n y m i n e ;
( 2 ) n o boy shall be e m p l o y e d in c a g i n g or u n c a g i n g t r u c k s
or skips on cages ; a n d
( 3 ) n o boy shall be e m p l o y e d as l a n d e r or b r a c e m a n a t a n y
p l a t or l a n d i n g - p l a c e e i t h e r a t or below t h e surface.
(4) N o person n o t n o w e m p l o y e d in a m i n e shall be allowed
to w o r k i n t h e face of t h e w o r k i n g s u n t i l h e has h a d t w o y e a r s '
e x p e r i e n c e of s u c h w o r k u n d e r t h e s u p e r v i s i o n of skilled w o r k m e n , or
u n l e s s a c c o m p a n i e d b y a skilled w o r k m a n , or unless h e shall h a v e been
previously employed for two y e a r s in or a b o u t t h e face of t h e w o r k i n g s
of a m i n e .
27. T h e provisions of t h i s A c t shall n o t —
(a) p r e v e n t a boy u n d e r t h e a g e of f o u r t e e n y e a r s w h o , before
t h e c o m m e n c e m e n t of t h i s A c t , w a s lawfully e m p l o y e d in or
a b o u t a n y m i n e from c o n t i n u i n g to be employed in or a b o u t
a m i n e ; nor
(b) p r e v e n t a boy w h o , before t h e c o m m e n c e m e n t of t h i s A c t , was
lawfully e m p l o y e d above or b e l o w g r o u n d i n c o n n e c t i o n w i t h
a n y m i n e from c o n t i n u i n g to be e m p l o y e d above or below
g r o u n d in c o n n e c t i o n w i t h a m i n e ; n o r
(c) p r e v e n t a c o m p e t e n t m a l e person above t h e a g e of e i g h t e e n
years w h o , before t h e c o m m e n c e m e n t of t h i s A c t , w a s
lawfully e m p l o y e d in c h a r g e of or to c o n t r o l a n y w i n d i n g
e n g i n e from c o n t i n u i n g to be so employed.
28. (1) T h e o w n e r or m a n a g e r of every m i n e shall k e e p in t h e
office a t t h e m i n e a register, a n d shall cause to b e e n t e r e d in t h a t
register, in such form as t h e M i n i s t e r m a y prescribe or sanction, t h e
n a m e , a g e , r e s i d e n c e , a n d d a t e of first e m p l o y m e n t of e v e r y boy e m p l o y e d
below g r o u n d in t h e m i n e , a n d of every boy e m p l o y e d above g r o u n d i n
connection with t h e m i n e ; a n d shall on r e q u e s t p r o d u c e t h e register
to a n y inspector, a n d to a n y officer of t h e D e p a r t m e n t of P u b l i c
I n s t r u c t i o n , a t t h e m i n e , a t all reasonable t i m e s , a n d shall allow a n y
inspector or s u c h officer to i n s p e c t a n d copy t h e s a m e .
( 2 ) T h e i m m e d i a t e e m p l o y e r of every boy, o t h e r t h a n t h e
o w n e r or m a n a g e r of t h e m i n e , before h e causes t h e boy to be below
g r o u n d in a n y m i n e , shall r e p o r t to t h e m a n a g e r of t h e m i n e , or to
some person a p p o i n t e d b y t h e m a n a g e r in t h a t behalf, t h a t h e is a b o u t
t o e m p l o y t h e boy in t h e m i n e . 29.
29. N o person o t h e r t h a n a n o w n e r or a person a c t i n g in t h e
m a n a g e m e n t of t h e m i n e s h a l l he e m p l o y e d below g r o u n d in any
m i n e for m o r e t h a n e i g h t consecutive h o u r s a t a n y t i m e n o r for more
t h a n f o r t y - e i g h t h o u r s in a n y week, except in cases of e m e r g e n c y .
30. (1) N o person i n c h a r g e of m a c h i n e r y i n w h i c h steam,
w a t e r , electricity, gas, oil, or air, or a n y two or m o r e of t h e m are
u s e d as a m o t i v e - p o w e r in c o n n e c t i o n w i t h a n y m i n e or for the
t r e a t m e n t of t h e p r o d u c t s of a n y m i n e , shall be so e m p l o y e d for more
t h a n e i g h t c o n s e c u t i v e h o u r s a t a n y t i m e , or for m o r e t h a n eight
h o u r s in a n y t w e n t y - f o u r h o u r s , except w h e n c h a n g i n g shifts a t t h e
e n d of t h e week ; such period of e i g h t h o u r s shall be e x c l u s i v e ol
a n y t i m e occupied in r a i s i n g s t e a m or s u p p l y i n g air a n d in d r a w i n g
fires a n d e x h a u s t i n g s t e a m in c o n n e c t i o n w i t h t h e m a c h i n e r y in t h e
c h a r g e of s u c h person, a n d of a n y t i m e in w h i c h s u c h p e r s o n is
e m p l o y e d in case of b r e a k a g e , e m e r g e n c y , or necessity.
(2) A n y s u c h person Avho is g u i l t y of n e g l i g e n c e in such
e m p l o y m e n t as aforesaid, b y "which a n y p r o p e r t y is destroyed or
d a m a g e d , shall be eruilty of a n o f f e n c e a g a i n s t this A c t .
3 1 . (1) If a n y person c o n t r a v e n e s or fails to c o m p l y w i t h , or
p e r m i t s a n y person to c o n t r a v e n e or fail to comply w i t h a n y provision
of t h i s A c t w i t h r e s p e c t to t h e t i m e for w h i c h persons shall n o t b e
e m p l o y e d beloAV g r o u n d , or to t h e t i m e for w h i c h persons in c h a r g e
of m a c h i n e r y shall n o t be employed, or to t h e e m p l o y m e n t of boys or
females, or t o t h e r e g i s t e r of boys, or to r e p o r t i n g t h e i n t e n d e d
e m p l o y m e n t of boys, h e shall b e g u i l t y of a n offence a g a i n s t this A c t .
(2) And i n t h e e v e n t of a n y s u c h c o n t r a v e n t i o n or n o n ­
c o m p l i a n c e b y a n y person w h o m s o e v e r , t h e o w n e r and m a n a g e r
of t h e m i n e shall each be g u i l t y of a n offence a g a i n s t t h i s A c t , unless
h e proves t h a t h e h a d t a k e n all reasonable m e a n s , b y p u b l i s h i n g a n d
to t h e best of his poAver e n f o r c i n g t h e p r o v i s i o n s of this A c t , to p r e v e n t
t h e contraA'ention o r n o n - c o m p l i a n c e .
(3) N o person shall be d e e m e d to be g u i l t y of a n offence
a g a i n s t t h i s A c t for a c o n t r a v e n t i o n of so m u c h of c i t h e r of t h e tAvo
n e x t p r e c e d i n g sections as relates to t h e t i m e for w h i c h persons shall
n o t be employed below g r o u n d , if s u c h person proves t h a t t h e r e w e r e
special c i r c u m s t a n c e s to r e n d e r s u c h c o n t r a v e n t i o n necessary for t h e
s a f e a n d proper w o r k i n g of t h e m i n e , a n d t h a t s u c h c o n t r a v e n t i o n
Avas n o t injurious to t h e persons so e m p l o y e d in t h e m i n e .
(4) If it appears t h a t a boy Avas e m p l o y e d on t h e false
r e p r e s e n t a t i o n of his p a r e n t or g u a r d i a n t h a t h e w a s of t h e a g e a t
w h i c h his e m p l o y m e n t w o u l d n o t be in c o n t r a v e n t i o n of this xVct, a n d
u n d e r t h e b e l i e f in good faith t h a t h e was of t h a t age, t h e owner or
m a n a g e r of t h e m i n e a n d t h e i m m e d i a t e e m p l o y e r shall he e x e m p t e d
from a n y p e n a l t y , a n d t h e p a r e n t or g u a r d i a n shall for t h e false
r e p r e s e n t a t i o n be deemed g u i l t y of a n offence a g a i n s t this A c t .

PART IV.
INSPECTION AND MANAGEMENT.

DIVISION 1.—Inspection.

32. (1) T h e persons w h o a t t h e c o m m e n c e m e n t of t h i s A c t a r e


a c t i n g as Chief I n s p e c t o r of M i n e s a n d inspectors of m i n e s respectively
a r e h e r e b y a p p o i n t e d respectively t h e Chief I n s p e c t o r of M i n e s a n d
inspectors u n d e r t h i s A c t .
(2) T h e G o v e r n o r m a y a p p o i n t d u l y qualified persons t o b e
inspectors of m i n e s , a n d assign t h e m t h e i r d u t i e s .
( 3 ) E v e r y inspector a p p o i n t e d b y t h e G o v e r n o r shall hold
a certificate of c o m p e t e n c y or of service as m a n a g e r g r a n t e d u n d e r t h i s
A c t or a p p r o v e d b y t h e board of e x a m i n e r s of m a n a g e r s .
33. T h e Governor, b y p r o c l a m a t i o n i n t h e G a z e t t e , m a y a p p o i n t
districts or localities w i t h i n w h i c h t h e powers g i v e n b y t h i s A c t to a n
inspector shall b e exercised b y t h e i n s p e c t o r or inspectors n a m e d
t h e r e i n a n d b y t h e Chief I n s p e c t o r , a n d m a y a m e n d or rescind a n y
such proclamation.
34. N o person w h o practises or acts as or is a p a r t n e r of a n y
p e r s o n w h o practises or acts as a l a n d a g e n t or m i n i n g e n g i n e e r , or as
a m a n a g e r , a g e n t , or v a l u e r of m i n e s , or a r b i t r a t o r i n a n y difference
arising b e t w e e n owners, a g e n t s , or m a n a g e r s of m i n e s , or is otherwise
e m p l o y e d in or a b o u t a n y m i n e , or is a m i n e r ' s a g e n t or a m i n e - o w n e r
shall a c t as a n i n s p e c t o r u n d e r t h i s A c t , a n d n o i n s p e c t o r shall b e a
p a r t n e r or h a v e a n y i n t e r e s t direct or i n d i r e c t i n a n y m i n e i n N e w
S o u t h "Wales.
35. A n y inspector w h o , w i t h o u t t h e consent of t h e o w n e r of
t h e m i n e , divulges or m a k e s k n o w n t o a n y person o t h e r t h a n t h e Chief
I n s p e c t o r , U n d e r Secretary, or M i n i s t e r , e x c e p t as a witness i n a C o u r t
of j u s t i c e , a n y i n f o r m a t i o n o b t a i n e d b y h i m i n t h e discharge of h i s
duties r e s p e c t i n g a n y drift, g u t t e r , lead, vein, lode, reef, or o t h e r
metalliferous or m i n e r a l deposit i n a n y m i n e , e x c e p t w h e r e t h e m i n e
is for t h e t i m e b e i n g a b a n d o n e d , shall b e liable t o a p e n a l t y n o t
e x c e e d i n g fifty p o u n d s , a n d shall b e dismissed from his office.
36. A n i n s p e c t o r m a y do a l l or a n y of t h e following t h i n g s ,
n a m e l y :—-
(a) m a k e s u c h inspection, e x a m i n a t i o n , a n d i n q u i r y as m a y
be necessary t o a s c e r t a i n w h e t h e r in respect of a n y m i n e t h e
provisions of t h i s A c t r e l a t i n g t o m a t t e r s above or below
g r o u n d a r c complied w i t h ;
(b) a t all t i m e s b y d a y a n d n i g h t e n t e r a n y m i n e a n d i n s p e c t
the same and examine and inquire respecting t h e state and
condition a n d v e n t i l a t i o n of t h e m i n e or a n y p a r t thereof,
a n d t h e state a n d c o n d i t i o n of t h e m a c h i n e r y , a n d t h e
sufficiency
sufficiency of t h e special r u l e s (if a n y ) in force t h e r e i n , a n d
all m a t t e r s a n d t h i n g s c o n n e c t e d w i t h or r e l a t i n g to t h e safety
of t h e persons employed i n or a b o u t t h e m i n e or a n y m i n e
c o n t i g u o u s t h e r e t o , or t h e care a n d t r e a t m e n t of t h e horses
a n d o t h e r a n i m a l s used in t h e m i n e ;
(c) exercise s u c h o t h e r powers as m a y b e necessary for c a r r y i n g
t h i s A c t i n t o effect.
E v e r y person w h o wilfully o b s t r u c t s a n y inspector i n t h e
e x e c u t i o n of his d u t y u n d e r t h i s A c t , a n d every o w n e r or m a n a g e r of
a m i n e w h o refuses or n e g l e c t s to f u r n i s h to t h e inspector t h e m e a n s
necessary for m a k i n g a n y e n t r y , inspection, e x a m i n a t i o n , or i n q u i r y
u n d e r this A c t in relation to s u c h m i n e , shall be guilty of a n offence
against this Act.
37. (1) If i n a n y respect n o t provided for by express provision
of this A c t or b y a n y special r u l e a n y inspector finds a n y m i n e or a n y
p a r t thereof, or a n y m a t t e r , t h i n g , or p r a c t i c e in or connected w i t h
such m i n e , or in connection w i t h t h e control, m a n a g e m e n t , or direction
thereof b y t h e m a n a g e r to be d a n g e r o u s or defective, so as in his opinion
to t h r e a t e n or t e n d to injure t h e h e a l t h or t h e b o d y of a n y person, s u c h
i n s p e c t o r shall give notice thereof in w r i t i n g to t h e owner or m a n a g e r
of the m i n e , a n d shall state in s u c h n o t i c e t h e p a r t i c u l a r s in which
h e considers s u c h m i n e or a n y p a r t thereof, or a n y m a t t e r , t h i n g , or
practice, t o b e d a n g e r o u s or defective, a n d r e q u i r e t h e s a m e to hi;
remedied w i t h i n a period n a m e d i n such n o t i c e ; a n d if t h e cause of
d a n g e r is n o t r e m o v e d or if s u c h defect is not remedied w i t h i n t h e period
so n a m e d , t h e inspector m a y t a k e proceedings a g a i n s t the owner or
m a n a g e r for s u c h default, a n d on b e i n g satisfied t h a t s u c h notice was
justified by t h e m a t t e r c o m p l a i n e d of, t h e C o u r t m a y impose on s u c h
owner or m a n a g e r a p e n a l t y n o t e x c e e d i n g fifty p o u n d s , a n d a f u r t h e r
p e n a l t y of five p o u n d s for every day after s u c h decision d u r i n g w h i c h
s u c h notice is n o t complied with.
( 2 ) A copy of every notice as aforesaid shall f o r t h w i t h be
t r a n s m i t t e d b y t h e inspector to t h e M i n i s t e r .
38. I n t h e case of a n y m i n e , in w h i c h n o t less t h a n t w e n t y
persons are employed below g r o u n d , w h e r e a n inspector has given a n y
n o t i c e i n w r i t i n g to t h e o w n e r or m a n a g e r in respect of t h e mode of
c o n d u c t i n g t h e works of s u c h m i n e e i t h e r above or below g r o u n d , or
h a s g i v e n notice of a n y m a t t e r , t h i n g , or p r a c t i c e in or c o n n e c t e d w i t h
s u c h m i n e , or w i t h t h e control, m a n a g e m e n t , or direction thereof which,
in t h e opinion of t h e inspector, t h r e a t e n s or t e n d s to i n j u r e t h e h e a l t h
or body of a n y person, t h e details of such notice shall be entered in

all acts done in conformity w i t h or in c o n s e q u e n c e of a n y such notice

shall

39. W h e r e i n a n y m i n e a n explosion or a c c i d e n t has caused loss
of life or p e r s o n a l injury to a n y p e r s o n , t h e M i n i s t e r shall f o r t h w i t h
direct an inspector to m a k e a special r e p o r t w i t h respect to t h e
explosion or accident, a n d m a y cause t h e r e p o r t to be m a d e p u b l i c a t
s u c h t i m e a n d in s u c h m a n n e r as he m a y t h i n k tit.
40. E v e r y i n s p e c t o r shall m a k e a n a n n u a l report of his
p r o c e e d i n g s d u r i n g t h e p r e c e d i n g y e a r to t h e Chief I n s p e c t o r , w h o
shall r e p o r t to t h e M i n i s t e r , a n d s u c h r e p o r t s , when embodied in t h e
a n n u a l r e p o r t of t h e D e p a r t m e n t of M i n e s , shall be laid before b o t h
H o u s e s of P a r l i a m e n t .

D I V I S I O N 2 . — P l a n s , returns, notices, and abandonment.

41, (1) T h e o w n e r or m a n a g e r of a m i n e a t w h i c h n o t less t h a n


t w e n t y persons a r e employed below g r o u n d w i t h i n t h r e e m o n t h s after
t h e c o m m e n c e m e n t of t h i s A c t in t h e case of a m i n e w o r k i n g a t t h e said
c o m m e n c e m e n t , a n d , in t h e case of a n e w or a b a n d o n e d m i n e , w i t h i n
t h r e e m o n t h s after w o r k h a s c o m m e n c e d in s u c h m i n e , a n d t h e o w n e r
or m a n a g e r of a m i n e a t w h i c h less t h a n t w e n t y p e r s o n s a r e so employed,
on b e i n g ordered so to do b y t h e M i n i s t e r , b y n o t i c e in w r i t i n g , shall
deposit in t h e office a t t h e m i n e a n a c c u r a t e p l a n a n d sections of t h e
w o r k i n g s of such m i n e , m a d e b y a d u l y qualified m i n i n g e n g i n e e r , or
b y a certificated m a n a g e r , or b y a m i n i n g s u r v e y o r a u t h o r i s e d b y t h e
M i n i s t e r , s h o w i n g t h e w o r k i n g s u p to a d a t e n o t m o r e t h a n t h r e e
m o n t h s p r e v i o u s l y , a n d shall p r o d u c e such p l a n a n d sections a t t h e m i n e
to a n y i n s p e c t o r or to a n y o t h e r person d u l y authorised in w r i t i n g b y
t h e M i n i s t e r , and shall, if r e q u e s t e d by a n y such i n s p e c t o r or o t h e r
person, m a r k on such p l a n t h e p r o g r e s s of t h e w o r k i n g s of t h e m i n e u p
lo t h e t i m e of such p r o d u c t i o n , a n d shall allow t h e i n s p e c t o r to e x a m i n e
a n d t a k e a copy or t r a c i n g thereof.
S u c h p l a n shall, u n l e s s t h e M i n i s t e r otherwise p e r m i t s , be d r a w n
to a scale of n o t less t h a n t w o c h a i n s to a n i n c h .
( 2 ) If a n i n s p e c t o r h a s reason to t h i n k t h a t a n y p l a n
p r o d u c e d to h i m as aforesaid is i n c o r r e c t h e s h a l l r e p o r t t h e fact to t h e
M i n i s t e r , who m a y cause a c h e c k s u r v e y to be m a d e ; a n d if t h e r e u p o n
t h e said p l a n proves to be i n c o r r e c t in a n y m a t e r i a l r e s p e c t t h e o w n e r
or m a n a g e r of t h e m i n e shall be liable to p a y all costs a n d c h a r g e s
of m a k i n g s u c h c h e c k s u r v e y , or in c o n n e c t i o n t h e r e w i t h , a n d such
costs a n d c h a r g e s m a y be recovered b y a n y i n s p e c t o r as a line u n d e r
t h i s Act. (3)
( 3 ) IF t h e owner or m a n a g e r of a n y m i n e of w h i c h a p l a n
a n d sections a r e r e q u i r e d to be deposited fails to deposit, or wilfully
refuses to p r o d u c e or allow to be e x a m i n e d or copied, t h e p l a n a n d
sections aforesaid, or wilfully w i t h h o l d s a n y portion thereof, or wilfully
refuses on r e q u e s t to m a r k on such p l a n t h e state of t h e w o r k i n g s of
t h e m i n e , or conceals t h e p l a n or section of a n y p a r t of those w o r k i n g s ,
or produces a n imperfect or i n a c c u r a t e plan or section, h e shall (unless
h e shows t h a t h e was i g n o r a n t of t h e c o n c e a l m e n t , imperfection, or
i n a c c u r a c y ) be g u i l t y of a n offence a g a i n s t t h i s A c t .
(1) A n inspector m a y , b y notice in w r i t i n g ( w h e t h e r a
p e n a l t y for s u c h offence has or has n o t been inflicted), r e q u i r e t h e
o w n e r or m a n a g e r to cause a n a c c u r a t e p l a n a n d sections of t h e
w o r k i n g s to be m a d e a n d deposited a t t h e office a t t h e m i n e w i t h i n a
reasonable t i m e at t h e expense of t h e owner.
If t h e owner or m a n a g e r fails, w i t h i n t h i r t y days or s u c h
f u r t h e r t i m e as m a y be shown to be necessary after t h e requisition of
t h e inspector, to m a k e a n d deposit such p l a n a n d sections, lie shall be
g u i l t y of an offence a g a i n s t this A c t .
42. (1) W h e r e a n y m i n e , of w h i c h a p l a n and sections are
r e q u i r e d u n d e r t h e provisions of this A c t to be deposited, is a b a n d o n e d ,
t h e parson who a t t h e t i m e of a b a n d o n m e n t was t h e o w n e r shall,
w i t h i n t h r e e m o n t h s after s u c h a b a n d o n m e n t , forward to t h e M i n i s t e r
a n a c c u r a t e p l a n a n d sections of t h e w o r k i n g s of such m i n e u p to t h e
t i m e of a b a n d o n m e n t .
( 2 ) If t h e said person fails to c o m p l y w i t h this section, he
shall be g u i l t y of a n offence a g a i n s t this Act, a n d be liable to a fine
n o t exceeding t h i r t y p o u n d s .
( 3 ) A n information for a n offence u n d e r this section m a y
b e laid a t a n y t i m e w i t h i n six m o n t h s after t h e a b a n d o n m e n t of t h e
m i n e , or after service on t h e owner aforesaid of a notice by a n inspector
to c o m p l y w i t h t h e r e q u i r e m e n t s of t h i s section, w h i c h e v e r last h a p p e n s .
43. (1) W h e r e in or a b o u t a n y m i n e , w h e t h e r above or below
g r o u n d , loss of life or a n y personal i n j u r y w h a t e v e r to a n y person
e m p l o y e d in or a b o u t t h e m i n e occurs b y reason of a n y explosion
of gas, or of a n y explosive, or of a n y s t e a m boiler, or b y r e a s o n of a n y
a c c i d e n t whatever, t h e owner or m a n a g e r of t h e m i n e shall, w i t h i n
t w e n t y - f o u r h o u r s n e x t after t h e explosion or accident, send notice in
w r i t i n g of t h e explosion or a c c i d e n t a n d of t h e loss of life or personal
i n j u r y occasioned t h e r e b y to t h e inspector of t h e district, a n d shall
specify in t h e notice t h e c h a r a c t e r of t h e explosion or accident, and
t h e n u m b e r of persons killed or injured, a n d in t h e case of injured
persons a description of t h e injuries.
( 2 ) W h e r e in or a b o u t a n y m i n e , w h e t h e r above or below
g r o u n d , loss of life or serious personal i n j u r y h a s i m m e d i a t e l y resulted
from an explosion or accident, t h e place w h e r e t h e explosion, or accident
occurred
o c c u r r e d s h a l l he left as it w a s i m m e d i a t e l y after t h e explosion or
accident, u n t i l t h e e x p i r a t i o n of a t least t h r e e days after t h e s e n d i n g
of s u c h notice as aforesaid of s u c h explosion or accident, or u n t i l t h e
visit to t h e place b y a n inspector, w h i c h e v e r first h a p p e n s , u n l e s s
c o m p l i a n c e w i t h t h i s e n a c t m e n t would t e n d to increase or c o n t i n u e a
d a n g e r , or w o u l d u n n e c e s s a r i l y i m p e d e t h e w o r k i n g of t h e m i n e .
( 3 ) W h e r e a n y personal injury, of w h i c h notice is r e q u i r e d
to be sent u n d e r this section, r e s u l t s i n t h e d e a t h of t h e person
i n j u r e d , n o t i c e in w r i t i n g of t h e d e a t h shall be sent to a n inspector
w i t h i n t w e n t y - f o u r h o u r s after such d e a t h comes to t h e k n o w l e d g e of
t h e owner, or m a n a g e r .
( 4 ) E v e r y owner or m a n a g e r w h o fails to act in c o m p l i a n c e
w i t h t h i s section shall be g u i l t y of a n offence a g a i n s t t h i s A c t .
44. I n t h e case of a n y m i n e in w h i c h n o t less t h a n t w e n t y
persons are employed below g r o u n d —
(a) w h e r e a n y w o r k i n g is c o m m e n c e d for t h e p u r p o s e of s i n k i n g
a shaft for t h e purpose of o p e n i n g u p a vein, lode, or m i n e r a l
deposit ; or
(b) w h e r e t h e m i n e , or a n y p a r t thereof, is a b a n d o n e d , or t h e
w o r k i n g thereof discontinued ; or
(c) w h e r e t h e w o r k i n g of t h e m i n e , or a n y p a r t thereof, is
r e c o m m e n c e d after a n y a b a n d o n m e n t or d i s c o n t i n u a n c e for a
period e x c e e d i n g t w o m o n t h s ; or
(d) w h e r e a n y c h a n g e occurs in t h e n a m e of s u c h m i n e , or in t h e
n a m e of t h e o w n e r or m a n a g e r of s u c h m i n e , or in t h e p r i n c i p a l
officers of a n y c o m p a n y w h i c h is t h e o w n e r of s u c h m i n e ,
t h e o w n e r or m a n a g e r of t h e m i n e shall give notice thereof to a n
inspector, w i t h i n fourteen d a y s after t h e c o m m e n c e m e n t , a b a n d o n m e n t ,
d i s c o n t i n u a n c e , r e c o m m e n c e m e n t , or c h a n g e ; a n d if s u c h n o t i c e is
n o t given, t h e owner or m a n a g e r shall be g u i l t y of a n offence a g a i n s t
this A c t .
45. (1) W h e r e a n y m i n e is a b a n d o n e d or t h e w o r k i n g thereof
discontinued, at w h a t e v e r t i m e t h e a b a n d o n m e n t or d i s c o n t i n u a n c e
occurred, t h e person w h o , a t s u c h t i m e , w a s t h e owner thereof shall
cause t h e t o p of every shaft a n d every side e n t r a n c e from t h e surface
to be securely p r o t e c t e d for t h e p u r p o s e of p r e v e n t i n g accidents :
(2) If a n y person fails to a c t i n conformity w i t h t h i s section
h e shall b e g u i l t y of a n offence a g a i n s t t h i s A c t .
( 3 ) No person shall be p r e c l u d e d b y a n y a g r e e m e n t from
doing, or be liable u n d e r a n y c o n t r a c t t o a n y d a m a g e s , p e n a l t y , or
forfeiture for d o i n g s u c h a c t s as m a y be necessary i n order to c o m p l y
w i t h t h e provisions of t h i s section.
( 4 ) If a n y occupier of l a n d or o t h e r person wilfully
o b s t r u c t s t h e owner of a m i n e or o t h e r person in d o i n g a n y s u c h acts,
h e shall be g u i l t y of a n offence a g a i n s t t h i s A c t .
(5)
( 5 ) A n y shaft or side e n t r a n c e w h i c h is n o t p r o t e c t e d as
r e q u i r e d b y t h i s section, a n d is w i t h i n fifty y a r d s of a n y h i g h w a y , road,
footpath, or place of p u b l i c r e s o r t , or is i n open or unenclosed l a n d ,
shall be deemed to be a public nuisance.
( 6 ) I f a n y person shall, after a n y shaft or a d i t h a s b e c o m e
disused for m i n i n g purposes, wilfully d a m a g e or r e n d e r useless such
shaft or a d i t b y t h e r e m o v a l of a n y fencing, t i m b e r i n g , slabs, covering,
casing, l i n i n g , ladder, p l a t f o r m , or o t h e r a p p l i a n c e provided in s u c h
shaft or adit, w i t h o u t t h e c o n s e n t in w r i t i n g of t h e M i n i s t e r , h e shall
be g u i l t y of a n offence a g a i n s t t h i s A c t .

DIVISION 3.—Boilers.

46. ( 1 ) O n t h e r e c o m m e n d a t i o n of t h e board of e x a m i n e r s for


engine-drivers t h e M i n i s t e r m a y g r a n t t o a n y i n s p e c t i n g a n d c o n s u l t i n g
e n g i n e e r or b o i l e r - m a k e r a license a u t h o r i s i n g t h e h o l d e r thereof to test
a n d e x a m i n e a n y boiler u s e d or t o b e u s e d a t or i n a n y m i n e , a n d to give
a certificate t h a t h e h a s inspected a n d e x a m i n e d s u c h boiler, a n d t h a t
t h e s a m e is i n good a n d sufficient c o n d i t i o n a n d fit for u s e , a n d m a y
cancel a n y s u c h license if i t is p r o v e d to his satisfaction t h a t t h e person
to w h o m t h e s a m e h a s b e e n g r a n t e d is i n c o m p e t e n t or h a s supplied
a false certificate as t o t h e fitness for u s e of a n y boiler.

( 2 ) I\ o boiler shall b e placed i n position or b u i l t i n a t or
in a n y m i n e before a n inspector of m i n e s or a d u l y licensed i n s p e c t i n g
a n d c o n s u l t i n g e n g i n e e r h a s e x a m i n e d a n d passed it, or before a
certificate h a s been given for t h e boiler as hereinbefore provided.
( 3 ) T h e t e r m " b o i l e r " m e a n s a n y boiler or closed vessel
in w h i c h or by m e a n s of w h i c h w a t e r is h e a t e d to g e n e r a t e steam for
w o r k i n g m a c h i n e r y a t or i n a n y m i n e .

D I V I S I O N 4 . — A c c i d e n t s at mines.

47. W i t h respect to coroners' i n q u e s t s on t h e bodies of p e r s o n s


whose d e a t h m a y h a v e been caused b y explosions or a c c i d e n t s i n or
a b o u t m i n e s , t h e following provisions shall h a v e e f f e c t : —
(a) W h e r e a coroner holds a n i n q u e s t o n t h e b o d y of a n y person
w h o s e d e a t h m a y h a v e b e e n caused b y a n y explosion or
accident, of w h i c h n o t i c e is r e q u i r e d b y this A c t to he given
t o a n inspector, t h e coroner shall a d j o u r n t h e i n q u e s t , unless
a n inspector, or some p e r s o n on behalf of t h e M i n i s t e r , is
p r e s e n t to w a t c h t h e proceedings.
(b) T h e coroner, a t least four days before h o l d i n g t h e adjourned
i n q u e s t , shall send to a n i n s p e c t o r notice i n w r i t i n g of t h e
t i m e a n d place of h o l d i n g t h e a d j o u r n e d i n q u e s t .
(c) T h e coroner, before t h e a d j o u r n m e n t , m a y t a k e evidence to
identify t h e b o d y , a n d m a y order t h e i n t e r m e n t thereof.
(d)
(d) I f a n explosion or a c c i d e n t has n o t occasioned t h e d e a t h of m o r e
t h a n one person, a n d t h e c o r o n e r h a s s e n t t o a n inspector
notice of t h e t i m e a n d p l a c e of h o l d i n g t h e i n q u e s t a t such
t i m e as t o r e a c h t h e i n s p e c t o r n o t less t h a n t w e n t y - f o u r h o u r s
before t h e t i m e of h o l d i n g t h e s a m e , it shall n o t be i m p e r a t i v e
on h i m t o a d j o u r n t h e i n q u e s t in p u r s u a n c e of t h i s section if
t h e m a j o r i t y of t h e j u r y t h i n k it u n n e c e s s a r y so to a d j o u r n .
(e) A n i n s p e c t o r m a y a t a n y s u c h i n q u e s t e x a m i n e a n y witness,
subject n e v e r t h e l e s s t o t h e order of t h e coroner.
(f) W h e r e evidence is g i v e n a t a n i n q u e s t a t w h i c h a n i n s p e c t o r
is n o t p r e s e n t of a n y n e g l e c t as h a v i n g caused or c o n t r i b u t e d
to t h e explosion or accident, or of a n y defect i n or a b o u t t h e
m i n e a p p e a r i n g t o t h e coroner or j u r y t o r e q u i r e a r e m e d y ,
t h e coroner shall send to a n inspector notice i n w r i t i n g of
s u c h n e g l e c t or defect.
(g) A n y p e r s o n h a v i n g a p e r s o n a l i n t e r e s t in, or e m p l o y e d i n , or
i n t h e m a n a g e m e n t of t h e m i n e i n w h i c h t h e explosion or
a c c i d e n t o c c u r r e d , or b e i n g a relative of a n y person w h o s e
d e a t h m a y h a v e b e e n c a u s e d by t h e explosion or accident,
shall n o t be qualified t o serve on t h e j u r y e m p a n e l l e d on
t h e i n q u e s t ; a n d it shall b e t h e d u t y of t h e constable or
o t h e r officer n o t t o s u m m o n a n y p e r s o n disqualified u n d e r
t h i s provision, a n d it shall b e t h e d u t y of t h e c o r o n e r n o t to
allow a n y s u c h person, or a n y p e r s o n w h o , i n t h e o p i n i o n of
t h e coroner, m i g h t e x h i b i t a n i m u s a g a i n s t t h e m i n e owner,
t o b e sworn or t o sit o n t h e j u r y ; n e v e r t h e l e s s , w h e n e v e r it
is p r a c t i c a b l e , one-half of t h e j u r y m e n shall b e m i n e r s .
(h) A n y r e l a t i v e of a n y p e r s o n whose d e a t h m a y h a v e b e e n caused
b y t h e explosion or a c c i d e n t w i t h r e s p e c t t o w h i c h t h e i n q u e s t
is b e i n g held, a n d t h e o w n e r or m a n a g e r of t h e m i n e i n w h i c h
t h e explosion or accident o c c u r r e d , a n d a n y person a p p o i n t e d
b y t h e o r d e r in w r i t i n g of t h e m a j o r i t y of t h e p e r s o n s e m p l o y e d
a t t h e said m i n e , s h a l l b e a t l i b e r t y t o a t t e n d a n d e x a m i n e
a n y witness, e i t h e r i n person or b y h i s counsel, solicitor, or
agent.
E v e r y p e r s o n w h o fails to c o m p l y w i t h t h e provisions of this section
s h a l l b e g u i l t y of a n offence a g a i n s t this A c t .

DIVISION 5.—Lead poisoning.

48. (1) T h e G o v e r n o r m a y m a k e r e g u l a t i o n s for t h e p r e v e n t i o n


of lead poisoning, e i t h e r b y i n h a l i n g t h e finely-powdered lead m i n e r a l
in t h e m i n e or b y i n h a l i n g t h e oxide of lead f u m e s from t h e f u r n a c e s
d u r i n g s m e l t i n g operations, or i n t h e c o n d u c t of a n y o p e r a t i o n in
c o n n e c t i o n w i t h t h e o b t a i n i n g of a n y m e t a l or a n y m i n e r a l o t h e r t h a n
coal
coal or shale, or a n y operations for t h e p u r p o s e of t r e a t i n g t h e
p r o d u c t s of a n y m i n e ; a n d m a y provide t h e r e i n for t h e i r e n f o r c e m e n t
b y penalties n o t exceeding t w e n t y p o u n d s for each offence, a n d in t h e
case of a c o n t i n u i n g offence a f u r t h e r p e n a l t y n o t e x c e e d i n g five
p o u n d s for each day t h a t s u c h offence c o n t i n u e s to be c o m m i t t e d .
( 2 ) S u c h regulations shall, u p o n p u b l i c a t i o n in t h e G a z e t t e ,
be valid in law a n d h a v e effect in such p o r t i o n s of t h e Colony as t h e
G o v e r n o r m a y direct.
( 3 ) Copies of every s u c h r e g u l a t i o n shall be laid before
b o t h H o u s e s of P a r l i a m e n t , if sitting, a n d if n o t sitting, t h e n w i t h i n
f o u r t e e n days after t h e c o m m e n c e m e n t of t h e n e x t session.

P A R T V.
DRAINAGE OF MINES.
49. I n this division, unless t h e c o n t e x t otherwise indicates :—
" A l l u v i a l l e a d " m e a n s deposit of d e t r i t a l origin o c c u p y i n g a n
ancient drainage channel and containing any mineral other
t h a n coal or shale.
" M a c h i n e r y for d r a i n a g e " includes all appliances, i n c l u d i n g
t u n n e l s u s e d or t h a t m a y be used for t h e p u r p o s e of raising,
lifting, or d r a i n i n g •water, w h e t h e r worked b y s t e a m , w a t e r ,
horse, or o t h e r power.
" O w n e r of a n y m a c h i n e r y for d r a i n a g e " includes t h e m o r t g a g e e
in possession.
50. (1) T h e owner of a n y m a c h i n e r y for drainage, w h e t h e r
erected before or after t h e c o m m e n c e m e n t of this A c t u p o n or n e a r to
a n y q u a r t z reef or o t h e r m i n e r a l lode or a n y a l l u v i a l lead or o t h e r
deposit c o n t a i n i n g a n y m i n e r a l o t h e r t h a n coal or shale, m a y r e q u i r e t h e
o w n e r of a n y m i n e t h e w o r k i n g s of w h i c h h a v e reached t h e n a t u r a l
water-level drained b y s u c h m a c h i n e r y to c o n t r i b u t e a fair share of t h e
t o t a l expense of d r a i n i n g or d r a w i n g t h e w a t e r from t h e mines drained
by such machinery.
(2) T h e o w n e r of a n y such m a c h i n e r y a c t u a l l y i n u s e for
r a i s i n g h e a d - w a t e r w h e t h e r erected before or after t h e c o m m e n c e m e n t
of this A c t u p o n or n e a r t o a n y a l l u v i a l lead m a y r e q u i r e t h e o w n e r of
a n y m i n e on t h e same lead or a n y b r a n c h thereof a n d w i t h i n a d i s t a n c e
of t w o miles, t h e w o r k i n g s of w h i c h m i n e h a v e n o t reached t h e n a t u r a l
water-level, a n d w h i c h m i n e is n o t b e i n g worked or in w h i c h m i n e
h e a d - w a t e r is n o t b e i n g raised, to c o n t r i b u t e a fair share of t h e total
expense of raising h e a d - w a t e r b y such m a c h i n e r y .
I n this section " h e a d - w a t e r " m e a n s w a t e r derived from or
a c c u m u l a t e d in or b e t w e e n two or m o r e sheets of volcanic rock or o t h e r
i m p e r v i o u s s t r a t a overlying a n y lead a n d above t h e n a t u r a l water-level
of s u c h lead. (3)
(3) I n default of p a y m e n t of a n y c o n t r i b u t i o n as in t h i s
section provided, or in case of d i s a g r e e m e n t r e s p e c t i n g t h e a m o u n t of
s u c h c o n t r i b u t i o n , t h e o w n e r of s u c h m a c h i n e r y m a y s u m m o n t h e
o w n e r of a n y s u c h m i n e before a w a r d e n , w h o m a y m a k e a n order
o n s u c h o w n e r to p a y s u c h s u m or s u m s periodically or otherwise;
t o t h e o w n e r of s u c h m a c h i n e r y as t h e w a r d e n m a y t h i n k j u s t a n d
reasonable.
(1) T h e w a r d e n m a y in s u c h order impose on t h e o w n e r

thereof for t h e benefit of all p a r t i e s as to s u c h w a r d e n m a y seem j u s t
a n d order t h e s a m e t o h e p e r f o r m e d , or m a y m a k e s u c h o t h e r order
c o n c e r n i n g t h e p r e m i s e s as t h e j u s t i c e a n d e q u i t y of t h e case m a y
d e m a n d , a n d m a y a n n u l , v a r y , or a l t e r a n y order so m a d e .
(5) T h e w a r d e n shall have all t h e powers a n d d u t i e s i n
r e l a t i o n t o proceedings before h i m u n d e r t h i s section as h e h a s u n d e r
t h e M i n i n g A c t , 1874, in r e l a t i o n t o p r o c e e d i n g s before h i m u n d e r
t h a t A c t ; a n d t h e provisions of t h a t A c t r e l a t i n g to proceedings
before a w a r d e n a n d appeals from t h e decision of a w a r d e n to a m i n i n g
a p p e a l court, a n d appeals from s u c h c o u r t to t h e S u p r e m e C o u r t , shall
a p p l y in respect of proceedings before a n d decisions by a w a r d e n u n d e r
t h i s section.
51. (1) T h e e x p e n s e of t h e d r a i n a g e effected by t h e owner of
a n y s u c h m a c h i n e r y shall be arrived a t b y c a l c u l a t i n g —
(a) T h e i n t e r e s t on t h e v a l u e of t h e m a c h i n e r y and p l a n t used for
d r a i n a g e p u r p o s e s only.
(b) T h e w e a r a n d t e a r of s u c h m a c h i n e r y a n d p l a n t .
(c) T h e cost of oil, grease a n d p a c k i n g .
(d) T h e p r o p o r t i o n a t e cost of fuel expended or of horses employed
i n d r a i n a g e operations.
(e) T h e wages of e n g i n e - d r i v e r s a n d of o t h e r persons in s u c h
proportions as s u c h persons m a y be d e e m e d to be e m p l o y e d
i n d r a i n i n g operations ; a n d
(f) S u c h o t h e r e x p e n s e as t h e o w n e r can p r o v e h a s necessarily
b e e n i n c u r r e d in respect of t h e d r a i n a g e effected b y a n y s u c h
machinery.
(2) B u t i n d e t e r m i n i n g s u c h expense, if t h e whole or a n y
p a r t of t h e w a t e r raised b y s u c h m a c h i n e r y is used b y t h e o w n e r of
s u c h m a c h i n e r y for m i n i n g purposes, t h e v a l u e of s u c h w a t e r shall be
ascertained a n d deducted.
52. (1) N o c o n t r i b u t i o n t o w a r d s t h e e x p e n s e of d r a i n a g e shall
b e d e m a n d e d for a n y period d u r i n g suspension of d r a i n i n g operations.
(2) I n d e t e r m i n i n g w h a t a m o u n t of c o n t r i b u t i o n t o w a r d s
t h e e x p e n s e of t h e d r a i n a g e effected b y t h e owner of a n y m a c h i n e r y
shall be paid i n respect of a n y m i n e , r e g a r d shall be h a d to t h e t o t a l
l e n g t h of reef or lode, or t h e e x t e n t of a l l u v i a l lead or o t h e r m i n e r a l
bearing
b e a r i n g deposit affected b y t h e d r a i n i n g operations of s u c h m a c h i n e r y ,
a n d to t h e a m o u n t of t h e benefit derived by t h e owners of m i n e s from
s u c h o p e r a t i o n s ; a n d t h e share to b e c o n t r i b u t e d in respect of each
m i n e d r a i n e d shall be proportioned as nearly as m a y h e to t h e l e n g t h of
s u c h reef or lode, or t h e e x t e n t of s u c h a l l u v i a l lead or o t h e r m i n e r a l
b e a r i n g deposit contained w i t h i n t h e l a n d held, used, or occupied for
m i n i n g purposes, a n d to t h e a m o u n t of benefit so derived.
(3) T h e owners of each m i n e liable so to c o n t r i b u t e shall
receive credit for t h e v a l u e of a n y w o r k t h e y p e r f o r m in assisting to
d r a i n , a n d s u c h value shall be added to t h e g e n e r a l e x p e n s e of drainage.
53. A n y order m a d e b y a w a r d e n i n exercise of t h e jurisdiction
or powers conferred b y t h i s division shall be i n t h e form or to t h e
effect in Schedule O n e , signed b y t h e w a r d e n m a k i n g t h e same,
a n d shall be valid a n d effectual w i t h o u t a n y recital or s t a t e m e n t
to show jurisdiction ; a n d n o order of a w a r d e n u n d e r t h i s division
shall be set aside or declared invalid in a n y C o u r t w h a t s o e v e r for w a n t
of form.
54. (1) W h e r e a n order of a w a r d e n u n d e r this division for
t h e p a y m e n t of m o n e y to t h e o w n e r of a n y m a c h i n e r y for d r a i n a g e
( w h e t h e r s u c h m o n e y was ordered to be paid a t one t i m e or b y instal­
m e n t s ) is unsatisfied in whole or in p a r t , for f o u r t e e n days or u p w a r d s ,
t h e w a r d e n w h o m a d e s u c h order or a n y o t h e r w a r d e n to w h o m a
certified copy of t h e said order is p r o d u c e d m a y on t h e application of
s u c h o w n e r of m a c h i n e r y issue a certificate i n t h e form i n Schedule
Two or to t h e like effect.
(2) S u c h o w n e r of m a c h i n e r y m a y file s u c h certificate w i t h
t h e r e g i s t r a r of a n y m i n i n g a p p e a l c o u r t held w i t h i n t h e m i n i n g district
in w h i c h s u c h order h a s been m a d e , a n d t h e r e u p o n e x e c u t i o n m a y issue
a n d all s u c h proceedings b e h a d a n d t a k e n to enforce p a y m e n t of t h e
m o n e y s m e n t i o n e d in s u c h order as u p o n a n order of t h e said c o u r t .
(3) W h e r e t h e said order of t h e w a r d e n imposes u p o n t h e
o w n e r of m a c h i n e r y a n y t e r m s w i t h r e g a r d to t h e efficient w o r k i n g of
t h e m a c h i n e r y or o t h e r w i s e , s u c h t e r m s m a y b e enforced in t h e same
m a n n e r as orders b y a w a r d e n m a y be enforced u n d e r t h e M i n i n g Act,
1874 ; a n d t h e w a r d e n m a y s u s p e n d t h e issue of t h e certificate afore­
said u n t i l t h e said t e r m s h a v e b e e n carried o u t .
(4) Where s u c h certificate h a s b e e n filed w i t h t h e r e g i s t r a r
of t h e m i n i n g a p p e a l court, a n y m o n e y s d u e u n d e r t h e order m e n t i o n e d
or set o u t i n t h e certificate shall, so l o n g as a n y p a r t thereof r e m a i n s
u n p a i d , b e c o m e a n d be a c h a r g e subject to prior e n c u m b r a n c e s u p o n
t h e estate or i n t e r e s t of t h e owner i n t h e m i n e in r e s p e c t of w h i c h t h e
order was m a d e a n d i n a n y l a n d used or occupied for m i n i n g purposes in
c o n n e c t i o n w i t h s u c h m i n e a n d u p o n all p l a n t a n d m a c h i n e r y t h e r e o n ;
a n d t h e said w a r d e n or a n y o t h e r w a r d e n to w h o m a certified copy of
s u c h certificate is p r o d u c e d m a y b y his order r e s t r a i n t h e sale or o t h e r
disposal
disposal or transfer of s u c h estate, i n t e r e s t , p l a n t , a n d m a c h i n e r y , u n t i l
s u c h m o n e y s h a v e b e e n p a i d ; h u t this provision shall n o t be deemed
in a n y w a y to lessen t h e r i g h t of seizure a n d sale of s u c h m i n e , land,
p l a n t , a n d m a c h i n e r y , u n d e r a n y e x e c u t i o n issued for t h e realisation
of t h e m o n e y s ordered in s u c h w a r d e n ' s order t o be paid.

PART VI.
RULES.

D I V I S I O N 1.— General Rules.

55. T h e following g e n e r a l r u l e s shall, so far as m a y be reason­


a b l y practicable, b e observed i n every m i n e : Provided that the
G o v e r n o r , m a y , b y p r o c l a m a t i o n in t h e G a z e t t e , e x e m p t a n y m i n e or
class of m i n e s from t h e o p e r a t i o n of such rules or a n y of t h e m ; a n d
s u c h e x e m p t i o n m a y b e e i t h e r w i t h o u t conditions, or d u r i n g t h e t i m e
a n d on t h e conditions specified in s u c h p r o c l a m a t i o n :—
(1) (a) A n a d e q u a t e a m o u n t of v e n t i l a t i o n shall b e c o n s t a n t l y
p r o d u c e d i n every m i n e so t h a t t h e shafts, winzes, levels,
u n d e r g r o u n d stables, a n d w o r k i n g - p l a c e s of s u c h m i n e , a n d
t h e t r a v e l l i n g roads to a n d from s u c h w o r k i n g - p l a c e s , shall be
i n a fit s t a t e for w o r k i n g a n d p a s s i n g t h e r e i n .
(b) A l l drives, b y w h i c h a n y t w o m i n e s a r e connected, shall,
if considered necessary b y a n inspector, a n d if a n inspector so
directs, b e k e p t open for v e n t i l a t i o n a n d for escape drives.
(c) W o r k i n g s w h i c h a r e n o t m o r e t h a n t h r e e h u n d r e d feet
a p a r t shall be c o n n e c t e d b y drives w h e r e such drives a r e b y a n
i n s p e c t o r considered necessary for t h e purposes of v e n t i l a t i o n
a n d e s c a p e ; a n d s u c h drives shall b e c o n s t r u c t e d u p o n t h e
order of s u c h inspector a n d a t t h e e x p e n s e of t h e owners of
s u c h w o r k i n g s , or of s u c h of t h e m , a n d i n s u c h p r o p o r t i o n s
as t h e inspector s h a l l direct.
( 2 ) Notwithstanding a n y t h i n g to the contrary contained in the
G u n p o w d e r and E x p l o s i v e Consolidation A c t of 1 8 7 6 , g u n ­
p o w d e r or o t h e r explosive or i n f l a m m a b l e s u b s t a n c e m a y be
stored a n d u s e d in a m i n e b u t shall only be so stored a n d
used as hereinafter p r o v i d e d ( t h a t is to say) :—•
(a) I t shall n o t b e stored in t h e m i n e u n l e s s i n s u c h m a g a z i n e
a n d in such q u a n t i t i e s as m a y in w r i t i n g b e a p p r o v e d of
b y a n i n s p e c t o r of m i n e s .
(b) W i t h o u t s u c h w r i t t e n a u t h o r i t y it s h a l l n o t be stored in t h e
m i n e i n a n y q u a n t i t y e x c e e d i n g w h a t w o u l d be r e q u i r e d
for u s e d u r i n g six w o r k i n g days for t h e p u r p o s e s of t h e
mine;
m i n e ; a n d if stored in t h e m i n e it shall he k e p t in a drive
or c h a m b e r separated by a door from t h e working-places
of t h e m i n e a n d in a position w h i c h a n inspector of mines
approves.
(c) Explosives w h e n t a k e n from a m a g a z i n e for use in t h e
w o r k i n g s shall be conveyed direct to such w o r k i n g s , a n d
shall n o t be t a k e n for use i n t o t h e w o r k i n g s of t h e m i n e
e x c e p t in a securely covered case or canister, of a p a t t e r n a n d
m a k e approved of by a n inspector of mines, each of w h i c h
shall c o n t a i n n o t more t h a n sixteen p o u n d s of g u n p o w d e r
or ten p o u n d s of a h i g h explosive.
(d) All h i g h explosives k e p t for use in a n y m i n e shall be k e p t
in t h e c u s t o d y of t h e m a n a g e r of s u c h m i n e or of such
person as h e m a y a p p o i n t for t h a t p u r p o s e ; a n d if such
m a n a g e r or person issues a g r e a t e r q u a n t i t y of s u c h h i g h
explosive t h a n is reasonably sufficient for use in s u c h m i n e
d u r i n g t h e six days n e x t following t h e t i m e of s u c h issue,
or n e g l i g e n t l y omits to r e t a k e possession of a n y q u a n t i t y of
h i g h explosive n o t so used a t t h e e n d of t h e w e e k ' s w o r k
or w h i c h a t a n y t i m e appears n o t likely to be soon r e q u i r e d ,
or n e g l i g e n t l y p e r m i t s a n y h i g h explosive to be retained,
removed, or disposed of by any o t h e r person, or if a n y person
o t h e r t h a n s u c h m a n a g e r or person r e t a i n s , removes, or
disposes of a n y s u c h h i g h explosive c o n t r a r y to t h e p r o ­
visions of t h i s section, such m a n a g e r or person shall be
liable to a p e n a l t y n o t exceeding fifty pounds, a n d s u c h h i g h
explosive m a y be forfeited.
(e) A w o r k m a n shall n o t h a v e in his possession a t one t i m e a t
a n y one place m o r e explosive t h a n is r e q u i r e d for u s e on
t h e shift on w h i c h h e is e m p l o y e d , a n d e x c e p t when a c t u a l l y
i n u s e for purposes of c h a r g i n g , explosives shall be placed
in a safe position, a n d so t h a t t h e y c a n n o t be s t r u c k b y
a n y m a t e r i a l t h r o w n o u t from t h e face.
(f) N o p e r s o n shall e n t e r w i t h a n a k e d l i g h t a powder m a g a z i n e
or a n y e x c a v a t i o n or place in a m i n e w h e r e powder or o t h e r
explosive or inflammable s u b s t a n c e is stored.
(g) N o iron or steel t a m p i n g bar shall be used in a n y m i n e in
c h a r g i n g , t a m p i n g , or r a m m i n g , a n d no iron or steel p r i c k e r
or t a m p i n g b a r shall be t a k e n i n t o a n y m i n e , a n d w h e r e a
h i g h explosive is used only wooden r a m m e r s shall be used
in c h a r g i n g .
(h) N o boy shall he allowed to h a n d l e explosives or c h a r g e a
hole w i t h explosives or to fire a n y c h a r g e of explosives.
(i) N o drill hole shall be bored in a n y r e m a i n i n g portion of a
hole in which a c h a r g e of high explosive has been previously
exploded. (j)
(j) I n all cases w h e r e t h e fumes arising from t h e explosion
of a n y h i g h explosive c a n n o t h e effectively dispersed b y
v e n t i l a t i o n or spray of w a t e r from t h e m i n e , s u c h f u m e s
shall be n e u t r a l i z e d or rendered i n n o c u o u s b y t h e person in
c h a r g e of t h e b l a s t i n g operations b y t h e u s e of a s p r a y of
solution of s u l p h a t e of iron before a n y p e r s o n is p e r m i t t e d
to r e t u r n to t h e sites of s u c h b l a s t i n g operations.
(k) P e r s o n s employed in b l a s t i n g w i t h h i g h explosives shall,
w h e n considered necessary i n t h e opinion of a n inspector,
b e supplied by t h e o w n e r or m a n a g e r w i t h t h e m e a n s of
t h a w i n g s u c h c o m p o u n d s , a n d w i t h t h e m e a n s of p r o d u c i n g
s u l p h a t e of i r o n s p r a y w h e n necessary.
(1) A n a c c u r a t e record shall be k e p t b y every person w h o is
c h a r g i n g a hole for b l a s t i n g , of t h e distance from t h e o u t e r
end of the c h a r g e to t h e collar of t h e hole. A c h a r g e of
p o w d e r or o t h e r explosive w h i c h h a s missed fire shall n o t
be d r a w n ; b u t t h e t a m p i n g shall be carefully r e m o v e d to
a d e p t h d i s t a n t n o t m o r e t h a n t w e l v e , a n d n o t less t h a n
six, i n c h e s from t h e o u t e r e n d of t h e c h a r g e ; a n d a fresh
c h a r g e , or fresh c h a r g e s , shall b e inserted for t h e purpose
of e x p l o d i n g t h e original c h a r g e , till t h e s a m e be exploded ;
a n d n o hole s h a l l be bored in t h e n e i g h b o u r h o o d of a n
u n e x p l o d e d c h a r g e for t h e purposeof e x p l o d i n g it b y m e a n s
of t h e explosion of a c h a r g e in t h e n e w hole.
(m) I n t h e e v e n t of t h e b o t t o m of a hole in w h i c h a b l a s t h a s
been exploded r e m a i n i n g in a n y w o r k i n g - p l a c e , t h e n , u n l e s s
or u n t i l it c a n be clearly seen b y two persons, one of w h o m ,
a t least, is a n official of t h e m i n e , t h a t n o explosive r e m a i n s
u n e x p l o d e d i n s u c h b o t t o m , no w o r k , w h e t h e r of boring,
b a r r i n g d o w n ( e x c e p t so far as m a y be absolutely necessary
i n order to m a k e it safe to a p p r o a c h such b o t t o m ) , p i c k i n g ,
or otherwise, s h a l l be done in s u c h place, u n t i l s u c h b o t t o m
h a s b e e n b r o k e n a w a y a n d completely exposed b y a f u r t h e r
c h a r g e or f u r t h e r c h a r g e s inserted t h e r e i n ; b u t , for t h e
p u r p o s e of inspection, s u c h b o t t o m s h a l l be carefully
cleaned out, w a t e r b e i n g freely used therein, before b e i n g
finally proved to c o n t a i n n o explosive. This r u l e shall
a p p l y to all " o l d b o t t o m s , " w h e r e v e r f o u n d .
(n) I n t h e e v e n t of a " miss-fire," n o person shall, e x c e p t i n
t h e case of a c h a r g e fired b y a n electric c u r r e n t , r e t u r n to
w i t h i n a distance from t h e c h a r g e w h i c h would bo unsafe
i n t h e e v e n t of its e x p l o d i n g u n t i l t h e e x p i r a t i o n of one
h o u r a n d a half from t h e t i m e of t h e l i g h t i n g of t h e fuse :
P r o v i d e d t h a t , if t h e p e r s o n whose d u t y it was to l i g h t t h e
fuse
fuse h a s good reason to believe, a n d does i n fact believe,
t h a t h e o m i t t e d t o l i g h t it, t h e n h e only m a y r e t u r n w i t h i n
t h i r t y m i n u t e s . A " b u l l e d " hole shall n o t b e r e c h a r g e d
w i t h i n tAvo h o u r s of t h e t i m e of explosion of t h e " b u l l i n g "
charge, unless it is t h o r o u g h l y w a s h e d or swabbed o u t w i t h
w a t e r , a n d unless, after t h e hole is cleaned out, a m e t a l
rod inserted a n d left t h e r e i n for a t least live m i n u t e s is at
no p o i n t h o t to t h e t o u c h ; i n w h i c h case t h e hole m a y b e
recharged within thirty minutes.
(o) N o blast shall he fired u n d e r s u c h c i r c u m s t a n c e s t h a t t h e
life or lives of a n y p e r s o n or persons m a y b e e n d a n g e r e d
thereby.
( 3 ) I n t h e case of a n y m i n e in w h i c h n o t less t h a n t w e n t y
persons are ordinarily employed below g r o u n d , i m m e d i a t e l y
u p o n it b e c o m i n g k n o w n at t h e office a t t h e m i n e t h a t a n y
a l t e r a t i o n or c h a n g e has been m a d e i n t h e composition of a n y
o n - c o m i n g shift, or how a n y u n c e r t a i n t y in t h a t respect h a s
b e e n settled, full p a r t i c u l a r s of s u c h a l t e r a t i o n or c h a n g e , or
s e t t l e m e n t , shall, w i t h all possible despatch, b e c o m m u n i c a t e d
to t h e m e m b e r s of t h e p a r t y u n d e r g r o u n d .
(4) After t h e last shot has been fired i n a n y w o r k i n g - p l a c e , a n d
before a n y relief of shift, a c o m p e t e n t person b e i n g a
m e m b e r of t h e p a r t y tiring s u c h shot shall, except in t h e case
of a miss-fire, carefully inspect t h e face of s u c h place.
I n t h e e v e n t either of a n y d a n g e r b e i n g found to exist,
or of a shot m i s s i n g fire, t h e fact shall be r e p o r t e d to t h e
relieving shift before it comes to t h e face.
T h e m e m b e r s of a relieved p a r t y shall, on proof of
failure to m a k e t h e inspection or t h e report r e q u i r e d as afore­
said, each b e g u i l t y of a n offence a g a i n s t this A c t , a n d be liable
to a p e n a l t y of n o t less t h a n t w o p o u n d s , n o t w i t h s t a n d i n g t h a t
s u c h failure is t h e w r o n g f u l act or omission of a m e m b e r
or m e m b e r s of s u c h p a r t y to w h o m t h e o t h e r m e m b e r or
m e m b e r s h a v e e n t r u s t e d t h e d u t y of m a k i n g s u c h r e p o r t or
inspection.
( 5 ) T h e m a n a g e r of every m i n e , or such c o m p e t e n t person or
p e r s o n s as h e m a y a p p o i n t for the purpose, shall, once a t
least i n every t w e n t y - f o u r h o u r s , e x a m i n e t h e s t a t e of all
safety a p p l i a n c e s or gear connected w i t h t h e cages or shafts
of t h e m i n e , and shall once in each week carefully e x a m i n e
t h e b u i l d i n g s , m a c h i n e r y , shafts, levels, planes, a n d all places
used in t h e w o r k i n g of s u c h m i n e , a n d shall record in w r i t i n g
i n a book to b e k e p t on t h e m i n e for t h a t purpose his opinion
as to t h e i r condition a n d safety, a n d as t o a n y repairs or
alterations
a l t e r a t i o n s r e q u i r e d to i n s u r e g r e a t e r safety to t h e persons
employed in t h e w o r k i n g of s u c h m i n e ; a n d s u c h hook shall
on d e m a n d he o p e n to p e r u s a l b y a n y i n s p e c t o r ; a n d every
s u c h safety a p p l i a n c e or gear if c o n d e m n e d b y a n y inspector
shall be forthwith r e m o v e d or m a d e fit.
( 6 ) (a) If a t a n y t i m e it is found b y t h e person, for t h e t i m e being,
in c h a r g e of t h e m i n e , or a n y p a r t thereof, t h a t by reason of
a n y cause w h a t e v e r , t h e m i n e or t h a t p a r t is d a n g e r o u s , every
w o r k m a n shall b e w i t h d r a w n from t h e m i n e or p a r t so found
d a n g e r o u s , a n d a c o m p e t e n t person appointed for t h e p u r p o s e
b y t h e o w n e r or m a n a g e r shall i n s p e c t t h e m i n e or p a r t so
found d a n g e r o u s , a n d if t h e d a n g e r arises from i n f l a m m a b l e
gas, shall inspect t h e m i n e or p a r t w i t h a locked safety-lamp ;
a n d in every case shall m a k e a t r u e r e p o r t of t h e condition of
t h e m i n e or p a r t ; a n d a w o r k m a n shall not, e x c e p t i n so
far as is necessary for i n q u i r i n g into t h e cause of d a n g e r or
for t h e r e m o v a l thereof, or for exploration, be r e a d m i t t e d i n t o
t h e m i n e , or p a r t so found d a n g e r o u s , u n t i l t h e same is s t a t e d
b y t h e p e r s o n appointed as aforesaid n o t to be d a n g e r o u s .
E v e r y such r e p o r t shall be recorded in a book w h i c h for t h e
purpose shall be k e p t o n t h e m i n e a n d accessible to w o r k m e n ,
a n d shall be signed b y t h e person w h o m a k e s t h e i n s p e c t i o n .
(b) If a n y m i n e or a n y p a r t thereof is considered unsafe b y
t h e person or persons w o r k i n g t h e r e i n , t h e persons w o r k i n g
i n s u c h m i n e m a y , a t t h e i r own cost, a p p o i n t t w o c o m p e t e n t
persons to e x a m i n e a n d inspect t h e w o r k i n g s of such m i n e b y
g i v i n g t w e n t y - f o u r h o u r s ' notice to t h e m a n a g e r (who m a y , if
h e t h i n k s fit, a c c o m p a n y t h e m ) , a n d all persons in t h e m i n e
shall afford every facility for s u c h inspection, a n d t h e persons
so a p p o i n t e d shall record t h e results of s u c h inspection i n a
book to be k e p t a t t h e m i n e for t h e purpose, a n d t h e r e p o r t
shall b e signed by t h e persons i n s p e c t i n g . A n d if t h e r e p o r t
states t h e existence or a p p r e h e n d e d existence of a n y d a n g e r ,
t h e o w n e r or m a n a g e r shall f o r t h w i t h cause a t r u e copy of
t h e r e p o r t to be sent to t h e inspector of t h e district.
(7) N o person u n d e r t h e a g e of t w e n t y - o n e y e a r s shall be placed
in c h a r g e of or h a v e t h e c o n t r o l of a n y w i n d i n g e n g i n e , a n d
no boy shall b e placed in c h a r g e of or h a v e t h e c o n t r o l of
a n y o t h e r s t e a m e n g i n e or boiler u s e d i n c o n n e c t i o n w i t h
t h e w o r k i n g of a n y m i n e . N o person in c h a r g e of s t e a m
m a c h i n e r y in connection w i t h t h e w o r k i n g of any m i n e shall,
u n d e r any p r e t e x t w h a t e v e r unless relieved b y a p r o p e r l y
qualified a n d c o m p e t e n t person, a b s e n t himself or cease to
h a v e c o n t i n u a l supervision of s u c h m a c h i n e r y d u r i n g t h e
t i m e it is a c t u a l l y used in w o r k i n g t h e m i n e , a n d every
winding
w i n d i n g e n g i n e shall he in c h a r g e of a p r o p e r l y qualified
e n g i n e - d r i v e r d u r i n g t h e t i m e m i n e r s are e m p l o y e d u n d e r ­
g r o u n d in t h e m i n e unless in any case a n i n s p e c t o r certifies
in w r i t i n g t h a t t h e u n d e r g r o u n d w o r k i n g s are so shallow t h a t
t h e services of such a n engine-driver are not necessary.
(8) All boilers, compressors, engines, g e a r i n g a n d all o t h e r p a r t s
of m a c h i n e r y , w h e n used for a n y m i n i n g p u r p o s e , or for t h e
t r e a t m e n t of ores, or for t h e t r e a t m e n t of t h e p r o d u c t s of a n y
m i n e , shall be k e p t in a fit state a n d condition for work, to
t h e satisfaction of a n inspector.
(9) E v e r y fly-wheel, a n d all exposed or d a n g e r o u s p a r t s of t h e
m a c h i n e r y , a n d every t r a m w a y c o n s t r u c t e d on a n elevated
p l a t f o r m a n d n o t w o r k e d b y ropes shall he, a n d be kept,
securely fenced.
(10) (a) E v e r y s t e a m - b o i l e r c o m i n g into use after t h e c o m m e n c e ­
m e n t of t h i s A c t shall be provided w i t h a proper s t e a m - g a u g e
and t w o w a t e r - g a u g e s , to show, respectively, t h e p r e s s u r e of
s t e a m a n d t h e h e i g h t of w a t e r in t h e boiler, a n d w i t h t w o
p r o p e r safety-valves, one of w h i c h shall he locked.
(h) A t least once in every six m o n t h s every boiler shall be
t h o r o u g h l y cleansed, a n d once in every t w e l v e m o n t h s such
boiler shall be subjected to a n e x a m i n a t i o n a n d h y d r o s t a t i c
t e s t b y a c o m p e t e n t a n d properly qualified p e r s o n ; t h e test
of w o r k i n g boilers shall be e q u a l to o n e a n d a half times t h e
pressure a t which t h e safety-valve blows off, a n d t h a t of n e w
boilers double t h e i n t e n d e d w o r k i n g pressure.
(c) Air-receivers shall be tested once in t w e l v e m o n t h s to
o n e - t h i r d over t h e allowed w o r k i n g p r e s s u r e .
(d) S t e a m - g a u g e s shall be tested a n d adjusted once in t w e l v e
m o n t h s , a n d no g a u g e shall be passed w h i c h varies m o r e t h a n
five p o u n d s from t h e s t a n d a r d gauge.
(e) T h e d a t e a n d full description of every s u c h cleansing
a n d test u n d e r t h i s rule, a n d of a n y repairs t o or a l t e r a t i o n s
i n a n y boiler, air receiver, or g a u g e , shall be entered in a book
(to be k e p t on t h e m i n e ) b y t h e e n g i n e e r in c h a r g e , or b y t h e
m a n a g e r w h e r e no s u c h e n g i n e e r is employed on t h e m i n e , or
b y a n engine-driver or b r a c e m a n , a n d t h e entries in s u c h book
shall, on d e m a n d , be open to p e r u s a l b y a n y inspector.
(11) T h e s m o k e from every boiler for g e n e r a t i n g steam, a n d from
every furnace used in a n y p a r t of t h e u n d e r g r o u n d w o r k i n g s
of a m i n e , shall n o t be allowed to escape into a n y p a r t of
such w o r k i n g s , nor in a n y m a n n e r o t h e r t h a n b y m e a n s of a n
a i r - t i g h t flue c o n d u c t i n g such smoke directly from t h e boiler

or f u r n a c e i n t o a shaft c u t in t h e rock u p to t h e surface
of t h e g r o u n d to t h e o p e n air, or b u i l t u p to t h e surface as
aforesaid, i n s u c h m a n n e r as to be completely a i r - t i g h t .
(12) E v e r y w o r k i n g shaft i n w h i c h a cage is used, a n d every
division of s u c h shaft in w h i c h persons a r c raised and lowered,
a n d every shaft in w h i c h appliances worked b y s t e a m m a c h i n e r y
a r c used, shall be provided w i t h guides a n d some proper m e a n s
of c o m m u n i c a t i n g d i s t i n c t a n d definite s i g n a l s —
(a) from t h e b o t t o m of t h e shaft a n d from a n d b e t w e e n
every e n t r a n c e for t h e t i m e b e i n g in w o r k b e t w e e n t h e
t o p a n d t h e b o t t o m of t h e shaft to t h e t o p , a n d t h e n c e
to the engine-room; and
(b) from t h e e n g i n e - r o o m a n d top to t h e b o t t o m of t h e
shaft, a n d to a n d b e t w e e n every e n t r a n c e for t h e t i m e
b e i n g in w o r k b e t w e e n t h e t o p a n d t h e b o t t o m of t h e
shaft.
S u c h s i g n a l line shall be so b a l a n c e d as to be casiiy
w o r k e d b y h a n d w i t h o u t t h e aid of a lever.
N o verbal signals or c o m m u n i c a t i o n s shall be m a d e up
or d o w n a shaft e x c e e d i n g t w e n t y y a r d s i n d e p t h in w h i c h
cages are used except t h r o u g h s p e a k i n g t u b e s or telephones
in a c o m p a r t m e n t of s u c h shaft n o t u s e d for hoisting.
A line or some o t h e r a p p l i a n c e shall be provided in
each shaft to a d m i t of d a n g e r signals b e i n g c o m m u n i c a t e d to
t h e e n g i n e - d r i v e r from a n y p o r t i o n of s u c h shaft.
(13) A clear view shall b e k e p t for t h e e n g i n e - d r i v e r b e t w e e n his
s t a t i o n a n d t h e shaft or t u n n e l or adit a t t h e surface e n t r a n c e
a n d brace.
(14) W h e n e v e r a n y u n d e r g r o u n d w o r k is b e i n g performed in
a l l u v i a l m i n e s at g r e a t e r distances t h a n t w o h u n d r e d feet
from t h e shafts, p r o p e r m e a n s shall be p r o v i d e d for com­
m u n i c a t i n g a l o n g t h e lower drives of s u c h mines, distinct a n d
definite signals to a n d from t h e plats a t t h e b o t t o m of t h e shafts,
a n d to a n d from places in w h i c h m e n m a y be a t work.
(15) E v e r y u n d e r g r o u n d p l a n e on w h i c h persons travel w h i c h is
self-acting or w o r k e d b y a n engine, windlass, w h i m , w h i p
or g i n shall be provided (if e x c e e d i n g t h i r t y y a r d s i n l e n g t h )
w i t h some p r o p e r m e a n s of signalling b e t w e e n t h e s t o p p i n g
places a n d t h e ends of t h e p l a n e , a n d shall b e provided in
e v e r y case a t i n t e r v a l s of n o t m o r e t h a n t w e n t y y a r d s w i t h
m a n - h o l e s for places of refuge of s u c h size a n d n u m b e r as
a n i n s p e c t o r m a y d e e m sufficient.
(10) E v e r y person employed in a m i n e shall m a k e himself
a c q u a i n t e d w i t h t h e s y s t e m s a n d codes of signals provided in
s u c h m i n e i n accordance w i t h t h e s e rules.
(17)
(17) T h e code of signals to be used in a n y m i n e or class of m i n e s
shall be s u c h as m a y be prescribed b y t h e M i n i s t e r ,
( 1 8 ) E v e r y road on which persons t r a v e l u n d e r g r o u n d w h e r e t h e
p r o d u c e of t h e m i n e in t r a n s i t exceeds t e n t o n s in a n y
o n e h o u r over a n y p a r t thereof, a n d w h e r e t h e load is d r a w n
b y a horse or o t h e r a n i m a l , shall be provided a t i n t e r v a l s of
n o t m o r e t h a n one h u n d r e d y a r d s w i t h sufficient spaces or
places of refuge, each of w h i c h shall he of sufficient l e n g t h
a n d of a t least t h r e e feet i n w i d t h b e t w e e n t h e w a g g o n s
r u n n i n g on t h e t r a m r o a d a n d t h e side of t h e road.
(19) W h e n a shaft is b e i n g s u n k in rock f o r m a t i o n , a n d b l a s t i n g
operations a r e necessary, s h o r t cross-drives or m a n - h o l e s
shall be formed a t d e p t h s of every t w o h u n d r e d feet for use
b y m i n e r s as places of refuge d u r i n g t h e o c c u r r e n c e of blasts,
a n d access to such m a n - h o l e s shall lie provided b y t h e u s e of
suitable ladders from t h e b o t t o m of t h e shaft to t h e surface
affording access to each m a n - h o l e .
( 2 0 ) E v e r y m a n - h o l e a n d space for a place of refuge shall be
c o n s t a n t l y k e p t clear, a n d n o p e r s o n shall so place a n y t h i n g
i n a m a n - h o l e or s u c h space as to p r e v e n t access t h e r e t o .
( 2 1 ) A l l e n t r a n c e s b e t w e e n t h e b o t t o m of every w o r k i n g or
p u m p i n g shaft a n d t h e p o p p e t - h e a d p u l l e y wheels, a n d all
elevated p l a t f o r m s w h e r e b a r s or a u t o m a t i c or safety doors
are erected or self-acting c a t c h e s are used, shall be p r o p e r l y
a n d securely fenced, railed, or covered, b u t t h i s provision
shall n o t be t a k e n to forbid t h e t e m p o r a r y r e m o v a l of a n y
fence or cover for t h e purpose of repairs or o t h e r operations if
p r o p e r p r e c a u t i o n s a r e u s e d ; a n d every a b a n d o n e d or disused
shaft or d a n g e r o u s e x c a v a t i o n shall be fenced or securely
covered in b y t h e o w n e r or m a n a g e r , a n d t h e position of s u c h
covered shaft shall be i n d i c a t e d on t h e surface b y a post with
a notice t h e r e o n affixed.
( 2 2 ) A t all plats w h e r e h a u l i n g operations are carried on, doors
or some o t h e r approved a p p l i a n c e shall b e fixed. I n t h e case
of doors a lever or h a n d l e s h a l l b e a t t a c h e d w h e r e b y t h e said
doors c a n be safely lowered i n t o position or raised w i t h o u t
possible d a n g e r to t h e person p e r f o r m i n g t h e d u t y .
( 2 3 ) W h e n a fence or cover h a s b e e n t e m p o r a r i l y r e m o v e d from
a n y e n t r a n c e to a shaft to a d m i t of t h e p e r f o r m a n c e of
o r d i n a r y m i n i n g operations, t w o s t r o n g horizontal b a r s shall
be securely fixed across s u c h e n t r a n c e n o t less t h a n t w o n o r
m o r e t h a n four feet from t h e floor of t h e brace c h a m b e r or
drive, as t h e case m a y be.
( 2 4 ) E v e r y w o r k i n g or p u m p i n g shaft shall be securely cased,
lined, or otherwise m a d e secure ; for which purpose a n a m p l e
s u p p l y of sound t i m b e r if necessary shall be k e p t on t h e
g r o u n d r e a d y for u s e . • (25)
(25) E v e r y drive a n d every e x c a v a t i o n of a n y k i n d i n c o n n e c t i o n
w i t h t h e w o r k i n g of a m i n e shall he securely p r o t e c t e d a n d
m a d e safe for persons e m p l o y e d t h e r e i n .
(2G) S u i t a b l e l i g h t s effectually p r o t e c t e d from d r a u g h t s of air
shall be provided for t h e use of persons in every w o r k i n g
p l a t a n d in t h e m a i n drives of a n y m i n e ; a n d t h e u p p e r
e n t r a n c e to every winze, rise, or j u m p - u p , while open or
u n f e n c e d , shall be i l l u m i n a t e d b y a fixed light.
(27) W h e r e one portion of a shaft is used for t h e a s c e n t a n d

descent of persons by ladders or a m a n - e n g i n e a n d a n o t h e r
p o r t i o n of t h e s a m e shaft is used for raising m a t e r i a l , t h e
first-mentioned p o r t i o n shall be cased or otherwise securely
fenced off from t h e l a s t - m e n t i o n e d portion, a n d w h e r e t h e
shaft exceeds one h u n d r e d feet in d e p t h , shall h a v e a division
between buckets ascending and descending.
( 2 8 ) (a) E v e r y shaft e x c e e d i n g t w o h u n d r e d feet in d e p t h w h e r e
e n g i n e power is used for w i n d i n g shall be provided w i t h a
cage, a n d s u c h cage shall h a v e a sufficient cover overhead
w h e n u s e d for l o w e r i n g or raising persons i n a n y w o r k i n g
s h a f t ; such c a g e cover shall b e a t least six feet six inches
above t h e floor of t h e cage, a n d shall be c o n s t r u c t e d of iron
n o t less t h a n t h r e e - s i x t e e n t h s of an i n c h or of steel n o t less
t h a n o n e - q u a r t e r of a n i n c h t h i c k , a n d shall be securely
h u n g on h i n g e s a n d fitted w i t h sloping sides so as to be

readily lifted u p w a r d s b y persons w i t h i n t h e cage.
(b) N o tools, iron, t i m b e r , rails, sprags, or o t h e r m a t e r i a l , or
explosives shall be t a k e n u p or down t h e shaft i n t h e s a m e
cage w i t h a n y p e r s o n : P r o v i d e d t h a t this shall n o t be held
t o p r e v e n t t h e person h a v i n g t h e custody of a n explosive or
explosives from r i d i n g in t h e s a m e cage w i t h s u c h e x p l o s i v e '
or explosives.
(c) E x c e p t when, a shaft is b e i n g repaired, all persons w o r k i n g
or b e i n g lowered or raised t h e r e i n shall be p r o t e c t e d o v e r h e a d
from falls of m a t e r i a l d o w n s u c h shaft b y m e a n s of a roof or
other suitable appliance.
(d) N o t h i n g in t h i s r u l e contained shall p r e v e n t t h e use of
b u c k e t s or skips d u r i n g t h e s i n k i n g of shafts or winzes or for
r a i s i n g or lowering m i n i n g m a t e r i a l , m i n e p r o d u c t s , or debris.
(29) (a) E v e r y cage used in a m i n e shall be fitted w i t h special
a n d s u i t a b l e a p p l i a n c e s to p r e v e n t its s u d d e n fall, d o w n a
•baft, a n d also a safety hook w i t h suitable d e t a c h i n g a p p l i a n c e s
f i x e d to t h e p o p p e t h e a d s to p r e v e n t it c o m i n g i n t o c o n t a c t
w i t h t h e p o p p e t h e a d s ; a n d n o safety hook shall b e used t h a t
will n o t s u s p e n d a cage at t h e p o p p e t h e a d w h e n d e t a c h e d
from t h e ropes. (b)
(b) A l l d e t a c h i n g a n d s u s p e n d i n g hooks a n d safety catches
shall, a t least once in every m o n t h , he t a k e n to pieces,
e x a m i n e d , cleaned, a n d oiled by a c o m p e t e n t person, w h o shall
record t h e fact in a book to b e k e p t a t t h e m i n e for t h e p u r p o s e .
(c) T h e r e shall be n o t less t h a n t e n feet of c l e a r a n c e between
t h e d e t a c h i n g hooks a n d t h e point of d e t a c h m e n t w h e n t h e
cages a r e a t t h e l a n d i n g .
(30) N o safety-cage shall be used at a n y m i n e unless a n d u n t i l
it h a s been tested b y t h e m a n a g e r , in t h e presence of a n
inspector, if available, a n d proved to his satisfaction to be
supplied w i t h proper appliances, a n d to be i n fit w o r k i n g
order a n d condition ; t h e m a n a g e r or e n g i n e e r in c h a r g e at
t h e m i n e shall test t h e cages from t h e d r u m s a t least once in
every m o n t h a n d e n t e r t h e r e s u l t in t h e record book to be
k e p t a t t h e m i n e for t h e p u r p o s e .
(31) Before a n y rope or c h a i n is used in t h e shaft of a m i n e it
shall be tested a t t h e m i n e , a n d proved to b e e q u a l t o c a r r y i n g
twice t h e w e i g h t of t h e o r d i n a r y load w h i c h shall consist of
t h e cage t r u c k a n d c o n t e n t s a n d w e i g h t of r o p e from b o t t o m
of shaft to p i t - h e a d pulley, a n d t h e w o r k i n g load shall n o t
lie m o r e t h a n one-eighth of t h e b r e a k i n g s t r a i n of rope, a n d
i n m i n e s w h e r e m e n are lowered or raised in shafts t h e ropes
a n d c h a i n s used for s u c h p u r p o s e s shall a t s u c h i n t e r v a l s as
a n inspector m a y r e q u i r e be tested to carry twice t h e w e i g h t of
t h e ordinary load. Before a n y ropes ( i n c l u d i n g c a p s t a n ropes)
are used for w i n d i n g in a m i n e t h e owner or m a n a g e r shall
o b t a i n a certificate from t h e m a n u f a c t u r e r or his a g e n t showing
t h e i r b r e a k i n g strain, a n d s u c h certificates shall be available
a t t h e office a t t h e m i n e for t h e perusal of t h e inspector.
(32) Gates or some o t h e r a p p r o v e d a p p l i a n c e shall b e used in all
shafts w h e r e h a u l i n g is done w i t h cages. S u c h gates shall
b e secured to t h e sole plates of t h e p l a t sets, so t h a t t h e y can
be easily placed over t h e shaft a n d raised w i t h o u t a n y t r o u b l e ,
a n d shall be fixed to t h e satisfaction of a n inspector.
(33) W h e n chains are employed as couplings to cages or t a n k s ,
t w o single-linked c h a i n s of u n i f o r m size shall be used to each
coupling.
(31) T h e r e shall be a t t a c h e d to every m a c h i n e w o r k e d by steam,
w a t e r , or m e c h a n i c a l power erected after t h e c o m m e n c e m e n t of
this A c t a n d used for l o w e r i n g or raising persons, if considered
necessary by a n inspector, a n a d e q u a t e b r a k e or other
sufficient appliance in addition to t h a t on t h e fly-wheel, fitted
to e a c h w i n d i n g d r u m in s u c h a m a n n e r t h a t it can be applied
by t h e engine-driver w i t h o u t l e a v i n g t h e s t a r t i n g h a n d l e of
the
t h e e n g i n e , a n d also a dial or indicator (in addition t o a n y
m a r k on t h e rope) to show to t h e person w h o w o r k s t h e
m a c h i n e t h e position of each of t h e cages or loads i n t h e shaft.
(35) W h e n m e n are b e i n g lowered or raised in a n y shaft b y m e a n s
of m a c h i n e r y t h e r a t e of speed for t h e descent or ascent
w i t h i n fifty feet of t h e surface or b o t t o m , as t h e case m a y be,
shall n o t exceed t h r e e h u n d r e d feet i n each m i n u t e of t i m e .
(36) I n a n y shaft e x c e e d i n g t w e n t y feet in d e p t h i n w h i c h cages
are n o t used, n o person s h a l l descend or ascend b y t h e aid of
m a c h i n e r y unless, in addition to t h e use of t h e loop, crossbar,
or o t h e r a p p l i a n c e , h e is securely stayed to t h e rope employed
for l o w e r i n g or raising in s u c h shaft by a s t r a p or o t h e r
f a s t e n i n g passing r o u n d t h e b o d y u n d e r t h e a r m s ; a n d s u c h
m e t h o d of s t a y i n g shall be used b y every person who finds it
necessary in t h e e x e c u t i o n of his d u t y to descend or ascend a
shaft on top of t h e cage covers.
(37) T h e r e shall b e on t h e d r u m of every m a c h i n e used for
l o w e r i n g or r a i s i n g persons s u c h flanges or h o r n s a n d also if
t h e d r u m is conical s u c h o t h e r appliances as m a y be sufficient
to p r e v e n t t h e rope from slipping.
(38) A u t o m a t i c or self a c t i n g doors or t u m b l e r s of a suitable k i n d
shall be affixed to t h e skids or guides below t h e p o p p e t heads
of every shaft in w h i c h a cage is used t o p r e v e n t t h e fall of
s u c h cage d o w n the shaft w h e n d e t a c h e d from t h e rope or
chain b y overwinding, a n d s u c h a u t o m a t i c or self a c t i n g doors
or t u m b l e r s shall be s u r r o u n d e d b y p r o p e r p l a t f o r m s a n d
h a n d - r a i l i n g s , a n d a t every p l a t or level w h e r e t r u c k s are
r e m o v e d on or off' t h e cage while i n t h e shaft s u c h shaft shall
be fitted w i t h bearers or gates securely fixed to t h e sole piece
of t h e plat set w i t h s t r o n g hinges, a n d loose wooden bearers
shall n o t be used.
(39) A w h i p shall n o t be used for t h e s i n k i n g of shafts or for
l o w e r i n g or raising m e n u n l e s s t w o - t h i r d s of t h e shaft is
covered by a p e n t house.
(40) E v e r y b r a c e or p i t b a n k shall h a v e a d e q u a t e protection
p r o v i d e d for t h e w o r k m e n from t h e i n c l e m e n c y of t h e w e a t h e r .
(41) N o o p e n - h o o k shall b e used w i t h a b u c k e t in hoisting b u t
o n l y i n s u c h form of grip-hook or shackle-hook, as m a y be
sanctioned in w r i t i n g b y a n inspector.
(42) E v e r y m i n e , b u t n o t necessarily every shaft, shall h a v e , in
a d d i t i o n to a n y m e c h a n i c a l m e a n s of ingress a n d egress, a t
least one proper l a d d e r or foot w a y c o m m u n i c a t i n g f r o m t h e
surface to t h e w o r k i n g s . S u i t a b l e l a d d e r or foot w a y s shall
be provided to connect floors of sets in slopes, a n d o t h e r
places r e q u i r i n g c o m m u n i c a t i o n , in a m i n e .

(43) A ladder p e r m a n e n t l y used for t h e a s c e n t or descent of
persons in t h e m i n e shall n o t be fixed in a vertical or over­
h a n g i n g position e x c e p t in shafts used exclusively for p u m p i n g ,
a n d shall be inclined a t t h e m o s t c o n v e n i e n t a n g l e which
t h e space in w h i c h t h e ladder is fixed allows. E v e r y ladder-
shaft shall h a v e s u b s t a n t i a l platforms or sollars a t i n t e r v a l s
of n o t m o r e t h a n t h i r t y feet. T h e space b e t w e e n t h e r u n g s
in a ladder, provided after t h e c o m m e n c e m e n t of t h i s A c t ,
shall n o t exceed t w e l v e inches. T h e r u n g s of a ladder shall
in no case be less t h a n five i n c h e s from t h e wall of t h e shaft.
A s u i t a b l e fixture for a h a n d grip shall be placed above each
l a d d e r for t h e use of persons a s c e n d i n g or descending.
(44) L a d d e r s , a n d w h e n necessary c o n v e n i e n t p l a t f o r m s connected
t h e r e w i t h , shall be provided in each rise, j u m p - u p , or passage
g i v i n g access to w o r k i n g a t a h i g h e r level in a m i n e , a n d a
notice shall he posted a t the foot of each s u c h rise, j u m p - u p ,
or passage, s t a t i n g t h e h e i g h t of such rise, j u m p - u p , or
passage t o t h e c h a m b e r or drive above :
Provided t h a t in t h e case of mines in w h i c h n o t less
t h a n fifty persons are ordinarily employed below g r o u n d , t h e r e
shall be at least one additional l a d d e r - w a y to c o n n e c t each
level w i t h t h e one above it. T h e sufficiency for f u r n i s h i n g
m e a n s of escape, of such ways, in r e g a r d to t h e i r position in
t h e m i n e , a n d in all other respects shall he d e t e r m i n e d in each
case b y a n inspector.
(45) (a) I n every w o r k i n g in a m i n e a p p r o a c h i n g a place likely
to c o n t a i n a d a n g e r o u s a c c u m u l a t i o n of w a t e r or n o x i o u s or
i n f l a m m a b l e gas, boring-rods shall be k e p t a n d used for t h e
p u r p o s e of p e r f o r a t i n g t h e g r o u n d t w e n t y feet in a d v a n c e in
alluvial mines, a n d t e n feet i n q u a r t z m i n e s of or n e a r or a t
a n y a n g l e from such w o r k i n g ;
(h) no drive, gallery, or o t h e r e x c a v a t i o n shall be m a d e
w i t h i n a d a n g e r o u s distance of such a c c u m u l a t i o n of w a t e r
or g a s ; a n d
(c) safety-lamps shall be provided for t h e u s e of persons
whilst employed in or n e a r a n y place w h e r e t h e r e is reason
to suspect t h e p r e s e n c e of i n f l a m m a b l e gas.
(46) I n every alluvial mineAvhich, in t h e opinion of a n inspector,
is liable to a n y i n u n d a t i o n or i n b u r s t of Avater s u c h a d d i t i o n a l
rises, chandlers, drives, a n d o t h e r Avorkings, or a n y of t h e m
shall h e c o n s t r u c t e d as m a y seem necessary, a n d as m a y be
ordered, b y t h e M i n i s t e r for t h e escape of p e r s o n s from t h e
lower w o r k i n g s , or to i n s u r e t h e i r safety i n every s u c h m i n e
d u r i n g t h e period of a n y i n u n d a t i o n or i n b u r s t of w a t e r in
such m i n e . (47)
(47) I f m o r e t h a n four persons are employed in t h e m i n e below
g r o u n d in one shift sufficient a c c o m m o d a t i o n shall be p r o ­
vided above g r o u n d n e a r t h e p r i n c i p a l e n t r a n c e of t h e m i n e
b u t n o t in t h e e n g i n e - h o u s e or boiler-house for e n a b l i n g t h e
persons employed in t h e m i n e to c o n v e n i e n t l y d r y a n d c h a n g e
t h e i r dresses ; a n d in no case shall a n y p e r s o n be allowed to
c h a n g e his dress u p o n a boiler.
(48) T h e b a t t e r of a n open c u t shall be at s u c h a n a n g l e as,
t a k i n g into consideration t h e s u r r o u n d i n g conditions, shall,
in t h e opinion of a n inspector, be safe.
(49) W h e n w o r k is b e i n g carried on i n a n y o p e n cut, no s t o p i n g
shall be carried o u t w i t h i n one h u n d r e d feet of t h e b o t t o m of
such open c u t for a distance h o r i z o n t a l l y e i t h e r w a y of t w o
h u n d r e d feet. W h e n operations in a n open c u t are completed,
m i n i n g operations m a y be carried on u n d e r s u c h o p e n c u t ;
b u t in n o case shall open c u t a n d s t o p i n g operations be carried
on a t t h e s a m e t i m e w i t h i n one h u n d r e d feet in d e p t h of one
another.
(50) W h e r e m o r e t h a n twelve persons a r e ordinarily employed
u n d e r g r o u n d , a m b u l a n c e s or stretchers, w i t h splints a n d
b a n d a g e s , shall be k e p t in t h e m i n e ready for i m m e d i a t e use
in case of accident.
(51) E v e r y person shall observe s u c h directions w i t h respect to
w o r k i n g as m a y be given to h i m w i t h a view to a compliance
w i t h t h i s A c t or t h e special r u l e s (if a n y ) in force i n t h e m i n e .
(52) T h e books m e n t i o n e d in these r u l e s shall be provided b y t h e
owner or m a n a g e r , a n d t h e books, or a correct copy thereof,
shall be k e p t a t t h e office on t h e m i n e , a n d a n y inspector m a y ,
a t all reasonable t i m e s , inspect a n d t a k e copies of a n d e x t r a c t s
from a n y s u c h b o o k s ; b u t n o t h i n g i n t h e s e rules shall b e
construed to impose t h e obligation of k e e p i n g a n y s u c h book
or a copy thereof for m o r e t h a n twelve m o n t h s after t h e hook
h a s ceased to be u s e d for m a k i n g entries t h e r e i n u n d e r this
A c t . A n y r e p o r t b y t h i s A c t r e q u i r e d to be recorded i n a
book m a y be p a r t l y in p r i n t ( i n c l u d i n g l i t h o g r a p h ) a n d p a r t l y
in writing.
(53) N o person shall wilfully d a m a g e , or, w i t h o u t proper
a u t h o r i t y , r e m o v e or r e n d e r useless a n y t i m b e r , f e n c i n g , casing,
l i n i n g , guide, m e a n s of signalling, s i g n a l cover, chain, flange,
h o r n , b r a k e , indicator, ladder, platform, s t c a m - g u a g c , w a t e r -
g a u g e , safety-valve, or o t h e r a p p l i a n c e or t h i n g provided i n
a n y m i n e in c o m p l i a n c e w i t h t h i s A c t .
56. (1) T h e G o v e r n o r m a y —
(a) a m e n d or r e p e a l a n y or all of t h e g e n e r a l r u l e s hereinbefore
set o u t ; a n d (b)
(1)) m a k e g e n e r a l rules dealing' w i t h —
(i) t h e v e n t i l a t i o n a n d c o n s t r u c t i o n of m i n e s a n d m i n i n g works ;
(il) t h e m a n a g e m e n t a n d supervision of m i n e s ;
( i l l ) t h e d r a i n a g e of m i n e s ;
(iv) t h e storage a n d use of explosives in or a b o u t m i n e s ;
(v) t h e n a t u r e , m a i n t e n a n c e , e x a m i n a t i o n , a n d i n s p e c t i o n of all
m a c h i n e r y used in or a b o u t m i n e s ;
( v i ) a n y o t h e r m a t t e r dealt w i t h i n t h e g e n e r a l rules herein­
before set o u t ; a n d all o t h e r m a t t e r s w h a t s o e v e r involved
in or c o n n e c t e d w i t h t h e control a n d w o r k i n g of m i n e s , a n d
of w o r k s in w h i c h m i n e r a l is reduced, smelted, refined, or
otherwise t r e a t e d , w h e t h e r s u c h w o r k s a r c i m m e d i a t e l y
c o n n e c t e d or n o t w i t h a n y m i n e .
( 2 ) A l l s u c h a m e n d m e n t s , repeals, a n d all s u c h g e n e r a l
r u l e s shall he p u b l i s h e d in t h e G a z e t t e , a n d shall t a k e effect from a
d a t e to b3 n a m e d t h e r e i n ; a n d a copy thereof shall be laid before b o t h
H o u s e s of P a r l i a m e n t f o r t h w i t h if s i t t i n g , and if n o t s i t t i n g , t h e n
w i t h i n fourteen davs after t h e c o m m e n c e m e n t of t h e n e x t session.
(3) After t h e d a t e n a m e d in t h e G a z e t t e as aforesaid, s u c h
rules shall, so far as m a y be reasonably practicable, be observed in a n d
a b o u t every m i n e in t h e s a m e m a n n e r as if t h e y w e r e enacted in this A c t :
P r o v i d e d t h a t t h e G o v e r n o r m a y , b y p r o c l a m a t i o n in t h e
G a z e t t e , e x e m p t a n y m i n e or class of mines from t h e o p e r a t i o n of a n y
s u c h rule.
57. A n y person w h o c o n t r a v e n e s or does n o t c o m p l y w i t h a n y
of t h e g e n e r a l r u l e s hereinbefore set out, or a n y of s u c h rules as
a m e n d e d , or a n y g e n e r a l r u l e m a d e u n d e r this A c t , shall he g u i l t y of
a n offence a g a i n s t t h i s A c t ; a n d in t h e e v e n t of a n y s u c h c o n t r a v e n t i o n
or n o n - c o m p l i a n c e b y a n y p e r s o n w h o m s o e v e r in t h e case of a n y m i n e ,
t h e o w n e r a n d m a n a g e r of t h e m i n e shall each he g u i l t y of a n offence
a g a i n s t t h i s Act, unless IK; proves t h a t h e h a d t a k e n all r e a s o n a b l e
m e a n s b y p u b l i s h i n g a n d to t h e best of his p o w e r enforcing t h e r u l e s
as r e g u l a t i o n s for t h e w o r k i n g of t h e m i n e so as to p r e v e n t s u c h con­
t r a v e n t i o n or n o n - c o m p l i a n c e .

DIVISION 2.—Special Rules.


58. (1) A n inspector m a y b y n o t i c e in w r i t i n g r e q u i r e such
r u l e s (referred to i n t h i s A c t as special rules) to be established for t h e
c o n d u c t and g u i d a n c e of t h e persons a c t i n g in t h e m a n a g e m e n t
of a n y m i n e or e m p l o y e d in or a b o u t t h e m i n e as, u n d e r t h e p a r t i c u l a r
s t a t e a n d c i r c u m s t a n c e s of such m i n e , m a y a p p e a r best c a l c u l a t e d to
p r e v e n t d a n g e r o u s accidents, a n d to provide for t h e safety, c o n v e n i e n c e ,
a n d p r o p e r discipline of t h e persons e m p l o y e d in or a b o u t t h e m i n e .

(2) S u c h special r u l e s , w h e n established, shall h e signed b y
t h e Chief I n s p e c t o r , a n d shall be observed i n a n d a b o u t t h e m i n e to
w h i c h t h e y refer ( i n c l u d i n g a n y e x t e n s i o n thereof) in t h e same
m a n n e r as if t h e y were e n a c t e d in t h i s A c t .
( 3 ) If a n y person w h o is b o u n d to observe t h e special
r u l e s established for a n y m i n e acts in c o n t r a v e n t i o n of or fails to
c o m p l y w i t h a n y of t h e m , he shall be g u i l t y of a n offence a g a i n s t t h i s
A c t , a n d also t h e o w n e r a n d m a n a g e r of s u c h m i n e shall each be
g u i l t y of a n offence a g a i n s t this A c t , u n l e s s h e proves t h a t h e h a d
t a k e n all reasonable m e a n s , b y p u b l i s h i n g a n d to t h e best of his
p o w e r enforcing t h e r u l e s as r e g u l a t i o n s for t h e w o r k i n g of t h e m i n e ,
so as to p r e v e n t such c o n t r a v e n t i o n or n o n - c o m p l i a n c e .
( 4 ) If special r u l e s h a v e b e e n established for a n y m i n e ,
a n d s u b s e q u e n t l y t h e r e t o a c h a n g e occurs, e i t h e r in t h e n a m e of
such m i n e or in t h e o w n e r s h i p of s u c h m i n e , s u c h special r u l e s shall,
n o t w i t h s t a n d i n g t h e aforesaid c h a n g e , b e a n d c o n t i n u e t o be t h e special
rules of s u c h m i n e , u n t i l t h e y are a m e n d e d or n e w rules a r e established
u n d e r t h e provisions of t h i s A c t .
59. (1) T h e owner or m a n a g e r of any m i n e , if so required
as aforesaid, shall w i t h i n t h r e e m o n t h s after t h e receipt b y h i m of s u c h
r e q u e s t , frame a n d t r a n s m i t t h e special r u l e s to a n inspector, for
a p p r o v a l b y t h e Chief I n s p e c t o r .
(2) T h e proposed special rules, t o g e t h e r w i t h a p r i n t e d

notice s t a t i n g t h a t a n y objection to t h e r u l e s on t h e g r o u n d of any -
t b i n g contained t h e r e i n or o m i t t e d t h e r e f r o m , m a y be sent b y a n y of
t h e persons e m p l o y e d in t h e m i n e t o a n inspector, a t t h e address
s t a t e d i n t h e notice, shall, d u r i n g n o t less t h a n t w o weeks before t h e
rules a r e t r a n s m i t t e d to t h e inspector, be posted u p in like m a n n e r as
is provided i n t h i s A c t r e s p e c t i n g t h e p u b l i c a t i o n of special rules for
t h e i n f o r m a t i o n of persons employed in t h e m i n e ; a n d a certificate
t h a t t h e r u l e s a n d notice h a v e b e e n so posted u p shall be sent to t h e

i n s p e c t o r w i t h t w o copies of t h e r u l e s signed by t h e person s e n d i n g t h e
same.
( 3 ) T h e proposed special r u l e s , t h e objections (if a n y ) , a n d
t h e certificate, i n t h e p r e c e d i n g s u b c l a u s e m e n t i o n e d , shall b e t r a n s ­
m i t t e d b y t h e inspector, w i t h his r e p o r t t h e r e o n , to t h e Chief I n s p e c t o r .
( 4 ) I f t h e rules are n o t objected to b y t h e Chief I n s p e c t o r

w i t h i n thirty days after t h e i r receipt by t h e i n s p e c t o r , t h e y shall be
established.
60. (1) If t h e Chief I n s p e c t o r is of opinion t h a t t h e proposed

special rules so t r a n s m i t t e d , or a n y of t h e m , do n o t sriflieicntly provide
for t h e p r e v e n t i o n of d a n g e r o u s a c c i d e n t s i n t h e m i n e , or for t h e safety
or c o n v e n i e n c e of t h e persons e m p l o y e d in or a b o u t t h e m i n e , or are
u n r e a s o n a b l e , h e m a y , w i t h i n t h i r t y days after t h e r u l e s a r e received
by
b y t h e inspector, object to t h e rules, a n d propose to t h e owner or
m a n a g e r , in writing, a n y modifications in t h e rules b y w a y either of
omission, a l t e r a t i o n , s u b s t i t u t i o n , or addition.
(2) If t h e owner or m a n a g e r does n o t , w i t h i n t w e n t y days
after t h e modifications proposed b y t h e Chief I n s p e c t o r are received
by h i m , object in w r i t i n g t o t h e m , t h e proposed special rules, w i t h
those modifications, shall be established.
( 3 ) I f t h e o w n e r or m a n a g e r sends his objection in w r i t i n g
w i t h i n t h e said t w e n t y days to t h e Chief I n s p e c t o r , t h e m a t t e r shall be
referred to t h e M i n i s t e r for decision, a n d t h e rules shall be established
in accordance w i t h a n d from t h e date of t h e decision of t h e M i n i s t e r ,
61. (1) After special rules are established u n d e r t h i s A c t in
a n y m i n e , t h e owner, or m a n a g e r of t h e m i n e m a y , from t i m e to t i m e ,
propose in w r i t i n g to a n inspector, for t h e a p p r o v a l of t h e Chief
I n s p e c t o r , a n y a m e n d m e n t of t h e rules, or a n y n e w special r u l e s ;
a n d t h e provisions of this A c t w i t h respect to t h e original special rules
shall a p p l y to all s u c h a m e n d m e n t s a n d n e w r u l e s in like m a n n e r , as
nearly as m a y bo, as t h e y a p p l y to t h e original r u l e s .
(2) T h e Chief I n s p e c t o r m a y , from t i m e to t i m e , propose in
w r i t i n g to t h e owner or m a n a g e r of t h e mine, a n y n e w special rules,
or a n y a m e n d m e n t of t h e special r u l e s ; a n d t h e provisions of t h i s Act,
w i t h respect to a proposal of t h e Chief I n s p e c t o r for m o d i f y i n g t h e
special r u l e s t r a n s m i t t e d b y t h e o w n e r , or m a n a g e r of a m i n e , shall
apply to all such n e w special rules and a m e n d m e n t s in like m a n n e r ,
as n e a r l y as m a y be, as t h e y a p p l y to t h e proposal.
62. If the owner or m a n a g e r of a n y m i n e m a k e s a n y false
s t a t e m e n t w i t h respect to t h e posting u p of t h e r u l e s a n d notices, h e
shall be g u i l t y of a n offence a g a i n s t t h i s A c t ; a n d if special rules for
a n y m i n e a r e n o t t r a n s m i t t e d w i t h i n t h e t i m e l i m i t e d b y this A c t to a n
inspector for t h e a p p r o v a l of t h e Chief I n s p e c t o r , t h e o w n e r a n d m a n a g e r
of s u c h m i n e shall each be guilty of a n offence a g a i n s t this A c t , unless
h e proves t h a t h e h a d t a k e n all reasonable m e a n s , b y enforcing, to t h e
best of his power, t h e provisions of this A c t , to secure t h e transmission
of t h e rules.
63. A n inspector shall, w h e n required, certify a copy shown
to his satisfaction to be a t r u e copy of a n y special rules established
u n d e r this A c t in a n y m i n e , a n d a copy so certified shall be evidence
( b u t n o t to t h e exclusion of o t h e r proof) of s u c h special rules, a n d
of t h e fact t h a t t h o s e rides are d u l y established u n d e r t h i s A c t a n d
h a v e been signed b y t h e Chief I n s p e c t o r .
64. T h e G o v e r n o r m a y m a k e a n d p u b l i s h i n t h e CJazette a set
of special r u l e s for a n y m i n e , a n d t h e r e a f t e r t h e rules so m a d e a n d
p u b l i s h e d shall be d e e m e d t h e special rules of s u c h m i n e : P r o v i d e d
t h a t u p o n special r u l e s b e i n g established for a n y m i n e , t h e special
r u l e s m a d e b y t h e Governor as aforesaid shall cease to a p p l y to s u c h
mine. DIVISION
DIVISION 3.—Publication oj rules.
65. F o r t h e p u r p o s e of m a k i n g k n o w n t h e provisions of t h i s
A c t a n d t h e special r u l e s (if a n y ) to all persons e m p l o y e d in and a b o u t
a m i n e , a n a b s t r a c t of this A c t s u p p l i e d , on t h e a p p l i c a t i o n of t h e
o w n e r or m a n a g e r of t h e m i n e , b y a n inspector, a n d a correct copy
of t h e special r u l e s (if a n y ) shall, if deemed necessary b y a n inspector,
be p u b l i s h e d as follows : —
(a) T h e o w n e r or m a n a g e r of t h e m i n e shall c a u s e t h e a b s t r a c t
of t h e A c t a n d copy of t h e r u l e s (if a n y ) , w i t h t h e n a m e of
t h e m i n e a n d t h e n a m e of t h e o w n e r a n d of t h e m a n a g e r
to be posted u p , i n legible c h a r a c t e r s , in some c o n s p i c u o u s
place at or n e a r t h e m i n e , w h e r e t h e y m a y b e c o n v e n i e n t l y
r e a d b y t h e p e r s o n s e m p l o y e d t h e r e i n ; a n d so often as such
a b s t r a c t or copy becomes defaced, obliterated, or destroyed,
shall cause i t to b e r e n e w e d w i t h all reasonable d e s p a t c h .
(b) T h e o w n e r or m a n a g e r shall, on r e q u e s t , s u p p l y a p r i n t e d
copy of t h e a b s t r a c t a n d t h e special rules (if a n y ) gratis to
each p e r s o n e m p l o y e d in or a b o u t t h e m i n e .
I n t h e e v e n t of a n y n o n - c o m p l i a n c e w i t h t h e provisions of t h i s section
t h e o w n e r a n d m a n a g e r shall e a c h be g u i l t y of a n offence a g a i n s t t h i s
A c t , u n l e s s h e proves t h a t h e h a d t a k e n all r e a s o n a b l e m e a n s , b y
enforcing, to t h e best of his power, t h e observance of this section to
p r e v e n t such n o n - c o m p l i a n c e .
66. E v e r y p e r s o n w h o p u l l s down, injures, or defaces a n y
a b s t r a c t , notice, proposed special r u l e s , or special rules, w h e n posted
u p in p u r s u a n c e of t h i s A c t , or a n y notice posted u p in p u r s u a n c e of
t h e special r u l e s , shall be g u i l t y of a n offence a g a i n s t this A c t .

PART VII.
L E G A L PROCEEDINGS AND MISCELLANEOUS.
DIVISION 1.—Legal Proceedings.
67. (1) E v e r y person e m p l o y e d i n or a b o u t a m i n e , o t h e r t h a n
a n o w n e r , or m a n a g e r , who is g u i l t y of a n y a c t or omission, w h i c h
i n t h e case of a n owner or m a n a g e r w o u l d be a n offence a g a i n s t t h i s
A c t , shall be d e e m e d to be g u i l t y of a n offence a g a i n s t t h i s A c t .
( 2 ) E v e r y p e r s o n w h o is g u i l t y of a n offence a g a i n s t t h i s
A c t for w h i c h a p e n a l t y is n o t e x p r e s s l y p r e s c r i b e d shall be liable to
a fine n o t e x c e e d i n g , if b e is a n o w n e r or m a n a g e r , fifty p o u n d s , a n d if
h e is a n y o t h e r p e r s o n , five p o u n d s for each offence; a n d if a n i n s p e c t o r
h a s given w r i t t e n notice of a n y such offence, to a f u r t h e r fine n o t
e x c e e d i n g five p o u n d s for e v e r y day after s u c h notice t h a t s u c h offence
c o n t i n u e s to be c o m m i t t e d . 68.
68. W h e r e a n owner, or m a n a g e r of, or a person employed in or
a b o u t , a m i n e is g u i l t y of a n y offence a g a i n s t this A c t w h i c h , in t h e
opinion of t h e C o u r t t h a t tries t h e case, is one w h i c h was reasonably
calculated to e n d a n g e r t h e safety of t h e persons employed in or a b o u t
t h e m i n e , or to cause serious personal i n j u r y to a n y of s u c h persons, or
to cause a d a n g e r o u s accident, a n d was c o m m i t t e d wilfully by t h e
personal act, personal default, or personal n e g l i g e n c e of t h e person
accused, s u c h person shall be liable, if t h e C o u r t is of opinion t h a t a
fine will n o t m e e t t h e c i r c u m s t a u c e s of t h e case, to i m p r i s o n m e n t w i t h
or w i t h o u t h a r d l a b o u r for a period n o t e x c e e d i n g t h r e e m o n t h s .
69. (1) All offences u n d e r this A c t n o t declared to be mis­
d e m e a n o u r s , a n d all fines u n d e r t h i s A c t , a n d all m o n e y s a n d costs b y
this A c t directed to be recovered as fines, m a y b e p r o s e c u t e d a n d
recovered before a n y j u s t i c e b e i n g a warden, in accordance w i t h t h e
provisions of t h e A c t s in force for t h e t i m e b e i n g r e g u l a t i n g proceedings
on s u m m a r y convictions before j u s t i c e s .
( 2 ) S u m m a r y orders u n d e r this A c t m a y be m a d e on
c o m p l a i n t before a n y j u s t i c e b e i n g a w a r d e n .
( 3 ) A n y information or c o m p l a i n t m a d e or laid in p u r s u a n c e
of t h i s A c t shall (save as otherwise expressly provided b y this A c t ) be
laid or m a d e w i t h i n t h r e e m o n t h s from t h e t i m e w h e n t h e m a t t e r of t h e
i n f o r m a t i o n or c o m p l a i n t c a m e to t h e k n o w l e d g e of t h e person l a y i n g
or m a k i n g t h e i n f o r m a t i o n or c o m p l a i n t .
(4) A t t h e h e a r i n g of a n y such i n f o r m a t i o n or c o m p l a i n t ,
t h e j u s t i c e shall, if r e q u i r e d by either p a r t y , t a k e or cause to be t a k e n
m i n u t e s of t h e evidence, a n d shall cause t h e same to be preserved.
70. If a n y person feels a g g r i e v e d hj a n y conviction u n d e r t h i s
A c t , h e m a y appeal t h e r e f r o m in like m a n n e r as any o t h e r conviction
b y j u s t i c e s m a y b e appealed from.
7 1 . (1) W h e r e an offence has been c o m m i t t e d , for w h i c h t h e
owner or m a n a g e r of a m i n e is liable u n d e r t h i s A c t , b u t w h i c h h a s not

personally b e e n c o m m i t t e d by s u c h o w n e r or m a n a g e r , no proceedings
for s u c h offence shall be i n s t i t u t e d a g a i n s t s u c h o w n e r or m a n a g e r
e x c e p t b y a n inspector or with t h e c o n s e n t in w r i t i n g of t h e M i n i s t e r .
( 2 ) A n inspector shall n o t i n s t i t u t e a n y p r o s e c u t i o n u n d e r
t h i s A c t a g a i n s t t h e o w n e r or m a n a g e r or a n enrployee of a m i n e if
satisfied t h a t h e had. t a k e n all reasonable m e a n s to p r e v e n t t h e com­
mission of t h e offence.
( 3 ) N o prosecution shall bo i n s t i t u t e d a g a i n s t a coroner for
a n y offence u n d e r t h i s Act, e x c e p t with t h e consent i n w r i t i n g of t h e
Minister.
72. W h e r e t h e o w n e r or m a n a g e r of a m i n e h a s t a k e n
proceedings u n d e r this A c t a g a i n s t a n y person employed in or a b o u t a
mine
m i n e in respect of a n offence c o m m i t t e d u n d e r t h i s Act, h e shall
w i t h i n t w e n t y - o n e days after t h e h e a r i n g of t h e case r e p o r t t h e r e s u l t
t h e r e o f to a n inspector.
73. (1) N o t h i n g in this A c t shall p r e v e n t a n y person from b e i n g
i n d i c t e d or liable u n d e r a n y o t h e r A c t or o t h e r w i s e to any o t h e r or
h i g h e r p e n a l t y or p u n i s h m e n t t h a n is provided for a n y offence b y t h i s
A c t : P r o v i d e d t h a t n o person shall be p u n i s h e d twice for t h e s a m e
offence.
(2) I f t h e j u s t i c e before w h o m a person is c h a r g e d w i t h a n
offence u n d e r t h i s A c t t h i n k s t h a t proceedings o u g h t to be t a k e n a g a i n s t
s u c h person for s u c h offence u n d e r a n y o t h e r A c t or otherwise, h e m a y
a d j o u r n t h e case to e n a b l e Such proceedings t o b e t a k e n .
74. W h e r e a fine is imposed u n d e r this A c t for n e g l e c t i n g to
send a notice of a n y explosion or accident, or for a n y offence a g a i n s t
t h i s A c t w h i c h h a s occasioned loss of life or personal i n j u r y , t h e
M i n i s t e r m a y direct s u c h fine to be paid to or d i s t r i b u t e d a m o n g t h e
persons injured, a n d t h e relatives of a n y person whose d e a t h m a y h a v e
b e e n occasioned b y t h e explosion, accident, or offence, or a m o n g some
of t h e m : P r o v i d e d t h a t —
(a) s u c h p e r s o n s did n o t in his opinion occasion or c o n t r i b u t e to
occasion t h e explosion or accident, a n d did n o t c o m m i t a n d
were n o t parties to c o m m i t t i n g t h e offence;
(b) t h e fact of t h e p a y m e n t or d i s t r i b u t i o n shall n o t in a n y way
affect or be receivable as evidence in a n y legal proceeding
relative to or c o n s e q u e n t i a l o n t h e explosion, accident, or
offence,
Save as aforesaid all fines recovered u n d e r t h i s A c t shall be paid into
t h e T r e a s u r v a n d carried to t h e Consolidated R e v e n u e P u n d .
75. A l l notices a n d d o c u m e n t s r e q u i r e d b y t h i s A c t to be served
or s e n t b y or t o a n i n s p e c t o r m a y be e i t h e r delivered personally, or
served or sent b y post b v a registered l e t t e r .

DIVISION 2.—Miscellaneous.

76. If a n y question arises, o t h e r w i s e t h a n i n legal p r o c e e d i n g s ,


Whether a m i n e is a m i n e to w h i c h t h i s A c t applies, t h e q u e s t i o n shall
be referred to t h e M i n i s t e r , whose decision t h e r e o n shall be final.
77. T h e G o v e r n m e n t Geologist a n d t h e Geological S u r v e y o r s
m a y e n t e r a n y m i n e a t all reasonable t i m e s a n d e x a m i n e t h e m i n e or
a n y p a r t thereof.
78. A n y order or e x e m p t i o n a u t h o r i s e d b y or u n d e r this A c t to
be m a d e or g r a n t e d b y t h e M i n i s t e r m a y be m a d e a n d g r a n t e d , a n d from
t i m e to t i m e r e v o k e d or a l t e r e d b y t h e Minister, either u n c o n d i t i o n a l l y
or subject to s u c h conditions as h e m a y see fit, a n d shall be signed b y
t h e M i n i s t e r or t h e U n d e r S e c r e t a r y . 79.
79. (1) E v e r y p e r s o n employed in or a b o u t a n y m i n e shall
before c o m m e n c i n g a n d whilst at w o r k , satisfy himself of t h e safely
of a n y skips, chains, t a c k l e , windlass, ropes, or o t h e r appliances h e m a y
be r e q u i r e d to use, a n d in case of a n y defect or i n s e c u r i t y h e shall
cease to use t h e s a m e u n t i l m a d e safe.
(2) E v e r y s u c h person w h o witnesses, in or a b o u t a n y
m i n e , a n y c i r c u m s t a n c e , m a t t e r , or t h i n g w h i c h m a y be likely to be a
cause of d a n g e r of a n y k i n d shall i m m e d i a t e l y notify t h e s a m e to t h e
person (if a n y ) u n d e r whose i m m e d i a t e direction or control be is.
( 3 ) E v e r y person i n s u b - c h a r g e of a n d employed in m i n i n g
operations in a n y p a r t of a m i n e shall, on c h a n g i n g his shift, inform
t h e person a p p o i n t e d to relieve h i m of t h e state of t h e w o r k i n g s in t h e
p a r t of t h e m i n e in which he has been e m p l o y e d : Provided t h a t
n o t h i n g in t h i s clause shall relieve a n y owner, m a n a g e r , or inspector
of a n y of t h e i r responsibilities i n c u r r e d u n d e r this A c t .
80. (1) W h e r e t h e m a n a g e r of a n y c o m p a n y c l a i m i n g to be
legally or e q u i t a b l y interested in a n y land adjoining or n e a r to a n y
m i n e , or of a n y person so claiming, alleges b y affidavit, t a k e n before
a n y J u s t i c e or Commissioner for affidavits, t h a t t h e o w n e r of such
m i n e is believed by t h e person m a k i n g s u c h affidavit to be e n c r o a c h i n g
upon such land, t h e M i n i s t e r m a y , b y w r i t i n g u n d e r his h a n d , a u t h o r i s e
an inspector, t o g e t h e r w i t h a m i n i n g surveyor or experienced m i n e r , to
e n t e r such m i n e a n d l a n d for t h e p u r p o s e of a s c e r t a i n i n g w h e t h e r a n y
such e n c r o a c h m e n t h a s been m a d e , a n d if so t h e e x t e n t thereof. But
before g r a n t i n g such a u t h o r i t y t h e M i n i s t e r shall r e q u i r e a deposit to
be m a d e of s u c h a s u m of m o n e y n o t exceeding one h u n d r e d p o u n d s as,
in his opinion, will be necessary to cover the cost of s u c h inspection.
( 2 ) T h e persons so a u t h o r i s e d m a y t h e r e u p o n e n t e r such
m i n e a n d l a n d a n d descend a n y shaft or e n t e r a n y m i n e t h e r e i n , a n d
use t h e engines a n d o t h e r m a c h i n e r y ordinarily employed for t h a t
p u r p o s e , a n d m a k e s u c h p l a n s a n d sections of t h e m i n e a n d l a n d
entered a n d of a n y drives or o t h e r works t h e r e i n as m a y b e considered
n e c e s s a r y ; a n d t h e owner a n d m a n a g e r of a n y s u c h m i n e shall r e n d e r
all necessary assistance to t h e persons so authorised.
( 3 ) E v e r y person so a u t h o r i s e d shall, before e n t e r i n g such
m i n e or land, m a k e a s t a t u t o r y declaration before a n y person authorised
to t a k e t h e s a m e t h a t h e will n o t (except as a witness in a C o u r t of
j u s t i c e ) , w i t h o u t t h e consent i n w r i t i n g of t h e o w n e r of t h e m i n e or
land, divulge, or cause to be divulged to a n y person whomsoever a n y
i n f o r m a t i o n obtained u p o n or by s u c h e n t r y save only as to w h e t h e r
s u c h o w n e r is e n c r o a c h i n g as aforesaid.
( 4 ) A n y owner or m a n a g e r w h o refuses such assistance,
a n d a n y person who acts c o n t r a r y t o s u c h d e c l a r a t i o n , shall hi.) liable
to a fine n o t exceeding t e n p o u n d s . (5)
( 5 ) T h e M i n i s t e r m a y , o u t of t h e sum. deposited as afore­
said, defray t h e cost of such inspection, a n d if t h e owner a n d m a n a g e r
of t h e m i n e r e n d e r such assistance as aforesaid, a n d if t h e r e is no
e n c r o a c h m e n t , m a y out of such s u m a w a r d to s u c h owner c o m p e n s a t i o n
for a n y loss or e x p e n s e to w h i c h he m a y be p u t b y reason of such
inspection.
