AFFIDAVIT OF WITNESS

I, JOLIVEN ABALO DAMASCO, Filipino, of legal age, single, with residential


address at Purok 13, Salvacion, Bayugan, Agusan del Sur, after having been sworn to in
accordance with law, do hereby depose and say the following, that:

PRELIMINARY STATEMENT

I am executing this judicial affidavit after having been examined by Atty.


Juderick C. Ramos at PAO Bayugan District Office, Government Center, Bayugan City,
Agusan del Norte.

I hereby state that in answering the questions asked of me as appearing below, I


was fully aware and conscious that I did so under oath and that I may face criminal
liability for false testimony or perjury.

Q1. Please state your name, age, residence and occupation.


A1. I am Joliven Abalo Damasco, 23 years old, single and a resident of Purok 13,
Salvacion, Bayugan, Agusan del Sur. I am presently as an office worker.

Q2. Why are you here?


A2. To stand as the sole witness for the Petition for cancellation of affidavit of
legitimation with registry no. 2005-131, cencellation of the remarks /annotations found
in the certificate of live birth of Joliven Abalo with registry 2005-419 and to use the
surname of the father.

Q3. Please explain briefly what happened to the first marriage contracted by your
father, if you know.
A3. Sometime in 29, 1988, my father Bernabe M. Damasco contracted a first marriage
with certain Fe L. Saldo before the 2 nd Municipal Circuit Court of Banga, Cotabato. The
said marriage was solemnized by Hon. David E. Villa and was registered thereafter
before the Civil Registry of Banga, South Cotabato. Copy of marriage certificate hereto
attached and marked as Annex “A”;

Q4. What happened next?


A4. For reasons unknown, my father and Fe Saldo broke up few years after their
marriage and separated without their first marriage being legally terminated.

Q5. And then, what happened after?


A5. After being separated from his wife, my father Bernabe Damasco found new
happiness in the loving arms of Catalina Abalo and they lived together as husband and
wife without the benefit of marriage. As a result, they produced children and one of
them is me, the petitioner in this case;
Q6. When were you born?
A6. I was born on July 22, 1988, when Bernabe Damasco and my mother Catalina Abalo
were not yet married. Copy of Certificate of Live Birth hereto attached and marked as
Annex “B”.

Q7. What happened next?


A7. My father Bernabe Damasco and my mother Catalina H. Abalo contracted marriage
on January 13, 2000 which was duly solemnized by Hon Judge Eliseo M. Campos and
was subsequently registered before the Office of the Civil Registry of Bayugan, Agusan
del Sur.

Q8. What happened after that?


A8. My father Bernabe Damasco and my mother Catalina Abalo went to the Office of
the Municipal Registrar of Esperanze and filed an Affidavit of Legitimation of my status
as their son, believing in good faith that their marriage was clothed with all the
legalities;

Q9. What did you do then?


A9. I went to Philippine Statistics Office to secure a copy of my certificate of live birth
but was advised by a personnel that I could not just be summarily be considered as
legitimated child.

Q10. What did you do after?


A10. I went to Public Attorney’s Office to seek legal assistance for the purpose of filing
the appropriate action to correct the entries in my certificate of live birth.

Q11. What is your purpose then of filing the appropriate petition before the court?
A11. To ask for Court’s approval for the Civil Registrar of Esperanza, Agusan del Sur to
cancel the annotations/remarks found at the upper right portion of herein Petitioner’s
Certificate of Live Birth with Registry No. 2005-419 and cacel the affidavit of
legitimation with registry no. 2005-131 and allow the petitioner to use the surname of
his father, Bernabe Damasco.

Q12. Are you aware that the statements you made here are under oath and that you
may face criminal liability for false testimony for perjury should any of the statements
you made here are untruthful or false?
A12. Yes
