COUNTER-AFFIDAVIT

I,________,46years old, Filipino, marriedand a resident of

_____________, afterhaving been sworn to in accordance
with law, dohereby depose and declare that:

1. I am the Respondent in__________for Estafa now pending

before the City Prosecutors Office;
2. I deny all the imputations of wrongdoing against me in
the complaint for being groundless and unmeritorious,
thus, I hereby pray for the dismissal of the present
complaint maliciously filed against me;
3. The truth of the matter is that I previously lived at ____
from June 2009 to May 2014. Attached is a copy of
Barangay Certificate as proof of my residence.
4. On the last week of May 2014, my house located at
______ had collapsed. As a result, I asked the
Complainant if I could build a small house in her
property beside her old house. Hereto attached is a
machine cope of Service Memorandum issued by ______
evidencing that my house has collapse;
5. Before I built a small house beside her property,we do
not have any agreement whether written or verbal that
I will shoulder the expenses of the electricity of her old
house;
6. I never put up any connections of electricity from her old
house to my house. In fact, I have been using solar
energy since the time I built a house and lived at the
property. Attached is a copy of affidavit of witness
executed by the _____ and photographs to prove such
claim;
7. In truth, after years of using solar energy I decided to
apply for my house a special connection of electrical
meter under my name before _____ and the CITY
Engineering Office. However, complainant’s daughter
protested and brought the task force ____ to cut-off
my electrical connection from the post to my house.
Complainant’s daughter action has caused harassments
to me and my family but I just it pass.
8. In order to avoid any further disagreements with the
complainant’s family, I decided to transfer my residence
at ______
9. I know for a fact that the complainant’s old house has
been rented by other persons from the year 2008 to
2018 and that she has received rental payments from
them but did not pay the electric bill;
 10. As such, the case filed against me is just pure
harassment to force me to withdraw the case I filed
against her nephew, who is the son of the complainant’s
older sister _____ , for physical injury in relation to R.A
7610 for hurting my daughter. Attached is a copy of
the Resolution to prove such claim;
11. I also filed a case against the mentioned person for
trespassing and slight physical injuries. Attached
hereto is a copy of the Investigation Data Form of
the Office of the City Prosecutor and Resolution as
evidence of filing;
12. I am executing this counter - affidavit to refute all
the imputations of wrongdoings against me, to inform the
concerned authorities and this Honorable Office of the
foregoing facts and to attest to the truth thereof.

For Complaint of Syndicated Estafa, to set the record straight
the respondents officer denied such an accusation, the law
provides that money must have to be received by the
respondents being one of the elements of estafa Records from
the --Treasurer revealed no collection of monthly dues paid
and received by the complainants to the association through
its collectors, which was fraudulently disbursed. Reynaldo
Ronquillo and Arnold Granada haveno membershiprecords to
the association. Copies of OHAI Receipts presented by the
complainants were illegally obtained and nopermission from
the payee regarding his intention to use it as evidence
, and complainants have no personality representing them.
