IIIIEREAS, the Metro Manila Council (MMC) approved the


implementation of the uniform truck ban regulation in Metro Manila when it
enacted MMDA Resolution No. O7-05, Series of 2OO7;
YEEREAE, under MMDA Resolution No. O1 & 3, Series of 2Ol3 the r
MMC Special Traflic Committee have implemented a uniform truck ban in
Metro Manila from 6:00 AM to 1O:OO AM and 5:OO PM to 1O:OO PM daily, except
Sundays and Holidays;
WEEREASI, the City Government of Valenzuela has been suffering from
the recurrent and perennial problem of tra-ffic congestion brought about the
expansion and development within the City and its neighboring communities;
WIfEREAS, Section 16 of Republic Act No. 7160, also known as ttre
"Local Government Code of 1991', provides as follows:
Section 16. General Welfare. - Every local government unit
shall exercise the powers expressly granted, tlrose necessarily
implied therefrom, as well as powers necessary, appropriate, or
incidental for its ellicient and effective governance' and those
which are essential to tJle promotion of the general welfare.
Within their respective territorial, jurisdictions, local govern-
ment units shall ensure and support' among other things, the
preservation and enrichment of culture, promote health and
safety, enhance t}re right of the people to a balanced ecolory,
encourage and support the development of appropriate and self-
reliant scientilic and technological capabilities, improve public
\t morals, enhance economic prosperity and social justice' p
full employment arnong their residents, maintain peace and
order, and prese rve t]le comfort and convenience of their inha-
bitants.'
VIIEREAS, the City Government of Valenzuela, in order to alleviate and
ease up the traflic congestion within the City and being a part of Metro Manila
uncil, hereby adopts the tru ck ban of the Metropolitan Manila Development

lI) ADUINIST'RATilD WIALTI - a legal mechanism that allows the
local government to penalize ttre violation of this Ordinance, which
consist of the imposition of monetar5z fine. It is intended to provide
an altemative enforcement mechanism that is more cost-effective,
timely and practical than prosecuting the offender/ s through the
court system.

partnership or entity who own, operate, use and employ any motor

connecting the City to neighboring towns and cities and play an
important role to the transportation and passage of goods and
person.
(IIn EXDUPIDD VDEIOLE - all motor vehicle dedicated solely for
emergency situation and are primarily used and intended to save
lives and properties, such as fire trucks, government specialized
vehicles, and the likes are exempted from tJ e coverage of this
ordinance.
Trucks and delivery vans tJlat carry rice and other perishable
items such as lish, vegetables, dairy and poultry products, as well
as frozen meat products, animal feeds livestock, and export goods
and petroleum products.
(Vl D,:XEUPTION - Business and commercial entities, whether it be
sole proprietor, partnership or corporation, in furtherance of its
business and/or commercial interest may apply for an exemption
from the coverage of the truck regulation upon application from
Traffic Management Office and subject to the payment of the filing
and processing fees.
fVIl PDruOL OF @VEnaOA - The truck ban shall be enforced and
elfective from SIX (6:tN) Lt. to T9,N (l0:(nt A-td. and iM
(5:OO) P.t. to TDN (1O:OO) P..U. everyday, except Sundays and
\R Holidays.
(VIII ,RUCX - a motor vehicle designed to transport cargo. Tlucks vary 1-
greatly in sizr, power and configuration, with the smallest being
mechanically similar to an automobile. {
For purposes of this Ordinance, a motor vehicle e<ceeding gross

Owner/s, operator/s and driver/s seeking exemption for heavy vehicles


enumerated below and the likes, shall be issued conduct passes after

flagship projects as identified by MMDA and subject to t].e issuance of
a valid certification an! a valid trip pass by the government authority
concemed (DPWH, DOTC, LGUs, pEA, etc. as the case maybe).
SECTIOI 5. IIUIDRIAIZOX ITTSSEUIMTIOIY _ For purposes of
information dissemination regarding the ovalenzuela city Truck^ Retihtion,
o-rdinance, appropriate signage thereof shall be installed informing trr"e public
of the same and shall be made no less t].an fifteen (15) days from frre approval
of this Ordinance.

partnership or entit5r found violating the provision of this ordinance or its
implementing rules and reguLations, shall upon conviction, be penalized as
follows:

guidelines governing the said Ordinance.
SEgfIOIt 10. REPEALIilG CLAUSE - All Ordinance, Administrative
Circular and Executive Order or part thereof, which are inconsistent
contrary to the provision of this ordinance shall be considered hereby repeatr
or amended accordingly.
SEC"TIOIY 11. SEPARIBILITY CLIIUSE If any part or provision
this Ordinance shall be held declared null and void by a court of competent
jurisdiction, the other portion or portions thereof shall remain valid and in full
effecL
SE9IIOII 12. DI?BCIMTI. - This Ordinance shall take effect fifteen
( 15) days after its publication in a newspaper of eral circulation.
