NHAI/13013/CO/2015-16 Date : 06.02.2016 Circular No. NHAI/CO/03/2016 Sub: Amendments to the Fee Rules vide Notifications dated 16.12.2013 {G.S.R.770(E)], 29.12.2014 (G.S.8.02(E)] and 23.03.2015 [G.S.8.220(E)] on Overloaded Vehicles ~ Tolerance upto 5% of maximum GVW under CMV Rules/ MV Act vide Notification dated 07.01.2016. . Ret. Policy Circulars dated 05.05.2014 (Tech-154/2014) and dated 31.12.2015 (Tech-192/2018) on above subject. As per the amendments fo the Fee Rules cited in the subject, which are applicable on all Toll Plazas, a overloaded vehicle is a mechanical vehicle which is loaded in excess of the permissible maximum Gross Vehicle Weight (GVW) in respect of such vehicle specified for its category under MV Act and the Rules made thereunder. 2. Ministry vide Notification dated 07.01.2016 [SO 41(E]] amended the rules under MV Act relating fo maximum GVW as under (ii) offer the schedule, the following Explanation shail be inserted, namely : "Explanation - FoF the purposes of this notification, the tolerance upto five percent in the gross vehicle weight and safe axle weight as specified above may be alowed for the purpose of compliance to sub-section(3) of section 113 of the Motor Vehicles Act, 1988(59 of 1983).". 3. Copy of Notification dated 07.01.2016 is enclosed herewith alongwith the Principal notification dated 18.10.1996 and amendment dated 26.05.2000. The above explanation may be strictly complied with for determining whether the vehicle is overloaded or not. This Circular shall be applicable on all Toll Plazas (NHAI as well as Concessionaires). S.0.728(E), dated 18.10.1996. In exercise ofthe powers conferred by sub-section (1) of section $8 of the Motor Vehicles Act, 1988 (59 of 1988) and in supercession ofthe ‘notification of the Government of India in the Misty of Surface Transport 8.0. No.4) (E), dated the 4 July, 1996, the Central Government hereby specifies that in relation to the transport vehicles (other than motor cabs) of various categories detailed. in the Schedule below the maximum gross vehicle weight and the maximum safe axte weight of cach axle of such vehicles shall, having regard to the size, nature and number of tyres and maximum weight permitted to be carried by the tyes as per rule 95 of the Central Motor Vehicles Rules, 989, be- (vehicle manufacturers rating of the gross vehicle weight and axle weight respectively for each make and model as duly certified
