2 20-01-2022 It is submitted on behalf of learned counsel for the

petitioners that they have been allotted vacant piece of land in

the Bazar Samiti for running vegetable and fruit shops and

subsequently, some more vacant lands were allotted for

construction of temporary godown for storing and selling

vegetables and fruits in Bazar Samiti.

Notice has been issued by the S.D.O., Biharsharif to

vacate the land and to demolish their godown as the land is

required for some developmental project under smart city.

It is submitted that land has been duly allotted by the

Bazar Samiti and they were permitted to construct a temporary

godown on the land of Bazar Samiti and they are in possession

of the land and godown for several decades and it is the only

source of their livelihood.

Petitioners have also brought on record a letter issued

by Principal Secretary, Agriculture Department, Government of

Bihar, in which direction has been issued to the D.M., Nalanda

to identify the bonafide allottee in Bazar Samiti, whose godown

are to be demolished and to construct new shops and other

structures in order to shift them provisionally under new

constructed premises.

List this case on 24.01.2022 by which date necessary

instruction should be obtained by the counsel for the State.
