Advertisement for Empanelment of Advocates in NRDC

National Research Development Corporation (NRDC) was established in 1953 by


the Government of India, with the primary objective to promote, develop and
commercialize the technologies / know-how / inventions / patents / processes
emanating from various national R&D institutions / Universities and is presently
working under the administrative control of the Dept. of Scientific & Industrial
Research, Ministry of Science & Technology. NRDC invites applications from
eligible applicants across the country for empanelling them as Advocates. The
services of Advocates would be utilized to undertake various legal matters of
NRDC like representing NRDC in various courts/Tribunals/Commissions and
other Judicial and quasi-judicial authorities across the country, scrutinizing/vetting
the proposals for all policies/Acts/Rules/Procedures, drafting of
contracts/agreements, preparation of replies of RTI applications/Grievances, Legal
opinion etc.

The Eligibility criteria shall be as follows:

I. The Essential Qualification for the empanelment as an advocate in NRDC is


Degree in Law from the recognized university. Preference shall be given to
those who are having post graduation Degree/Diploma in Alternative
Dispute Resolution (ADR)/ Arbitration from any recognized University.
II. The minimum experience of Advocate/Law Firm required to be empanelled
for appearing before Hon’ble Supreme court and High Court should be 10
years and for district courts/ commission/ tribunals/ forums etc, the
minimum experience should be 5 years. Preference shall be given to those
who are presently working as Panel Advocates and handling arbitration
cases/ recovery cases of one or more central/ State Government
Organization/PSU in Hon’ble Supreme Court/High Court/ District Court /
Commission/ Tribunal.
III. The Advocate/law Firms should have adequate setup/infrastructure to deal
with the matters and should be currently practicing in the relevant fields as
aforesaid.
IV. The Advocates/Law Firms shall not appear/appearing against NRDC/DSIR
in any matter before any forum/Courts/Tribunals etc.
V. Advocates/Law Firms desirous of applying for empanelment may submit in
the format provided at ANNEXURE-A.
VI. The Advocate/Law Firms’ payment will be as per the office memorandum
O.M. No.26 (1)/2014-Judl. Dated 1st October, 2015 issued by Ministry of
Law & Justice, Department of Legal Affairs, New Delhi.
VII. No retainer fee shall be paid to any panel Advocate/Law firm merely
because such advocate has been empanelled.
VIII. That the initial Empanelment will be for 3 years which can be reviewed on
year to year basis and the same may be extended or withdrawn based on
their performance.
IX. Applications are invited in sealed envelope superscripted as “Application for
empanelment of Advocates”. Sealed envelope containing complete set of
hard copy of application along with Documents in support of the application,
if any, should be submitted by post to or delivered in person at NRDC
office.
a. Application should be typed and submitted on A4 size paper with all
pages therein in serial order.
b. All pages of the application should be signed. Any interlineations,
erases or overwriting shall be considered invalid.

X. The last date for submission of application is 9th March 2022 up to 05:00
PM. In case the designated day is declared a holiday, the next working day
will be deemed as the last date for submissions of Applications.
XI. On scrutiny, any application not found in desired
format/legible/complete/not containing clear information, or failing to fulfill
the relevant requirement will be rejected for further evaluation process at the
sole discretion of NRDC.
XII. Short listing or empanelment by NRDC does not create any right in favor of
shortlisted or empanelled Advocate to get appointed as dealing Advocate in
any case/matter.
XIII. NRDC reserves the right to accept or reject any or all applications received
without assigning any reason therefore whatsoever and the NRDC decision
in this regard will be final. No contractual obligation whatsoever shall arise
from the application process.
XIV. NRDC is not responsible for non-receipt of applications within the specified
date and time due to any reason including postal delays or holiday in
between.
XV. NRDC reserves the right to verify the validity of information provided in the
application and reject any application where the contents appears to be
incorrect, inaccurate or inappropriate at any time during the process of
application/empanelment.
XVI. The applicants shall bear all costs associated with submission of application
desired by NRDC. NRDC will not be responsible or liable for any cost
thereof, regardless of the conduct or outcome of the process.
