EXECUTIVE ORDER PROMULGATING NEW LOCALIZED GUIDELINES ON THE


MANAGEMENT OF CORONAVIRUS DISEASE 2019 (COVID-19) IN
CATBALOGAN CITY

WHEREAS, our 1987 Constitution mandates that the State shall protect and
promote the right to health of the people and instill health consciousness among them.
It also provides that the right of the people to travel maybe impaired in the interest of x
x x public health x x x.

WHEREAS, the Local Government Code of 1991 (RA 7160) mandates every
local government unit has to exercise the powers expressly granted, those necessarily
implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of
the general welfare;

WHEREAS, in the same law, City Mayors are mandated to carry out such
emergency measures as may be necessary during and in the aftermath of man-made
and natural disasters and calamities;

WHEREAS, Section 3 of Mandatory Reporting of Notifiable Diseases and Health


Events of Public Health Concern Act (RA 11332) expressly empowers the public health
authorities to declare quarantine, isolation, and rapid containment measures for disease
prevention and control;

WHEREAS, the National Inter-Agency Task Force for the Management of Emerging
Infectious Diseases as well as the Department of Health has indicated that the COVID-19
cases in the Philippines is slowly stabilizing and/or rapidly decreasing in almost all areas of
the Philippines, thereby, allowing the downgrading of alert levels in formerly critical COVID-
19 areas, such as the National Capital Region;

WHEREAS, with the availability of COVID-19 vaccines and considering the


substantial number of individuals inoculated by said vaccines, there is a need to shift
existing COVID-19 health protocols with less restrictive policies and guidelines to vaccinated
individuals to enable faster economic recovery in the City;

NOW THEREFORE, I, DEXTER M. UY, Mayor of Catbalogan City, by virtue of


the powers vested in me by law, do hereby promulgate this Executive Order

promulgating new localized guidelines on the management of coronavirus disease 2019
(COVID-19) in Catbalogan City;

SECTION 1. Quarantine Classifications of Catbalogan City Barangays.


1. All barangays of Catbalogan shall be under Modified General Community
Quarantine consistent with the declared quarantine classifications of the
IATF-EID;
2. To ensure swift response in addressing local COVID-19 transmission and
utilizing the Operational Guidelines on the Application of Zoning Containment
Strategy in the Localization of the National Action Plan against COVID-19
Response, the local IATF against COVID-19 is authorized to enforce
applicable guidelines on Enhanced Community Quarantine on specific
residential houses, building, business/work/school establishment, market,
street, and block without the need of an Executive Order. For purok, district,
village, subdivision and barangay, ECQ rules shall only be enforced upon
issuance of the undersigned of an Executive Order to that effect;
3. Travel restrictions shall also be enforced in specific residential houses,
building, business/work/school establishment, market, street, block, purok,
district, village and subdivision if these areas record high positivity rates for
all tested suspected cases; there exists high number of many clustered cases;
and/or in order to hasten contact tracing efforts. A separate Executive Order
shall be issued to enforce travel restrictions; and
4. Purok, district, village, subdivision, and barangay with more than
seventy percent (70%) of its constituents are fully vaccinated are
exempted from the effects or application of the preceding
provisions.

SECTION 2. Guidelines for businesses and transportation services.


1. Business establishments shall be allowed to operate subject to their strict
compliance to health standards as enumerated in Section 5 except in
barangays or areas declared as critical areas or under Enhanced Community
Quarantine, in which case, only essential establishments shall be allowed to
operate. Workers from said establishments shall only be issued with
medical clearances/health certificates if they are fully vaccinated.

Moreover, the following establishments shall only be allowed to operate in


limited capacities if all its workers are fully vaccinated, provided however,
that they shall only admit/allow customers and clients who are aklso fully
vaccinated:
1. Beerhouses, videoke bars, discobars and other similar closed
establishments whose primary business activity is selling liquors
and other alcoholic beverages;
2. Restobars, carenderias, eateries, and other similar food
establishments that sell as part of their menu liquors and other
alcoholic beverages;
3. Coffeeshops, milk tea shops, and other similar refreshment
shops;

4. Beach resorts, swimming pools and other open leisure areas;
and
5. KTV rooms.

The Joint Inspection Team (JIT) shall regularly inspect the said
establishments for said compliance. They shall recommend to the City Mayor
closure of any establishment that failed to comply with the herein stated
health standards.

2. Public and Private Transportation shall continue to operate subject to their


strict compliance with the 50% capacity limit, wearing of facemasks both
passengers and drivers and the existing ordinance, i.e. Ordinance 2019-008,
on coding scheme within the City, and all other relevant directives and
issuances from DOTr, LTFRB and LTO. Vaccination status of operators
and drivers are required during renewal of licenses or franchises of
public transport vehicles.

The Barangays, City PNP, City Law Enforcement Auxiliary Unit (CLEAU) and
authorized volunteer groups shall regularly monitor the compliance of the
transportation sector of the required public health standards. In accordance
with existing applicable ordinances, they shall issue citation tickets to
violators of COVID-19 related ordinances.

SECTION 3. Other highlight guidelines for areas that will be declared


under Enhanced Community Quarantine as provided for in the national
IATF Omnibus Guidelines in the Implementation of Community Quarantine for
areas:
1. Public gatherings shall be prohibited;
2. Religious gatherings shall be prohibited;
3. 24/7 curfew to all except to accessing essential services and goods as
provided for in Section 6. Strict Home Quarantine;
4. Curfew and Liquor ban are in effect as detailed in Sections 10 and 11 of the
Executive Order; and
5. All outdoor exercise shall be prohibited.

SECTION 4. Other highlight guidelines for areas under Modified


General Community Quarantine as provided for in the national IATF
Omnibus Guidelines in the Implementation of Community Quarantine for areas:
1. Public gatherings shall be allowed provided that participants shall be limited
to fifty percent, however said capacity limitation may be increased
upon approval of City’s IATF if the participants of the said public
gatherings are fully vaccinated;
2. Religious gatherings shall be allowed provided that participants shall be
limited to fifty percent however said capacity limitation may be
increased upon approval of City’s IATF if the participants of the said
religious gatherings are fully vaccinated;
3. Curfew shall be imposed only to minors consistent with the existing ordinance
on the said matter; and

4. Outdoor non-contact sports and other forms of exercise such as but not
limited to walking, jogging, running, biking, golf, swimming, tennis,
badminton, equestrian, range shooting, billiards, chess, and skateboarding
are allowed, provided, that the minimum public health standards are
observed. Other sports may be allowed if the participants/players are
fully vaccinated.

SECTION 5. Minimum public health standards. The following standards


shall always be complied with by all persons residing and visiting the City as well
as by business establishments, private and government offices during the
effectivity of this EO:
1. For business establishments, private and government offices and all other
premises which are open to public that allow their customers, clients, and
visitors to enter their establishment or premises, there shall be provision of
handwashing area at the entrance of said establishments, offices or
premises. Hand sanitizers or alcohol may be used in lieu of a handwashing
area;
2. All persons going outside their respective residences including customers or
clients as well as workers of business establishments, private and
government offices and visitors of all other public places shall be required
wear face masks, earloop masks, indigenous, reusable, do-it-yourself masks,
handkerchiefs, or such other protective equipment, or any combination
thereof, which can effectively lessen the transmission of COVID-19. FACE
SHIELDS SHALL NO LONGER BE REQUIRED UPON ENTERING
BUSINESS ESTABLISHMENTS, PRIVATE AND GOVERNMENT
OFFICES AS WELL AS VISITORS OF ALL OTHER PUBLIC/OPEN
PLACES.
3. All persons going outside their respective residences including customers or
clients as well as workers of business establishments, private and
government offices and visitors of all other public places shall always observe
social distancing of at least one (1)-meter. In view of Ordinance No. 2020-
008 mandating the wearing of masks and physical distancing, violators shall
be meted with fines of at least one thousand pesos only (Php 1,000.00);
4. For business establishments, private and government offices and all other
premises which are open to public, they are mandated to install physical
barriers and appropriate visible markers to encourage physical distancing.
These physical barriers and appropriate visible markers may be
dispensed with if the employees and/or workers are fully
vaccinated.
5. For business establishments, private and government offices and all other
premises which are open to public, management is mandated to designate
security and control officer/s to control and require compliance from
customers, clients, and/or visitors of these minimum public health standards.
6. They are also mandated to use of thermal scanners to screen clients,
customers, and visitors showing symptoms;
7. For contact tracing purposes, the management of the abovementioned
establishments, offices and premises shall scan the Quarantine Passes of
their clients, customers and visitors;

8. For business establishments, they are highly encouraged to slowly transform
to cashless transaction. Incentives shall be provided to said businesses
who shall have mechanisms and arrangements for customers without the
need for physical cash.

SECTION 6. Human mobility or stay-at-home restrictions. As


supplemental guideline to the omnibus guidelines of the IATF-EID on the
implementation of community quarantine released last September 23, 2021, the
following are provided:
1. In ECQ areas, only those with Quarantine All Purpose Pass, Worker’s Pass,
and Frontliner’s Pass shall be allowed to go outside their residence to access
essential goods and services, while in MGCQ areas, all holders of Quarantine
All Purpose Pass, Quarantine Relief Distribution Pass, Worker’s Pass,
Frontliner’s Pass and Individual Pass shall be allowed to go outside their
residence to access essential and non-essential goods and services;
2. Any person under fifteen (15) years of age, as well as those over sixty-five
(65) years old, those with immunodeficiency, comorbidities, and other health
risks, and pregnant women, including any person who resides with the
aforementioned, shall be required to remain in their residences at all times,
except when indispensable under circumstances for obtaining essential goods
and services or for work in permitted businesses, industries and offices, and
if the said person has been fully vaccinated by COVID-19 vaccines; and
3. The use of quarantine all-purpose pass shall be only limited to accessing
open businesses, offices, and services in the City. The same shall not also be
used for any cross-border transactions or purposes.

SECTION 7. Travel Protocols. As supplemental guidelines to IATF-EID


Resolutions, the following guidelines are hereby ordered:
1. Vaccinated travelers, returning residents and tourists entering the city shall
not be required to present any coordination letter or proof of coordination
upon entering the city;
2. Unvaccinated travelers, returning residents and tourists must secure proof of
coordination from the city. The following are the contact details to secure

Section 8. Curfew. In view of Ordinance No. 2020-009, 24-hour curfew shall


be imposed during enhanced community quarantine. Furthermore, in areas
under ECQ, all business establishments allowed to operate shall close at 8:00 PM
except those rendering essential services and offering essential goods. The
curfew shall be imposed upon all persons residing or visiting Catbalogan except
for those individuals categorized as “Authorized Persons Outside Residence
(APOR)”. In areas under GCQ, minors’ curfew is 10 PM consistent with Ordinance
No. Penalties shall be imposed upon violators of the said ordinance.

SECTION 9. Liquor Ban. In accordance with Ordinance No. 2020-010, there
shall be a ban on selling, delivery and consumption of liquor in barangays under
Enhanced Community Quarantine (ECQ). Thus, business establishments within
the barangays under ECQ are hereby prohibited to sell or deliver alcohol, wine,
beer, liquor and other intoxicating beverages to any person. Exemptions may be
granted to business establishments selling liquors in bulk orders and selling
beyond areas under ECQ or Catbalogan City. Furthermore, selling and delivery of
alcohol and other related products in MGCQ areas shall be allowed but
consumption of such in public open places such as sidewalks, roads, parks, and
open private areas shall be prohibited.

SECTION 10. Penalties. Violators of the provisions on curfew, liquor


regulations, non-compliance to the required minimum health standards such as
wearing of masks, social distancing, discrimination to frontliners, health workers
and COVID-19 cases and violation of herein stated quarantine guidelines shall be
penalized applying appropriate national laws and existing ordinances of the city.
Also, the Philippine National Police (PNP) Catbalogan City Police Office, City
Health Office, City’s IATF and CIC-EOC are hereby mandated to enforce the
applicable provisions of RA 11332 or the “Mandatory Reporting of Notifiable
Diseases and Health Events of Public Health Concern Act” in which violators of
the following prohibited acts shall be penalized with a fine of not less than
Twenty Thousand Pesos (P20,000.00) but not more than Fifty Thousand Pesos
(P50,000.00) or imprisonment of not less than one (1) month but not more than
six (6) months, or both such fine and imprisonment, at the discretion of the
proper court.

SECTION 11. Repealing Clause. All executive orders, local rules and
regulations or parts thereof which are not consistent with this Executive Order
are hereby repealed, amended, or modified accordingly.

SECTION 12. Separability Clause. If, for any reason, any part or provision of
this order is declared invalid or unconstitutional, any part or provision not
affected thereby shall remain in full force and effect.

SECTION 13. Effectivity. This order shall take effect on November 8,


2021, 12:00 AM until revoked or superseded by subsequent issuances.
