Dear Sir,
Owner acknowledges that in any professional contractual relationship it is essential that the
parties involved work together in a conciliatory manner to accomplish a satisfactory outcome.
Bearing this in mind, Owner confirms its willingness, as it has always done, to work with
Contractor to achieve a win/win situation that is fair and equitable to all.
However, clearly notwithstanding the numerous requests and instructions to do so. Contractor's
continuous failure to comply with the Contract by satisfactorily updating its "Control Schedule"
since August 2019 has been a major contributory factor influencing the failure to identify key
issues that have had a direct impact on area handovers.
Contractor's inability to mobilize its resources (plant, labour, equipment, supervisory staff and
temporary facilities) in accordance with the "Control Schedule" has not helped the situation,
resulting in Contractor being unable to address the work fronts available for handover due to
these issues. Moreover, it should be recognized that a lack / late issue of IFC information and IFC
information issued with extensive holds has seriously impeded the Contractor's ability to
undertake work in areas that are available.
Contractor has also not been able to identify beyond reasonable doubt or provide any significant
evidence to support its contentions of delay impact by Owner. This being largely due the failure of
Contractor to update the Control Schedule and the lack of Contractor definition under the
construction activities within the "Control Schedule" that was conditionally approved in August
2019.
Owner will not be drawn or comment on the conclusions reached by Contractor in its letter as to
do so at the present time will not be productive in moving forward to achieve a successful
outcome of the Project. Owner does, however, reserve the right to revisit and reconcile these
Issues under the provisions of the Contract and seek redress at the appropriate time where the
Contract allows for this.
In the meantime, Owner encourages Contractor to diligently proceed with fulfilling its contractual
obligations by bringing the Control Schedule to the appropriate level and working with all parties
involved in the spirit of mutual cooperation.

With reference to the Owner's letter No. 286/KPB1000/2020-30, Contractor hereby responds as
follows.
In general. Owner's statements in the letter are not supported by precise evidence, rather it is a
groundless allegation based on prejudiced, and misleading records. For an objective
understanding of the circumstances, Contractor hereby refutes to Owner's statements point by
point as below.
• Point 1: Contractor has continuously informed Owner of specific areas being delayed or
expected to be delayed, and duly requested handover as listed in 1.1.2.C of attachment 1 of
the Contractor's letter No. 26071-JO-PMC-LT-01846 and Attachment 1 of this letter. Moreover,
Owner has been informed of such information during regular Area Handover meetings.
• Point 2: Contractor provided the updated Level 3 Schedule through 26071-JO-PMC-TR-
00300 dated 10 May 2019. within 90 days after the Contract Effective Date(27 February 2019)
under the Contract, and the Level 3 Schedule Rev.000 was approved by Owner through
Transmittal No. PMC-01-TRANSMIT-003675.
• Point 3~5: The engineering, procurement, and construction Work of the Project shall be
carried out simultaneously, for the smooth execution of the Work. Thus, the performance of
construction Work based on the partial 'Hold' mark on Issue for Construction ("IFC") drawings,
is the essential part of Work for the completion of Project in accordance with Schedule of the
Project. Importantly, such Issuance of IFC drawing with 'Hold' enables Contractor to perform
Construction Work for un-Hold parts. Revisions of such drawings to develop the design and
to release 'Hold' are also the general process of the detail engineering work, thereby allow
Contractor's performance of the Construction Work with properly developed design
information. Hence, Owner's assertion that Contractor has issued drawings with 'Hold' for
cash flow Is groundless, and is misleading in such circumstances.
As shown in Hold status of Stone Column("S/C") drawing (Attachment 3), the quantity of
available S/C drawing without hold for construction of each ISBL and OSBL is 126,135 m^
and 75,928 m' respectively, which is 72% and 97% of the total quantity. Based upon the above
Actual records, the figure of 40% S/C's IFC drawing with hold stated by Owner is not correct
data, since the portion of S/C drawing with hold is 28% for ISBL and 3% for OSBL in the total
quantity of the drawing.
Additionallly, the part of design Hold of S/C drawing is originated from Owner EOT Risk events
addressed in the below response to Point 9-11.
Point 6-8: The background of the circumstances is that Owner has continuously postponed
forecasting dates for Site handover and split the area through Area Handover Meetings from
16 September 2019 as referred to the Letter No. 26071-JO-PMC-LT-01846 and Attachment
2. Contractor's plan to mobilize resources has been prevented and disrupted by such Site
handover delay by Owner accordingly.
Despite the above situation, Contractor has mobilized sufTtcient Construction Equipment
having the capacity to carry out cumulative 208,000 m3 of S/C works until the end of May
2020, whereas cumulative work-front as of the end of May 2020 is only around 137,068 m3
based on the transferred area of Site specified in Attachment 2.
Furthermore, continuously changed Site handover schedule by Owner did not allow
Contractor to effectively revise the actual plan of Work, including the mobilization for
manpower and Construction Equipment, Subcontract, Temporary Facilities, and other related
activities, to avoid the significant idle resources as notified through 26071-JO-PMC-LT-00728
and 26071-JO-PMC-LT-01138.
• Point 9-11: The schedules of issuance for S/C drawing and Pile Location Plans were affected
by numerous events previously notified to Owner, including but not limited to deficiencies in
design data, delay, and revocation for Owner's confirmations/instructions and the provision of
updated/required design data.
The Extension of Time request in relation to such events is submitted for Owner's review and
approval through Contractor's letter No. 26071-JO-PMC-LT-01846.
Additionally, the ground of Owner's opinion for the piling productivity rates is not provided in
Owner's letter, therefore Contractor could not review and/or clarify for such argument.
In Contractor's point of view, the productivity rates per mobilized Construction Equipment and
its related resources, provided by valuable Indonesian Subcontractors, are superior and
sufficient to execute Construction Work.
As the S/C work is the pre-requisite of piling work in general, and S/C work has been affected
by the circumstances addressed in the above-mentioned Contractor's response to Point 6-11,
piling work also has been adversely affected accordingly.
In conclusion. Owner failed to provide Contractor with possession of the Site in accordance with
the Level 3 Schedule (Rev.OOO). Furthermore, Owner has continuously changed the forecasting
schedule of Site handover, and split area of Site into total 99 areas rather than 4 Clusters of Site,
which is the concept of Site handover Schedule provided by Owner during the bidding stage as
specified in Attachment 2 of this letter. The split of area for Site handover limits the work-front for
Contractor's construction Work, thereby prevent Contractor's performance of work as planned
and cause the idle resources accordingly. Such idle resources inevitably result in additional cost
and time impact on the Project, and furthermore does not contribute to the execution of
Construction Work due to the limited work front.
As addressed in Attachment 2, only 20 out of 99 Nos. areas of Site have been transferred to
Contractor, and even 22 out of 99 Nos. areas of Site's handover schedule have yet to be
confirmed as of 22 June 2020 (see Attachment 2 marked as "TBD").
Moreover, Contractor's construction Works have been disrupted due to numerous punch items of
Site handover, including unforeseen material such as underground obstacles, unpredictable
existing Facilities, and contaminated soil as notified through letters listed in Attachment 1 of this
letter. Such punch list activities can not be closed out as a simultaneous operation, as Contractor's
construction Work at the area with punch item can only be started after resolution thereof.
Lastly, the way of Owner's assertions provided in the above-mentioned Owner's letter is neither
in the appropriate contractual manner nor in accordance wth recognized international industry
practices.
In this regard, Contractor has not been able to plan and formulate the efficient mitigation plan,
due to the absence of the fixed Site handover forecasting schedule and pending Owner's
confirmation for design issues. Therefore, Owner is requested to provide a firm Site handover
schedule and confirmation for pending design issues as soon as possible, to avoid further impact
on the Project and to re-plan the Schedule of the Work properly.
