Petitioners/accused Ns! ‘The State represented by, ‘The Inspector of police, ‘Thogaimalai PS., Cr.No.227/2021. Respondent/Complainant. This petition coming on for final hearing before me today in the presence of Thiru. P, Saravanan, advocate for the petitioners and of Selvi. T.M. Dhatchayani, Public Prosecutor appearing for the state and upon hearing the arguments of both sides and having stood over for consideration till this day, this Court has passed the following, ORDER This is a petition filed by the petitioners w/s.439 of Cr.P.C., seeking bail. The learned counsel for the petitioners submits that a case has been registered against the Petitioners for the offences punishable u/s 379 of IPC and Sec. 21(1) of Mines and Minerals (Development and Regulation) Act. According to him, it is alleged by the prosecution that the petitioners illegally transported river sand. In fact, the petitioners have loaded soil which was dug up in a well of a private land and same was used to fill up the pits in the lands. He further submits that the petitioners have been in judicial custody on and from 30.05.2021. He therefore prayed for granting bail to the petitioners. The learned Public Prosecutor submits that the petitioner illegally transported soil in a JCB and tipper lorry and investigation is pending. Considering the gravity of offence and the period of incarceration of the petitioners, this Court is inclined to grant bail to the petitioners subject to the following conditions:- i) The petitioners shall deposit a sum of Rs.10,000/-each before this Court and on showing the receipt thereof, they are ordered to be released on bail on their executing own bonds for a sum of Rs.10,000/-each to the satisfaction of the Superintendent, Sub-Jail, Kulithalai. {i) They shall not tamper with the evidence and they shall make themselves available to the investigating authorities as and when required. Further, they should not indulge in any unlawful activiti i) They shall sign before the respondent/police daily at 10.00 a.m. until further orders.
