JUDICIAL AFFIDAVIT
OF
OSCAR VILLEGAS

This Judicial Affidavit of OSCAR VILLEGAS, as one of the Heirs of the Estate
of Evaristo Abellero and Benidecta Hernane, is executed to serve as his direct
testimony in the instant case.

This Judicial Affidavit is being offered to prove:

A. That the Plaintiffs Executed a Special Power of Attorney designating one

of their co-heirs, OSCAR VILLEGAS as their representative in the instant
case;

B. That OSCAR VILLEGAS mother is one of the six children of the late
spouses Evaristo Abellero and Benidecta Hernane, and that by operation
of law they are entitled to a share to the Estate left behind by Evaristo
Abellero and Benidecta Hernane;

C. That promptness of reporting upon discovery of the FACT of LOSS to the

Registry of Deeds;

D. All other related matters, facts and circumstances relevant and material
to this case.

This Judicial Affidavit was taken at the office of Atty. Michael Pert D. Gonzaga
at Room 201 2nd Floor DCT Building, Rizal Street, Tagum City.

Questions were propounded by Atty. Michael Pert D. Gonzaga in English and

thereafter translated to Bisaya which the Affiant fully understands. The
questions were numbered consecutively. Each question is followed by the
answer of the witness.

kamatuoran lang? (Do you swear to tell the truth and nothing but the truth?)

tinuod ? (Are you aware that you are answering the questions asked of you
under oath and that you may face criminal liability for false testimony or
perjury if you will not tell the truth?)

am OSCAR VILLEGAS, of legal age, Filipino, married and currently residing at
Purok 5, Piglabasan, Anonang, Kaputian, Samal Davao del Norte)

Q4: Ikaw ba kini si OSCAR VILLEGAS ang isa sa mga reklamante ug

representante aning kasoha? (Are you the same OSCAR VILLEGAS, one of the
plaintiffs and the representative of the Plaintiffs in this case?)

A4: OO ako sir (Yes Sir.)

related by Affinity or Consanguinity with the herein Plaintiffs? )

A6: Yes sir, they are my brothers and sisters and we are the children of the
late spouses Filex Villegas and Catalina Abellero Villegas and they have
executed an SPA before notary public Atty. Michael Pert D. Gonzaga ; (Oo

sila Filex Villegas ug Catalina Abellero ug nagpabuhat kini sila ug SPA sa

ana? (Now, you said the “late” Evaristo Abellero Villegas, why is that
so? )

A7: Namatay akong lolo adtong Oktobre 5, 1973 mao pud nakabutang
saiyang sertipikisyo sa kamatayanon, ug kanabutang sab dira na
sertipikasyon sa kamatayun na menyo sila sa akong lola na si Benedicta

 Hernane (My grandfather died last October 5, 1973, as stated in his
Certificate of Death, it was also stated in that certificate of death that he
was married to my late grandmother Benedicta Hernane) ;

TCT- T-20876 ( It is unfair sir as the title of our rightful inheritance, the land that
we possessed and tilled this very day and part of our rightful inheritance from

our Lolo Evaristo and Lola Benedicta is registered only in the name of Uncle
Islaw or Wenceslao Abellero as found in TCT T-20876);

mentioned that the land that you possessed and tilled up to this very day is
registered in the name of of Uncle Islaw or Wenceslao Abellero, how did that
happen if you knew?)

na siya lang isa ang anak sa among lolo Evaristo Abellero ug lola Benedicta
Hernane ug sa pagsundog sa perma sa among lola nga si Benedicta Hernane
sa Extra-Judicial Settlement of the Estate of Deceased Evaristo Abellero with
Sale instrument denominasyon nga dokumento numero 443, Panid 89, Libro
XXIV, Tuig 1976, notarial nga rehistro Atty. Alberlo O. Lumakang nga taga
Davo City (Uncle Islaw willfully and intentfully deprived us of our of our rightful
and lawful share by making it appear he is the only child of our paternal
grandfather Evaristo Abellero and by forging the signature of my grandmother,
Benedicta Hernane, in an EXTRA-JUDICIAL SETTLEMENT OF THE ESTATE OF
DECEASED EVARISTO ABELLERO WITH SALE instrument denominated as Doc.
No. 443, Page 89, Book XXIV, Series of 1976, of the Notarial Registry of Atty.
Alberto O. Lumakang of Davao City);

MARKING. It is respectfully prayed to the Honorable Court that the Machine

Copy of the EXTRA-JUDICIAL SETTLEMENT OF THE ESTATE OF DECEASED
EVARISTO ABELLERO WITH SALE instrument denominated as Doc. No. 443,
Page 89, Book XXIV, Series of 1976, of the Notarial Registry of Atty. Alberto O.
Lumakang of Davao City be marked as Annex “D” and the name and
signature of Benedicta Hernane as appearing in the same document as
be marked as Annexes “D-1 and D-2” as previously attached in the complaint;

unsa imong pasabot? (When you mentioned that the signature of your
grandmother Benedicta Hernane was forged, what do you mean with it?)

is a known fact in our community that my grandmother is illiterate and
cannot sign her own name sir. Further, sir, I am intimately familiar with
the signature of Uncle Islaw Abellero as I worked for him for several years
as his former store keeper and I will attest that the alleged cursive
signature of my grandmother as appearing in the EXTRA-JUDICIAL
SETTLEMENT OF THE ESTATE OF DECEASED EVARISTO ABELLERO
WITH SALE instrument denominated as Doc. No. 443, Page 89, Book
XXIV, Series of 1976, of the Notarial Registry of Atty. Alberto O. Lumakang
is Wenceslao Abellero’s own doing);

Q9: Karon balik ta sa mga anak ni Evaristo Abellero ug Benedicta Hernane,

asa naman sila karon? Unsa ilang gebuhat pagkabalo aning EXTRA-
JUDICIAL SETTLEMENT OF THE ESTATE OF DECEASED EVARISTO
ABELLERO WITH SALE kung kabalo ka ? (Now going back to the
children of Evaristo Abellero and Benedicta Hernane, where are they
now and what did they do when they learned about the EXTRA-
JUDICIAL SETTLEMENT OF THE ESTATE OF DECEASED EVARISTO
ABELLERO WITH SALE, if you know?)

A9: Patay na sila tanan sir. Pero nag pasaka sab na sila ug kaso nga
Recovery of Ownership, Possession, Damages and Attorney’s Fees adtong
Disyembre 23, 1992 laban sa kahimtang sailang igsuon na si Wenceslao
Abellero (They are all dead sir, but they instituted a case for Recovery of
Ownership, Possession, Damages and Attorney’s Fees last December 23, 1992
against the estate of their brother Wenceslao Abellero)

Q10: Naa sa ako karon ang sertipikado na kopya sa reklamo nga nay civil case
number 93-69 nga gekaso sa mga manunod nila Evaristo Abellero ug
Benedicta Hernane batok sa kahimtang ni Wenceslao Abellero . Mao b
ani imong pasabot na kaso? (I have with me in my possession a certified
copy of the Complaint with civil case number 93-69 filed by the Heirs of
Evaristo Abellero and Benedicta Hernane against Estate of Wenceslao
Abellero, is this the same case you mentioned just a while ago?)

A10: Oo Sir mao kana sir pero na dismiss na na kaso sir (Yes sir,
definitely that is the one sir, unfortunately said case was dismissed);

MARKING. It is respectfully prayed to the Honorable Court that the machine

attached in the complaint;

Q11: Nganong na dismissed man kung kabalo ka? (Why was it dismissed if
you know?)

A11: Na dismissed tungod nay Joint Motion to Dismiss na ge file sa

duha ka aprtido (It was dismissed sir because there was this Joint
Motion to Dismiss filed by both parties).

Q12: Nganong naa may Joint Motion For Dismissal? (And why was there a
joint motion for dismissal?)

A12: Ang Joint Motion Dismissal kay gebuhat tung naa nay oral nga
kasabutan tali sa manununod ni Wenceslao Abellero ug sa among ginikanan
mahitungod sa partisyon sa lupa sumala kung unsay husto ug subay sa
balaod sa manununod ni Evaristo Abellero ug Benedicta Hernane ug ang mga
manununod ni Wenceslao Abellero na ipatuman ang Deed of Sale or a Deed of
Donation sa legal nga mga manununod nga nay epekto sa legal na titulo saila
(A Joint Motion for Dismissal was initiated sir as there was already an oral
agreement between the heirs of Wenceslao Abellero and our parents regarding
the partition of the property according to what is right and lawful among the
heirs of Evaristo Abellero and Benedicta Hernane and that the Heirs of
Wenceslao Abellero would execute a Deed of Sale or a Deed of Donation to the
other lawful heirs which in effect would convey legal title to them);

heirs of Wenceslao Abellero reneged on the agreement and will not sign
any document despite the lapse of 27 long years already)

Q14: Ni ingon ka gebalibad unsay ba pasabot nimo ana?(When you said

renege what did you meant with it?)

A14: Dili lang sila mu perma sir. Dili nila ihatag kung unsay sakto para
sa amoa bisan pa ug kami najud ang nagpuyo aning lupa sugud pa sauna. Nag
organized ko ug reunion adtong ni-aging tuig pero na uli ra kin isa gubot kay
dili mi nila bayaran sa kung unsa among nagasto na mao wala koy laing
kapilian kundi ang magpasaka ug kaso kanila ug ako hapit nako ma senior
citizen mao kailangan nako e siguro ang kaugmaon sa akong mga anak ug mga
apo labi na nga ang rehistrado nga tag-iya kay walay paki-alam sa kabtangan,
labi na wala jud sila nagpuyo sa maong lupa dili pareha namo na didto jud mi
nagpuyo ug didto namo gekuha among panginabuhi ug ako pud gabayad sa
buhis sa lupa (They just won’t sign sir, they will not give us our lawful share
despite the fact that we had been in possession of our share since time
immemorial. I organized a reunion last year but it turned messy as they will not
hand it to us without any payment, so I was left with no choice but to file this
instant case as I am nearing Senior Citizen age sir and I do see the need to
secure the future of my children and grandchildren especially since the
registered owner shows no care to our property as a matter of fact they don’t live
there as they have other land unlike us who rely on said property for our daily

means of living and also I am the one paying for the property taxes of the
property in dispute);

Q10: Naa diri sa ako ang resibo sa Real Property Tax nga ge issue sa Office
City Treasurer sa Samal, Davao del Norte ng age isyu sa lahi lahi nga
petsa nga gebayaran tanan ni Osar Villegas. Mao ning resibo imong
pasabot? (I have with me in my possession original receipt of Real
Property Tax issued by the Office City Treasurer of Samal, Davao del
Norte dated differently all paid by Oscar Villegas. Is this the same receipt
you mentioned just a while ago?)

A10: Oo Sir. Mao kana sir (Yes sir, definitely that is the one sir)

MARKING. It is respectfully prayed to be Honorable Court that the original copy

of receipt of the Real Property taxes be marked as Annex “F”, “F-1”, “F-2” and
“F-3” as previously attached in the complaint;

A16: Ako pud ang nagpa survey sa maong yuta nga gepangutana
sumala sa kasabutan adtong tuig 1995 nga ang maong yuta ma bahin sa patas
(I also caused the surveying of the land in questioned according to what was
agreed upon way back in 1995, that the disputed property be divided equally);

Q10: Karon ipakita nako saimo ang kopya sa survey ni adtong Setyembre 16-
17, 2004 ge isyu ni Geodetic Engineer Navarro R. Eustaquio

I am showing you a certified copy of a survey dated September 16-17, 2004,

issued by Geodetic Engineer Navarro R. Eustaquio that one Oscar
Villegas paid for Php 30,000.00, is this the same receipt you mentioned
just a while ago?

MARKING. It is respectfully prayed to be Honorable Court that the machine copy

of a Survey Map showing equal distribution as to the heirs of Evaristo Abellero
and Benedicta Hernane be marked as Annex “I” and the receipt of the said
survey and Annex “I-1” be marked as previously attached in the complaint;

Q17: Karon, imong na ingon na ang ubang igsuon saimong mama Catalina ,
uban niyang igsuon sama ni Wenceslao kay patay na, naa baka nahibal-an na
uban manununod nila? (Now you mentioned earlier about the other siblings of
your mother, Catalina and that of Wenceslao are already dead, do you know if
they did have some heirs?)

A17: Oo sir. Ang uban Nakong mga ig-agaw kay naka puyo na sa kung
asa ilang bahin nakabutang maong kadtong tuig 1995 na nagsugud ang kaso,
kumpyansa sila ug mas gepili nil ana dili nalang mu apil sa among gena
atiman nga kaso. (Yes sir. My cousins are currently residing in their share of
the disputed land as specified informally way back 1995, unfortunately, they
became complacent because of the fact that they are in possession, so that is
why they chose to not participate in this instant case);
