TECHNICAL ASSISTANCE CONTRCT FOR OPERATION AND MAINTENACNE OF WAGON TIPPLER WITH M/S

THYSSENKRUPP INDUSTRIES.

SCOPE OF WORK AND OTHER TERMS & CONDITIONS

1.0 SCOPE OF WORK

The scope of work covers three shift Operations and technical assistance for
Mechanical, Electrical, Instrumentation maintenance of M/s Thyssen krupp supplied &
commissioned Wagon tipplers 02 nos. (including associated apron feeders, puller cum
pusher arrangement & SACs) WT 1 &2 at NTPC - Kaniha STPS along with related sub
systems/auxiliaries on round the clock basis. Includes desk operation of Thyssen krupp
supplied wagon tippler and maintenance support for maintaining the accessories such as
hydraulic power packs, electrics, PLCs, control rooms (excluding CHP main control
room), control panels etc. for the equipment mentioned above.

If required agency needs to deploy manpower for three shift operation depending upon
the rake receipt condition.

The M/s Thyssen krupp ind. here after mentioned as agency in PR document shall be
responsible for managing operations and technical assistance for maintenance including
desk operation of wagon tippler complex (WT1 & 2)

1.1 Wagon Tipplers & Conveying Plant Package

1.2 Battery Limits

Plant Equipment:
From - Wagon Tippler Table
To - Discharge Point of Conveyor at TP -31
This includes operations and maintenance of the system with the resources as
stipulated in the organigram.

1.3Tentative Organigram attached for reference separately in pradip file. To be


included in the contract document.

1.4Qualification and experience of the various roles described in the Organigram will
be as per the attached sheets with PR file in pradip.

1.5Scope of Activities

A. The scope of activities under this contract includes operation of WT 1&2 and
technical assistance for maintaining two sets of Wagon tipplers, SACs & AFs & Dribble
conveyors as per the requirement under scope of this contract.
B. All mechanical / hydraulic / electrical / electronic / C&I / PLC / Control
Accessories support & technical assistance services shall be provided by the agency.
Providing required mechanical and electrical technicians for attending faults and
break downs as and when required round the clock for equipment covered under the scope
of this contract.
C. Electrical maintenance jobs will cover from switch gears (after MCC) to electrical
motors including all electrical accessories supplied by M/s Thyssen krupp ind.
Periodical checking of electrical controls, safety features, etc. shall be carried out
by agency. This will be applicable for all electrical equipments covered under scope
of this contract.
D. Operation shall be carried out round the clock if requird. Puller cum pusher and
SAC control desk panels will be manned by the NTPC. Adequate deputation of manpower
shall be done for operation and maintenance as per requirement. If required both WT to
be operated for unloading two rakes simultaneously.
E. NTPC shall place wagons for unloading, in the reach of side arm charger with brake
released condition. NTPC shall deploy manpower for placement of wagons through SAC to
cradle and after unloading placement of the wagon in the outhaul line. Sufficient
manpower shall be deployed at the hopper grate to keep the grate clear for faster
unloading by the NTPC. Disengagement and engagement of brake lines shall be done by
the NTPC.
Consumables like jute, marking cloth, kerosene oil, general purpose welding
electrodes, DA/Oxygen gases, rustling, wrapping and coating materials etc will be
arranged by the NTPC.
M/s Thyssen krupp ind. shall submit list of T&P to be deploye d for maintenance job to
EIC in advance prior to the commencement of work and get the items checked at site.
G. M/s Thyssen krupp ind. shall submit list of staffs before commencement of work.
Frequent change of workforce shall be avoided where work output could be affected.
Local outsourcing of manpower not allowed. M/s Thyssenkrupp should arrange staff and
engineers preferably on the roll of company. It the responsibility of the agency to
remove all staff after completion of the contract. Retention of any staff is not
allowed in any case.
H. All jobs shall be carried out in an approved manner to the satisfaction of the
Engineer-In-Charge and the quality of the job should be as specified by him (EIC). M/s
Thyssen krupp ind. shall ensure that the equipment to be attended / dismantled
carefully without damage to any part. However, if there is any such damage before
dismantling of the equipment, the same shall be shown to the Site Engineer.
I. M/s Thyssen krupp ind. shall rectify faults noticed during trial run of the
equipment after each maintenance job immediately
J. Safe working procedures will be established.
K. NTPC shall provide all the spares applicable as per requirement of site on time.
L. All interruptions shall be attended immediately, major breakdowns (likely time to
repair more than 2 hours) like module replacement, drive system changing, alignment,
etc shall be attended to during general shift
M. Boulders removal from wagon tippler grill in the scope of NTPC and to be dumped it
to nearby area (within 100 meters from the WT complex)
N. GENERAL MAINTENANCE
TIPPLER DRIVE:
If it is required to disconnect the tippler-drive unit, first bring the tippler to a
state of balance (around 85 deg.), otherwise the machine will swing rapidly upon
its pivots as soon as the drive assembly are removed.
A) HYDRAULIC DRIVE
To balance the tippler, release the hydraulic brake mounted on hydraulic motor
gradually and let the machine turn until it is in equilibrium, now the drive unit may
safely be disconnected. For gradual brake release, refer hydraulic motor manual.

B) ELECTROMECHANICAL DRIVE
To balance the tippler, release the electromagnetic thruster type disc / drum
brake to bring the machine to its equilibrium position. Now the drive unit may
safely be disconnected

OVERTRAVEL (BACK UP) LIMIT SWITCH:


The operating level of this switch is actuated by strikers mounted on end shield.
The setting of the switch requires adjustment.
A. Rotate the tippler to its normal "TIPPED" position.
B. Set striker so that any furt her rotation of the tippler in the "END"
direction will trip the switch.
C. Rotate the tippler to its normal "0 DEG" position.
D. Set striker so that any further rotation in the "0 DEG" direction will trip the
switch.
ENCODER
Encoder is provided to detect various positions (in terms of angle) so that assigned
functions of wagon tippler/side arm charger are carried out. Encoder is mounted
on main shaft. Encoder signals are given to PLC which reads these signals in terms
of wagon tippler positions & related functions are executed.

1.2 Checking tightness of main pivot bearing base bolts.
1.3 Platform rail fixing bolts & rail foundation bolts at inhaul & outhaul side.
1.4 Toothed rim connection bolts.
1.6 Checking tightness of WT clamp assembly bolts.
1.7 Checking tightness of side beam & end ring joint bolts
1.8 Checking tightness of platform & bearing eye fixing bolts.
1.9 Checking tightness of guide roller and cup & cone fixing bolts.
1.10 Checking cylinder pin connections.
1.11 Checking of foundations / grouting / foundation bolts for crack & damage.
2. HYDRAULIC:
2.1 Oil top up.
2.2 Oil cooler cleaning (By compressed air).
2.3 Foundation bolts of power pack, electric motor, pump base checking for
tightness.
3. ELECTRICAL:
3.1 Power cable connection tightness checking.
3.2 Spray of CRC on power & auxiliary contractor contacts.
3.3 Cleaning of solenoid coil plug and tightness checking.
C. SIX MONTHLY:
1. MECHANICAL:
1.1 Wear on guide roller, cup & cone arrangement readjusts gu ide roller / cup &
cone arrangement if required.
1.2 Checking tightness of rack fixing bolts.
1.3 Checking tightness of all foundation base bolts.
1.4 Lubrication of Electrical Motor Bearing.
1.5 Replace worn out top clamp rubber pads.
2. HYDRAULIC:
2.1 Cleaning of oil tank and oil replacement.
2.2 Replacement of filter element (After six month or after filter clog
indication).
2.3 Oil cooler cleaning.
2.4 Servicing of pressure relief valve.
3. ELECTRICAL:
3.1 Physical inspection of cable.
D. YEARLY MAINTENANCE:
1. Overhaul the whole machine.
2. Checking of wear of toothed rim & pinion.

1.6 BOQ item namely 'Amount linked to Safety Aspects/ compliance to Safety Rules.
Provisions pertaining to Safety Aspects / compliance to Safety Rules 5 % of total
estimated contract value is separated and will be paid on quarterly basis after
compliance.

2.0 SPECIAL TERMS & CONDITION OF CONTRACT


The contract for Operation including round the clock shift operation from WT control
room & Maintenance of 02 nos. Wagon tipplers & associated equipments.
Scope of work of this contract envisaged supervision of maintenance job, operation of
the desk including desk engineer deployment.
Routine/preventive/breakdown maintenance of all equipments/ sub system covered in
contract scope.
The agency shall submit the detailed list of his staff before the commencement of the
work. Frequent change of workforce will affect the work performance which will not at
all be accepted. Any change in manpower deployment will have to be done by prior
approval of EIC. All maintenance job will have to be carried out with valid permit to
work from main CHP control room. PTW can be withdrawn at any instant, if required by
NTPC.
It is the responsibility of the maintenance in charge of the agency to depute his
supervisor for the jobs and at the time of returning the PTW it has to be recorded in
a separate register the details of manpower deployed, defect found, action taken and
spares consumed. Copy of the same shall be submitted to EIC on weekly basis for review
of work.

Attendance register shall be maintained by the agency and should show these details to
area ENGINEER every morning.
The agency has to ensure that all his workmen follows the safety measures, rules and
regulations defined in GCC of O&M works of NTPC Kaniha.
Necessary scaffoldings approach requiring ladders and platform etc for
working/cleaning shall be arranged by the NTPC.
The agency has to arrange the list of T&Ps and consumables required. The healthiness
of T&P shall be jointly inspected by agency and NTPC every month and report needs to
be submitted by the agency to EIC.
Supply of spares, lubricant and grease is in the scope of NTPC. The contractor shall
maintain the record of fast moving spares and consumables. The contractor shall give
written request for spares one day in advance to prepare SIV. Also details of
consumption of spares and consumable shall be submitted to EIC on fortnightly basis.
Transportation of spares/consumables from site stores/central store to work site and
return of old worn out spares and their proper stacking shall be treated as included
in the scope of NTPC. Agency will make required arrangement for shifting of spares
from central store to working site.
Scraps/rejects generated during maintenance work will have to be returned to scrap
yard/ any identified location at his own means as per the direction of EIC.
The dismantled usable parts of the equipment are to keep in cleaned place covered
properly and the custody of the parts/spares equipment from damaged/theft/pilferage is
the responsibility of the agecny.
Agency shall furnish periodic (week/fortnight/monthly/half yearly) maintenance
schedule of all major equipment including details of work/checking to be carried out
by them so that maintenance of equipment is not affected. Engineer in-charge shall
approve these schedules.
Agency shall take all necessary precautions to operate and maintain the equipment as
per manufacturer's recommendations. The log sheet shall be maintained to indicate
normal, maximum and minimum values for each parameters of main equipment.
The contractor has to maintain the records of the work being carried out daily, inputs
required, manpower deployed etc and inform the EIC on daily basis. All daily logging
work shall be recorded by agency in a bound register to be arranged by him as per
Performa approved by engineer in charge.
All stand-by equipments shall be uniformly put into operation to have proportionally
equal running hours.
Over loading and over stressing of equipment will not be allowed.
3.0 SITE ORGANISATION OF THE AGENCY / SUPERVISION OF WORK

The Site-In-Charge should be a technically competent person capable of understanding


and ensuring satisfactory execution of technical aspect of work in addition to his
administrative function.
In addition to the Site-In-Charge the contractor has to ensure supervision of work in
progress by deploying technically competent, experienced of similar operati ng system
and authorized site supervisors equipped with mobile.
For attending routine and break down maintenance work, the Site-In-Charge or Shift
Site Supervisor of the contractor has to be available in side the plant round the
clock as and when required for the entire period of contract (including holidays).
Shift Site Supervisor of the contractor has to be in close contact with the EIC or his
authorized representative to take instruction regarding commencement of work and to
report progress of work.
The names of Site-In-Charge and Shift Site Supervisors shall be communicated in
writing to EIC prior to commencement of work.
Collection and return of materials required for execution of work. The site in charge
of the contractor shall authorize two of his representatives to collect materials from
NTPC as per requirement of work.
In case of emergency, if required, it is the responsibility of agency to call
additional manpower as directed by the EIC.

4.0 DESIRED PERFORMANCE LEVEL AND PENALTY


Performance Measure and Performance Guarantee
A. Penalty deduction for not deploying manpower as per the organigram.
B. Penalty deductions shall be done as detailed below for not deploying manpower from
RA bills provided by Agency.
4.1 Deductions of penality will be as per the following
o K. Agency should ensure the deployment of manpower as per the organigram submitted
along with the offer. Normally, the manpower should report in General Shift as well as
in shift as per the site requirement.
o Penalty will be deducted for less manpower reported on each day.
1. For shortfall of engineer deployment Rs. 3000/- will be deducted from the RA bill.
2. For shortfall of skilled manpower deployment Rs. 2000/- will be deducted from the
RA bill.
3. For shortfall of unskilled manpower de ployment Rs. 1000/- will be deducted from the
RA bill.

Daily progress report and daily manpower report along with the documentary support to
be submitted to EIC for review.

5.0 SECURITY, STATUTORY AND SAFETY REGULATIONS:


The contractor shall abide by all the safety & security regulations and site-specific
operations procedures of the NTPC in force and as prescribed from time to time. The
contractor shall also abide by all statutory requirements. The contractor shall be
responsible for the safety and security of all its deployed resources (manpower,
machine, equipment etc.) and NTPC shall in no way be responsible for any theft,
damage, loss of equipment etc. or for any injury or death of any of the contractor's
workmen.
The contractor shall depute minimum 1 No. of safety officer for the site in order to
abide the safety regulations.
The contractor shall report to NTPC and other local authorities concerned about all
cases of accidents. Howsoever caused and wherever occurring on the works and shall
make adequate arrangements for rendering immediately all possible aid to the victims
of the accidents,
The contractor shall arrange required gate pass from NTPC authority for entry and exit
to NTPC site and other areas for each one of its engineers/specialists,
representatives/agents, supervisors, workmen and staff as per NTPC prescribed
procedure and format.
NTPC shall not be held responsible in any way for any accident or damages incurred and
claims arising there from during the period of the contract. The contractor shall be
responsible for following the provisions of all safety laws and rules made there under
and other statutory requirements at his own cost.
The contractor shall keep records of all equipment that may be taken inside the plant
area in order to facilitate the issue of exit gate permits for such items to be taken
out after the completion of work.
The contractor shall not deploy any person below the age of 18 years or above the age
of 60 years for the purpose of the work. NTPC shall have the right to decide whether
any person employed by the contractor is below/above the age limit and to refuse to
allow any person, whom it considers to be under-age/ over age.
Safety -
a. All workers should be provided the following PPEs minimum once per year and minimum
twice for the two years contract of good quality (ISI mark):
a) Safety Shoes - Minimum 01 pairs to each worker.
b) Safety Helmets - Minimum 01 number to each worker.
c)Nose Mask - Monthly 02 nos. to each worker.
d)Any other safety equipment (PPE) required further.
b. As conveyor systems include a lot of rotary machinery, workers should not use loose
clothes (like Dhoti, Kurta, Pyjama etc).
c.During execution of the job the contractor shall have to follow the safety rules and
regulations as per NTPC norms. Agency should have to provide enough nose masks
regularly for two years. Also good quality with ISI marks safety shoes and safety
helmet have to be provided to workers minimum once in a year.
d.The agency should ensure the use of safety PPE inside the plant and during on job by
all the persons deployed by him under this contract. Safety training and clearance to
be taken from NTPC safety department.
e.The contractor and the laborers should follow all safety rules while working to
avoid any accidents. The contractor should educate his personnel regarding the
dangers, Dos, Don'ts etc. & the agency should ensure using of PPEs of his contract
workers during work. Also safety helmet to be used after they enter inside NTPC
premises.
f.The contractor should report any minor or major injury immediately to EIC/ SCE and
arrange for first aid / medical aid immediately at his own cost. The contractor shall
follow the accident reporting procedure of NTPC.
g.The contractor should keep FIRST AID BOX in their site office.
h.In case of any accident, the contractor is solely responsible for the expenses of
medical treatment. Also he will be responsible for the expenses of any fatal accidents
and later on responsible for the compensation of the worker.
i.All the workers under the contract should have registered with ESIC.
j.Contractor should comply with all applicable provisions of the factory act and other
statutory laws.
k.No person shall peep through access doors, work inside a chute, work below take-ups
and VGF tray cleaning without proper authorization or without a PTW. Nobody should
climb on the conveyor belt and nobody should touch running conveyor belts.

The contractor shall submit group insurance & ESI of the workman engaged in the
contract within 15 days of contract date or effective date whichever is earlier.
The contractor shall pay the payment of minimum wages (as prescribed by GOI/ Govt. of
Odisha whichever is higher along with applicable industries allowance) for their
worker.
The contractor shall make payment to the workmen by 7th day of every month (or any
such earlier date as may be required by the applicable laws as notified by statutory
bodies from time to time) and shall remit to their respective bank account. The
contractor shall ensure that all of his employees deployed for the contract shall have
bank account and shall facilitate for the same.
Minimum local content in this contract is 100%
Agnecy has to cover all contractual manpower under Pradhan mantri jeeban jyoti bima
yojna and Pradhan mantra surakhsa bima yojna.
The contractor shall submit documentary evidence towards this compliance along with
invoice.

6.0 TERMINATION OF CONTRACT


NTPC has the right to terminate the contract at any time in full/part, by giving 15
Days notice as per site requirement.
7.0 All other terms and condition of contract will be as per general terms and
condition of NTPC for O&M works.

8.0 NTPC INPUTS


The following inputs shall be provided by NTPC at free of cost as per requirement of
work. Special T&Ps if issued shall be returned to NTPC in fit to use condition.
Power supply for electrical accessories, welding machine if available inside plant
premises.
All types of steel (plates, structural etc.) subject to standard NTPC conditions and
special purpose electrodes.
All spares, including hardware items, which shall become part of equipment under
maintenance.
Supply of pipes, special types of electrode like C.I., SS, hard facing etc and
lubricant and special grease are in the scope of NTPC. The contractor shall keep track
on fast moving spares and inform in advance for arranging. The contractor shall give
written request for spares one day in advance to prepare SIV. Also details of
consumption of spares and consumable shall be submitted to EIC on fortnightly basis.
1. In the course of the contract or before award of contract if there is a significant
increase (=>5 %) in minimum wage of workmen by any government order, act or rule then
contractor shall be entitled for price revision.
2. Accommodation of contractor staff and engin eers will be arranged in NTPC township
if available on chargeable basis.

09. List of Exclusions


A. Following are the exclusions from this contract:
1. O&M or any other jobs of
i. Locomotives
ii. Track and signalling system
iii. Derailment handling excluding derailment in wagon tippler system.
3. Manning of CHP main control room.
4. Manual unloading of rakes
5. All design and engineering jobs.
6. Repair & maintenance of civil and structural's.
7. Housekeeping of WT complex, conveyor galleries, Clearing and cleaning of all
drains, pits and manholes.
8. Removal, disposal and transportation of stones from WT to any other location
specifies by the EIC.
9.All site and field manning except WT control room will be done by NTPC.

10.Additional Points Included after Amendment


Scope of work:
a) Plant Operations:
1) Preparation of Standard Operation Procedures.
2) Preparation of forms and formats like log books, data record sheets, task lists.
3) Operation of plant and WT from control room, Desk Operation of Wagon Tipplers shall
be done by ThyssenKrupp Industries India Pvt. Ltd. engineers, field operators and
workmen to be provided by NTPC.
4) Timely Unloading of Rake.
5) Operation of Ventilation System, Dust Suppression System, Drinking system and other
associated Equipment from control room.
6) Supervise wagon unloading activity.
7) Coordinate area housekeeping.
8) Coordination with NTCP officials for railway movement and unloading.
9) Daily reporting of operation and maintenance activities.
10) Training field operators in plant operation.
11) Sample collection for testing.
b) Plant Maintenance:
1) Preparation of Maintenance Strategy for assets.
2) Preparation of maintenance plan.
3) Preparation of maintenance procedures and task lists.
4) Planned Maintenance: Execution of planned maintenance work orders (time based,
running hours based, opportunity based), Blue Collared Manpower such as riggers,
helpers, welders, cutters along with tools and tackles shall be provided by NTPC.
Crane, hydra special tools and instruments to be provided by NTPC
5) Unplanned / Breakdown Maintenance: Attend equipment breakdown and restore equipment
to working condition in minimum time. ThyssenKrupp Industries India Pvt. Ltd. manpower
shall be available in general shift only. However, in case of emergency only
ThyssenKrupp Industries India Pt. Ltd. team shall come in shifts and the same shall be
billed / adjusted accordingly.
6) Logging maintenance activity details in maintenance log books.
7) Monitoring maintenance performance indicators.
8) Daily and monthly reporting of maintenance activities and performance indicators.
9) Spare parts list and consumables list preparation.
10) Assisting NTPC in procurement and requisit ion from stores.
11) Training maintenance team in plant maintenance.
NTPC Scope of work:
a) Plant Operation:
1) Provide field operators with suitable qualification as required for plant
operation.
2) Provide unskilled labour along tools and supervisor for plant housekeeping.
3) Provide workmen for rake handling i.e. coupling decoupling etc.
4) Loco Operations, rake movement co -ordination with railways, rake placement at
railway track, rake formation, track maintenance, signalling, point formation, Loco
maintenance & other railway management system and marshalling yard works.
5) Weighment of rake.
6) Provision of heavy machinery (excavator / JCB etc.) if required (clearing over size
material from grizzly)
7) Provision of tractor trolley for handling spilled material as and when required.
8) Manual unloading for sick wagons (provision of heavy machinery for unloading).
9) Provide office and storage space for O&M team.
10) Payment of railway demurrage.
11) Lab testing of coal samples
12) Ambulance and medical aid services for workmen and engineers.

b) Plant Maintenance:
1) Provide skilled technicians and helpers along with tools and instruments.
2) Provide all kinds of spare parts, wear parts, consumables, lubricants etc.
3) Provide PPEs to workmen deployed by NTPC.
4) Provide crane, hydra, pick up as and when required for material movement.
5) Restoration of derailed wagons.
6) External OEM / expert engineer deployment, AMC etc as and when required.
7) Provision of scaffolding as and when required.
8) Major over hauling and modification.
9) Painting.

Charges for Additional Manpower:


For deployment of additional manpower following man month rate shall be applicable:
i)Engineer-94,000/-(Rs. Ninty Four Thousand only)

12.Compliance to Safety Clause: -

The Employer has formulated Safety Rules for O&M of Power Plants and is enclosed at
Annexure-B to GCC. These Safety Rules lay down the safety requirements for safe
execution of project activities, responsibilities of the Contractor, and all concerned
involved in O&M. The Contractor, including his sub-contractors, while executing the
Works, shall strictly comply with these Safety rules and statutory requirements
(including amendments thereof), as applicable, in respect of safety of personnel,
equipment and materials at site area under execution of the Contractor.

In addition to other clauses specified in 'NTPC Safety Rules for O&M of Power Plants'
[as enclosed with GCC/SCC], Contractor shall adhere to the following provisions for
payment linked to Safety Compliances as specified in Payment Terms:

i) Safety Personnel
Contractor shall adhere to the requirements of Clause 2.3 (requirement of Safety
personnel) of 'NTPC Safety Rules for O&M of Power Plants'.

ii) Personal Protective Equipment & Safety Equipment


Contractor shall adhere to the requirements of Clause 4 (Personal Protective
Equipment) of 'NTPC Safety Rules for O&M of Power Plants' and the provisions of the
Bidding Documents with regards to number of Safety Equipment/PPEs to be provided by
the Contractor.

In case Contractor fails to comply with aforesaid requirement, EIC/Safety Officer


shall issue a warning letter/Non-compliance Memo to the Contractor regarding the same
advising him to take corrective action.
EIC/NTPC Safety Officer shall maintain written record of all such incidents when
Warning letter/Non-compliance Memo is issued to the Contractor for not meeting the
requirements of Clause 4.0 (Personal Protective Equipment) and the provisions of the
Bidding Documents.

iii) Safety Induction and Training


Contractor shall adhere to the requirements of imparting Safety training as per Clause
8.0 (Safety Induction and Training) of 'NTPC Safety Rules for O&M of Power Plants.

Contractor shall maintain written record of Safety trainings imparted to its


Employees/ workmen for purpose of aforesaid payment. These records shall be available
for review of EIC/NTPC Safety Officer all the time.

iv) Medical and First Aid Amenities


Contractor shall adhere to the requirements of Clause 13 (Medical and First Aid
Amenities) of 'NTPC Safety Rules for O&M of Power Plants.

NTPC Safety Officer/EIC shall maintain written record of incidences when requisite
Medical and first aid amenities as per Clause 13 of Safety Rules were not available
for purpose of aforesaid payment.
v) Compliance to Work Permit System
Contractor shall adhere to the requirements of Clause 17 (Work Permit System) of 'NTPC
Safety Rules for O&M of Power Plants'.

In case Contractor fails to obtain work permit or fails to comply to any requirements
of aforesaid Work permit system, he will be issued a warning letter/Non-compliance
Memo by EIC/Safety Officer of NTPC regarding the same advising hi m to take corrective
action.

NTPC Safety Officer / EIC shall maintain written record of all such incidents when
Warning letter / Non-compliance Memo is issued to Contractor for not complying with
the requirements of Work Permit System as per Clause 17 of Safety Rules for purpose of
aforesaid payment.

NOTE: "Safety Rules for O&M of Power Plants" is hereby inserted as Annexure -B to GCC.
This shall be separately attached along with the tender documents.

Amount linked to Safety Aspects/ compliance to Safe ty Rules: -

1. Five (05) % of the total contract value shall be the "Amount linked to Safety
Aspects/ compliance to Safety Rules".

2. In this regard, a new line item with Five (05) % of the total contract price shall
be created in PO. The contract prices against other items shall be proportionately
adjusted so that the total contract price remains unchanged.

3. The payment against this line item "Amount linked to Safety Aspects/ compliance to
Safety Rules" shall be released as per Clause No. 20.7 of GCC which is inserted via
Clause No. 36 of SCC.
A new Clause No. 20.7 "Payment of Amount linked to Safety Aspects/ compliance to
Safety Rules" as detailed below is hereby inserted to GCC:

Payment of Amount linked to Safety Aspects/ compliance to Safety Rules

I. The amount linked to Safety Aspects/ compliance to Safety Rules shall be paid in
two parts, viz,

A) 10% amount (calculated as 0.1 Y of the service portion amount of RA bill) shall be
linked to Fatal/Major Accidents, and

B) 90% amount (calculated as 0.9 Y of the service portion amount of RA bill) shall be
linked to various Safety Aspects specified in Safety Rules of NTPC.

II. While raising each RA Bill, Contractor shall claim Amount linked to Safety
Aspects/ Compliance to Safety Rules in such a manner that amount claimed is equal to
Y% of the total works portion (Civil + Structural etc.) of RA Bill.

III. This aforesaid amount at para 24.10 (I) shall be withheld from first and second
monthly RA bill of the respective quarter/three-month period and shall be released in
part or full based on safety compliance duly certified by EIC and Safety-in-charge on
quarterly basis. The amount for the entire quarter (i.e. RA bills raised during a 3-
month period) shall be paid to the Contractors at the end of that three months’ period
along with 3rd/last RA Bill for the quarter/three months’ period upon complying the
following conditions:
A) Amount of RA Bill linked to Fatal/ Major Accidents (0.1Y i.e. 10% of amount as
elaborated above at para G.I.A)

Aforesaid amount (on quarterly basis) shall be payable to Contractor only in case,
there is
i) No fatal injury or accident causing death in that three months’ period
and
ii) No Major injury or accident causing 25% or more perm anent disablement to workmen
or employees in that three months’ period. Permanent disablement shall have the same
meaning as indicated in The Workmen's Compensation Act' 1923.

In case of any fatal injury or accident as elaborated above occurs during that three-
month period, the stipulated amount (0.1Y) subject to minimum of Rs 10 Lakh per
fatality shall be forfeited and shall not be payable to the Contractor under the
contract. In case, the amount to be deducted/forfeited exceeds the amount linked to
Fatal/ Major Accidents, the same shall be recovered from remaining Amount (0.9Y)
linked to Compliance of Safety Rules and/or any other payments immediately due to the
Contractor under the Contract.

In case of any Major injury or accident causing 25% or more permanent disablement to
workmen or employees occurs during that three-month period, Rs 4 lakh per Major injury
shall be deducted from the amount (0.1Y) linked to Fatal/ Major Accidents and shall
not be payable to the Contractor under the contract. In case, the amount to be
deducted/forfeited exceeds the amount linked to Fatal/ Major Accidents, the same shall
be recovered from remaining Amount (0.9Y) linked to Compliance of Safety Rules and/or
any other payments immediately due to the Contractor under the Contract.

Further, in case, Contractor doesn’t raise RA Bills in any three-month period/quarter


and if any fatal injury and/or major accident takes place in that period, EIC shall
deduct the amount [Rs 10 Lakh per fatality and Rs 4 lakh per Major injury] pertaining
to this particular quarter from his next RA bill/due payment. In case, the amount to
be deducted/forfeited exceeds the amount linked to Safety, the same shall be recovered
from any other payments immediately due to the Contractor under the Contract.

The amount deducted/forfeited as mentioned above shall be in addition to the


compensation payable to the workmen / employees under the relevant provisions of the
Workmen's Compensation Act' 1923 and rules framed there under or any other applicable
laws as applicable from time to time.

B) Amount of RA Bill linked to Compliance of Safety Rules (0.9Y i.e. 90% of amount as
elaborated above at para G.I.B)
Aforesaid amount (on quarterly basis) shall be payable to Contractor in five equal
parts under five heads as under:

(i) Amount payable on deployment of required Safety Personnel


One fifth of the amount specified in para 24.10.III.B (calculated as 0.18Y of Service
portion amount of RA Bill), on quarterly basis, shall be paid upon certification by
EIC in consultation with Safety dept. that required number of Safety personnel as per
Clause 2.3 of ‘NTPC Safety Rules for O&M of Power Plants’ (as enclosed with GCC/SCC)
have been deployed. The aforesaid amount linked to deployment of requisite safety
personnel shall be paid as under:

a) 50% of the amount referred at 24.10.III.B.(i), for deployment of Safety Supervisors


shall be paid on pro-rata basis depending upon the actual no. of Safety Supervisors
deployed vis-à-vis actual requirement:
Amount to be paid = 0.09Y x Works portion of RA bill amount x (a/b)

Where ‘a’ is actual no. of Safety supervisors deployed


And
‘b’ is required no. of Safety supervisors as per Safety Rules.

In case, actual no. of Safety supervisors deployed is more than requisite number (i.e.
a/b is more than 1), the amount to be paid shall be restricted to 0.09Y.
b) 50% of the amount referred at 24.10.III.B.(i), for deployment of Safety Officers
shall be paid on pro-rata basis depending upon the actual no. of Safety Officers
deployed vis-à-vis actual requirement:
Amount to be paid = 0.09Y x Works portion of RA bill amount x (a/b)
Where ‘a’ is actual no. of Safety Officers deployed
and
‘b’ is required no. of Safety Officers as per Safety Rules.
In case, actual no. of Safety Officers deployed is more than requisite number (i.e.
a/b is more than 1), the amount to be paid shall be restricted to 0.09Y.

c) In case aforesaid requisite no. of Safety personnel are not deployed by Contractor,
amount not to be paid as calculated above for that particular quarter/three-month
period shall be forfeited and shall not be payable to the Contractor under the
contract.

(ii) Amount payable on providing requisite Personal Protective Equipment & Safety
Equipment
One fifth of the amount specified in para 24.10.III.B (calculated as 0.18Y of Service
portion amount of RA Bill), shall be paid upon certification by EIC in consultation
with Safety dept. that Contractor has adhered to the requirements of Clause 4
(Personal Protective Equipment) of ‘NTPC Safety Rules for O&M of Power Plants’ and the
provisions of the Bidding Documents with regards to number of Safety Equipment/PPEs to
be provided by the Contractor.

In case of non-compliance by Contractor, warning letter/Non-compliance shall be issued


by EIC/Safety Officer of NTPC as per clause 10.4.9 (ii) of GCC. Further, if more than
two such warning letters/Non Compliance Memos are issued in a quarter/three monthly
period, above mentioned amount for that particular quarter/three month period shall be
forfeited and shall not be payable to the Contractor under the contract.

(iii) Amount payable on providing requisite Safety Induction and Training


One fifth of the amount specified in para 24.10.III.B (calculated as 0.18Y of Service
portion amount of RA Bill), shall be paid upon certification by EIC in consultation
with Safety dept. that Contractor has adhered to the requirements of imparting Safety
training ad per Clause 8.0 (Safety Induction and Training) of ‘NTPC Safety Rules for
O&M of Power Plants’ to at least 90% of its employees/workmen (who have not been
previously provided with requisite training) in a quarter/ three months period.

In case Contractor fails in meeting the aforesaid requirement, above mentioned amount
for that particular quarter/three month period shall be forfeited and shall not be
payable to the Contractor under the contract.

(iv) Amount payable on providing requisite Medical and First Aid Amenities
One fifth of the amount specified in para 24.10.III.B (calculated as 0.18Y of Service
portion amount of RA Bill), shall be paid upon certification by EIC in consultation
with Safety dept. that Contractor has adhered to the requirements of Clause 13
(Medical and First Aid Amenities) of ‘NTPC Safety Rules for O&M of Power Plants’.

In case Contractor fails to provide Medical and first aid amenities as per requirement
of aforesaid Clause 13 even on one incidence in any quarter/three month period, above
mentioned amount for that particular quarter/three month period shall be forfeited and
shall not be payable to the Contractor under the contract.

(v) Amount payable on compliance to Work Permit System


One fifth of the amount specified in para 24.10.III.B (calculated as 0.18Y of Service
portion amount of RA Bill), shall be paid upon certification by EIC in consultation
with Safety dept. that Contractor has adhered to the requirements of Clause 17 (Work
Permit System) of ‘NTPC Safety Rules for O&M of Power Plants’.

In case of non-compliance by Contractor, warning letter/Non-compliance shall be issued


by EIC/Safety Officer of NTPC as per clause 10.4.9 (v) of GCC. Further, if more than
two such warning letters/Non Compliance Memos are issued in a quarter/three monthly
period, above mentioned amount for that particular quarter/three month period shall be
forfeited and shall not be payable to the Contractor under the contract.

NOTE:
No interest shall be payable on the amounts linked to Safety Aspects / Compliance to
Safety Rules including aforesaid retained amount. The amounts linked to Safety Aspects
/ Compliance to Safety Rules including aforesaid retained amount shall be payable in
part or full based on safety compliance duly certified by EIC and Safety-in-charge on
quarterly basis.
