CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This document executed by and between:

The ILOILO PROVINCIAL GOVERNMENT represented by HON. ARTHUR R.

DEFENSOR, JR., Governor, Province of Iloilo, of legal age, Filipino, married and a resident of
Mina, Iloilo, hereinafter referred to as the FIRST PARTY,

and

LESLY F. CARMONA, of legal age, Filipino, single and a resident of Jardin,

Dumangas, Iloilo, hereinafter referred to as the SECOND PARTY;

WITNESSETH:

WHEREAS, The FIRST PARTY, through the Hospital Management, operates one (1)
Provincial Hospital and twelve (12) district hospitals in the Province of Iloilo;

WHEREAS, Ramon D. Duremdes District Hospital, shall maintain compliance with the
licensing requirements of the Department of Health and operational needs in terms of health
human resource that must complement the authorized bed capacity and actual bed occupancy
rate of the hospital;

WHEREAS, the hospital shall maintain the standard of quality for hospital services and
shall continuously improve and expand its services pursuant to the policies of the Universal
Health Care Law;

WHEREAS, the FIRST PARTY needs the services of the SECOND PARTY that are
essential to maintain the required patient care and continued operations, programs and activities
of the hospital by providing laboratory services necessary in the exigency of the services;

WHEREAS, the SECOND PARTY possesses the license, education, experience and
competencies required to perform laboratory services;

WHEREAS, the SECOND PARTY, is of good moral standing and has not been
previously dismissed from the service by reason of an administrative case;

IN VIEW THEREOF, the SECOND PARTY is hereby contracted as CONTRACT OF

SERVICES Medical Technologist I for the period of six (6) months January 1, 2022 to June 30,
2022 with a daily rate of Nine Hundred Forty Three Pesos and Thirty Six Centavos (Php 943.36),
payable once a month, chargeable against the Maintenance and Other Operating Expenses (Other
Professional Services) of Ramon D. Duremdes District Hospital subject to withholding tax
prescribed by the BIR.

THAT, the SECOND PARTY shall perform the following duties and deliverables:

1. Receive or obtain specimen for laboratory analysis and record the results,
2. Perform various chemical, microscopic and bacteriological tests used in diagnosis and
treatment of diseases,
3. Operate, maintain and calibrate laboratory equipment according to the prescribed
techniques,
4. Maintain records of test worksheets, logbooks of final test results and examinations,
5. Ensure safekeeping and proper utilization of equipment and supplies,
6. Perform other tasks that may be validly directed;

THAT, the SECOND PARTY shall report to Ramon D. Duremdes District Hospital and
coordinate directly with the immediate supervisor and shall render a total of 176 hours of
services a month subject to the approved schedule of duty in the exigency of service as
determined by the FIRST PARTY;

THAT, the monitoring of delivery of services of the SECOND PARTY shall be time
based and output based as determined by the Head of Office;

THAT, the SECOND PARTY may be allowed to travel locally if such travel is required
in the performance of official duties such as conducting site visits, stakeholder’s consultation,
attending/facilitating meetings with relevant partner agencies or attending to any matter as may
be required by the Office or as may be necessary. Foreign travels, however, shall not be allowed;

THAT, the SECOND PARTY may be allowed to attend trainings, seminars, workshops,
conferences and other activities necessary and relevant in the performance of official duties or
needed to comply with the DOH licensing requirements for hospitals. For this purpose, the
FIRST PARTY may assume payment of per diems, travelling allowances, and registration and
training fees subject to availability of funds and other limitations provided by law.

THAT, the SECOND PARTY shall not be entitled to the benefits enjoyed by the regular
government employee such as PERA and other benefits such as Mid-Year and Year-End Bonus,
Productivity Incentive and Cash Gift pursuant to CSC, DBM and COA rules and regulations on
the matter;

THAT, it is understood that this contract does not create an employer-employee

relationship between the FIRST PARTY and the services to be rendered shall not be credited as
government service and the SECOND PARTY is not covered by Civil Service law and
regulations but by the COA rules and regulations;

THAT, the FIRST PARTY reserves the right to review the performance of the SECOND
PARTY and may terminate this CONTRACT for reasons of inefficiency, misbehavior,
insufficiency of funds, or other grounds as may deemed valid by the FIRST PARTY.

THAT, in case the SECOND PARTY contracts COVID-19 during the effectivity and by reason
of the performance of its duties under the contract, they shall be paid while under quarantine
which period shall be used, as far as practicable, to prepare reports and other documentary
requirement;

THAT, in case the SECOND PARTY has no Tax Identification Number (TIN), he/she
undertakes to secure a TIN within 15 days from execution of the Agreement otherwise he/she
shall be paid separately from the payroll or through a separate voucher conditioned upon
securing a Tax Identification Number (TIN).

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures the _____
